VMA is an Idaho Non-profit corporation and is operated to give young people a high quality college-preparatory education in a high standard, structured environment. VMA is not a correctional facility, and accepts only applicants that can live within the high standards. Cadets sign, and are held accountable, to a "code of conduct" in which they abstain from drugs, tobacco products, alcohol, and sex. Students have a high degree of peer and adult supervision until they develop the self discipline of the upper levels of the cadet grade structure. The characteristics of the property that make this use desirable is the existence of an updated older home which can immediately be used as an administrative center, wide access on the North and South that would allow access lanes for emergency vehicle entrance. There is ample room for an enclosed campus behind the administrative building, with additional space for parking area if needed. There is already 10 parking spaces on the southwest part of property, and an adjacent area that could be expanded for off street parking. Additionally, even before expanding to the East end of the property, parking could be expanded on about a 140 x 80 foot area in the front. All cadets (students) even of driving age, are not authorized to drive to campus, as this is a • reserved privilege. These are labeled on the plot plan. There is room to build a learning center in the rear of the administration building and remain within all codes. Property has a fire hydrant on the front end of the property, and has available sewer and city water running to the administration building at this time. Additionally, there is property on the north of existing property, that may become available for future expansion. This academy can provide a valuable asset to the community in and around Meridian in that it provides high quality academic, values building, and leadership education for the youth of the area. The applicant will pay any additional sewer, water, or trash fees or charges, if any, associated with the use if approved. The contents of this application has been read and I (we) verify that the information herein is true and correct. Shari any comments for Council? Stiles: Mr. Mayor and Council after the initial public hearing the applicant did not return any phone calls or requests for additional information. For that reason the Planning and Zoning Commission went ahead and prepared the findings which were to deny the request. Rountree: So this is just a clean up item? Stiles: Yes Morrow. Mr. Mayor, Shari is that to say that we have had and Will we have had no correspondence at all from this applicant? So basically we are going to treat it as though it were an abandoned project? Stiles: Yes Corrie: I will entertain a motion for the findings of fact and conclusions of law then. Toolsen: Greg Toolsen, JGT Architecture, 1212 12th Avenue South, Nampa. Mayor and Council we are asking for a conditional use to have a covered, drive through ATM machine at the First Security Bank in Meridian here. The conditions that are recommended by Planning we don't have any problem with. I would like to make one clarification. One condition that mentions that there are 2 handicapped parking spaces and one is across, one is not adjacent to the building as originally indicated on our plan was misrepresented. There are two handicapped spaces an #hey are presently adjacent to the building. Outside of that we accept all the other conditions. So I guess we are asking for your approval. Robert McRill, 530 N. Five Mile Road, Boise, was sworn by the City Attorney. McRill: Vanguard Military Academy is anon-profit organization 501 C3. We are the only bonified military academy in the Northwest United States. In fact we are only one of three bonified military academies in the western United States. New Mexico has one and California has the other. Obviously ours is here. We are the newest academy in ten years and this is by General Scott who is head of the United States Military Academy Association in Washington D.C. Our organization is not specifically or our idea is not to turn out troops that is not the basis of it. Number one is academics, we run from 5th grad through high school. The organization does not accept individual who are whore care young people. Occasionally we have heard over the we get calls in from somebody who would like to place their young people obviously military discipline seems to be they figure the answer to it all. But it isn't, consequently hard core cadets are not accepted in. We have a screening process that parents sign in. A conditional agreement that cadet is taken under for six weeks of probation in the academy. During that time should we find anything that is not in condition with their contract with us that cadet is dismissed from the academy. We have had very good luck our academic rates are running 92% across the board with our young people. Our military, the National Guard has been very kind in helping us out. In fact I have sitting with us here one of the young people, one of my cadets here who happens to be the (Inaudible) of the State of Idaho General Cane's son is here with us tonight. So I think you can see that the type of Meridian Planning & Zo~j Commission • Special Meeting June 18, 1997 Page 4 young people we are trying to place in here our main emphasis number one is academics and number two is the military disciplines and training. With the academics self discipline we find that is necessary in a military