Per the findings of the attached staff report for Shays Cove Subdivision, I am granting approval of a two
year time extension to obtain the City Engineer's signature on a final plat as requested.
In accordance with UDC 11-SA-3F and UDC 11-SA-6, you have the option to have this decision
reviewed by City Council. All City Council Reviews shall be filed in writing to the Planning Department
within fifteen (15) days after the date of this letter. The request will be forwarded to the City Council to
conduct a public hearing. The application should specify the grounds upon which the review is filed.
You have until January 27, 2013 to obtain the City Engineer's signature on a final plat for Shays Cove
Subdivision.

I. APPLICATION SUMMARY

The applicant and property owner, John Shay, requests approval of a two year time extension in order
to obtain the City Engineer's signature on a final plat for Shays Cove Subdivision.
The preliminary plat (PP-08-009) for Shays Cove Subdivision was approved by the Meridian City
Council on January 27, 2009. A final plat (FP-09-005) application was approved by Council on May
12, 2009 but has not yet been recorded. The final plat consists of 6 residential building lots and 3
common/other lots on 4.45 acres of land.
Per Unified Development Code (LTDC) 11-6B-7, approval of a preliminary plat shall become null and
void if the applicant fails to obtain the City Engineer's signature on the final plat within 2 years of the
approval of the preliminary plat. Per the conditions of approval, the preliminary plat would otherwise
expire on January 27, 2011.
The Applicant states in the application narrative that the project has been delayed due to the
significant decline in the residential housing market since the project was approved. Because the
Applicant is unable to meet the time requirements specified in the UDC, a time extension is
requested. A time extension will allow the applicant to continue with development of the project.
The subject property is located at 3155 S. Mesa Way, in the SE % of Section 19, T.3N., R.IE.
II. STAFF RECOMMENDATION
Staff recommends approval of a two year time extension to obtain the City Engineer's signature on a
fmal plat for Shays Cove Subdivision to expire on January 27, 2013.
III. STAFF ANALYSIS
The City of Meridian's Unified Development Code (iJDC 11-6B-7C and UDC 11-SB-6F) allows the
Director to authorize one administrative time extension to obtain City Engineer's signature on a final
plat, not to exceed two years, when the applicant files a written request for an extension prior to the
expiration of the approved preliminary plat. The applicant has met the necessary deadline by filing a
written request before the preliminary plat expires. Additional time extensions up to two years may be
granted if approved by City Council.
With all extensions, the City may require compliance with the current provisions of the UDC as a
condition for granting a time extension (UDC 11-6B-7C). In addition, the City Council provided staff
with guidelines to use when evaluating time extension requests. These guidelines are meant for
guidance and not as a mandate.
Staff has reviewed the aforementioned guidelines provided by City Council in relation to this project
and believes the project complies with current provisions of the UDC. Therefore, Staff does not
recommend new conditions of approval be added to those previously approved for this project.
