Dear Shari,
On behalf of Max A. Boesiger, Inc., we hereby submit the attached preliminary/final plat
application for you to review for completeness and then place on the agenda for the next Planning
& Zoning hearing.
Summerfield Subdivision No. 4 is a re-subdivision of Lot 16, Block 19 of Summerfield
Subdivision No. 3. This re-subdivision is being done at the request of the City of Meridian in
order to provide an individual lot for the well previously located within the 10' wide public
utilities, irrigation and drainage easement on Lot 16, Block 19. No new improvements will
constructed in conjunction with this plat and no variances are begin requested.

PLANNING AND ZONING COMMISSION
TIME TABLE FOR SUBMISSION:
A request for preliminary plat approval must be in the City Clerk's possession no later than three days
following the regular meeting of the Planning and Zoning Commission.

Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 p.m., on September 10, 1996, for the purpose of
reviewing and considering the Application of Max Boesiger Inc., for aPreliminary/Final Plat
for land located in Lot 16, Block 19 of Summerfield Subdivision No. 3, Boise Meridian, Ada
County, Idaho, and which property is generally located North of Ustick Road, East of
Locust Grove Road.

Tracey Persons, 1087 West River Street, Suite 250, Boise, was sworn by the City
Attorney.
Persons: The preliminary plat and final plat for Granite Creek Subdivision were previously
approved in 1994. The developer withheld development of this site at that time cue to the
market. Earlier this year when he was ready to proceed again it was discovered that a time
extension for the plat was overlooked and the plat was null and void. So they are back
before you with the preliminary plat. The preliminary plat has not changed from the
originally approved preliminary plat. It contains 21 lots, 20 buildable and 1non-buildable
lot. It is located on 5.81 acres and zoned R-8 currently. Sewer and water and pressurized
irrigation will be provided. The streets will be constructed to ACHD standards and 5 foot
sidewalks will be provided. The site specific and general comments offered a3' Shari and
Bruce I addressed their comments previously as requested. There are a few comments
that I would like to go over. The first one is number 7 of the site specific, it talks about a
6 foot non-combustible perimeter fence being constructed. I believe the intent of that
condition was that a 6 foot non-combustible fence be constructed along the Finch Lateral
easement and not around the entire site. We will construct perimeter ferx~ng on the
remaining three sides just not (inaudible) is that what you meant?

SUBJECT: SUMMERFIELD SUBDIVISION - PRELIMINARY PLAT
On June 23, 1993, the Commissioners of the Ada County Highway
District (hereafter called "District") approved the Preliminary
Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for
acceptance, the Developer shall cause the following applicable
standard conditions to be satisfied prior to District certification
and endorsement:
1. Drainage plans shall be submitted and subject to review and
approval by the District.
2. If public street improvements are required: Prior to any
construction within the existing or proposed public right-of-
way, the following shall be submitted and subject to review
and approval by the District:
a. Three complete sets of detailed street construction
drawings prepared by an Idaho Registered Professional
Engineer, together with payment of plan review fee.
b. Execute an Inspection Agreement between the Developer and
the District together with initial payment deposit for
inspection and/or testing services.
c. Complete all street improvements to the satisfaction of
the District, or execute Surety Agreement between the
Developer and the District to guarantee the completion of
construction of all street improvements.

3. Furnish copy of Final Plat showing street names as approved by
the Local Government Agency having such authority toctether
with payment of fee charged for the manufacturing and
installation of all street signs, as required.
4. If Public Rights-of-Way Trust Fund deposit is required, make
deposit to the District in the form of cash or cashier's check
for the amount specified by the District.
5. Furnish easements, agreements, and all other datum or
documents as required by the District.
6. Furnish Final Plat drawings for District acceptance,.
certifications, and endorsement. The final plat must contain
the signed endorsement of the Owner's and Land Surveyor's
certification.
7. Approval of the plat is valid for one year. An extension of
one year will be considered by the Commission if requested.

FACTS & FINDINGS:
1. Summerfield is a 200-lot single family residential subdivision on 69.5
acres of property located at the northeast corner of Ustick Road and
Locust Grove Road. There will be 10,800-feet of new public streets
added to the system.
2. Ustick Road currently has 50-feet of right-of-way and is improved with
24-feet of pavement.
The 2000 Urban Functional Street Classification Map designates Ustick
as a minor arterial roadway, which generally requires a minimum of
66-feet of right-of-way (the District requires 90-feet of right-of-way
for arterials in an urban impact area) , width sufficient for 4 traffic
lanes (52-foot street section) and 5-foot sidewalks, and bicycle path-
ways. The ultimate right-of-way should be acquired now to minimize
acquisition and construction costs in the future.
In the interim, the developer will be required to construct 5-foot side-
walk .
3. The ACHD .Capital Improvement Plan shows Ustick as currently operat-
ing at Level of Service (LOS) A/B and is projected to operate at LOS
A/B in 2010. It is approved for use of Road Impact Fee funds to in-
crease its capacity; therefore, Road Impact Fee offsets may be given
for construction of the roadway improvements along Ustick by the devel-
oper, but may be given for right-of-way dedication in addition to what
exists now. A person seeking offsets must submit an application to the
impact fee administrator prior to breaking ground, in accordance with
Section 15 of ACRD Ordinance #188.

