We also feel this would be a nice addition to those shopping. the craft store to be able to get an espresso while they shop our craft store. Bill Brewer, owner of the Chapel of the Chimes has stated to us that we will be able to use the parking, area in the rear of his building if needed for parking. Stiles: The second is a Sunday but even if they were ready by, we have to have the agenda for the City Council, it would need to be Johnson: (Inaudible) Stiles: The agenda has to be prepared by Thursday? Johnson: The findings of fact would have to be ready by January 29, that is probably doable, we have two attorneys now right? Fitzgerald: We can get it done. Johnson: I would think so because these are not going to be complicated findings of fact. Stiles: It would save them two weeks. Johnson: If you could do that it would save you two weeks getting the approvals assuming everything else is a slam dunk Oslund: Well heck we are meeting Thursday, let's get them done for Thursday. Johnson: So I am ready to take a motion. MacCoy: Mr. Chairman, I move we have the attorney prepare findings of fact and conclusions of law for this project. Oslund: Second Johnson: Moved ad seconded we have the City Attorney prepare findings of fact and conclusions of law on the application for John and Becky Schiebout, all those in favor? Opposed? ITEM #7: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A CRAFT STORE W/ESPRESSO SHOP, SOUTHWEST CORNER OF CARLTON AND SECOND STREET (141 E. CARLTON) BY LISA & CLIFF SEXTON AND KRIS & STEWART HASKELL: Meridian Planning & Zoning January 14, 1997 Page 30 Johnson: I will now open this public hearing and invite the applicant or the representative of the applicants to come forward and address the Commission. Stewart Haskell, 2155 North 24`h, Boise, was sworn by the City Attorney. Haskell: Basically I am in the same boat as she was, unprepared. Johnson: If you just briefly tell us what you have in mind and then we will ask you questions. Haskell: What we have planned for is this house we bought and we are going to, it originally was flower shop I guess there. She went out of business so we bought it and we are going to turn it into a craft store. Wel! I guess the conditional use permit would allow that just for a lateral transfer but when we decided to add the espresso shop we have to come back through this and that is why we are here. It is mostly for the espresso shop. So that is, it is going to be a craft store with an espresso shop on the side. Johnson: Well we can probably handle the rest of it with questions if that is your presentation. Whoever wants to ask the first question (inaudible). Borup: Mr. Chairman, the only thing I have questions on is ACHD comments. MacCoy: What kind of signage do you plan to have at your place? Haskell: Well there is already an existing sign there and all we are going to do is put new plastic in which is our logo Crafts by Nature and probably a neon espresso sign in one window and an open and closed sign basically is it. MacCoy: In the window, not out on the street side? Haskell: No, we won't make any other sign other than what is already there. MacCoy: No blinking .lights or anything like that? Haskell: No blinking lights or flashy jazzy stuff. MacCoy: On the handicapped, what is your plan there? Haskell: On the east side eventually we would like to build a ramp corning up into the shop area. MacCoy: You say eventually, when is that? Meridian Planning & Zoning January 14, 1997 Page 31 Johnson: Is that like when we require it? Haskell: Okay Johnson: Is that what you mean? I am just asking where you are coming from on that, because that is a good question. Haskell: If it is a requirement then I guess we will have to do before we can open. Otherwise we are going to put it off until we can afford we can do this. MacCoy: I suggest that you might want to think about that (inaudible) because it is a requirement. We are governed by the Americans with Disabilities Act, it is a Federal law, it is also good for your business too as well. So you get a benefit from that. This tree they talk about, where are you going put this tree, is that going to be out on the lawn or the (inaudible). Haskell: I am not familiar with the tree? Borup: Mr. Chairman, did you receive a copy of Shari's comments, Shari Stile's comments? Haskell: F received this packet, which one is she under? Johnson: This letter is dated January 10, do you have that letter? Haskell: (Inaudible) I don't see one in here. MacCoy: Our staff reviews this and then gives us a base line to go with here. Johnson: You can have my copy there, and then you can get an original if you want. MacCoy; Okay, look at item 3 on that, on the first page there, since you haven't (inaudible). I did have a question on your lighting, what were you planning on your lighting your parking or lighting what? See we would require the fact that if you do have lighting that it doesn't form a glare and create a problem. Haskell: Okay, basically the lighting is just, there is a street tamp there on the comer and the lighting would just be exterior lights on the house like porch lights. MacCoy: So it-would be pretty well what you have already then you are talking about. Haskell: Maybe we were doing to go with a little bit larger flood limit type thing but as far as, we wouldn't point them into the street. They would be more for security around Meridian Planning & Zoning • January 14, 1997 Page 32 the, it is kind of an out of the way area there, dark. Especially with that old school across the street and the kids and vandalism and stuff we just