GENERAL PARTNERSHIP AGREEMENT

WILD SHAMROCK
THIS GENERAL PARTNERSHIP AGREEMENT (hereinafter "Agreement")
is executed effective the 1st day of October, 1991, by HAROLD E.
THOMAS and KENRICK "RICK" E. THOMAS, said parties being
collectively referred to herein as the "Partners."
R E C I T A L S:
The purpose of this Partnership is to acquire and manage that
certain real property legally described in the attached Exhibit A.
Such property shall be referred to herein as the "Property." The
partnership established hereby shall exercise any and all
privileges or powers related to the Property now or hereafter
conferred upon partnerships by the laws of the State of Idaho. In
consideration of the mutual terms contained herein, the parties
agree as follows:
ARTICLE 1.
1.1 General: The parties do hereby adopt the foregoing
Recitals and do hereby form a General Partnership under the Uniform
Partnership Law of Idaho.
1.2 Name and Principal Office: The name of the Partnership
shall be WILD SHAMROCK, and the principal office of the Partnership
shall be at 7259 Cascade Drive, Boise, Idaho 83704, or at such
other place or places as the Partners may from time to time
designate.
1.3 Term of Partnership: The Partnership shall commence on
the date of this Agreement and shall continue from such date until

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, at the hour of 7:00 p.m., on April 8, 1997, for the purpose of
reviewing and considering the Application of Rockets Inc., for a Conditional Use Permit

ITEM #12: REQUEST FOR A CONDITIONAL USE PERMIT FOR A FULL SERVICE
RESTAURANT WITH LIQUOR LICENSE BY ROCKETS INC. (STEVE
YOUNGERMAN):
Youngerman: 1 am Steve Youngerman and I operate Harry's Bar and Grill across the
street here. (Inaudible) people we started the whole thing on the premise that people
don't want to go out to just dinner anymore, they want to go out and be entertained.
Theme restaurants are the hottest thing going across the country as Planet Hollywood,
Harley Davidson Cafe, Motown Cafe, all those places will attest to that. What we have
proposed is a science fiction theme restaurant with props and items from movies and
the whole science fiction art form from Flash Gordon and Buck Rogers right up to the
new stuff. As part of that we want to have a liquor license which is why we are doiny the
conditional use permit. The location is up on the, it would be the NE comer of 1 and
Gem and it is the vacant lot between the Godfathers Blimpie building and the Les
Schwab building, south side of Gem Street. The development is called the First
Meridian Plaza. I have a plan over here, it is approximately 230 seats, 70 in the bar,
160 in the dining room. This would be the south (inaudible) we have raised dining here,
raised dining here, raised bar area, banquet area that could not only be used for small
banquets but also as overflow dining on busy nights. Full, the style of cuisine is what we
call American cuisine, probably if you have been to TGI Fridays that kind of menu,
pasta, salads, chicken dishes, small steak, items like that. A place where a family can
go and there is a lot of visual stuff for the kids to look at and have a good time with but
mom and dad can get the kind of adult beverages that they like to have. It appeals to a
wide variety of people, you get a great cross section of people. We think we have a

pretty good plan. There is one item, I read the findings of fact and conclusions of law
and there is one item that was kind of inserted in there about a pedestrian access
across the Eight Mile Lateral which is on the north margin of the property on the south
side of Gem Street. The developer already had an agreement with the Nampa Meridian
Irrigation District to tile that entire ditch. Ada County Highway District has approved a
drive and entrance on Gem Street there. So, I .guess I ask that be stricken from
(inaudible) that kind of came in at the last meeting kind of out of nowhere. I think it was
something that was mentioned in 95 when the project first brought up.
Tolsma: Is this kind of similar to Planet Hollywood?
Youngerman: Yes, in fact that is going to be interior look is going to be quite a bit like
that. We don't have $14 million to spend.
Tolsma: (Inaudible)
Youngerman: When we first came up with this idea I have a really top notch designer
who is a local guy working on this but if you watch science fiction movies there are two
distinct looks there is the real clean sanitary look like the Death Star or the Starship
Enterprise and then there is the kind of used kind of rough worn look of the off world
stuff and that is the look we are going for kind of industrial. There is a place in Las
Vegas called Dive and it is a submarine place and they have a conveyor system that
has submarines going around the place all the time. We are going to try to put a
conveyor in there with rocket ships going around. We have rounded up props from the
movies, we have am Imperial Storm trooper, we have an Alien from the Alien movies,
we have a Martian from Mars Attacks and we are trying to get a Borg. We have a prop,
we have been able to find a lot of stuff, there is 'a ton of stuff out there. I tell you what it
is going to be a fun project, it is going to be unique in this valley. I think our goals are to
be the premiere restaurant in the valley to be the restaurant employer in the valley.
Rountree: I guess your comment with respect to the findings of fact and conclusions is
that item 8 page 9. It talks about if the applicant desires to place a pedestrian bridge
across.
Youngerman: Right, but we are going to tile the ditch. Like I said ACHD has already
given their blessing to an access on Gem Street.
Bentley: Question for the chief, the liquor license.
Gordon: Mr. President and Council I would presume that Mr. Youngerman already
possess a liquor license issued to the State. That would not be an issue, I am sure he
is aware of rules and regulations on liquor licenses.