atmosphere. Goes parallel with the academic program. Both the disciplines are required, the self-disciplines are the same. So we find that our young people in general are really of very high quality type of individual. Thank you. Johnson: I have a couple of question for my own edification. Your academy is an operating entity now is it not off of Five Mile? McRill: Yes, actually we have been in existence for two years. This is our first year on academics. We are in the process of accreditation through ACSI which is an accrediting institution. Johnson: Is your facility co-ed? McRill: Yes sir, by law it, we beat Virginia Military Institute. Johnson: A couple of times in your short presentation you mentioned the word hard core, what does that mean to you? McRill: What that means to me is individuals that have been in a constant problem with the law. WE cannot take that type of individual and haven't been able to take those into the academy. Though we have had individuals that would have, those that would like to have their young people come in. I mean by hard core those that are constant offenders. A Young person might make a mistake and we have all seen that. If that is not a gross mistake that doesn't keep that young person out of the academy. But we have a 6 weeks probation also so that we can constantly keep an eye on that young person. Our goal also is to train up a young person in the way he should go. Honor, Duty, Country. Johnson: Your source of funding? McRill: Ours is private sir, being a private institution that is a very hard subject that we have answer continually as a private school We have no statements that come in are private funds, donations and things on this order as well as tuition into the academy. Johnson: Your information indicates up to 120 students. McRill: This is what the anticipation is right now, we are up to the is the maximum right now. Johnson: You lost me when you said this is our first attempt or first entry into academics, what were you into the past two years? Meridian Planning & Zo~g Commission • Special Meeting June 18, 1997 Page 5 McRill: The first year we had a part time program. When we started the academy out and we received our, ran our material through the State of Idaho and was licensed and everything, we started a part time program for young people knowing that we were eventually expanding into an educational program. The first we had it part time (inaudible). Johnson: Part-time did not include academics? J McRill: It is not include academics, yes sir. So what we did, that gave us also the opportunity to look for a curriculum that would function and work with the academy tf'„~t had a high standing on math and science and English as well as social studies. But a hard emphasis on mathematics, that is very important. 4'~ Johnson: I appreciate that, (inaudible) anyone else like to ask some questions of the applicant? MacCoy: I have a couple here, on the material you submitted which is this material right here, it made it very difficult to really tell what you were proposing here. The building type you gave us nothing in the way dimensions nor do did you give us anything in the way of elevations. McRill: And those need to be in there. MacCoy: We need to have that in order to figure out really what you are asking. McRill: I understand, we had about I believe 3 or 4 days in order to produce that sir. We will be happy to put the others with it. We had a short period of time to do it and when we came over we asked for a copy of something we could see that we could look at that would give us some idea of what was required by Planning and Zoning. We were shown a schematic of a plan and we used it as fast as we could to get in so we could at least get this before Planning and Zoning. We would be glad to get you anything else you need in here. MacCoy: We need quite a bit along that line because really it leaves us out in left field (inaudible) that we can't understand. McRill: Anything that we need to put in there we can assemble. All I need is a list so that I can hand it into the proper people and have that handled for you. MacCoy: Do you have a copy of the staff report? McRill: I have a copy of the staff report and I read it through just here the other day. McRill: No sir MacCoy: I know we talk about code and ADA is a code which is required by Federal. I am just curious from the stand point I know quite a bit about your type of business, do you plan to have handicapped people being a part of your organization? McRill: There are no exceptions that handicapped can't be because the 501 C3 codes that we are under for IRS absolutely prohibits us from denying anybody those applications. MacCoy: I think our staff people did a fine job in outlining the material. McRill: I did too, looking through it, it was very detailed. MacCoy: (Inaudible) well documented and spelled out. My main concern was that you understood what you received because (inaudible) to make a final decision. Thank you very much. Smith: Mr. Chairman, I would like to read a line out of the staff report, "a revised site plan incorporating staff and agency comments needs to be submi#ted to the Planning and Zoning Commission prior to action on this proposal. There is really nothing for us to review as far as site plan or building information. Therefore in the interest of time I would like to move that we table this item until this information is submitted to satisfy the staff report. MacCoy: I second that. Johnson: We can do that but we are