Idaho Avenue Meridian, Idaho 83642 RE: Meridian High School Bleacher Expansion Application for Conditional Use Permit Ms. Stiles: Meridian Joint School District No. 2 respectfully requests approval of the attached Conditional Use Application to allow for the expansion of bleacher seating at Meridian High School's varsity football field and track. The School District proposes to increase the current bleacher seating capacity of 380 to 3,416. At the proposed ratio of four bleacher seats per parking space, the High School's 855 on-site parking spaces will permit a maximum seating capacity of 3,420. This bleacher seating will typically not be used when classes are in session, nor simultaneous with other on-campus sporting events. In addition to additional bleacher seating, a new two-story press box and concessions structure is proposed on the home side of the field, along with a smaller one-story concessions building on the visitor's side. Two relocatable classroom buildings are also proposed to be moved, and one repositioned. If we can answer any. questions or provide you with additional information, please don't hesitate to call. Wayne Thowless, 1735 Federal Way, Boise, was sworn by the City Attorney. Thowfess: Mr. Chairman, members of the Commission on behalf of the Meridian School District I would, like to briefly give .you an overview of the proposed project at Meridian High School: The High School currently at the varsity football field and track has a bleacher unit with a seating capacity of approximately 380 seats. The School District, the Board of Trustees has made the decision that the district needs to rely less on Bronco stadium for home football games and hold the majority of the home games within the district at the home school field. That necessitates a significant expansion of seating at the high school. The proposal before you is to expand that bleacher seating to a total of 3416 seats. The parking lot at the high school has a capacity of 855 spaces and at a ratio of one parking space per 4 bleacher seats which is a well established ratio in jurisdictions around the country that would allow a total seating capacity of 3420. We are just under that. I am going to step over to the drawing here and explain a bit more about the project. At the high school located basically at the corner of Linder and Pine the existing football field and track are behind or to the north of the main complex of buildings. It is proposed that about 213 of the seating capacity would be on the home side of the field or the south side closest to the buildings of the high school Approximately 113 of the seating capacity would be on the.visitor side or north side of the field and track. There is an existing grass bens on that north side of the field which would be leveled to accommodate the new bleachers on that side. The field lighting for the track and the €ootball field as you may be aware has already been constructed by the district so the project before you this evening is simply an expansion of the bleacher seating, a proposal to build a permanent and larger than presently exists concessions building and press box structure. In order. to accommodate the new bleacher seating on the south side of the field the relocation of two relocatabie classroom buildings from the north side of the high school complex to just south of the parking lot north of Pine Street behind the existing pre-school building. There is currently no fencing of any type along the north boundary of the school property. It is Meridian Planning & Z..~ng Commission February 11, 1997 Page 31 proposed as .part of this project that a 6 foot chain link fence be constructed along this entire north property line behind the visitor bleachers and the visitor side of the field. Additional fencing would be provided within the track and football field complex itself to keep spectators off of the field and off of the track and also to segregate the visiting crowd from the home crowd to hopefully alleviate or minimize problems. In a nut shell that this the proposal of the school district. I would like to if I could before responding to questions, address the staff report which we and the school district have reviewed. The most significant item in that staff report is the question about toilet facilities for this bleacher expansion project. There are of course ample toilets within the Meridian High School complex, the permanent buildings. However the district has found from experience that opening their full facility for home football games or other major events that might be held in the stadium is very problematic from both a security standpoint and a maintenance and janitorial standpoint. Eagle High School as you may be aware developed a similar project to this approximately a year ago. This past fall held a series of home games there in a stadium with roughly the same seating capacity. At Eagle High School there is a permanent exterior restroom with doors that open to the outside of the building adjacent to the football field with four toilets in the men's room and four toilets in the women's room. At the home games the district augmented those permanent facilities with rental toilets and the exact quantity of those rental toilets varied from game to game but the principle indicated it ranged between 5 and 7. He also indicated, has indicated to us that seemed perfectly adequate for the crowds on hand. At least one. of those home games was absolutely sold out and the bleachers were filled to capacity. In the staff report, mention is made of some toilet ratios out of the uniform plumbing code for assembly and gathering type spaces or facilities and a calculation was done by staff using those ratios out of the plumbing code and on page 4 of that staff report what the assessment is if you were to go with those plumbing code ratios the requirement would be for a total of 35 toilets between the two or divided between the two sexes. The school district feels based on their experience at Eagle High .School that is excessive. What the school district would like to propose is that a total number of toilets more in line with what they have found with what is adequate at Eagle High School be provided for events being held in the stadium and those toilets not be required at least all of them to be permanent and not all fo be handicapped accessible because the district would like to meet some of that faality need with rental toilets as opposed to a .large building permanent structure that would have that total number of plumbing fixtures in it. The district is certainly willing to open one or more of its buildings with permanent and accessible toilet rooms in it to crowds in addition to the rental toilets provided. @;~t flees feel the number of fixtures as proposed I the staff report is excessive. Johnson: Well since we are on that subject specifically for the maximum capacity they are looking at 21 water closets for females and 6 water closets for mails and 8 urinals. So combinations thereof would work. I have a question concerning the existing facilities that are somewhat adjacent to the track now. It is my understanding there are Meridian Planning & Z~ .,ng Commission February 11, 