In regard to the conditions in Exhibit B of the staff report mentioned below, please note the following: Condition 1.6 - If a property boundary adjustment isn't approved prior to CZC then asite/landscape plan that shows the entire property in its current configuration needs to be submitted for CZC approval. A 25-foot wide landscape buffer would also be required to be shown on the site/landscape plan along the south boundary of the property adjacent to the existing residential uses, as required by UDC Table 11-2B-3 in accord with the standards in UDC 11-3B-9C. An alternative would be to submit for CZC as stated w/plans showing the whole property & then come back with revised plans (CZC application "with prior approval" - $173) showing the new configuration of the property after the PBA is approved, prior to occupancy. Condition 1.4 -Hours of Operation: Staff recommends the hours of operation of the drive-thru be limited because staff is of the opinion the residences that border the south boundary of this site would likely be adversely affected by noise from the drive thru speaker as well as noise from cars (stereos/music) (the nearest residential properties are approximately 150' from the site). Typically there is a transition in zoning and/or uses between higher intense commercial uses & residential uses that lessen the adverse impacts of uses such as this on residential uses; however, there is none in this case. You may present your request fora 24 hour drive-thru at the Commission during the public hearing. ITD received a transmittal of the application from the City Clerk. However, you should contact them for a letter indicating the site plan is in compliance with ITD's standards and policies for submittal with the CZC application. Two of these items we feel would greatly hinder the development. IX Analysis Item A. 1. Site Plan: the Property Boundary Adjustment being approved and finalized prior to issuance of the CZC. This is an item that is by the owner and not Jack in the Box. While we understand that this does need to be done we do not see why it is required prior to approval of the CZC. As without the CZC approval it is my understanding that we cannot submit for our building permits. On many of the other projects that we have done in the area some of those required a PBA process and the jurisdiction allowed the project to flow forward with the understanding of all parties that the PBA is conditioned to receiving final occupancy. We ask that you reconsider this condition. 11/18/2010 Page 2 of 2 Item A. 1. Hours of Operation: The hours of operation at this site is vital to its existence at this location. The 24 hour drive-thru is a function that drives most of the business for a JIB location as 60% of the sales made are through the drive-thru. There is only one speaker in the drive-thru and after 10 pm it automatically reduces the decibels levels from the daytime operation. Additionally the menu board faces west not south towards the residential. We request that this item be reconsidered as it is a driving point for the success if this location. The last item is A. 1.
