Ree Timing of Improvements
In reference to the timing of the required improvements, the fence and slats need to be installed
right away (i.e. within the next 30 days). This will require a fence permit from the Building
Dept.
The paving and landscaping also need to be done as soon as possible. Any improvements that
cannot be completed within the next 30 days, must be bonded for with cash, certified check, or
irrevocable bank letter of credit in the amount of 110% of the cost of the improvements. A bid
for the improvements must accompany the bond.
All improvements must be complete and installed by May 15, 2000. This allows 5 months to
complete the improvements.

1. All outdoor storage of equipment and materials is to be screened from view, particularly
as residential use is across the street, including semi trailers.

4. If the area inside the fenced area is to be used for driveways or parking of vehicles, it will
need to be paved.

Shari,
I have reviewed the site plan submitted by Kent Mortensen for his contractor's yard at
Franklin & 10th West and have the following questions for you.
1. The site plan shows the two existing sem-trailers to remain outside the fence. Is this
OK? I assume they must be behind the fence. However, they are quite large and
may be difficult to maneuver inside the fence.
2. The irrigation control is mounted to a power pole. Is this a problem? (I remember the
church behind us had a problem temporarily locating power meters to the pole when
they moved the building.)
3. 1 would like to go over the tree locations with you. As far as I'm concerned, it meets
the requirements we told him in our memo, but there is not a consistent buffer along
Franklin, so I thought I should run it by you.
4. Also, our memo only requires paving on the driveway and none inside the fenced
area. He is complying with that, but I just wanted to verify that since I have heard
different requirements from you on other sites recently.
Other issues that I will address include:
The 2" trees must be changed to 3" (or additional trees added to meet the 110% rule).
I will also recommend a different tree species. Quaking Aspen get stressed and often
turn brown in our hot summers—it is a prohibited tree in rights-of-way in the draft
landscape ordinance.

Attached is a copy of the Certificate of Zoning Compliance checklist that we use internally to review
plans If you have any questions, feel free to give me a call.
You need to submit:
• 3 copies of site plan
• Calculations for the square Wage of asphalt and the number of trees provided
• Copy of ACHD approval letter (for driveway access onto N. 1 e St West)
We will check for the following elements:
1. The driveway must be panned and at least 25' wide.
2. 1 - 3" caliper tree must be planted per 1500 sq. ft of asphalt.
3. Tree species and size must be listed on the plan. The location of the trees is up to you, but we
would prefer there to be placed along Franklin Rd. Franklin Road is identified as an entryway corridor
in the Meridian Comprehensive Plan, and landscaped setbacks of a minimum ZQjeet beyond right-of-
way
ight-ofway are encouraged.
4. The trees and other landscaping must be served by an automatic underground sprinkler system.
5. The fence must be screened on all sides (with slats placed in the chain link).
6. Nothing may be stored outside the fence. Within the fence, use is limited to storage, maintenance,
and processing incidental to contracting work.
7. The shed sales and advertising must be removed.
8. The site must be mowed and kept free of weeds over 8" in height

I received letter from you concerning our commercial lot at the comer of 10th and Franklin Roads
concerning some of the junk that has accumulated over time. I apologize for letting it build up. As of this
letter I had already done some cleaning up and still hood to finish up. I have also made some phone calls to
a couple of our subcontractors that have stored items (i.e. insulation blankets, old trucks) to have them
removed.
This letter is an appeal to the you the City Clerk and the City Council for an additional 30 days
past the 5 days to take care of everything.
As far as the equipment and other storage items in our fenced area, I will be applying for a certificate of
Zoning Compliance with the City for the usage of the lot. We have been storing items on the lot now for
about 10 years and did not realize that I needed the Zoning Certificate for that purpose. Our plans for the
future is to build a construction office at that site with the fenced in storage arca staying were it is. I did
know that for the future construction of the building I would have to go through Zoning to get the
evayd* approved.