like to keep it lighted as much as possible. MacCoy: Keep in mind if you do put up lights that glare is a real item of issue here with us. Johnson: Anyone else have questions of the applicant at this time? Borup: Maybe not the applicant, I am still confused on ACHD's comments. Johnson: Would you like clarification as best we can get it from staff? Borup: Yes I would. Johnson: Bearing in mind they did not write these Borup: I realize that, at one point they say that it conforms to their standards and this item will not be heard. , At one point they say everything is okay. And then they give a list of recommendations. Are they saying they everything meets their standards, but that is not what that says. Am I reading that wrong then? Johnson: The second paragraph under B? Borup: Yes, well both paragraphs. One says that it conforms and then it says in the second paragraph the item will not be heard. Stiles: I believe what they are referring to are the accesses that would come off the street and there is no right of way dedication that they need. The site plan itself is not any problem with them, that is why it is a staff level approval. But when Bill Brewer came through with his conditional use permit these same conditions were a part of that application but the improvements were never constructed. MacCoy: Does it put it in your hands to govern the site specific requirements then? Stiles: No MacCoy: I agree with Keith, if you read this it gives you the impression that it is ail okay and the next thing you know you have yourself thinking which hand am I talking about. They talk about curb and gutter and gravel and driveways and quite a bit of things. Oslund: Have you reviewed the ACRD comments? Meridian Planning & Zoning January 14, 1997 Page 33 Haskell: We went down, we had to go to ACRD and they gave us this particular, whatever you want to call it here. But it was a total shocker to me too, 1 was not even expecting as far as the curbs and gutters and when she started going off about that I was like "oh man". We were not even, as far as our curbs and gutters, f don't know if you are familiar with that street but they are not nearly has bad as some of the other businesses that are right. there in the area. So that is why we couldn't figure out is why they are going to make us replace curbs and gutters when ours aren't nearly as bad as some of the other places that are right on that little comer there. MacCoy: Well the same thing came up during the flower shop. Haskell: Right, I talked to Mr. Brewer about that and he basically, it just seemed to, we are basically in the same boat. Depending on how our business goes we may or may not want to add a parking lot onto our back area. So we would like to request that the curb and gutters be delayed for one to two years so we can determine how busy out place is going to be, then we can determine where to put the cuts into the streets after we decide to go with parking on the lot itself. MacCoy: And meanwhile Mr. Brewer has given you, I read someplace in here, his permission. Haskell: Yes he did, Mr. Brewer did give us permission to use the bade part of his mortuary as overflow parking for our business. Oslund: I have a question for staff, what is the, procedurally what are we ta~Cing about here, this is not a preliminary plat and there is not plat approval on ACHD's part. If we choose to look at this comments as somewhat vague and confusing and just go off in my opinion the right is just to approve this. The change in use is virtually nothing, it is good for downtown. We are talking about some minor things here. Is there another approval process that ACRD is involved in ~ this particular application? Stiles: Ada County Highway Districf does sign off on all occupancies now Haskell: She told us when we were down there that, we were like I said dumbfounded by the whole thing. She said just remember that these are recommendations. Borup: That is what I was going to mention here that is what they say they are just provided recommendations for the City. To me that is saying the City can require it or not depending on (inaudible) Oslund: Okay, then wee are done then. Johnson: I don't think it is particularly unusual for the Ada County Highway District's comments to be ignored. Because you can never go bade to them and say well you Meridian Planning & Zoning January 14, 1997 Page 34 didn't tell us to because they have told you everything that you need to do. But the practical matter is that I don't think something like this we are going to keep an operation from opening its doors because of ACHD's requirements that they don't see important enough to even go beyond staff level approvals. Oslund: The only one that possibly does is that corner (inaudible). Haskell: Now that is something that we had also discussed between the four of us is that it comes right down to it where we can open we will: be more than happy to do the corner portion of the sidewalk where the pedestrian ramp comes up and we can just delay doing the curb and gutter until we can figure out exactly haw busy we are going to be and get some more money. This is our savings right here. Oslund: You understand that you have to hire somebody to do that work that is bonded. Haskell: Right Oslund: If that ramp is not there is still decent access, are you planing to provide handicapped access for your customers, that would be my (inaudible). Haskell: We have talked about it and we are going to put a ramp onto one of the doors. There are two entrances. Oslund: Would there be a way to get from that ramp to a parking space that somebody would conceivably use for (inaudible). Haskell: The existing cut out that goes into the drive way now 1 suppose a wheel chaired individual could come up that way onto the sidewalk. But as far as the actual curb on the street no, just the cut out that is there right now for the actual, which is what we use as our drive way and loading area. MacCoy: Well at least they have away to get into it and park. Johnson: Any other questions? Borup: I think the applicant is probably aware then at the time of putting in paved parking you probably need to be prepared for a lot of this ACRD stuff ~ looks like. Haskell: Right Johnson: Anyone else that would like to address the Commission on this application? Any further comments or discussion? If not 1 will close the public hag at this time. Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance. 2. Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-414.D.3 3. All Signs shall be in accordance with the standards set forth in 2-415 of the City of Meridian Zoning and Development Ordinance. 4. Sanitary Sewer and Water to this facility would be via. existing service lines. Assessments for sewer and water service will be reviewed to see if additional load would justify an adjustment. Please provide any information that you may have with regards to your anticipated water demand. BEFORE THE MERIDIAN PLANNING AND ZONING COMMISSION CLIFF AND LISA SEXTON, AND STEWART AND KRIS HASRELL CONDITIONAL USE PERIyIT FOR CRAFT STORE WITH ESPRESSO SHOP 141 EAST CARIaTON MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS OF LAW The above entitled matter having come on for public hearing January 14, 1997 at the hour of 7:00 o'clock p.m., one of the Applicants, Stewart Haskell, hereinafter the "Applicant," appearing in person, the Planning and Zoning Commission of the City of Meridian having duly considered the evidence and the matter makes the following Findings of Fact and Conclusions of Law: FINDINGS OF FACT 1. A notice of a public hearing on the Conditional Use Permit was published for two (2) consecutive- weeks prior to the said public hearing scheduled for January 14, 1997, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the -January 14, 1997 hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations. 2. This property is located within the City of Meridian and the Applicants are the owners of the property; that the property is currently zoned (OT) Old Town; that in the ZONING SCHEDULE OF USE CONTROL, Section 11-2-409 B., Retail Stores and Restaurants are FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 1. HASKELL listed as conditional uses in the (OT) Old Town District and, therefore, in the (OT) Old Town District a conditional use permit for the operation of the craft store with esgresso shop is required. 3. The (OT) Old Town District is described in the Zoning Ordinance, 11-2-408 B. 12. as follows: (OT) Old Town District: The purpose o~f the (OT} District is to accommodate and encourage further expansion of the historical core of the community; to delineate a centralized activity center and to encourage its renewal, revitalization and growth as the public, quasi-public, cultural, financial and recreational center of the City. A variety of these uses integrated with general business, medium-high to high density residential, and other related uses is encouraged in an effort to provide the appropriate mix of activities necessary to establish a truly urban City center. The district shall be served by the Municipal Water and Sewer systems of the City of Meridian. Development in this district s~st give .attention to the handling of high volumes of traffic, adequate parking, and pedestrian movement, and to provide strip commercial development, and must be approved as a conditional use, unless otherwise permitted. 4. Conditional Use Permit is defined in the Zoning Ordinance as follows: "Permit allowing an exception to the uses authorized by this Ordinance in a zoning district." 5. The property is located at 141 Sast Carlton, Meridian, Ada County, Idaho. 6. The Applicant testified that the intention of the Applicants is to operate a craft store with an espresso shop. 7. The Applicant testified as follows. The Applicants will operate a craft store and espresso shop from the subject property. There presently exists a sign at the subject property, which the Applicants intend to use. They plan to replace the plastic on the FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 2. HASRELL sign with plastic displaying their business' logo, and to place a neon espresso sign and an open and closed sign at windows inside the building. Other than the existing outside sign, the Applicants will not display any outside signs. The signs will not have blinking lights or other similar characteristics. The Applicants will build a ramp into one of the entrances to the shop area of the subject property if required to provide handicapped access. The Applicants will use exterior lights, such as flood porch lights, to light the subject property for security purposes. The lights will not point into the street. The Applicants are aware of the comments and requirements of Ada County Highway District. Dependent upon the success of the Applicants' business, they may add a parking lot to the back area of the subject property. The Applicants have permission from Mr. Brewer to use the back portion of the parking area of his mortuary for overflow parking for their business. 