Bever: Basically this used to be Ambrose Plaza it is down here on East 1st Street and
State Avenue. My husband and I self own it and we have owned it for a year and a half
now. We came to attention because we rented to a barber shop I believe that was the
reason for the conditional use. We were unaware that we were required to obtain a
conditional use permit when we purchased the property the people who were in the
offices are still there basically. We have non -retail businesses, low traffic businesses,
builder, barber shop, a typography place, long distance carrier which has not street

Johnson: At this time I will open the public hearing and ask Mr. Youngerman to address

Steve Youngerman, 5451 South Caper Place, Boise, was sworn by the City Attorney.
Youngerman: We are going to have, it is going to be a 6,000 square foot building, 230
seats, 160 in the dining room, 70 in the bar. The dining area will be non-smoking, the
bar will be the smoking area. American cuisine, science fiction theme, lunch and dinner
not breakfast.
Johnson: Any questions of Mr. Youngerman from the Commissioners?
Borup: 1 assume you have read all of the staff comments and no questions (inaudible) I
do have a couple on the ACHD comments. One was comment E talking about the
irrigation ditch. They were concerned about it being on the right of way.
Youngerman: It has all been settled.
Borup: Okay because it looked to me like (inaudible)
Youngerman: There was a question between where Gem Street is supposed to be. That
has all been settled and there has been an agreement signed between the developer
and ACHD. We are going to and if you notice there were comments from Nampa
Meridian Irrigation District. Right now the developer is entering into an agreement with
them to tile the ditch in the fall when there is no water in it. That is what the plat shows,
but if you read the comments the comments of the irrigation district it almost acts like
they haven't heard about it.

Borup: I assume that ACHD is probably correct with some of their other comments like
constructing a new entry drive way, I believe that is already there.
Youngerman: Yes, a lot of this stuff was kind of regurgitated from when they did the
original for the whole development.

Bever: I guess my comment is I don't know why I am here. I went to Ada County
Highway they didn't know why I was there. Bear with me for a minute, we have an
existing building that it falls in Old Town Meridian. We have owned it for about a year
and a half, we went to see if we needed a building permit to paint it and put a new roof
and they said no go ahead it is general upkeep. We received a note from planning and
zoning that it was being rezoned. It is about 70% full of tenants that half of them were
there when we bought it. The rezoning process is why we are here. We are apparently
in old town as it has been explained to us. Every time the property is zoned it has to be
rezoned. I spoke with the City Attorney on that and let me know about that. We paid our
$500 to come here and the problem with what we are having is that I have heard the
word boiler plate over here. We are going through the process as we should, I am not
sure again clear on this whole thing. But we recently got a letter from Ada County
Highway and they speak about us like we are a new property. We are to pave the alley

I have reviewed this submittal and offer the following comments as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted
by motion of the Meridian City Council:
GENERAL COMMENTS
1. Conditions of approval for First Street Plaza shall be applicable to this project.
2. Handicap parking, associated signage and building construction shall meet the
requirements of the Americans with Disabilities Act.
3. All signs must meet the requirements of the Uniform Sign Code and Meridian City
Ordinance. Flashing signs will not be permitted. All signs are subject to review and
approval of the Planning & Zoning Department.
4. Screened trash enclosures are to be provided in accordance with City Ordinance.
Coordinate dumpster site locations with the City's solid waste contractor, Sanitary
Services, Inc. Locate dumpsters so as not to impede fire access.
5. Provide parking lot lighting plans to the Meridian Public Works Department.
6. Sewer and water services are not existing to this site, however plans have been reviewed
and approved as part of the First Meridian Plaza project. Assessment fees would be
determined during plan review process. Applicant will be required to enter into an
Assessment Agreement with the City of Meridian.

