Subdivision as requested. In accordance with UDC 11-SA-3F and UDC 11-SA-6, you have the option to have this decision reviewed by City Council. All City Council Reviews shall be filed in writing to the Planning Department within fifteen (15) days after the date of this letter. The request will be forwarded to the City Council to conduct a public hearing. The application should specify the grounds upon which the review is filed. You have until May 18, 2012 to obtain the City Engineer's signature on the final plat for Una Mas Subdivision. The applicant, Una Mas, LLC, has requested approval of an 18 month time extension to obtain the City Engineer's signature on the final plat for Una Mas Subdivision. The Applicant states in the application narrative that a time extension is needed due to the market demand for office lots being low. Approval of a time extension will allow for the conclusion of ongoing negotiations with future commercial tenants. Because the Applicant is unable to meet the time requirements specified in the UDC, a time extension is requested. The subject property is located at 3475 E. Ustick Road, in the SE '/4 of Section 13, T.3N., R.1 W. II. STAFF RECOMMENDATION Staff recommends approval of an 18 month time extension to obtain the City Engineer's signature on the final plat for Una Mas Subdivision, as requested by the applicant, to expire on May 18, 2012. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property at 3475 E. Ustick Road, in the SE '/o of Section 13, T.3N., R.1 W. Parcel No. S 1104223082 B. UNIFIED DEVELOPMENT CODE Per UDC 11-6B-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer's signature on the final plat within two years of the approval of the Una Mas Sub PP TE PAGE 1 preliminary plat. Upon written request and filing by the applicant prior to the termination of the allowed time period, the Director may authorize a single extension of time to obtain the City Engineer's signature on the final plat not to exceed 2 years. Additional time extensions up to 2 years as determined and approved by City Council may be granted. With all extensions, the Director or City Council may require the plat to comply with current provisions of the UDC. V. HISTORY OF PREVIOUS ACTIONS: • The majority of this property was annexed in 2005 (Una Mas, AZ-OS-061) and zoned C-G, with a Development Agreement (Inst. No. 106137048). A smaller portion of this site was annexed in 2007 (ACRD Ustick Road Property, AZ-OS-060) and zoned C-G with a Development Agreement (Inst. No. 107026537). • A conditional Use permit (CUP-06-033) was approved on 12/7/06 fora 6,300 square foot daycare center on this site, which expired on 6/7/08. • A preliminary plat (PP-08-007) was approved on November 18, 2008 consisting of 21 commercial building lots on 12.62 acres of land for Una Mas subdivision. Private street (PS-08- 006) approval was also granted for two private streets within the development. • A final plat (FP-09-002) was approved on Apri17, 2009 consisting of 21 commercial building lots on 12.62 acres of land for Una Mas subdivision. The plat has not yet been signed by the City Engineer but has been submitted for signature. VI. STAFF ANALYSIS The applicant has met the necessary deadline by filing a written request for a time extension before the preliminary plat expired on November 18~'. A development agreement (DA) was approved with the annexation of this property. A provision of the DA requires the applicant to submit an application for design review with each building Certificate of Zoning Compliance. Elevations are required to be in substantial conformance to the elevations presented at the Apri14, 2006 hearing. Additionally, all future structures are required to substantially comply with the conceptual site plan, building elevations & materials approved with the preliminary plat, along with the City's design standards. The City Council has provided staff with guidelines to use when evaluating time extension requests. These guidelines are meant for guidance and not as a mandate. Staff has reviewed the guidelines in relation to this project and believes the project complies with current provisions of the UDC.