1997 Page 32 some on the eastern end of the building there are also some through the ag shop, is that correct? Thowless: Yes, there are restrooms that could be made available in the lower level of the gym and that is on the west side of the complex. And in the vo-ag building which is on the north side of the high school complex actually that is one of the closest buildings to the track and the football field. Johnson: I understand the problem of opening that up without some sort of control you would have to have that. But if those facilities were available what would that do to the numbers in terms of the numbers presented here, I am not familiar with those facilities. Thowless: tf both of those restrooms were opened up you would have more rest rooms more permanent rest rooms than they have been using at Eagle but not as many as proposed I the staff report. I don't have an exact fixture crount for those. The school district would be willing and actually fully intends to provide rental toilets in addition just so that the walk is not as long especially from that visitors side of the field all the way to those permanent buildings. There are some people that legitimately would find it difficult if not impossible to use the portable type of toilets. But for many people that would serve them just fine. And so the district understands that and at least one location a permanent and handicapped accessible facility would need to be made available and is willing to do so. Johnson: You have addressed your comments specifically toward football, do you see any other use that might necessitate or handling crowds of this magnitude? Thowless: The bleachers would also be used on occasion for track meets, track meets and football games would be the two principle uses of the facility. There may and this would be a very remote instance but there may be an occasion where some other special event might be held there but that would definitely not be a typical occurrence. By and large the football game crowds would be probably the only ones that would actually fill to capacity the bleacher seating. Johnson: And we are talking what five or 6 of those annually? (Inaudible) Thowless: We have both a representative from the district and from the high school here that might be bett r abbe to answer questions about pclicies and use of the facility. Johnson: We can defer that then. On the, we don't like to be compared to Eagle but since you brought it up, because we are tougher than Eagle,. is there a projection or is there thinking down the road that maybe if we permitted temporary use I mean use of temporary facilities tike the rental units, port-a-potties, that might be a short term solution down the road with funding or we might be build some more permanent facilities or are we restricted there in terms of space to build any permanent restrooms? Meridian Planning & Z~_ .,ng Commission February 11, 1997 Page 33 Thowless: Additional permanent rest rooms to serve the field and the bleachers is definitely in the long range thinking of the district and the school. One thing that I have not addressed yet and when I am finished with this question I would like to is the issue of the press box and concessions facility that is proposed. That will not be constructed with district funds but will be constructed as a project of the Meridian High School boosters. On the ground level of that facility here have been discussions about possibly incorporating some permanent rest rooms there. That would not nearly be the number of total fixtures. as proposed in the staff report or even the total number of fixtures that Eagle is currently using but it would be a step in the right direction. Still additional permanent toilets might be constructed at some point in the future on the visitor side of the field. There are no concrete plans however at the present time to do that. The Board of Trustees has given no direction in that matter. It is simply a discussion item at this time. If I might go back over to the drawing I have a schematic design for the press box and concessions facility that is being planned at Centennial High School, the design and specifics of the structure to be built by the boosters at Meridian high is still in the formative stages and so I show you this just to give you some concept of what the general scope of what this press box and concessions structure will be. But it should be noted for the record that this is not the specific design that we may end up with at Meridian High School. Johnson: Let's quickly stay with this subject and see if the Commissioners have any questions if they don't then we can move on. Oslund: Thank you Mr. Chairman, I have a couple of questions. How do you intend then to serve the handicapped users in the visitor area for restrooms? Thowless: They would at the present time have to use one of the restrooms in the main building. Oslund: So they would have to go around the track, around the fence, and I don't see anything in here that looks like a sidewalk, are there any sidewalks that would be on the outer separation? Thowless: We are proposing at a minimum compacted gravel or road mix pathway around the west end of the field to the visitor side bleachers. Oslund: How about in terms of noise, obviously there is going to be an increase in noise here are you proposing any mitigation for noise? Thowless: No, there is really no effective noise mitigation measures that the district could possibly afford. I mean basically the only thing possible is to build a huge barrier or sound wall which would be cost prohibitive for the district or to entirety enclose the facility which of could would likewise be prohibitive. Meridian Planning & Zc...,hg Commission February 11, 1997 Page 34 Oslund: The auto occupancy that you have 4 per vehicle, what is the source of that number? Thowless: That is a ratio that is fairly typically used for high school gymnasiums and other assembly, the auditoriums and things of that nature at secondary schools. That is the ratio for example that Boise City uses. Oslund: Did you check it all with like ITE, the ITE parking.generation manual? Thowless: No Oslund: That is all I have MacCoy: To go back about what Greg brought up about the handicapped and the visitor section. You mentioned a path or walkway which is gravel. Thowless: It is a mixture of compacted sand and gravel, it creates a very hard surface that water can percolate through so it doesn't become muddy or rutty like typical topsoil or sod or turf would in wet conditions. MacCoy: I am concerned about somebody in a wheelchair type trying to get through there and that is pretty if it is not compact it becomes quite a job to do that. I had another one I can't think of it. Johnson: That is okay, we can come back to it, Mr. Borup do you have anything before he moves on. Thank you, go ahead and move on. Thowless: On both the home side and visitor side of the field there are some bleacher sections which are ten row and some which are fifteen row. The fifteen row tend to be closest to the 50 yard line. On the home side of the field behind the 15 row section of bleachers a press box structure of masonry or concrete base something tike you see here is proposed