The above entitled matter having come on for public hearing on
April 8, 1997, at the hour of 7:00 o'clock p.m., at the Meridian
City Hall, 33 East Idaho Street, Meridian, Idaho, Steve Youngerman,
President of the applicant, hereinafter collectively referred to as
the "Applicant," appearing in person, the Planning and Zoning
Commission of the City of Meridian having duly considered the
evidence and the matter makes the following Findings of Fact and
Conclusions of Law.
FINDINGS OF FACT
1. A notice of a public hearing on the application for the
conditional use permit was published for two (2) consecutive weeks
prior to the said public hearing scheduled for April 8, 1997, the
first publication of which was fifteen (15) days prior to said
hearing; that the matter was duly considered at the April 8, 1997
hearing; that the public was given full opportunity to express

comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations.
2. The property included in the application for a
conditional use permit is described in the application, and by this
reference is incorporated herein as if set forth in full. This
property is located within the City of Meridian, Ada County, state
of Idaho at the southwest corner of East 1st Street and Gem Street.
3. Pursuant to the application, the Applicant is not the
owner of record of the property. The owner of the property is Wild
Shamrock Partnership whose managing partner is Rick Thomas, and it
has consented to the application for the Conditional Use Permit.
4. Pursuant to the application, the property is vacant. The
proposed conditional use of the property is for a full service
restaurant and bar with liquor license. The Applicant agrees to
pay additional sewer, water or trash fees or charges associated
with the proposed use of the property.
5. The Applicant testified substantially as follows. The
application for a conditional use permit is for a 6,000 square feet
building for a restaurant which will have a capacity of 230 people;
160 in the dining room and 70 in the bar. The dining area will be
designated non-smoking with the bar being a smoking area. The
restaurant will serve American cuisine lunch and dinner and have a
science fiction theme. Breakfast will not be served.
6. In response to questions of Commissioner Borup, the
Representative testified substantially as follows. With regard to
comment E of the Ada County Highway District's comments concerning

the irrigation ditch and the right-of-way, such issue has been
settled. There was a question as to where Gem Street was to be
located. The developer and Ada County Highway District has signed
an agreement resolving such issue. With rege f

comments and issues have been addressed at the time the development
of the property was first proposed.
7. The property is currently zoned (C-G) General Retail and
Service Commercial. In the ZONING SCHEDULE OF USE CONTROL, Section
11-2-409 B., Commercial, although restaurants are permitted uses on
property zoned (C-G) General Retail and Service Commercial, bars
and alcoholic establishments are listed as a conditional use on
property in the C-G district.
8. The (C-G) General Retail and Service Commercial district
is described in the Zoning Ordinance, 11-2-408 B. 11 as follows:
(C-G) General Retail and Service Commercial: The purpose
of the (C-G) District is to provide for commercial uses
which are customarily operated entirely or almost
entirely within a building; to provide for a review of
the impact of proposed commercial uses which are auto and
service oriented and are located in close proximity to
major highways or arterial streets; to fulfill the need
of travel-related services as well as retail sales for
the transient and permanent motoring public. All such
districts shall be connected to the Municipal Water and
Sewer systems of the City of Meridian, and shall not
constitute strip commercial development and encourage
clustering of commercial development.
9. Conditional Use Permit is defined in the Zoning And
Development Ordinance, City of Meridian, Idaho as "Permits allowing

an exception to the uses authorized by this Ordinance in a zoning
district."
10. Although a restaurant is a permitted use on property
zoned (C -G) General Retail and Service Commercial, a bar with a
liquor license is a specifically allowed conditional use in the
Zoning Schedule of Use Control, 11-2-409 B.
11. The Ada County Highway District submitted comments and
may in the future submit further comments on the subject
application, which comments are incorporated herein as if set forth
in full, and the comments hereafter submitted shall be incorporated
herein as if set forth in full when submitted.
12. Bruce Freckleton, Assistant to the City Engineer,
submitted comments, which comments are incorporated herein as if
set forth in full. His comments included the following:
a. The conditions of approval of the First Street
[Meridian] Plaza shall be applicable to this project;
b. Handicap parking, associated signage and building
construction shall meet the requirements of the Americans
with Disabilities Act;
c. All signs must meet the requirements of the Uniform
Sign Code and Meridian City Ordinance. Flashing signs
will not be permitted. All signs are subject to review
and approval of the Planning and Zoning Department;
d. Screened trash enclosures are to be provided in
accordance with City Ordinance. The Applicant is to
coordinate dumpster site locations with the City's solid
waste contractor and locate dumpsters so as not to impede
fire access;
e. The Applicant shall provide parking lot lighting
plans to the Meridian Public Works Department; and
f. Sewer and water services are not existing to the
site, however plans have been reviewed and approved as

part of the First Meridian Plaza project. Assessment
fees would be determined during plan review process. The
Applicant will be required to enter into an Assessment
Agreement with the City of Meridian.
13. Shari Stiles, Planning and Zoning Administrator, has or
may submit comments, and such comments are hereby incorporated
herein as if set forth in full or shall be incorporated herein as
if set forth in full when submitted.
14. The Meridian City Police Department submitted comments,
which comments are incorporated herein as if set forth in full.
15. The Meridian Fire Department submitted comments, which
comments are incorporated herein as if set forth in full. Its
comments included that it has no objection to the application if
all codes, water supplies, hydrant and sprinkler systems for fires
are met.
16. The Meridian Sewer Department submitted comments, which
comments are incorporated herein as if set forth in full. Its
comments included that the restaurant will need to have a 1,000
gallon or more outside grease interceptor.
17. Central District Health Department submitted comments
which comments are incorporated herein as if set forth in full.
Its comments included that after written approval from appropriate
entities are submitted, it can approve the proposal for central
sewage and central water; that runoff is not to create a mosquito
breeding problem; that it will require plans be submitted for plan
review for any food establishment; and that it recommends

