Two of these items we feel would greatly hinder the development. IX Analysis Item A. 1. Site Plan: the Property Boundary Adjustment being approved and finalized prior to issuance of the CZC. This is an item that is by the owner and not Jack in the Box. While we understand that this does need to be done we do not see why it is required prior to approval of the CZC. As without the CZC approval it is my understanding that we cannot submit for our building permits. On many of the other projects that we have done in the area some of those required a PBA process and the jurisdiction allowed the project to flow forward with the understanding of all parties that the PBA is conditioned to receiving final occupancy. We ask that you reconsider this condition. Item A. 1. Hours of Operation: The hours of operation at this site is vital to its existence at this location. The 24 hour drive-thru is a function that drives most of the business for a JIB location as 60% of the sales made are through the drive-thru. There is only one speaker in the drive-thru and after 10 pm it automatically reduces the decibels levels from the daytime operation. Additionally the menu board faces west not south towards the residential. We request that this item be reconsidered as it is a driving point for the success if this location. The last item is A. 1. F. Did the city notify ITD or was that something we were required to do?