with the (Inaudible) press box approximately 20 feet above grade. The press box itself would be approximately 40 feet long, 8 foot deep, fully enclosed with glass windows and be used for announcing score keeping coaching purposes. There would be a small camera platform on the roof. The press box would be accessible from both the aisles of the bleachers as well as stair to grade on the back side. Within the masonry or concrete base would be a concessions area. That concessions area depending on how the boosters decide they want to go with the project if it was developed with water and sanitary facilities they v~uld actually do some preparation of snack items in there such as roasting hot dogs, popping popcorn, etc. If the boosters decide that plumbing that concession structure is cost prohibitive or undesirable for some other reason by health department regulations afl that would be dispensed out of that concessions window would be fully prepackaged items that don't Meridian Planning & Zc,..,ng Commission February 11, 1997 Page 35 require any handling of food stuff by the people working in there. These elevations just give you a very basic idea, side views of that structure and bleacher seating coming off of it and front. The rear view with the concessions facility at grade and the front view facing the field showing the windows and the press box above the bleacher seating. Again, I need to reiterate that this is a concept that is being used in Eagle and there may be some variations when we are all said and done with exactly what takes place at Meridian this should be very close to this. Johnson: Do you have anything further to add? Thowless: I think that takes care of my comments. Agairi we do have a couple of representatives from the district that may wish to make some comments. Johnson: If they wish to make comments at this time they may or may after the testimony from the public whichever they wish to do. Reed: There were a couple of questions raised a minute ago about the bathroom facilities. 1 would like to show you where those exactly are on that one drawing. Johnson: Since there is no one from the audience that (inaudible) Reed: The bathroom facilities that are in the buildings that we would use would be in the gymnasium right here at the north end of the gym. It would be in the Ag building approximately right here and there is also, a comment was mentioned about the visitors handicapped access and there is bathroom facilities in the auto shop building. Visitors side here would be a little more convenient as far as accessibility. Johnson: I have a question to ask that I just don't know the answer to. On the rental facilities do they make, because I have never seen them, do they make handicapped facilities that are on a portable basis? (Inaudible) (Inaudible) Johnson: Anything else Jim? Reed: There was mention of the home games and there would be 3 varsity home games. We currently play sophomore games and freshmen games, have track meets. By far the bigger crowds would be the varsity football games and we just have 3 of those. Oslund: Three games per season then? Johnson: Those games are played I assume all in the evening? Reed: The varsity football games would be in the evenings. Johnson: Not on Saturdays. . Reed: They are in the evening, Friday night at our high school is when they would be played. Oslund: At what time? Reed: 7:00 Oslund: To? Reed: 9:30 or 10:00 Oslund: So by 10:00 things are pretty much v-rt'apped up? Reed: Yes, they would be done and I think the plans we have right now would be to clear the crowd and shut the lights down and Mme in the next day for clean up. Johnson: Thank you, any other questions you have of the applicant? Mr. Carberry did you have anything to add at this point? Jim Carberry, 3283 Raindrop Drive, Boise, was sworn by the City Attorney. Carberry: I would simply like to speak on behalf of Joint School District No. 2 Board of Trustees. We are all very excited to bring varsity football back to the City of Meridian. As you know we have been successful in doing that in the Eagle area, .I don't want to compare Meridian to Eagle I have heard some comments on that this evening but we are (inaudible) has been extremely exciting for us to do that. We have we of the Meridian school district and especially Meridian High School has been using as you know Bronco stadium since the late 70's. The use of the Bronco stadium has become more and more of a problem, not only for Meridian High School but for Centennial high school as well. As you realize that as this treasure valley grows the growth in traffic grows along with it. It is a hair raising experience sometimes driving from the Meridian area to Broadway Avenue and Bronco stadium. We have lots of parents out there that are very concerned abo~;t that in fact some are so concerned that they won't allow children to go to these games. Now you are talking a 25 to 30 minute drive to the Meridian Planning & Zo, .,ng Commission February 11, 1997 Page 37 stadium. Other concerns of course is that it is a fairly large fee for our district to pay to rent and lease Bronco stadium. We would like to get out of that. Other concerns of course are scheduling. Currently we are scheduling 6 high school football teams into Bronco stadium. Once Boise opens their fourth high school it will be seven. We are currently playing as you probably have heard and heard the screams many times playing Thursday night football games in Bronco stadium. We are even anticipating if we don't construct our facilities and get out of there that we will have to go to Thursday night double headers. Now realize that some of those Thursday night double headers, the first game would start at 6:15 the second game may start as late as 9:00 and that is on a school evening and we don't think that is conducive to high school football. Keep in mind that the Board of Trustees does not say that activity programs are the other half of education but they do play a very vital role in the total education process. Our kids and by saying that our students and our spectators are becoming disjointed with the football program. Granted we haven't had a great successful season for a few years, that may have attributed to some of that. But at the same time the drive to Bronco stadium, the Thursday night games, the late double headers have added to it also. For crying out loud we have to keep in mind that schools have to be a part of those students, students have to be part of the schools. Research has told us for years that students are more successful if they take pride in their school and they take part in their school. And because of those various reasons we r~nould like to bring a facility back to Meridian High School so that we can play varsity football games here in the City of Meridian. Currently this coming season we would play about 3 varsity football games. If we got into a playoff later in the season that may be a fourth. Each year the number of varsity games will vary according to the home schedule. Some years there may be as many as five, this coming year for instance there may be only three. So that will vary. With that 1 would thank you for the opportunity to speak to you. I would turn it over to you and any questions that you might have. Johnson: Thank you, any questions for Mr. Carberry'? Meyet: I guess I am go over for a minute with this thing. Well like I guess I have just written down some things about this. When like even at junior varsity or even like sophomore games l have seen people standing up out of the stands because the stands are filled bec..