4. Locust Grove Road currently has 50-feet of right-of-way and is im-

1. Submit a Traffic Impact Study to the District. Coordinate with Traffic
Services Department prior to beginning the study. Additional require-
ments may be imposed pending the findings of the study and any de-
sign engineering work accomplished prior to the District's review and
approval of the study is entirely at the risk of the applicant.
2. Dedicate 45-feet of right-of-way from the centerline of Ustick abutting
parcel (20 additional feet). The owner will be compensated for this
additional right-of-way from available impact fee revenues in this bene-
fit zone .
3. Construct 5-foot wide concrete sidewalk along Ustick abutting parcel
adjacent to the new right-of-way line .
4. Direct lot or parcel access to Ustick is prohibited, in compliance with
District policy. Lot access restrictions shall be stated on the final plat.
5. Dedicate 45-feet of right-of-way from the centerline of Locust Grove
abutting parcel (20 additional feet) . The owner will be compensated for
this additional right-of-way from available impact fee revenues in this
benefit zone.
6. Construct 5-foot wide concrete sidewalk along Locust Grove abutting
parcel adjacent to the new right-of-way line.

8. Dedicate a 20' x 20' triangle (or appropriate curve) of right-of-way at
the corner of Ustick and Locust Grove abutting parcel to keep the
street improvements in the public right-of-way.
STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies .
2. Dedicated streets and drainage systems shall be designed and construct-
ed in conformance with District standards and policies .
3. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACRD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
4. Provide written approval from the appropriate irrigation/drainage dis-
trict authorizing storm runoff into their system.
5. Locate obstructions (utility facilities, irrigation and drainage appur-
tenances, etc.) outside of the proposed street improvements. Authoriza-
tion for relocations shall be obtained from the appropriate entity.
6. Continue existing irrigation and drainage systems across parcel.
7. Submit three sets of street construction plans to the District for review
and appropriate action.
8. Submit site drainage plans and calculations for review and appropriate
action by ACHD. The proposed drainage system shall conform to the
requirements of Meridian City and shall retain all storm water on-site .
Public street drainage facilities shall be located in the public right-of-
way or in a drainage easement set aside specifically for that use .
There shall be no trees, fences, bushes, sheds, or other valuable amen-
ities placed in said easement . Drainage easements and their use restric-
tions shall be noted on the plat.
9. Provide design data for proposed access to public streets for review
and appropriate action by ACHD.
10. Locate driveway curb cuts a minimum of 5-feet from the side lot proper-
ty lines when the driveways are not being shared with the adjacent
property .

11. Developer shall provide the District with a copy of the recorded plat
prior to the installation of street name signs .
12. Install a stop sign on every unsignalized approach of a project street to
an intersection involving a collector or arterial as the cross-street.
The stop sign shall be installed when the project street is first accessi-
ble to the motoring public.
13. A right-of-way permit must be obtained from ACRD for all street and
utility construction within the public right-of-way. Contact Construc-
tion Services at 345-7667 (with zoning file number) for details.
14. A request for modification, variance or waiver of any requirement or
policy outlined herein shall be made, in writing, to the Manager of
Engineering Services within 15 calendar days of the original Commission
action. The request shall include a statement explaining why such a
requirement would result in substantial hardship or inequity.

Borup: That was my concern what the building was going to look like. (Inaudible)
Stiles: Mr. Hill stated that it would cost him $6000 to move the building, he was going to
move the building initially because he got a temporary permit from the City Council so he
could use it temporarily. But even if they had to move it 2 feet from the position that he had
it set he would have to pay another $6000 to move it onto a foundation later. He can't get
a building permit until he gets a conditional use permit.
Shearer: Are they going to landscape the parking on the farmers market part?
Stiles: One of my comments was they should provide a 20 foot landscape strip on that
parcel. It is not really possible on the Idaho Youth Ranch parcel because of maintaining
the use of those tanks. But they would need to meet the tree requirements and
landscaping requirement.
Johnson: Okay Ms. Stiles in the past ten years we have had a lot of professional
presentations this is not one of them.

I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant for final plat approval:
This application for the re-subdivision of an existing subdivision lot is being submitted at
the request of staff. During the development of Summerfield Subdivision No. 1, an off site
pressurized irrigation pump station was designed in a portion of the land that was to later
be Summerfield Subdivision No. 3. The final plat for No. 3 was approved and recorded
prior to the pump station being built. It was during the development plan review process
through the Public Works Department that we became aware of the actual location of the
pumping station. It was the developer's intent to locate the pumping station within the 10
foot wide public utilities, drainage and irrigation easement that existed across the rear of
Lot 16, Block 19 of Sub. No. 3.
We do not feel that it is appropriate for there to be irrigation facilities like this located
within easements on land that is not owned by the Homeowner's Association. The
pumping facility is for the benefit of the entire development, therefore the entire
development should be responsible for the ownership, liability and maintenance.
We allowed the construction of Sub. No. 3 with a building restriction being placed on Lot
16, Block 19 until such time as a re-subdivision plat is recorded that would create a
separate lot for the pumping facility. This final plat appears to meet the requirements of
the State of Idaho and City of Meridian.

Borup: That was my concern what the building was going to look like. (Inaudible)
Stiles: Mr. Hill stated that it would cost him $6000 to move the building, he was going to
move the building initially because he got a temporary permit from the City Council so he
could use it temporarily. But even if they had to move it 2 feet from the position that he had
it set he would have to pay another $6000 to move it onto a foundation later. He can't get
a building permit until he gets a conditional use permit.
Shearer: Are they going to landscape the parking on the farmers market part?
Stiles: One of my comments was they should provide a 20 foot landscape strip on that
parcel. It is not really possible on the Idaho Youth Ranch parcel because of maintaining
the use of those tanks. But they would need to meet the tree requirements and
landscaping requirement.
Johnson: Okay Ms. Stiles in the past ten years we have had a lot of professional
presentations this is not one of them.
Stiles: Thank you
Johnson: This is a public hearing, is there anyone else that would like to address the
Commission on this application, anybody here for this? Any further questions or further
discussion? There are a lot of things going on here, a lot more than meets the eye. So

Cook: This application that you have before you is basically a house keeping item. The