obligated to take public testimony, this is a public hearing. So I would rather not table this until the public has an opportunity to testify. Any other questions at this time of the applicant? Borup: I have a couple Mr. Chairman, it appears that you are planning on developing this in phases is that correct? McRill: Yes sir Borup: And the first phase the use is all existing buildings? McRill: There are some of those buildings that are existing on the property sir would have to be removed. Borup: My question is are you going to be building new buildings in the first phase? Borup: So you will be doing some in the first phase in addition to the parking and such. McRill: Yes sir Borup: The other staff comment I was curious on was whether all of this area has been annexed, have you had a chance to research that yet? McRill: I understand in reading through it obviously there must be a portion of the property in some area there, it says the City has not made an annex on it. That was my understanding when I read it there was a portion of the back property that has not received annex. Borup: It initially appears that McRill: And this would have to be Borup: (Inaudible) detailed survey McRill: I am not sure how much it is or anything on that and that is something that we need to address. Johnson: Anyone else? Thank you very much, we may call you back. Anyone from the public that v~uld like to testify on this application? Charles Knapp, 185 East Blue Heron Lane, Meridian, was sworn by the City Attorney. Knapp: I have a lot of concerns, I live on the north side of this right where the main building part of the main field and parking lot will be. One of my concerns is the way this is drawn it shows the entry will be along the north side of the property. There is no approach off of Meridian Road at that point. I talked to one of the real estate men and they said they were going to use the approach of the house in front and go around behind it. My concern is fire trucks are going to have a problem getting through. It is actually what they call a land locked property without using the house in front driveway. I am concerned about the noise and I know the City has moved out, we are in the county. There is one building there and that is the barn, that is the only thing that is on that property at the moment. So I would like to know how they are going to access the property, what they are going to do on it. All I see on the map, it just shows the north side. I think I am with a lot of other people that would like to know how they are going to do this and how they are going to get emergency vehicles in. I don't understand it. If not then it is probably appropriate to make your motion. Stephanie Anderson, 9609 Irving, Boise, was sworn by the City Attorney. Anderson: I just think I should let you know as a parent that has a child there and by the way my child is my daughter that Vanguard Military institution has been a phenomenal institution for her. As far as the academic curriculum they have there the first thing they did which I thought was a wild and wondertul idea when my daughter came to this school was test her to see where she ranked. academically. Where her strengths were and where her weaknesses were. We found that even though I had her in some private catholic schools in her math education she was about a 6th grade level due to the fact that she had always been trained to use a calculator. She didn't know how to do the basic concepts without pushing the buttons on the calculator. I have been very proud to see her progress here at Vanguard. What they are talking about with this military organization and I think what the General was trying to.communicate was it is not their goal to take problem children, children who are in trouble with the law constantly, disrupting neighborhoods which might be a concern to the neighborhood that the school is going to go into. That is not their goal to take those children and turn their lives around. Their goal is to provide an academic arena for these children that they can study and excel in and go onto be wondertul human beings. They intend to keep children who an opportunity and are basically good individuals to begin with. They intend to keep them good and productive members and have them help and contribute to the community. The military style works very well for my daughter and it actually gives her a sense of pride, achievement, the ability to achieve a rank and a goal. She has to earn that right, if something goes wrong then they have a way to say a person of a certain rank cannot behave that way so therefore you are not going to have these privileges. It is an institution that allows them to help her grow individually and personally as well as academically. So I have seen a huge difference in my daughter. But I think again it is important to stress these are good kids that can be even better kids and contribute to our community. The types of things they did before they had the academics were involvement in this type of rank and structure in drills, parades and giving them a sense of honor in the community. I think they have a lot to offer Meridian and I think they will bring a lot of productive individuals and keep a lot of good kids on the straight and narrow and keep them good. So I really hope you consider their application. Johnson: I appreciate your testimony, anyone else? Smith: Mr. Chairman, I would like to make a motion that we table this item until which time the applicant can submit a revised