~use thee? is not only like Sher students but there is like their parents and all of that. I have seen people stand up because of that. With the toilets, if they were opened up there would be an inconvenience with the further wise. Because it is like farther away and if they had the toilets then it would be more of a convenience if they were closer. With the inconvenience of the BSU games, if it was more convenient more people would come and then they would pay for the, more people would pay for concessions an~i it would be easier to raise funds for other school activities. Not just for like football games or sports but even academic needs such as Meridian Planning & Z..,ng Commission February 11, 1997 Page 38 debate. Like traveling needs for competitions and stuff. About the wheelchair issue if they see that the track or that the pathway is not I guess up to the recommendations for that person in the wheel chair then they are probably just going to stay off to the south side if they wanted to. If they are more womed about themselves than just what side of the track they are on. I was like looking at the thing and the bleachers are right beside the track and if like with the pathway if it is not as good as the wheelchair people see fit then can I am sure even with the rule that you are not supposed to be on the track I think they would let the people with wheelchairs use that track to get to the facilities were in the Ag building or the other building. I was .thinking, speaking of debate because I am in it, we made over a $1000 in one night working concessions and that has helped us a lot to get to our competitions and stuff. If there was like, in our basketball stadium we have quite an amount of bleachers in there and with all the people we get a lot of concessions. So if there are more people with the other games that are outside by the field then I am sure we can raise a lot of money for that. That is all I have. Johnson: I have a question, not so much a question but just a comment and I guess a question. Under the current concession situation at bronco Stadium now don't you have to share that revenue with another organization like Marriott or whoever it happens to be, Fine Host or whatever. Isn't a percent of that doesn't come to you that would come to you if you had the concessions at Meridian? In other words you would get a bigger share? Meyet: 1 am not sure, I haven't worked concessions at BSU but if that was true, yes. Johnson: I am pretty sure (Inaudible) anyway you did a good job, Mr. MacCoy probably has a question for you about the wheelchair. MacCoy: On the wheelchair which you have already heard and spoken to, is that track a, one of the new type tracks. I have not seen this track and I know a lot of tracks are cushioned tracks which would make very good travel for a wheelchair or are they cinder track. Meyet: I am not sure what it is made out of. MacCoy: So really would you say we should go ahead and build a walkway around there that a wheelchair vu~ use so ~,~ve avculdn°t (inaudible) Meyet: Yes it would be better t!-ian (inaudible}. MacCoy: One last part of that. Since this is a highly talked about project, this whole thing the bleachers and everything else, there seems to be a lot of school enthusiasm over this thing. Is there any student involvement in any of this material, like could they Meridian Planning & Zc...,ng Commission February 11, 1997 Page 39 for example take on building a walkway or something and helping out? Or is that off limits to you people. Meyet: I am sure most kids would do it if they got paid for it. Johnson: What we are talking about here is volunteer work. The people sitting up here in front of you are all volunteers, we don't get paid with the exception of the attorney on the end. He is the only one that gets paid. Meyet: It depends on the student, I wouldn't really know. I am pretty sure there would be a few students that would be willing to help out. If they wanted a track like this which I think a lot of students would then I think they would help out. Johnson: I think if we wanted it bad it enough you could get plenty of students to help you out, I think you need to just. test those waters. I think you will get a good response. Schlekeway: I have some concerns with one I don't quite agree with four to one as far as parking is concerned. That will clog the streets I think. Four to one is reaching a bit to where it tends to be closer in between 3 to 1 and 2 to 1 in my opinion. (End of Tape) my property borders, it would be the west boundary. The concern that I have is night time activities at the school tend to bring kids and I don't know, they can easy do smoking and chewing and drinking and stuff off of school property where they can't do it on school property because they get in more trouble for on school property. So they tend to go to buffering zones and typically a lot of kids smoke behind the fence. There is a wooden fence between the Ag shop there and the thing there. With that fence being wooden and completely hidden from the bleachers with the lights out there and the darkness behind the fence would tend to me add a zone for that kind of behavior and that is something that I wouldn't like on my property. They mentioned about putting a chain link fence on the north boundary but nothing on the west boundary. So I am concerned that wood fence is not much left of it. 1 have no buffer between that and my property. This will definitely ch~nre the value of my property cn That side with that much noise and that kind ~rf ~~ctivity because to develop that and people aren't going to want that exactly in their backyards so those lots would not be worth as much against that boundary. So that is a concern for me also. MacCoy: Do you think four times a year is too much? When tournaments are held in this area typically they go to different areas. So A-4 and stuff like that. So there is definitely, I know right now the plans are just for Meridian use but it always expands in the future. So I can see this being used 10, 15, to 20 times a year. That might be an exaggeration but I think they are part of and 4 or 5 (inaudible) those are my major concems. Well a traffic light on Linder and Pine was one other one but 1 think that is already being address by Ada County on that. Johnson: We wouldn't have any jurisdiction over that anyway. I have a question, I am always interested when people talk about their property values going down. Have you talked to you Realtor about that or is this just your conjecture. Review of the plan that was submitted with the application for Conditional Use, doesn't reveal how or where restroom facilities will be provided. With the proposal to accommodate 3,420 people at a football game, including the addition of concession stands that will be serving food and beverage, there needs