stormwater run-off flow into a grassy swale before discharging to
the subsurface.
18. The Nampa & Meridian Irrigation District submitted
comments, which comments are hereby incorporated herein as if set
forth in full. Its comments included the following:
a. The Nampa & Meridian Irrigation District's Eight
Mile Lateral courses along the south boundary of the
project. The right-of-way of the Eight Mile Lateral is
60 feet; 30 feet from the center each way. The developer
must contact the District for approval before any
encroachment or change of right-of-way occurs;
b. The Nampa & Meridian Irrigation District requires
that a Land Use Change/Site Development application be
filed for review prior to final platting;
C. All laterals and waste ways must be protected;
d. All municipal surface drainage must be retained on
site. If any surface drainage leaves the site, the Nampa
& Meridian Irrigation District must review drainage
plans;
e. The developer must comply with Idaho Code Section
31-3805; and
f. It is recommended that irrigation water be made
available to all developments within the Nampa & Meridian
Irrigation District.
19. There were no other comments by the public regarding this
application.
CONCLUSIONS OF LAW
1. All the procedural requirements of the Local Planning Act
and of the Ordinances of the City of Meridian have been met,
including the mailing of notice to owners of property within 300
feet of the external boundaries of the Applicant's property.

2. The City of Meridian has authority to grant conditional
uses pursuant to Idaho Code Section 67-6512 and pursuant to 11-2-
418 of the Zoning And Development Ordinance of the City of
Meridian.
3. The City of Meridian has the authority to take judicial
notice of its own ordinances, other governmental statutes and
ordinances, and of actual conditions existing within the City and
the State.
4. The City of Meridian has authority to place conditions on
a conditional use permit and the use of the property pursuant to
Idaho Code Section 67-6512 and pursuant to that section conditions
minimizing the adverse impact on other development, controlling the
duration of development, assuring the development is maintained
properly, and on-site or off-site facilities may be attached to the
permit; that 11-2-418 (D) authorizes the City to.prescribe a set
time period for which a conditional use may be in existence.
5. Section 11-2-418 D. states as follows:
In approving any Conditional Use, the Commission and
Council may prescribe appropriate conditions, bonds, and
safeguards in conformity with this Ordinance. Violations
of such conditions, bonds or safeguards, when made a part
of the terms under which the Conditional Use is granted,
shall be deemed a violation of the Ordinance and grounds
to revoke the Conditional Use. The Commission and
Council may prescribe a set time period for which a
Conditional Use may be in existence.
6. The Planning and Zoning Commission judges this
application for a conditional use upon the basis of guidelines
contained in Section 11-2-418 of the Zoning And Development
Ordinance of the City of Meridian and upon the basis of the Local

Planning Act of 1975, Title 67 Chapter 65, Idaho Code, the
Comprehensive Plan of the City of Meridian, and the record
submitted to it and the things of which it may take judicial
notice.
7. Section 11-2-418 C of the Zoning And Development
Ordinance of the City of Meridian sets forth the standards under
which the Planning and Zoning Commission and the City Council shall
review applications for Conditional Use Permits. Upon a review of
those requirements and a review of the facts presented and the
conditions of the area, assuming that the above conditions or
similar ones thereto would be attached to the conditional use, the
Planning and Zoning Commission concludes as follows:
a. Although a restaurant is a permitted use on property
zoned (C -G) General Retail and Service Commercial, a bar with
a liquor license as part of the restaurant would, in fact,
constitute a conditional use and a conditional use permit
would be required by ordinance;
b. The use would be harmonious with and in accordance with
the Comprehensive Plan and the Zoning Ordinance;
C. The use is designed and is, apparently, to be constructed
so as to be harmonious in appearance with the character of the
general vicinity. If the conditions set forth herein are
complied with the use should be operated and maintained to be
harmonious with the intended character of the general vicinity
and should not change the essential character of the area;
d. The use would not be hazardous nor should it be
disturbing to existing or future neighboring uses if the
conditions are met; however, traffic may increase, but the
development will have vehicular approaches to the property
which shall be designed to decrease interference with traffic
on surrounding public streets;
e. The Applicant shall be able to provide adequately for the
essential public facilities and services such as fire
protection, drainage structures, refuse disposal, water and