site plan incorporating staff and agency comments. Bugatsch: As I am sure you are aware this application is for the addition of a 12,536 square foot family life center to the existing facilities at Cherry Lane Christian church on Cherry Lane here in Meridian. We have reviewed the staff report and would like to address some of the items one by one if we could. Items 1 and 2 are fairly standard and we have no problem with. The owner in general really has no problem with meeting the ultimate goals of the city's zoning ordinance. The major concern at this point in time has to do with the landscaping and parking. The existing parking lot has been in place since 1983, my understanding is Meridian did not adopt the current zoning ordinance until April 2, 1994. So a lot of the requirements that exist now did not apply at that point in time. We realize that adding a fairly major project to this site does impose some requirements upon us. The owner would like you to take a look at the best way to approach this. They would like a little bit of latitude in how we go about landscaping and dealing with the parking problems that the staff report identified. Currently we would be required to have one 3 inch caliper tree for every 1500 square feet of parking that there is. That is 57 trees. The owner would like you to consider allowing them to reduce the caliper size or perhaps reduce the number of trees required and just give them some latitude in time frame to implement all the changes that are required. In addition to the tree problem staff report identifies the parking striping and drainage as needing to be revamped. Wll, in fact, constitute a conditional use as determined by City policy; b. ill be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; c. Wll be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Wild not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately arty such services; f. A revised site plan incorporating staff and agency comments needs to be submitted to the Planning and Zoning Commission prior to action on this proposal. In approving a~ Conditional Use, the Commission and Council may prescribe appropriate conditions, bonds and safeguards in conformity with this Ordinance. Violations of such conditions, bonds or safeguards, when made a part of the terms under which the Conditional Use is granted, shall be deemed a violation of the Ordinance and grounds to revoke the Conditional Use. The Commission and Council may prescribe a set time period for which a Conditional Use may be in existence. We have preliminarily reviewed the above-referenced submittal and request that the following conditions be placed on the project in consideration of approval of the application. These conditions are to be complied with in full, unless expressly modified or deleted by motion of the Meridian City Council: 1. The project site is located in a C-G zone, which allows for private schools only under the conditional use process. The site plan submitted with the application is extremely vague and rough, which makes it difficult to review compliance with various Meridian Ordinances and the overall desirability of the project. The site plan, although indicating a scale of 1 " = 40' , may not be accurate. 2. ACHD policy requires that the access for this project be located a minimum of 150 feet from any existing driveways/roads on Meridian Road. Applicant is to dedicate a total of 48 feet of right-of--way from centerline of Meridian Road. Revise site plan to conform to ACRD requirements and show centerline of roadway and property lines. Furnish copy of C:~MY DOCUMENTS~VANCiUARD.CUP.DOC • Planning & Zoning Commission/Mayor & Council June 13, 1997 Page 3 of 6 recorded warranty deed to the City Clerk's office for dedication of additional right of-way prior to submitting an application for building permit. 3. City Ordinance Section 11-9-605.G. requires that 20-foot-wide planting strips be placed next to incompatible features such as highways, railroads, commercial or industrial uses to screen the view from residential properties. Properties to the north and south are residential. Whether this school use should be considered commercial and incompatible is questionable. Also, City Ordinance Section 11-2-414.D.2.c. states that whenever a commercial off-street parking area is located in or adjacent to a Residential District, it shall be effectively screened on all sides which adjoin or face any property used for residential uses by a wall, fence, or planting screen that is not less than four feet (4') in height plus a planting strip of four feet (4') minimum width or in an alternate arrangement as approved by the Commission. Suitable landscaping and ground cover shall be provided and maintained on a continuing basis within the planting strip. Roadways shown immediately adjacent to the residential properties are unacceptable. Applicant to provide curbing and underground sprinkler system for all landscaped areas. 9. Provide temporary fencing to contain debris during construction. 10. All driveway and parking areas shall be paved, with all driveway accesses approved by the Ada County Highway District. Paving, striping and signage of parking lot to be in accordance with Meridian City Ordinance and the Americans with Disabilities Act. Driveway widths and parking stall lengths do not meet the requirements of City Ordinance Section 11-2-414; i.e., 25-foot-wide driveway aisles with 9'x19' stalls. The distance between proposed parking and the existing garage appears to be 11' . The extra parking shown on the eastern portion of the property shows 10' stalls with 10' driveways. Even with one-way traffic, this obviously is inadequate. Graveled driveways, parking, and access will not be allowed. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer with calculations (Ord. 557, 10-1-91) for all off-street parking areas. All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance, the Uniform Sign Code, and shall receive design approval of the Planning & Zoning Department. A-frame and other temporary signs will not be permitted and will be removed upon 3 days notice to the Applicant. Sign permits are needed for all signage. 13. All building construction shall be in compliance with the Americans with Disabilities Act (ADA) and all required Uniform Codes. 14. Applicant shall supply the Public Works Department with anticipated sewer and water usage for analysis in determining whether additional assessment fees should be charged. The City of Meridian owns and maintains aneight-inch diameter sanitary sewer main in Meridian Road. A four-inch diameter service line to the site is existing; however, it is not physically connected at this time. The treatment capacity of the Meridian Wastewater Treatment Plant is currently being evaluated. Approval of this application needs to be contingent upon our ability to accept the additional sanitary sewage generated byt his project. 17. The City of Meridian owns and maintains aten-inch diameter water main in Meridian Road. A service line to the site is existing; however, it is not physically connected at this time. Service lines to the site shall be reviewed during the plan review process. 18. Water service to this project is contingent upon positive results from a hydraulic analysis by our computer model. 19. Any existing irrigation/drainage ditches crossing or adjacent to the property shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate imgation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 20. Any existing domestic wells and/or septic systems within this project will. have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape imgation. 21. From looking at the County Assessor's records, it appears that a portion of the property (south of the existing barn) has not been annexed to the City of Meridian. The property is located within the City of Meridian at 2250 N. Meridian Road. The property is described in the application which description is incorporated herein. The Applicant is not the owner of record of the property. The record owners of the property are Jack E. and Doris Barrett, and they have consented to the application for the conditional use permit. 4. Pursuant to the application, the property is presently zoned (C-G) General Retail and Service Commercial; however, it is presently occupied as a residence by the current owners. The proposed use of the property is to develop and construct a school campus facility for a maximum of 120 students. in grades five through twelve. 5. This application has been the subject of two previous public hearings the first of which was on July 10, 1997. 6. At the June 18, 1997 public hearing, the Applicant's representative, Robert McRill, testified concerning the Applicant, its history, the type of school it operates and its plans for the development of the property. 7. At the June 18, 1997 public hearing Commissioner MacCoy commented that the material submitted by the Applicant as part of the application does not provide sufficient information to consider the application, such as the dimensions or appearance of the FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 2. In response, the Mr. McRill testified that the Applicant would be happy to provide such information to the Planning and Zoning Commission for consideration of this application. 8. Commissioner Smith commented on the City staff's comment that the Applicant needs to submit a revised site plan which incorporates comments of City staff and other agencies prior to action on the application, and that the Planning and Zoning Commission should receive such requested information to consider properly this application. 9. At the June 18,1997 public hearing, there was testimony from the public both in objection to and support of the application. Said testimony from the public is incorporated herein as if set forth in full as is summarized as follows: a. Charles Knapp testified about his .concerns of the proposed development of the property by the applicant, which concerns included the proposed entry to the property, emergency access to the property due to the proposed access, the noise created by the proposed use; and b. Stephanie Anderson testified about her support of the Applicant and its school based upon her daughter attending the Applicant's current school, and that the Applicant's school would be an asset to the community. 10. To permit the Applicant to submit further and additional information to the Planning and Zoning Commission for consideration of this application, the June 18, 1997 public hearing was continued to July 8, 1997. 11. At the continuation of the public hearing held on July 8, 1997, no person appeared on behalf of the Applicant with regard to FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 3. VANGUARD MILITARY ACADEMY, INC. - CONDITIONAL USE PERMIT • this application. Planning and Zoning Administrator, Shari Stiles, commented that no representative of the Applicant had been in contact with her, and that she heard through various sources that the Applicant was not successful with its endeavor to purchase the property. However, she would attempt to obtain a written statement from the Applicant pertaining to its pursuit of this application. 