to be an appropriate number of addition permanent restroom facilities, including provisions for the physically handicapped. Our plumbing official contacted the State of Idaho regarding what criteria should be expected for such a facility since the 94 Uniform Plumbing Code doesn't specifically note an outside public gathering place such as a football stadium, and was told that there isn't really a mandatory guideline to follow. They also said that they leave it up to the individual City's to determine the requirements of each of these type facilities. Following is an excerpt from the 1994 Uniform Plumbing Code, and calculations for the nearest applicable type facility (Assembly Places -Theaters, Auditoriums, Convention Halls, etc. -for public use). PII+IE AVE. MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS OF LAW The above entitled matter having come on for public hearing on February 11, 1997, at the hour of 7:00 o'clock p.m., the Applicant appearing through its representative, Wayne Th®wless, the Planning and Zoning Commission of the City of Meridian having duly considered the evidence and the matter makes the following Findings of Fact and Conclusions of Law: FINDINGS OF FACT 1. A notice of a public hearing on the Conditional Use Permit was published for two (2) consecutive weeks prior to said public hearing scheduled on February 11, 1997, the first publication of which was fifteen (15y days prior to said hearing; that the matter was duly considered at the February 11, 1997, hearing; that the public .was given full oppartunity to express comments and submit evidence; and that copies mf all notices were available to newspaper, radio and television stations. 2. This property is located within the City of Meridian at 1900 W. Pine Ave, Meridian, Ada County, Idaho. The legal FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 1. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditia~nal Use Permit description of the property is included in the application, and by this reference is incorporated herein. 3. The Applicant, Meridian School District No. 2, owns the property. The property is currently zoned (R-4) Low Density Residential District. 4. Pursuant to the application and the accompanying letter from the Applicant's representative, Wayne•Thowless, the Applicant proposes to increase the current bleacher seating capacity at the outdoor football/track field from 380 t© 3,416. At the proposed ratio of four bleacher seats per parking space, the on-site parking spaces of 855 spaces at the property, the Meridian High School, would permit a maximum seating capacity of 3,420. Typically, the bleacher seating would neither be used while classes are in session nor simultaneous with other on-campus sparting events. In addition to additional bleacher seating, the Applicant proposes the construction of a new two-story press box and concessions structure on the "home" side of the field, along with a smaller one-story concessions building on the "visitor" side of the field. The Applicant also proposes that two relocatable classrooms be moved, one of which would be repositioned. 5. The Assistant to the City Engineer, Bruce Freckleton, submitted comments which are incorporated herein as if set forth in full. The comments included the following that the plans submitted for the conditional use permit does not reveal how or where the restroom facilities will be provided. With the proposal to accommodate 3, 420 people at a football game, including the addition FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 2. MERIDIAN JOINT SCHOOL DISTRICT N0. 2 - Conditional Use Permit existing football/track field are behind or to the north of the main building complex. The Applicant proposes that approximately two-thirds of the seating capacity be on the "home" side or south side of the field, with the remaining one-third, approximately, of the seating capacity be on the "visitor" or north side of the field. There exists a grass berm on the north side of the field which would be leveled to accommodate the new bleachers on that side of the field. The lights for the field lighting already have already been constructed by the Applicant. To accommodate the new bleacher seating on the south side of the field will require the relocation of two relocatable classroom buildings from the north side of the high school complex to just south of tl~e parking lot north of Pine Street behind the existing pre-school building. Currently, there is no fencing of any type along the north boundary of the Applicant's property. The Applicant proposes, as part of the proposed project, to construct a six feet high chain link fence. along the entire north property line of the property behind the "visitor" side of the field. Additional fencing would be constructed within the football/track field area to keep spectators ~~ the track and football field, and also to segregate the visiting crowd from the home crowd. 8. In response to the staff comments, the testimony of the Applicant's representative, Wayne Thowless, continued substantially as follows. The Applicant and its representatives Dave reviewed the staff comments. The most significant comment of which was the questions concerning restroom facilities for the bleacher expansion FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 4. MERIDIAN JOINT SCHOOL DISTRICT N0. 2 - Conditional Use Permit project. There are ample restroom facilities within the Meridian High School complex; however, the Applicant has found from experience that opening its facility for home football games or other major events which may be held at the football/track field is very problematic from both a security standpoint, and a maintenance and janitorial standpoint. Comparing a similar facility at Eagle High School, there exists at Eagle High School a permanent exterior restroom with four toilets in the men's room and four toilets in the women's restroom. The Applicant augmented these available permanent restroom facilities at Eagle High School with rental toilets. The exact number of rental toilets varied from game to game from five to seven rental toilets. This number seemed adequate for the .crowds at the football games of Eagle High School, at least one of which was sold out with the bleachers filled to capacity. In the staff comments, mention is made: of some toilet ratios out of the uniform plumbing code for assembly and gathering type facilities. A calculation was made by staff using those ratios. Based upon the calculations by staff, a total of 35 toilets, divided between male and female, would be required. The Applicant feels that, based upon its experience at Eagle High School, 35 toilets is excessive. The Applicant proposes a total number of toilets as are available at Eagle High School be provided for events held at the football/track field, and that not all of the toilets be permanent and handicapped accessible. The Applicant would like to meet the restroom facility requirements with rental toilets as opposed to a large permanent building structure that FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 5. MERIDIAN JOINT SCHOOL DISTRICT N0. 