Applicant has submitted and DW has the proposed easement and maintenance agreement. Applicant received approval of said easement Thursday September 23rd. Said easement has been included in maintenance agreement. Applicant is yet to receive written or verbal approval from City legal counsel and has been informed verbally that City seeks their approval prior to recording agreement. Maintenance agreement is a private agreement between adjoining user of sewer and irrigation lateral that is being constructed by applicant. Process for signature of said document is not readily available due to the approval structure of the Presbytery Church. Due to the absence of City legal response we have not been in a position to route final copy to said neighbor in time for scheduled public hearing. Applicant has been informed by DW that written confirmation of general approval from adjoining user of said improvements will satisfy the requirement for this easement and maintenance agreement adequately for public hearing in question. /7o-ug.[as [?.