8. The Assistant to the City Engineer, Bruce Freckleton, submitted comments which are incorporated herein as if set forth in full. He commented as follows: that off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance; that outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in .accordance with City Ordinance Section 11-2-414 D. 3.; that all signs shall be in accordance with the standards set forth in 2-415 of the City of Meridian Zoning and Development Ordinance; that sanitary sewer and water to the FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 3. HASKELL facility would be through existing service lines; that assessments for sewer and water service will be reviewed to detp**~~ne whether the additional load justifies an adjustment to the assessments; that the Applicants provide any information that they may have regarding the anticipated water demand; and that the Applicants will be required to enter into an Assessment Agreement with .the City of Meridian. .. 9. The Planning and Zoning Administrator, Shari Stiles, submitted comments which are incorporated herein as if set forth in full, and which were basically as follows: that all signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance; that all signage shall receive design approval of the Planning & Zoning Department; that A-frame signs shall not be permitted; that sign permits must be obtained from the Building Departaent for all signage; that the building needs to be brought up to code for fire and life safety requirements and must meet handicapped accessibility standards; that one three-inch caliper tree is required for each 1,500 square feet of pavement; that all landscaping areas are to be provided with an underground sprinkling system; that all off-street parking areas are to be paved and striped; that no off-street parking spaces are shown in the Application; that a previous application submitted by Bill and Joyce Brewer in 1995 indicated that the Brewers would utilize funeral home parking area to meet their. off-street parking requirements; that the Applicants are to submit a notarized letter FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 4. Ada County Highway District submitted comments and requirements, all of which comments and requirements are hereby incorporated herein as if-set forth in full, and some of which are more particularly set forth as follows. Facts and Findings: A. The Ada County Highway District (ACRD) staff received the subject Application requesting conditional use approval for an espresso shop/craft store in an existing single family home. The 0.2- acre site is located at the southwest corner of E. Carlton and 2nd Street, approximately 350-feet east of East lst Street. This development is estimated to generate 60 additional (10 existing) vehicle trips. per day based on the Institute of Transportation Engineers Trip Generation manual. This site was previously reviewed by the District on February 3, 1995 as a conditional use for a flower shop. The conditions and requirements for the previous conditional use have not been met. B. The Application and site plan received by the City of Meridian, and submitted to the District on December 6, 1996, has been reviewed by the ACRD Development Services staff and conforms to applicable District standards/policy, or can be made to conform with. the change(s) to the plan described in the requirements stated below. Site Specific Requirements: 1. Construct pedestrian ramps on the corner of Carlton Street and 2nd Street in compliance with Idaho Code, Section 40-1335. 2. A 16 to 20 foot wide curb cut on 2nd Street, located a mini.m~um of 50-feet south of Carlton Street, shall be approved. 3. Replace damaged curb and gutter on 2nd Street and Carlton Street with new curb and gutter to match existing improvements. Segments to be replaced FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 6. HASKELL shall be determined by ACRD Construction Services staff . 4. Utility street cuts in new pavement less than five years old are not allowed unless approved in writing by the District. 5. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. If the driveway is not to be paved on site, pave the driveway its full required width to at least 30-feet beyond the edge of pavement of Carlton Street: 6. As required by District policy, restrictions on the width, number and locations of driveways, shall be placed on future development of this parcel. 11. Central District Health Department, submitted comments, which comments are hereby incorporated herein as if set forth in full; that Central District Health Department will require plans to be submitted for a plan review of any food establishment. 12. Meridian City Police Department and Nampa & Meridian Irrigation District submitted comments, which respective comments are hereby incorporated herein as if set forth in full. 13. Meridian Fire Department submitted comments,. which comments are hereby incorporated herein as if set forth in full; that as long as all codes are met, it will not have a problem with this permit. 14. There was comment and discussion between Commissioner Burop, Chairman Johnson, Planning ~ Zoning Administrator Shari Stiles, Commissioner MacCoy, Commissioner Oslund and the Applicant concerning Ada County Highway District's comments and requirements, and the approval the Applicants' Application. 15. There was no further testimony given at the hearing. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 7. HASRELL CONCLUSIONS OF LAW 1. All the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicants' property. 