2 - Conditianal Use Permit would have the total number of toilet fixtures in it. The Applicant is willing to open one or mare of its buildings with permanent and accessible restrooms in addition to the rental toilets provided; however, it feels the number of fixtures proposed by the staff is excessive. 9. Chairman Johnson commented that the staff is suggesting 21 water closets for females, and six wa~cer closets for males with 8 urinals, so combinations thereof would work. 10. In response to questions fram Chairman Johnson, the Applicant's representative testified substantially as follows. There are restrooms which could be made available in the lower level of Meridian High School's gymnasiums which is on the west side of the building complex, in the vo-ag building which is on the north side of the building complex and closest to the football/track field. If the restroom facilities in the gymnasium and vo-ag building were opened there would be more restrooms available than used at the footba~.l games at Eagle High School; however, there would not be as many as proposed by staff. The Applicant fully intends to provide rental toilets in addition so the walk is not a long to the permanent buildings, especially for the visiting crowd. Some people would find it difficult, if not impossible, to use the portable type of toilets, but for many of the people, the portable type of toilets would serve them fine. The Applicant understands that at least one permanent handicapped accessible facility will need to be made available, and it is willing to do so. Additional permanent restroom facilities to FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 6. MERIDIAN JOINT SCHOOL DISTRICT N0. 2 - Conditional Use Permit serve the football./track field are definitely in the long range thinking of the Applicant. 11. In response to questions from Chairman Johnson, the Applicant's representative testified substantially as follows. The bleachers would occasionally be used for track meets; football games and track meets are the two principle uses of the facility. On remote occasions, the facility may be used for some special event, but this would not be a typical occurrence. 12. The testimony of the Applicant's representative, Wayne Thowless, continued substantially as follows. The proposed press box and concession facility will not be constructed with the Applicant's funds, but will be constructed as a project of the Meridian High School boosters. There have been discussions of incorporating restroom facilities on the ground level of press box and concession facility. The number of restrooms would not be nearly the number of total fixtures as proposed by staff or even the total number of fixtures that .Eagle High School is currently using. However, it would be a step in the right direction. Additional permanent restroom facilities might be constructed at some point in the future on .the "visitor" side of the field; however, there are no concrete plans at the present time and the Applicant has given no direction on the matter. It is simply a discussion at this time. The design and specifics of the structure to be built by the boosters is still in the formative stage, so the schematic design presented is only to give a conceptual view of the general scope of what the facility will consist. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 7. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit 13. In response to questions from Commissioner Oslund, the Applicant's representative testified substantially as follows. The handicapped will have to use the restrooms in the main building of Meridian High School. The Applicant is proposing, at a minimum, compacted gravel or road mix pathway around the west end of the football/track field to the visitors bleachers. There exist no effective noise mitigation measures which the Applicant could afford. The only possible measure is to build a huge barrier or sound wall which would be cost prohibitive for the Applicant or to enclose entirely the facility which would also be cost prohibitive. The ratio used for parking is a fairly typical ratio used for high school gymnasiums and other assemblies; the auditoriums and similar facilities of that nature at secondary schools. It is the ratio which Boise City uses. Mr. Thowless did not check the ratio with the ITE parking generation manual. 14. In response to questions from Commissioner MacCoy, the Applicant's representative testified substantially as follows. The mixture of compacted sand and gravel for the pathway around the west end of the football/track field to the visitors bleachers creates a very hard surface that water can percolate through, so it does not become muddy or rutty like typical topsoil ar turf would in wet conditions. Commissioner MacCoy commented that he is concerned about a person in a wheelchair trying to move on the pathway, and the movement being difficult if the surface is not compact. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 8. MERIDIAN JOINT SCHOOL DISTRICT N0. 2 - Conditional Use Permit 15. The testimony of the Applicant's representative, Wayne Thowless, continued substantially as follows. Both the "home" and "visitor" side of the football/track field are bleacher sections, some of which are 10 row and some of which are 15 row. The 15 row tend to be located closest to the 50 yard line. On the "home" side of the football/track field behind the 15 row section of bleachers is a press box structure of masonry or concrete base approximately 20 feet above the grade. The proposed press box would be approximately 40 feet long by eight feet deep, and fully enclosed with glass windows. It would be used for announcing, score keeping and coaching purposes.- There would be a small camera platform on the roof. The press box would be accessible from both the aisles of the bleachers as well as a stair to grade on the back side. A concession area would be within the masonry or concrete base. Workers in the concession .area, depending upon. the boosters' decision and it was developed with water and sanitary facilities, would actually do some preparation of snack items, such as roasting of hot dogs and preparation of popcorn. If the boosters decide that plumbing is cost prohibitive or undesirable for some other reason, the items dispensed from the concession area would be fully packaged items that do not require handling of the food by those working. The schematic showing the elevations, front, rear and side views of the structure and the bleacher seating coming off of it provide a very basic idea of the proposed structure. There may be variations of the proposed structure, but it should be very close to the schematic. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 9. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit 16. Jim Reed a representative of the Applicant testified substantially as follows. The bathroom facilities that would be used are in the gymnasium at the north end and the Agricultural building, and in the auto shop building. The "visitor" side would be a little more convenient as far as .accessibility. There would be three varsity home games. Meridian High School presently plays its sophomore and freshmen games, as well•as track meets, at the football/track field. By far the largest crowds would be for the varsity football games, and Meridian High School would have three of them this year. There might be four. There would never be very many varsity football games. The varsity football games are played on Friday evenings from approximately 7:00 p.m. to 9:30 or 10:00 p.m. By 10:00 p.m., most activity is concluded. The following day would be for clean-up of the facility. 