sewer, but the Applicant may have to pay additional fees for
the use;
f. The use would not create excessive additional
requirements at public cost for public facilities and services
and the use would not be detrimental to the economic welfare
of the community;
g. If the conditions are met, the use should not involve a
use, activity, process, material, equipment or conditions of
operation that would be detrimental to person, property or the
general welfare by reason of excessive production of traffic,
noise, smoke., fumes, glare or odors;
h. The property should have vehicular approaches which shall
be designed as not to create an interference with traffic on
surrounding public streets, and sufficient parking for the
proposed use will be required to meet the requirements of the
City ordinance; and
i. The development and uses will not result in the
destruction, loss or damage of a natural or scenic feature of
major importance.
8. As conditions may be placed upon the granting of a
conditional use permit to minimize adverse impact on other
development, it is recommended by the Planning and Zoning
Commission that the following conditions of granting the
conditional use be required, to -wit:
a. The conditional use, pursuant to the Zoning and
Development Ordinance, shall not be transferable to
another owner or lessor of the property or to another
property;
b. The conditional use shall not be restricted to a period
of authorization but may be reviewed annually, upon
notice to the Applicant, for violation of any conditions
imposed herein and other conditional use applications;
C. The Applicant shall meet the requirements of the City
Engineer's office, the Planning and Zoning Administrator,
Meridian Police Department, Meridian Fire Department,
Meridian Sewer Department, Central District Health
Department, and the Nampa & Meridian Irrigation District,
which include, but are not limited to the following:

1. The conditions of approval of the First
Meridian Plaza conditional use permit shall be
applicable to and conditions of the grant of this
conditional use permit, a copy of the subject
FINDINGS OF FACT AND CONCLUSIONS OF LAW for said
First Meridian Plaza are attached as Exhibit "A"
and made a part hereof by this reference, said
conditions of approval including, but not limited
to the following:
(a) All ordinances of the City of Meridian
must be met, including but not limited to, the
Uniform Building Code, Uniform Fire Code,
Uniform Plumbing Code, Uniform Electrical
Code, the Uniform Mechanical Code, the Fire
and Life Safety Code, and all parking and
landscaping requirements;
(b) The drive way for a
any, shall not be used

property;

services shall be determined during plan review
process. The Applicant shall be required to enter
into an Assessment Agreement with the City of
Meridian;
7. The Applicant shall meet all requirements of
codes, water supplies, hydrant and sprinkler
systems for fires;.
8. The restaurant shall be required to have a
grease interceptor with a minimum capacity of 1,000
gallons. The acceptable capacity shall be subject
to review and approval by the City of Meridian;
9. Water runoff shall not create a mosquito
breeding problem;
10. The Applicant shall submit plans to the
Central District Health Department for plan review
for any food establishment; and
11. Storinwater run-off shall flow into a grassy
swale before discharging to the subsurface.
d. The Applicant shall meet the requirements of the Ada
County Highway District, including any comments or
requirements hereafter submitted.
9. The above -conditions are concluded to be reasonable and
the Applicant shall meet these conditions.
10. It is recommended that if the Applicant meets the
conditions stated above, that the conditional use permit be granted
to the Applicant.

6. That the location of the property is between East First
Street and Meridian Road, south of the Eight Mile Lateral and Gem
Street.
7. That proper notice has been given as required by law and
all procedures before the Planning and Zoning Commission have been
given and followed.
8. That the owners of record are Harold E. Thomas and Rick
E. Thomas and they have requested the conditional use and consented
to the Application.
9. That the Applicant's representative, Mike Craven,
testified regarding the comment from the Planning Director, Shari
Stiles, having to do with a variance request for tiling the Eight
Mile Lateral; that his understanding of the City's position has
been on laterals 48 inches or more in diameter have, -not been made
to tile. Commissioner Johnson stated that it still requires a
variance request and that the City Council grants them.
10. Mike Craven also questioned the comment from the Ada
County Highway District (ACED) regarding the curb, gutter and
sidewalk and asphalt on Gem Avenue; that their property does not
abut to that road; that there is 8Q feet of separation and
questioned who owned the 80 feet, if it is the irrigation district
or the Ada County Highway District.

11. Mr. Craven testified that one of the restaurant sites has
been spoken for and the 30,000 square foot building is actually the
one which might change to a sit down restaurant instead of a drive-
thru restaurant on the other pad, but at this time they are showing
the drive-thru on that side; that at some future point the concept
of a footbridge across the Eight Mile Lateral would be considered,
thereby having some responsibility: for curb, gutter and sidewalk
and the improvement of Gem Street, but at this point, the Applicant
is not asking for that access.
12. That Gene Quinteri testified regarding the improvements
he made of the South 29 feet of his property when the expansion of
the bowling lanes occurred; that his only objection to this
application would be to the size of foot bridge planned; that a 30
to 40 foot bridge would provide both ingress and egress in the area
across the canal causing four (4) to five (5) parking spaces to the
bowling lanes to be eliminated; that he would not.object to a six
(6) or eight (8) foot access and wants to go on record as objecting
to that portion of the plot only; that he is not objecting to the
drive--thru windows.
13. That no other public testimony was given.

