Sis?nal~e: No new signs are approved with this CZC. All new signs will require a separate sign permit in compliance with the sign ordinance. Landscapin>;: The Landscape Plan is approved per the plan stamped 12/4/03. The reduced landscape buffers are approved under Alternative Compliance provisions to respond to existing conditions. Additional trees have been added to the site wherever feasible per the approved plan. Irrigation: An underground, pressurized irrigation system must be maintained to all landscape areas. Curbin :Per Ordinance 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Protection of Any Existing Trees: All existing trees on site must be protected in accordance with the Tree Preservation section of the City's Landscape Ordinance. Parkin :Off-street parking is approved as shown on the approved site plan. Drive aisles must be at least 25 feet wide (MCC 11-13-5). Standard stalls shall be at least 9 feet wide by at least 19 feet deep, except that the southernmost row of stalls may be 1? feet deep, with a two foot overhang. Project architect shall certify that the number and size of handicap-accessible space(s) conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA. Si ewalk : All internal sidewalks shall be constructed as submitted and in accordance with the Meridian City Code requirements (MCC 12-S-2.K). Staffnotes that sidewalks are existing. i Drainage: No storm water drainage swales are depicted on the submitted site or landscape plans. If any storm water drainage swales are required in the future, they shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with the Meridian City Code. Li htin :Lighting shall not cause glare or impact the traveling public or neighboring development. Trash Enclosure: No trash enclosure is depicted on the site plan. A1195 gallon carts shall be stored in the existing storage building and remain screened from public view, as per the applicant's representation. Handicap-Accessibility: The structure, site improvements and parking must be in compliance with all federal handicap-accessibility requirements. ACRD Acceptance: Applicant shall be responsible for meeting the requirements of ACHD as they pertain to this development. All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. No occupancy will be granted until the final plat for the property is recorded. Plan Modifications: The approved Site Plan and Landscape Plan, stamped 12/4/03 are not to be altered without prior written approval of the Planning & Zoning Department. No significant field changes to the site or landscape plans are permitted; prior written approval of all changes is required. Steve and Brad It appears to me that MCC 12-3-10 would allow the adjustment needed to allow this building expansion to proceed. The adjustment does not create another "lot" it simply allows some expansion of the existing use. With the recent reported "condominiumization" of a building in Silverstone, we may need to add this subject to the "ordinances to be reviewed/updated pile. Mr. Watson: Per my discussion this afternoon with Steve Siddoway, please find attached the following documents: 1. A copy of the Idaho Condominium Property Act (and Idaho Code § 55-101B); 2. A copy of Condominium Plat for the Brady-Tingley Medical Building; and 3. A copy of the plans for the proposed addition to the Dr. Bergloff's building. Because the addition to Dr. Bergloff's building will be built on what is now "common area" on the condominium plat, Dr. Bergloff and the other condominium owner would like to do adjust the condominium ownership lines. Because a formal plat amendment process (involving multiple public hearings) would be unnecessary overkill for what are really minor adjustments, Dr. Bergloff and his partner would prefer to use the City's existing lot line adjustment process (or some variation thereof), if possible.