2. The City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and,~pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian. 3. The City has the authority to take judicial notice of its own ordinances and proceedings, other governmental statues and ordinances, and of actual conditions existing within the City and state of Idaho. 4. The City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to that section conditions minimizing the adverse impact on other development, controlling the duration of development, assuring the development is maintained properly, and on-site or off-site facilities may be attached to the permit; that 11-2-418 (D) authorizes the City to prescribe a set time period for which a conditional use may be in existence. 5. Section 11-2-418 D. states as follows: In approving any Conditional Use, the Commission and Council may prescribe appropriate conditions, bonds, and safeguards in conformity with this Ordinance. Violations of such conditions, bonds or safeguards, when made a part of the terms under which the Conditional Use is granted, shall be deemed a violation of the Ordinance and grounds to revoke the Conditional Use. The .Commission and Council may prescribe a set time period for which a Conditional Use may be in existence. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 8. HASKELL 6. The City has judged this Application for a conditional use upon the basis of guidelines contained in Section 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian and upon the basis of the Local Planning Act of 1975, Title 67 Chapter 65, Idaho Code, the Comprehensive Plan of the City of Meridian, and the record submitted to it and the things of which it may take judicial notice.. .. 7 . 11-2-418 (C ) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area and assuming that the above conditions or similar ones thereto would be attached to the conditional use, the Planning and Zoning Commission concludes as follows: a . The use, would in fact, constitute a conditional use and a conditional use permit would be required by ordinance; b. The use would be harmonious with and in accordance with the Comprehensive Plan but the Zoning Ordinance requires a conditional use permit to allow the use; c. The use is designed and constructed to be harmonious in appearance with the character of the general vicinit7i that if the conditions set. forth herein are complied with the use should be operated and maintained to be harmonious with the intended character of the general vicinity and should not change the essential character of the area; d . That the use would not be hazardous nor should it be disturbing to ezisting or future neighboring uses if the conditions are met; that traffic will increase, but due to the drop-off and pick-up being off of the street it should not be a problem; FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 9. HASRELL e. The property has sewer and water service already connected, but the Applicants ~y have to pay additional fees for the use; f. The use would not create excessive additional requirements at public cost for public facilities and services and the use woi:ld not be detrimental to the economic welfare of the community; g. If the conditions are met, the use should not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic, .noise, smoke, fumes, glare or odors; h. Sufficient parking for the proposed use will be required to meet the requirements of the City ordinance; and i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 8. As conditions may be placed upon the granting of a conditional use permit to minimize adverse impact on other development, it is recommended by the Planning and Zoning Commission that the following conditions of granting the conditional use be required, to wit: a. The conditional use, pursuant to the Zoning Ordinance, shall not be transferable to another owner of the subject property or to another property. b. The Applicants shall meet the requirements of .the City Engineer's office, the Planning and Zoning Administrator, Meridian Police Department, Meridian Fire Department, Central District Health Department, and the Nampa Meridian Irrigation District, which requirements specifically include: 1. Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Developaaent Ordinance; 2. The Applicants shall cause all design and construction to be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable Ada County Highway District ordinances unless specifically waived herein; 9. The Applicants shall submit revised plans for staff approval, prior to issuance of a building permit or other required permits, which incorporates any required design changes; and 10. The Applicants shall cause construction, use and property development to conform with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. d. The conditional use shall not be restricted to a period of authorization but may be reviewed annually, upon notice to the Applicants, for violation of any conditions imposed herein, other conditional use applications, or the ordinances fo the City of Meridian. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 13. HASRELL 10. The above-conditions are concluded to be reasonable and the Applicants shall meet these conditions. 