12. Based upon the information concerning the Applicant's pursuit of this application which was provided. by the Planning and Zoning Administrator to the Planning and Zoning Commission at the July 8, 1997 public hearing, the public hearing was continued to August 12, 1997 at 7:00 o'clock p.m. 13. At the continuation of the public hearing held on August 12, 1997, no person appeared on behalf of the Applicant with regard to this application. 14. There were no other comments by the public regarding this application. 15. Bruce Freckleton, Assistant to the City Engineer, and Shari Stiles, Planning and Zoning Administrator, submitted comments which comments are incorporated herein as if set forth in full. Their comments included the following: a. Section 11-2-418 C of the Meridian Zoning and Development Ordinance states: The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following and shall find adequate evidence showing that such use at the proposed location: a. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; c. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; f. Will not create excessive additional .requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, .processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; and i. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. Staff is unable to affirm that a. through i. are true with the information submitted by the Applicant. A revised site plan incorporating staff and agency comments needs to be submitted to the Planning and Zoning Commission prior to action on this proposal. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 5. VANGUARD MILITARY ACADEMY, INC. - CONDITIONAL USE PERMIT • b. In approving any Conditional Use, the Commission and Council may prescribe appropriate conditions, bonds and safeguards in conformity with this Ordinance. Violations of such conditions, bonds or safeguards, when made a part of the terms under which the Conditional Use is granted, shall be deemed a violation of the Ordinance and grounds to revoke the Conditional Use. The Commission and Council may prescribe a set time period for which a Conditional Use may be in existence. c. We have preliminary reviewed the above-referenced submittal and request the following conditions be placed on the project in consideration of approval of the application. These conditions are to be complied with in full, unless expressly modified or deleted by motion of the Meridian City Council: 1. The project site is located in a C-G zone, which allows for private schools only under the conditional use process. The site plan submitted with the application is extremely vague and rough, which makes it difficult to review compliance with various Meridian Ordinances and the overall .desirability of the project. The site plan, although indicating a scale of 1"=40', may not be accurate. 2. ACRD policy requires that the access for this project be located a minimum of 150 feet from any existing driveways/roads on Meridian Road. Applicant is to dedicate a total of 48 feet of right-of-way from centerline of Meridian Road. Revise sit plan to conform to ACHD requirements and show centerline of roadway and property lines. The Applicant is to furnish a copy of a recorded warranty deed to the City Clerk's office for dedication of additional right-of-way prior to submitting an application for building permit. 3. City Ordinance Section 11-9-605.G. requires that 20-foot-wide planting strips be placed next to incompatible features such as highways, railroads, commercial or industrial uses to screen the view from residential properties. Properties to the north and south are residential. Whether this school use should be considered commercial and incompatible is questionable. The (C-G) General Retail and Service Commercial district is described in the Zoning Ordinance, 11-2-408 B. 11 as follows: (C-G ) General Retail and Service Comtr~ercial : The purpose of the (C-G) District is to provide for commercial uses which are customarily operated entirely or almost entirely within a building; to provide for a review of the impact of proposed commercial uses which are auto and service oriented and are located in close proximity to major highways or arterial streets; to fulfill the need of travel-related services as well as retail sales for the transient and permanent motoring public. All such districts shall be connected to the Municipal Water and Sewer systems of the City of Meridian, and shall not constitute strip commercial development and encourage clustering of commercial development. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 10. VANGUARD MILITARY ACADEMY, INC. - CONDITIONAL USE PERMIT 18. Private schools are allowed uses by conditional use permit on property zoned (C-G) General Retail and Service Commercial; therefore, a conditional use permit would be required. 19. Conditional Use Permit is defined in the Zoning And Development Ordinance, City of Meridian, Idaho as "Permits allowing an exception to the uses authorized by this Ordinance in a zoning district." CONCLUSIONS OF LAW 1. All the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met, including the mailing of notice to owners of property within 300 feet of the external boundaries of the property. 