Summary of Public Hearing:
Bill Strite, representing the property owner, testified in favor and agreed with all proposed
staff conditions. He testified that he would work with Mr. Brent Wilde of Intermountain Gas
Company to annex their outparcel.
No testimony in opposition.
Key Commission Changes to Staff Recommendation:
The Commission added a condition to their motion that the Intermountain Gas Company
outparcel be included with the subject annexation.
Outstanding Issues for City Council:
1. The City Council will need to review this application in close coordination with the Kissler
Annexation (AZ-03-018), which has a continued public hearing scheduled for the same
meeting. Both of the Kissler applications are scheduled for the 11-5-03 City Council
meeting. As noted on page one of the staff report (transmitted 9-25-03), the Kissler/Dealy
annexation is not currently contiguous to land already within the city limits and is dependent
upon AZ-03-018 being annexed. The City Council must approve AZ-03-018 before the
Kissler/Dealy annexation (AZ-03-022) is acted upon, or an alternative path of annexation
must be demonstrated.
At this time, the information provided to staff by the applicant, BRS Architects, indicates
the Kissler application (AZ-03-018) will be amended to eliminate one of the four property
owners. If that application is amended, Staff is recommending the application either be
withdrawn and a new application with a new legal description be submitted OR the City
Council could proceed with the hearing and deny the active application. Staff recommends
the City Council treat the two Kissler applications in a similar manner and take similar
actions with both annexation requests.