14. That the City Planning Director and Assistant City
Engineer submitted comments regarding this application and they are
incorporated herein as if set forth in full..
15. That off-street parking, paving and striping, all signage
and sidewalks shall be provided in accordance with City Ordinances.
16. That sewer and water assessments shall be determined
during the building plan review process; that sewer and water
service to the site shall be coordinated with the Public Works.
Department and that a drainage plan shall be submitted for all off-
street parking areas; that water service is contingent upon
positive test results from a hydraulic analysis.
17. That a 90 foot road right-of-way is required on Meridian
Road; that a variance needs to be requested for tiling of the Eight
Mile Lateral and if granted, that no fencing be required in lieu of
tiling as it would serve no useful purpose; that eleven (11) feet
of landscaping will remain when and if the Ada County Highway
District takes the full right-of-way on East First Street; that the
parking spaces shall be 9' x 19, with a 25 foot driveway width with
designated spaces along Meridian Street for compact spaces if
dimensions remain as shown and that applicant should negotiate
license agreement with Nampa -Meridian Irrigation District to allow

landscaping within the Eight Mile Lateral easement for aesthetic
purposes.
18. That the Meridian Police Department, Meridian Fire
Department, Central District Health and the Nampa Meridian
Irrigation District they are incorporated herein as if set forth in
full.
19. That The Ada County Highway District (AcHD) submitted
site specific requirements, and they are incorporated herein as if
set forth in full, and which include providing a deposit to the
Public Rights -of -Way Trust fund to the District for required street
improvements of 5 -foot wide sidewalk on Meridian Road abutting the
parcel, constructing a 7 -foot wide attached sidewalk on East First
Street abutting the parcel, constructing curb, gutter, 5 -foot
sidewalk and match existing pavement along Gem Avenue abutting the
parcel, the dedicate 30 -feet of right-of-way from the centerline of
Meridian Road abutting the parcel (an additional five (5) feet),
and sidewalks shall be provided in accordance with City Ordinance.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property

within 300 feet of the external boundaries of the Applicant s
property.
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian.
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the
Revised and Compiled Ordinances of the City of Meridian, Idaho.
4. That 11-2-418(C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional. Use Permits; that upon a review of
those requirements and a review of the facts presented and the
conditions of the area, the Planning and Zoning Commission
concludes as follows:
a. The use, would in fact, constitute a conditional
use and a conditional use permit is required by
ordinance.
b. The use should be harmonious with and in accordance
with the Comprehensive Plan but the Zoning

The applicant is requesting conditional use approval to construct a 6,000 -square foot restaurant
with a bar. The 3.8 -acre site is located at the southwest corner of E. 1st Street and Gem

B. On April 5, 1995, the Commission reviewed MCU -6-95, requesting conditional use approval
to construct two drive-thru restaurants and a commercial center totaling 43,200 -square feet.
The subject application is one of the restaurants of the previous application.

C. Utility street cuts in new pavement less than five years old are not allowed unless approved
in writing by the District. Contact Construction Services at 345-7667 (with file r mbe rs) for
details.
D. The southerly portion of Gem Avenue's right-of-way is in the process of being ate
(approximately 32 -feet). The remaining Gem Avenue shall have a minimum of' ;-fey: :)f
right-of-way. Staff recommends that the applicant be required to complete the :catic. of
Gem Avenue's right-of-way prior to the issuance of a building permit.
E. An irrigation ditch borders the site's north property line along the site's Gem Avenue
frontage. After the applicant completes the vacation of Gem Avenue's right-of-way, the
ditch will be outside the public right-of-way of Gem Avenue, and the applicant plans on
tiling it.
F. As part of the vacation proceedings, a portion of Gem Street frontage is proposed to be
retained by ACHD's Commuteride Division until the existing park and ride facility is
relocated. Normally the District would require the applicant to construct curb, gutter, 5 -foot
wide concrete sidewalk and match paving to one half of a 41 -foot street section abutting the
site. However, this would eliminate the existing park and ride facility. Staff recommends
that the applicant be required to provide a $16,449.00 deposit to the Public Rights -of -Way
Trust Fund for the cost of constructing curb, gutter and 5 -foot wide concrete sidewalk and
pavement match to one half of a 41 -foot street section on Gem Avenue abutting the parcel
(approximately 400 -feet) prior to issuance of any required permits or District approval of a
final plat, whichever occurs first. This will allow the park and ride facility to remain at its
present location until such time that it is relocated.
G. The applicant is proposing to construct a 24 to 30 -foot wide curb return driveway with 15-
foot curb radii on Gem Avenue, located approximately 220 -feet west of E. 1st Street. This
location and width meet District policy.
H. The applicant is proposing to construct a 24 to 30 -foot wide curb return driveway with 15 -
foot curb radii on E. 1st Street, located approximately 220 -feet south of Gem Street that will
align with Watertower Lane on the east side of E. 1st Street. This location and width meet
District policy. ACHD has contracted with a consult to conduct a study of the Meridian
Road/East 1st Street couplet roadways. These streets may be restricted to one-way in the
future, which will restrict the driveway on East 1st Street to right turns only.
I. District policy requires the applicant to construct a 5 -foot wide detached concrete sidewalk
on E. lst Street abutting the entire site. The sidewalk should be located one -foot within the
right-of-way of E. 1st Street.
In order to reduce trips to and from this development, it is recommended that the tenants
occupying the proposed building(s) be required to participate in any Transportation
Management Association (TMA) or Transportation Management Organization (TMO) that is
formed with a boundary that includes this site or is adjacent to this development.