17. Jim Carberry a representative of the Applicant testified on behalf of the Joint School District No. 2 Board of Trustees substantially as follows. The Board is very excited to bring varsity football back to the City of Meridian. The Applicant has been very successful in the Eagle area with regard to playing .varsity football at Eagle High School. The Applicant has been using Bronco Stadium, especially for Meridian High School, since the late 1970s. The use of Bronco Stadium has become more and more of a problem, not only for Meridian High School but Centennial High School as well. As the Treasure Valley grows, the traffic grows. It is a hair raising experience sometimes to drive from the Meridian area to Broadway Avenue and Bronco Stadium in Boise, FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 10. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit Idaho. There are lots of parents who are very concerned about the drive into Bronco Stadium and they will not allow their children to go to the games. Other concerns include the large fee the Applicant pays to rent and lease Bronco Stadium and scheduling. The Applicant would like to get out of paying the fee. Currently, six high school football teams are scheduling their games at Bronco Stadium. After Boise opens its fourth high school, the number will increase to seven teams. The high schools are playing Thursday night football games at Bronco Stadium, which may go to Thursday night double headers if this application is not approved and the Applicant cannot construct the facilities. If there are double headers on Thursday nights, the first game would start at 6:15 p.m. and the second game would start at 9:00 p.m. This is on a school night, which the Applicant does not consider conducive to high school football. The Board of Trustees does not say that activity programs are the other half of education, but the Board believes it plays a vital role in the total education process. The students and the spectators are becoming disjointed with the football program. Although the football team has not met with great success of recent, which may play a role, but the drive to Bronco Stadium, the Thursday night games and the late double header also contribute to it. Schools have to be part of the students and students have to be part of the schools. Research has shown the Applicant for years that students are more successful if they take pride in their school and take part in their school. And for these various reasons, the Applicant desires to bring a facility to Meridian High FINDINGS OF FACT AND CONCLUSIONS t1F LAW - Page 11. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit School so that the varsity football games can be played in the City of Meridian. This coming season three varsity football games would be played at Meridian High School. If there was a playoff game, there would be four. Each year the number of varsity games would vary according to the home schedule. .Some years there may be as many as five. 18. Greg Meyet testified in favor of the application substantially as follows. The stands are filled at junior varsity and even sophomore games because of students and parents in attendance. If the home varsity football games were at Meridian High School rather than Bronco Stadium, more people would attend and pay for the concessions which would make fund raising for other school activities easier. With regard to those in wheelchairs attending the games, they could stay on the south side of the field if it is too difficult to use the pathway.. For those in wheelchairs, an exception could be made to the rule prohibiting the use of the track to access restroom.facilities and other areas. As a member of the debate team, the debate team raised $1,000.00 in one night working the concessions which has helped to travel to the debate competitions. In comparison to the basketball games inside the gym and the money raised from concessions, as the football games are outside more people could attend the games and a lot more money could be raised. 19. In response to a question of Chairman Johnson, Mr. Meyet testified that he did not know whether workers at the concessions stands at Bronco Stadium had to share the concession revenue with FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 12. MERIDIAN JOINT SCHOOL DISTRICT N0. 2 - Conditional Use Permit the concession stand operator; however, if they eliminated the sharing of the concession revenue the workers would raise more money. Chairman Johnson indicated that the workers did have to share the revenue with the operator. 20. In response to questions from Commissioner MacCoy, Greg Meyet testified substantially as follows. He is not sure of what type of material the track at Meridian High School is made. It would be better to construct a gathway for those in wheelchairs. Although he was uncertain and it depends upon the particular students, he believed that students would be willing to assist in the construction of a walkway or other facilities. 21. Alloys Schelekeway testified in opposition to the application substantially as follows. He is concerned with the four seats to one vehicle ratio for the parking; the ratio in his opinion is closer to three seats to one vehicle or two seats to one vehicle. His property borders the west boundary of the Applicant's property. Night time activities at,the school tends to bring kids who can easily smoke, chew and drink off of the Applicant's property, where they will not get into as much trouble as if they were on school grounds. They tend to go to adjacent properties. The Applicant plans to construct a fence along the northern property line, but nothing on the west boundary. He has no buffer between the west boundary and his property. No buffer between the west boundary and his property will definitely change the value of his property because of the noise and activity. People are not FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 13. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit going to want the noise and activity in their backyard, so the lots along the west boundary are-not going t® be worth as much. 22. In response to a question from Commissioner MacCoy, Mr. Schelekeway testified substantially as follows. Mr. Meyet does not foresee the football games at the football/track field being only four times per year. He sees not only freshmen, sophomore, and varsity games at the football/track fieid,~but other schools using the facility for different activities. He can foresee it being used 10, 15 to 20 times per year, although that may be an exaggeration. 23. In response to a questions from Chairman Johnson, Mr. Schelekeway testified that the decrease in his property value is based upon his personal opinion as some~e who is involved in the industry. 