11. It is recommended that if the Applicants meet the conditions stated above, that the conditional use permit be granted to the Applicants. The Ada County Highway District (ACHD) staff has received the above referenced application requesting conditional use approval for an espresso shop/craft store in an existing single family home. The 0.2-acre site is located at the southwest corner of E. Carlton and 2nd Street, approximately 350-feet east of E. 1st Street. This development is estimated to generate 60 additional (10 existing) vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. This site was previously reviewed by the District on February 3, 1995 as a conditional use for a flower shop. The conditions and requirements for the previous conditional use have not been met. B. The application and site plan received by the City of Meridian, and submitted to the District on December 6, 1996, has been reviewed by the ACRD Development Services staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This item will not be heard by the ACRD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Development Services staff decision is submitted as described within the Standard Requirements outlined below. Construct pedestrian ramps on the corner of Carlton Street and 2nd Street in compliance with Idaho Code, Section 40-1335. 2. A 16 to 20-foot wide curb cut on 2nd Street, located a minimum of 50-feet south of Carlton Street, shall be approved. 3. Replace damaged curb and gutter on 2nd Street and Carlton Street with new curb and gutter to match existing improvements. Segments to be replaced shall be determined by ACHD Construction Services staff. Contact Construction Services at 345-7667 (with file number) for details. .. 4. Utility street cuts in new pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 345-7667 (with file numbers) for details. . 5. Graveled driveways abutting. public streets create maintenance problems due to gravel being tracked onto the roadway. If the driveway is not to be paved on site, pave the driveway its full required width to at least 30-feet beyond the edge of pavement of Carlton Street. 6. As required by District policy, restrictions on the width, number and locations of driveways, shall be placed on future development of this parcel. Standard Requirements: 1. This decision of the Development Services Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by an owner of property within 300-feet of the parcel within 15 caletder days from the date of this report. The request shall specifically ;riPnr' each requirement to be reconsidered and include a written exFlanation of why such a ~gq»;rPmPnr would result_in a substantial hardshiF or inequity. The request will be heard by the District Commission at an evening meeting within 20 calender days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Development Services Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically was not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the MCU3296.SLA Page 2 Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived herein. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. All signage shall receive design approval of the Planning & Zoning Department. A-frame signs shall not be permitted. Sign permits must be obtained from the Building Department for all signage. 2. The building needs to be brought up to code for fire and life safety requirements and must meet handicapped accessibility standards. 3. One three-inch caliper tree is required for each 1,500 square feet of pavement. All landscaping areas are to be provided with an underground sprinkling system. 4. All off-street parking areas are to be paved and striped. No off-street parking spaces are shown in the application. A previous application submitted by Bill and Joyce Brewer in 1995 indicated that the Brewers would utilize funeral home parking area to meet their off- street parking requirements. Applicant is to submit a notarized letter from Bill and Joyce Brewer that this is still the case. 5. Handicapped accessible parking and walkways are to be provided in accordance with the Americans with Disabilities Act, including appropriate signage. 6. Screened trash enclosures are to be provided in accordance with City Ordinance. Coordinate dumpster site locations with the City's solid waste contractor, Sanitary Services, Inc. Improvements include replacement of the curb and gutter on Carlton and Second Street and construction of pedestrian ramps in compliance with Idaho Code, Section 441335. 9. All paving, striping and signage of parking lot to be in accordance with Meridian City Ordinance Section 11-2-414 and the Americans with Disabilities Act. All off-street parking spaces are to be paved. Parking stalls are to be 9'x19' minimum with 25' driveways. 10. Lighting shall not illuminate residential properties or cause glare problems, as determined by the City of Meridian. 11. Applicant shall supply the Public Works Department with anticipated sewer and water usage for analysis in determining whether additional assessment fees should be charged. Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance. 2. Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-414.D.3 3. All Signs shall be in accordance with the standards set forth in 2-415 of the City of Meridian Zoning and Development Ordinance. 4. The Ada County Highway District (ACRD) staff has received the above referenced application requesting conditional use approval for an espresso shop/craft store in an existing single family home. The 0.2-acre site is located at the southwest corner of E. Carlton and 2nd Street, approximately 350-feet east of E. 1st Street. This development is estimated to generate 60 additional (10 existing) vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. This site was previously reviewed by the District on February 3, 1995 as a conditional use for a flower shop. The conditions and requirements for the previous conditional use have not been met. B. The application and site plan received by the City of Meridian, and submitted to the District on December 6, 1996, has been reviewed by the ACRD Development Services staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This item will not be heard by the ACRD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Development Services staff decision is submitted as described within the Standard Requirements outlined below. The following requirements are provided as recommendations for conditions of approval to the City of Meridian: ada county highway district x.18 East 37th • 6oise, idc~o 83714-649 hone ;208) 345-7680 Site Specific Requirements: 1. Construct pedestrian ramps on the comer of Carlton Street and 2nd Street in compliance with Idaho Code, Section 40-1335. 