A Transportation Management Association (TMA) or Transportation Management
Organization (TMO) is formed with a coordinator that works as a liaison between businesses
and private and public transportation providers to increase the use of alternative
transportation and other trip reduction measures (shuttle buses, bus pass programs, vanpools,
carpools, bicycle and walking enhancements).
An annual survey will be required of the TMA/TMO to monitor participation in alternative
transportation programs and forwarded to the ACHD Ridesharing Office.
K. District policy states that direct access to arterials and collectors is normally restricted and
that the developer shall try to use combined access points. In accordance with District policy
the applicant should be required to provide a recorded cross access easement for the parcel
south of the subject parcel to use this parcel for access to the public streets prior to issuance
of a building permit (or other required permits). The District intends to require a similar
agreement of the owner of the parcel to the south if they are the subject of a future
development application.
L. Graveled driveways abutting public streets create maintenance problems due to gravel being
tracked onto the roadway. In accordance with past action by the District the applicant should
be required to pave the driveways their full required width of 24 to 30 -feet to at least 30 -feet
beyond the edge of pavement of Gem Avenue and E. 1st Street.
M. As required by District policy, restrictions on the width, number and locations of driveways,
may be placed on future development of this parcel.
N. The existing transportation system will be adequate to accommodate the additional traffic
generated by this proposed development with the requirements outlined within this report.
The following requirements are provided as conditions for approval:
Special Request of the Applicant:

Standard Requirements:
1. A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Development Services Supervisor. The request shall
specifically identify each requirement to be reconsidered and include a written explanation of
why such a requirement would result in a substantial hardship or inequity, The written
request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for
A6HD Commission action. Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission
action do not provide sufficient time for District staff to remove the item from the consent

agenda and report to the Commission regarding the requested modification, variance or
waiver. Those items will be acted on by the Commission unless removed from the agenda
by the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation
of data that was not available to the Commission at the time of its original decision. The
request for reconsideration will be heard by the District Commission at the next regular
meeting of the Commission. If the Commission agrees to reconsider the action, the applicant
will be notified of the date and time of the Commission meeting at which the reconsideration
will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building
permit (or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. No change in the terms and conditions of this approval shall be valid unless they are in
writing and signed by the applicant or the applicant's authorized representative and an
authorized representative of the Ada County Highway District. The burden shall be upon the
applicant to obtain written confirmation of any change from the Ada County Highway
District.
8. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances,
plans, or other regulatory and legal restrictions in force at the time the applicant or its
successors in interest advises the Highway District of its intent to change the planned use of
the subject property unless a waiver/variance of said requirements or other legal relief is
granted pursuant to the law in effect at the time the change in use is sought.

an undue burden on the existing vehicular and pedestrian transportation system within the
vicinity impacted by the proposed development.

Request for Conditional Use Permit
I have reviewed this submittal and offer the following comments as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted
by motion of the Meridian City Council:
GENERAL COMMENTS
1. Conditions of approval for First Street Plaza shall be applicable to this project.
2. Handicap parking, associated signage and building construction shall meet the
requirements of the Americans with Disabilities Act.
3. All signs must meet the requirements of the Uniform Sign Code and Meridian City
Ordinance. Flashing signs will not be permitted. All signs are subject to review and
approval of the Planning & Zoning Department.
4. Screened trash enclosures are to be provided in accordance with City Ordinance.
Coordinate dumpster site locations with the City's solid waste contractor, Sanitary
Services, Inc. Locate dumpsters so as not to impede fire access.
5. Provide parking lot lighting plans to the Meridian Public Works Department.
6. Sewer and water services are not existing to this site, however plans have been reviewed
and approved as part of the First Meridian Plaza project. Assessment fees would be
determined during plan review process. Applicant will be required to enter into an
Assessment Agreement with the City of Meridian.