You and each of you please take notice that pursuant to the authority of Idaho
Code § 50-334 the City of Meridian has declared and defined nuisances by ordinance which
declaration is codified at Chapter 9 of Title 8 Municipal Code of the City of Meridian, a copy of
which is attached to this notice for your information.
You are hereby further notified that the Code Enforcement Officer (authorized
representative of City Clerk) has determined that a public nuisance exist upon the above
described property which public nuisance is as follows:
Remove all vehicles, trailers, tarps, ladders, storage sheds, construction debris & general junk
from your property which is declared a public nuisance. Before your lot may be used you must
first obtain a Certiicate of Zoning Compliance.
NUISANCE ABATEMENT POLICY AND PROCEDURE - 1

You are hereby directed to abate the nuisance within five (5) days from the date
of this notification.
You are advised that within five (5) days from the date of this notification you
may appeal to the City Council this `notice to clean premises'. Such appeal shall be in writing
and shall be filed with the City Clerk and the City Council shall then hear this matter at its next
regularly scheduled Council Meeting. In the event of an appeal, if the City Council affirms this
notice you are hereby further notified that the nuisance shall be abated within five (5) days of the
Councils determination thereof; and
- You are further advised that upon the failure, neglect or refusal of any owner or
occupant as notified herein to remove the public nuisance within the time period herein
specified, the Code Enforcement Officer (authorized representative of City Clerk) will notify the
City Attorney in writing of the last known legal owner and property description in general terms
as above referenced. The City Attorney may cause legal action to be taken through the
Magistrate's Court as follows:
The owner or person in control of any lot, place or area within the City who shall
permit or allow the existence of a public nuisance as defined herein upon the above described
real property, owned. occupied or controlled by the same or who shall violate any of the
provision of §8-903 Municipal Code of the City of Meridian, shall be guilty of a misdemeanor
and upon conviction thereof shall be subject to a fine of not more than three hundred dollars
($300.00), or to imprisonment for a period not exceeding six (6) months, or both such fine and
imprisonment, or the City Attorney, in his discretion, may also take civil action to obtain an
order from said Court enjoining the maintenance of said public nuisance, which, such court order
shall include reimbursement to the City of its costs and attorney's fees.
You are further notified that upon the direction of the City Council and at the City
Council's discretion, upon the failure, neglect or refusal of any owner or occupant so notified to
remove the public nuisance as herein notified, the Code Enforcement Officer shall notify the
City Clerk's office in writing of the known legal owner and property description in general terms
as herein stated. The City Clerk's office shall proceed with the work specified in the notice. The
cost of the work shall be transmitted to the Council, who shall cause the same to be paid and give
Notification of Assessment of Abatement of Nuisance and levy a special assessment against the
above described property, for such cost which shall be collected with the real property taxes

The District has rcviewed the driveway location for the above referenced project, and it is accepted for public street
construction. The driveway shall be paved a minimum of thirty -feet bath from existing industrial gutter. Variances or
waivers trust be specifically and previously approved by the District in writing. The District will not assess an impact fee
for this project.
Standard Requirements:
1. Utility street cuts in new pavement less than five years old are not allowed unless approved in writing by
the District.
2. All irrigation facilities must be located outside the public right -0f --way unless otherwise approved by the
District.
3. Replace damaged curb, gutter, and sidewalk with new curb, gutter, and sidewalk to thatch existing
improvements,
4. All facilitics to be constructed with a proposed development, and to be owned and maintained by the
District, must be constructed according to the latest edition of I.S.P.W.C. and the District's Supplemental
Standard Specifications.
5. Any work in the public right-of-way requires a permit from ACRD Construction Services.

Shari,
I have reviewed the site plan submitted by Kent Mortensen for his contractor's yard at Franklin &
10th West and have the following questions for you.
1. The site plan shows the two existing sem-trailers to remain outside the fence. Is this OK? I
assume they must be behind the fence. However, they are quite large and may be difficult to
maneuver inside the fence.
2. The irrigation control is mounted to a power pole. Is this a problem? (I remember the church
behind us had a problem temporarily locating power meters to the pole when they moved the
building.)
3. 1 would like to go over the tree locations with you. As far as I'm concerned, it meets the
requirements we told him in our memo, but there is not a consistent buffer along Franklin, so I
thought I should run it by you.
4. Also, our memo only requires paving on the driveway and none inside the fenced area. He is
complying with that, but I just wanted to verify that since I have heard different requirements
from you on other sites recently.
Other issues that I will address include:
The 2" trees must be changed to 3" (or additional trees added to meet the 110% rule).
I will also recommend a different tree species. Quaking Aspen get stressed and often turn brown
in our hot summers—it is a prohibited tree in rights-of-way in the draft landscape ordinance.

construction. The driveway shall be paved a minimum of thirty -feet back from existing industrial gutter. Variances or
waivers must be specifically and previously approved by the District in writing. The District will not assess an impact fee
for this project.
Standard Requirements:
1. Utility street cuts in new pavement less than five years old are not allowed unless approved in %Titing by