2. A 16 to 20-foot wide curb cut on 2nd Street, located a minimum of 50-feet south of Carlton Street, shall be approved. 3. Replace damaged curb and gutter on 2nd Street and Carlton Street with new curb and gutter to match existing improvements. Segments to be replaced shall be determined by ACHD Construction Services staff. Contact Construction Services at 345-7667 (with f le number) for details. { 4. Utility street cuts in new pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 345-7667 (with file numbers) for details. 5. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. If the driveway is not to be paved on site, pave the driveway its full required width to at least 30-feet beyond the edge of pavement of Carlton Street. 6. As required by District policy, restrictions on the width, number and locations of driveways, shall be placed on future development of this parcel. Standard Requirements: 1. This decision of the Development Services Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by an owner of property within 300-feet of the parcel within 15 calender days from the date of this report. The request shall specifically ~dentifv each requirement to be reconsidered and include a written exFlanation of whyr such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calender days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Development Services Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that wac not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the MCU3296.SLA Page 2 Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. MCU3296.SLA Page 3 Conclusion of Law: ACHD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. The Ada County Highway District (ACHD) staff has received the above referenced application requesting conditional use approval for an espresso shop/craft store. in an existing single family home. The 0.2-acre site is located at the southwest corner of E. Carlton-and 2nd Street, approximately 350-feet east of E. 1st Street. This development is estimated to generate 60 additional (10 existing) vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. This site was previously review by the District on February 3, 1995 as a conditional use for a flower shop. The conditions and requirements for the previous conditional use have not been met. B. The application and site plan .received by the City of Meridian, and submitted to the District on December 6, 1996, has been reviewed by the ACHD Development Services staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This item will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Development Services staff decision is submitted as described within the Standard Requirements outlined below. The following... requirements are provided as recommendations for conditions of approval to the City of Meridian: ada county highway district 318 East 37th • Boise, Idaho 83714-6499 + Phone (208) 345-7680 1. ~' Site Specific Requirements: 1. Construct pedestrian ramps on the corner of Carlton Street and 2nd Street in compliance with Idaho Code, Section 40-1335. 2. Replace unused curb cuts on 2nd Street with standard curb, gutter and 5-foot wide concrete sidewalk to match the existing improvements. 3. Replace damaged curb and gutter on 2nd Street and Carlton Street with new curb and gutter to match existing improvements. Segments to be replaced shall be determined by ACHD Construction Services staff. Contact Construction Services at 345-7667 (with file number) for details. 4. Utility street cuts in new pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 345-7667 (with file numbers) for details. 5. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. If the driveway is not to be paved on site, pave the driveway its full required width to at least 30-feet beyond the.. edge of pavement of Carlton Street. 6. As required by District policy, restrictions on the width, number and locations of driveways, shall be placed on future development of this .parcel. Standard Requirements: This decision of the Development Services: Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by an owner of property within 300-feet of the parcel within 15 calender .days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a ~qu~rement would result in a substantial hardship or ine~u~ The request will be heard by the District Commission at an evening meeting within 20 calender days of the District's receipt of the appeal letter. The>appecant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Development Services Supervisor within two days of the action and shall` include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision The request for reconsideration will be heard by the District Commission at the next regular meeting of the MCU3296.SLA l~...~nl»oinr~ n~ T .~w• .-~ Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of .this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District.