Theme: Future/deco like Flash Gordon and Buck Rogers comics
of the 1930's and 40's. Lots of neon, stainless steel and deco
spaceship stuff. This theme could be carried right up into the
present day with Star Trek, Star Wars and Jctsons items. This
theme would establish a fun, family atmosphere with good food
and lots of visuals for the kids and good cocktails for the adults.
The theme would be carried in to the merchandising of Tee-shirts,
hats, key rings, etc., a very lucrative part of the business. This is a
multi -unit concept that has regional if not national potential and
should be considered a "ground floor" opportunity.
Food & Beverage: A menu that would reflect the best things that
Red Robin, Bennigan's, and the Hard Rock Cafe have to offer. The
menu would lean heavily towards burgers, salads, pastas and hot
sandwiches. Custom cocktails and specialty drinks would be
heavily merchandised. A large selection of appetizers would also
be offered. This type of concept is the hottest concept in the U.S.
as proven by the tremendous success of Red Robin, Hard Rock,
Bennigan's, Applebee's, etc. Meridian is starved for restaurants
and this type of operation will go over very big.
Site: The southwest comer of 1 st street and Gem street, just west
of the new Zamzows and south of Les Schwab Tires. This site
offers excellent freeway access and heavy drive by exposure in
Idaho's hottest and least developed retail markets. It is also
located across the street from the Central valley Corporate Park.
Facility: The restaurant willbe approximately 6000 square feet
with a full kitchen, bar and patio, total seating will be in the 225 -
250 range.
Rockets will employ a staff of approximately 80 to 100, both full
time and part time.
When constructed, this facility will be valued in excess of
$ l ,000,000, and will contribute a sizeable sum in property taxes.
Rockets will be a unique restaurant in the Treasure valley, there is
nothing else out there in this market niche.
Meridian is a market ripe for a restaurant of this type, there are stories
in the Statesman almost weekly about the growth in Meridian, one
such story talked about retail struggling to catch up. National
corporations like Fred Meyer and Albertson's have already recognized
the potential in Meridian.

Johnson: At this time I will open the public hearing and ask Mr. Youngerman to address
the Commission.
Steve Youngerman, 5451 South Caper Place, Boise, was sworn by the City Attorney.
Youngerman: We are going to have, it is going to be a 6,000 square foot building, 230
seats, 160 in the dining room, 70 in the bar. The dining area will be non-smoking, the
bar will be the smoking area. American cuisine, science fiction theme, lunch and dinner
not breakfast.
Johnson: Any questions of Mr. Youngerman from the Commissioners?
Borup: I assume you have read all of the staff comments and no questions (inaudible) I
do have a couple on the ACHD comments. One was comment E talking about the
irrigation ditch. They were concerned about it being on the right of way.
Youngerman: It has all been settled.
Borup: Okay because it looked to me like (inaudible)
Youngerman: There was a question between where Gem Street is supposed to be. That
has all been settled and there has been an agreement signed between the developer
and ACRD. We are going to and if you notice there were comments from Nampa
Meridian Irrigation District. Right now the developer is entering into an agreement with
them to tile the ditch in the fall when there is no water in it. That is what the plat shows,
but if you read the comments the comments of the irrigation district it almost acts like
they haven't heard about it.

Borup: I assume that ACHD is probably correct with some of their other comments like
constructing a new entry drive way, I believe that is already there.
Youngerman: Yes, a lot of this stuff was kind of regurgitated from when they did the
original for the whole development.

Bever: I guess my comment is I don't know why I am here. I went to Ada County
Highway they didn't know why I was there. Bear with me for a minute, we have an
existing building that it falls in Old Town Meridian. We have owned it for about a year
and a half, we went to see if we needed a building permit to paint it and put a new roof
and they said no go ahead it is general upkeep. We received a note from planning and
zoning that it was being rezoned. It is about 70% full of tenants that half of them were
there when we bought it. The rezoning process is why we are here. We are apparently
in old town as it has been explained to us. Every time the property is zoned it has to be
rezoned. I spoke with the City Attorney on that and let me know about that. We paid our
$500 to come here and the problem with what we are having is that I have heard the
word boiler plate over here. We are going through the process as we should, I am not
sure again clear on this whole thing. But we recently got a letter from Ada County
Highway and they speak about us like we are a new property. We are to pave the alley

Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission
action do not provide sufficient time for District staff to remove the item from the consent
agenda and report to the Commission regarding the requested modification, variance or
waiver. Those items will be acted on by the Commission unless removed from the agenda
by the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration ideration hall
specifically identify each requirement to be reconsidered and include written doc umentation
of data that was not available to the Commission at the time of its original decision The
request for reconsideration will be heard by the District Commission at the next regular
meeting of the Commission. If the Commission agrees to reconsider the action. the applicant
will be notified of the date and time of the Commission meeting at which the re nsideration
will be heard.
