specificall iy dentify requirements in this Certificate of Zoning Compliance does not relieve owner of
responsibility for compliance with these documents.
Approved Plan: The Site Plan (Sheet A1.0), dated 8-15-02 and stamped 8-19-02, is approved.
Existin Fencing & Landscaping The existing chain link fence along the east boundary, the existing
landscaping in the common lot north of the site, and the existing street trees shall all be protected
during construction and remain as is.
Sis;nage: No signage was proposed with this CZC application. All free-standing and wall signs require
separate permits.
Landscaping The Landscape Plan (Sheet L1.0, dated 7-8-02) is approved, with the two (2) redline
notes. The landscape plan is not to be altered without prior written approval of the Planning &
Zoning Department. No field changes to site plan permitted; prior written approval of all changes
required.
Trash Enclosure: Per Sanitary Service Company's 7-21-02 note to Tamura & Associates (signed by
Bill Gregory), this site will not have a permanent waste enclosure. In lieu of a commercial container,
this property will use 95 gallon refuse carts rolled to the curb on collection day. The property owner
shall ensure these containers are stored indoors at all times, except for garbage collection days.
After weekly collections, the carts must be returned indoors and the containers not visible from
the right-of--way.

Parking Off-street parking is approved as shown on Sheet A 1.0. Applicant must comply with redline
note to clearly paint "Compact" on the asphalt within the three (3) compact stalls. All handicap
parking, signage, striping and ramps must be designed and constructed to current ADA standards.
Irri ag tion: An underground, pressurized irrigation system must be installed to all Iandscape areas on
the project site.
Bondint?: All site improvements must be completed or bonded for at 110% of the incomplete amount
prior to P&Z Department signature of Certificate of Occupancy.

Please find attached the signed Certificate of Zoning Compliance for the Mallea Law building.
I gave a copy to the Building Department (Mindi Smith) to process with the commercial
building permit. The original copy is being mailed to you under separate cover.
Since Elizabeth Cooper with Tamura & Associates modified the driveway width on 8-15-02
from 20 feet to 25 feet AFTER the building sets were prepared, please make sure the
construction drawing set reflects this driveway change. When our department inspects the
site for the Certificate of Occupancy, we will require the 25 foot width. So please ensure this
change is made on all plans throughout the approval process.
I wanted to draw your attention to the last comment on the first page re. the trash enclosure.
Please make sure the owner is aware of the requirement to maintain the reoeptaGes inside
the building.
I also talked with Jack Dunn this morning and let him know that we are NOT approving the
three (3) Silver Lindens in front of the building (if that's indeed what they are). This area is too
small for this size of tree at maturity. An alternative species will need to be approved by our
department.

The Ada County Highway District (ACRD) staff has received and reviewed the application and site plan for the item
referenced above and is submitting this no review letter in response to the lead agency's request for comment.
Based on the submitted information, it has been determined that the proposed improvements exist adjacent to the site
and ACRD has no site improvement requirements attributable to this application.
ACRD policy states that no site related improvements will be required for developments generating less than 10
additional VTD. If the site plan or use changes in such a manner that more than 10 additional vehicle trips per day are
generated, then ACRD will review the site plan and may issue requirements based on the ACRD Policy Manual.
ACRD policy requires that before any improvements of any kind are constructed or installed within the public right-of-
way, apermit or license agreement permitting the improvements must be obtained.
All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual,
ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances
unless specifically waived in writing by the District. Meet District drainage requirements per section 8000 of the ACRD
Development Policy Manual. Contact District staff at 387-6170 for details.
Please contact the office for determination of possible road impact fees, prior to obtaining a building permit. These fees
are collected in accordance with Ordinance #195, the Ada County Highway District Road Impact Fee Ordinance.