2. The City of Meridian has authority to grant conditional uses pursuant to Idaho Code Section 67-6512 and pursuant to 11-2- 418 of the Zoning And Development Ordinance of the City of Meridian. 3. The City has the authority to take judicial notice of its own ordinances, other governmental statutes and ordinances, and of actual conditions existing within the City and the State. 4. The City of Meridian has authority to place conditions on a conditional use permit and the use of property pursuant to Idaho Code Section 67-6512 and pursuant to that section conditions minimizing the adverse impact on other development, controlling the duration of development, assuring development is maintained properly, and on-site or off-site facilities may be attached to the permit. We are proposing a drive through ATM automatic teller machine. This automatic teller machine will be located out in the existing parking lot area. It will comprise of one island, it is approximately 12 feet long, 3.5 feet wide with the ATM machine on it. With a real simple cover that. covers the machine and the vehicle that would be using it at the time. This canopy would be compatible with the architecture that is already there. It is our belief that the circulation in the parking tot will not be disturbed. We will be taking out approximately 6 parking spaces that ordinarily aren't used but we still exceed the requirements for the parking for the bank site. The Ada County Highway District (ACRD) staff has received the above referenced application requesting conditional use approval to construct a Military Academy Campus. The site is located on the east side of Meridian Road approximately '/s mile north of Fairview Avenue. This development is estimated to generate 230 additional (240 total) vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. B. The site has an existing 16-foot wide curb cut driveway located approximately 20-feet north of the south property line. There are several existing driveways on the east side of Meridian Road within the vicinity of the site's driveway. One driveway is located approximately 140- feet to the south of the site's driveway, another is located 228-feet to the north, and a third driveway/road is on the west side of Meridian Road, located approximately 112-feet to the south. In accordance with District policy the applicant should be required to locate a driveway, a minimum of 150-feet from any existing driveways/roads on both the east and west side of Meridian Road. The driveway should be constructed as a 24 to 30-foot wide curb return driveway with 15-foot curb radii. Coordinate the location and design of the driveway with District staff. C. The application and site plan received by the City of Meridian and submitted to the District on May 23, 1997, have been reviewed by the ACHD Development Services staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This is a staff level report and will not be heard by ACHD's Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Development Services staff decision is submitted as described within the Standard Requirements outlined below. ada county highway district 318 East 37th • Boise, Idaho 83714-6499 • Phone (208) 345-7680 • The following requirements are provided as recommendations for conditions of approval to the City of Meridian: Site Specific Requirements: Dedicate 48-feet of right-of--way from the centerline of Meridian Road abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. The owner will be compensated for this additional right-of--way from available impact fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of--way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance #188. 2. Locate a driveway a minimum of 150-feet from any existing driveways/roads on both the east and west side of Meridian Road. The driveway shall be constructed as a 24 to 30-foot wide curb return driveway with 15-foot curb radii. Coordinate the location and design of the driveway with District staff. 3. Replace the existing curb cut driveway with curb, gutter, and sidewalk to match the existing improvements on Meridian Road. 4. Pave the driveway its full required width of 24 to 30-feet wide to at least 30-feet beyond the edge of pavement of Meridian Road. 5. Utility street cuts in the new pavement are not allowed unless approved in writing by the District. Contact Construction Services at 345-7667 (with file number) for details. 6. Other than the access points specifically approved with this application, direct lot or parcel access to Meridian Road is prohibited. Standard Requirements: This decision of the Development Services Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by an owner of property within 300-feet of the parcel within 15 calender days from the date of this report. The request shall specifically 'di entif,Xeach reauirement to be reconsidered and include a written explanation of why such a reauirement would result in a substantial hardship or inequity. The request will be heazd by the District Commission at an evening meeting within 20 calender days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. MCU1797.SLA Page 2 • ~ 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Development Services Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #188, also known as Ada County Highway District Road Impact' Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall. require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject . property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. MCU1797.SLA Page 3 • Conclusion of Law: 1.