24. Jim Reed a representative of the Applicant further testified substantially as follows. There are no present plans to allow other schools to use the facility. Great pride will be taken in the care of the facility. The football teams do not practice on the football field; the teams practice on the west practice fields. The use of the facility by other schools would be contrary to the goal. Meridian High School will provide security at the football games through the presence of vice principals, student resource officer (police) from the school. There will be heightened security. The Applicant does not want to cause problems with the neighborhood. There are no guarantees as to where the kids will FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 14. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Canditional Use Permit go, but the security with the proposed fencing will help deter problems. 25. In response to questions from Chairman Johnson, Mr. Reed testified that the members of the football team and plenty of kids volunteer to accomplish that which needs to be done. 26. The Planning and Zoning Administrator has or may submit comments, and such comments are hereby incorporated herein as if set forth in full or shall be incorporated herein as if set forth in full when submitted. 27. The Meridian City Police Department and Nampa & Meridian Irrigation District submitted comments, which respective comments are hereby incorporated herein as if set forth in full. 28. MERIDIAN JOINT SCHOOL DISTRICT N0. 2 - Conditional Use Permit Linder Road abutting the parcel (20 additional feet) by means of a recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit, or other required permits, whichever occurs first. The Applicant will be compensated for this additional right-of-way from available impact fee revenues in this benefit zone. If the Applicant desires to be paid for the additional right-of-way, the Applicant must submit a letter of application to the impact fee administrator prior to breaking ground in accordance with Section 15 of ACRD Ordinance #188. The Applicant construct a five feet wide detached sidewalk on Linder Road abutting the parcel, located one foot within the new right-of- way of Linder Road. The Applicant provide a $7,500.00 deposit to the Public Rights-of-Way Trust Fund for the cost of the roadway lighting at the Pine Avenue/Cinder Road intersection. Restrictions on the width, number and locations of driveways shall be placed on future development of the property. Other than the existing access points, direct lot or parcel access to Pine Avenue and Linder Road are prohibited. 31. There was no further testimony given at the hearing. CONCLUSIONS OF LAW 1. All the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. The City of Meridian has authority to grant conditional uses pursuant to Idaho Code Section 67-6512 and pursuant to 11-2- FINDINGS OF ,FACT AND CONCLUSIONS OF LAW - Page 16. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit 418 of the Revised and Compiled Ordinances of the City of Meridian. 3. The City has the authority to take judicial notice of its own ordinances and proceedings, other governmental statutes and ordinances, and of actual conditions existing within the City and state of Idaho. 4. In the ZONING SCHEDULE OF USE CONTROL, Sections 11-2-409 B. Commercial, School - Public is listed as a permitted use in the (R-4) Low Density Residential District; 5. The (R-4) Low Density Residential District is described in the Zoning And Development Ordinance of the City of Meridian, 11-2-408 B. 3 as follows: (R-41 Low Density Residential District: Only single- family dwellings shall be permitted and no conditional uses shall be permitted and no conditional uses shall be permitted except for Planned Residential Development and public schools. The purpose of the (R-4) District is to permit the establishment of low density single-family dwellings, and to delineate those areas where predominantly residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incostpatible non- residential uses. The (R-4) District allows for a maximum of four (4) dwelling units per acre and requires connection to the Municipal Water and Sewer systems of the City of Meridian. 6. Section 11-2-407 D 1. of the City of Meridian Zoning and Development Ordinance provides: When a use is not specifically listed as a permitted use, such use shall be hereby expressly prohibited unless by application and authorization (as provided for under Conditional Use) it is determined that said use is similar to and compatible with listed permitted uses. Such uses may then be permitted as Conditional Uses. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 17. MERIDIAN JOINT SCHOOL DISTRICT N0. 2 - Conditional Use Permit Therefore, in the (R-4) Low Densitg Residential District a conditional use permit is required for construction to increase bleacher seating capacity at a public school's outdoor football/track field, for the constructi®n of anew two-story press box and concessions structure at a public school's outdoor football/track field, and for the relocation of two relocatable classrooms by a public school. 7. Conditional Use Permit is defined in the Zoning And Development Ordinance, City of Meridian, Idaho as "Permits allowing an exception to the uses authorized by this Ordinance in a zoning district." 8. The City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to Idaho Code Section 67-6512 and pursuant to that section conditions minimizing the adverse impact on other de~relopment, controlling the duration of development, assuring the development is maintained properly, and on-site or off-site facilities may be attached to the permit; that 11-2-418 (D) authorizes the City to prescribe a set time period for which a conditional use nay be in existence. 9. Section 11-2-418 D. provides as follows: In approving any Conditional Use, the Commission and Council may prescribe appropriate ca~nditions, bonds, and safeguards in conformity with this Ordinance. Violations of such conditions, bonds or safeguards, when made a part of the terms under which the Conditi®nal Use is granted, shall be deemed a violation of the Ordinance and grounds to revoke the Conditional Use. The Commission and Council may prescribe a set time period for which a Conditional Use may be in existence., FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 18. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit 10. The City has judged this Application for a conditional use upon the basis of guidelines contained in Section 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian and upon the basis of the Local Planning Act of 1975, Title 67 Chapter 65, Idaho Code, the Comprehensive Plan.of the City of Meridian, and the record submitted to it and the things of which it may take judicial notice. 11. Section 11-2-418 C of the Zoning And Development Ordinance of the City of Meridian sets forth the standards under which the Planning and Zoning Coimnissi.on and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area and assuming that the above conditions or similar ones thereto would be attached to the conditional use, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit would be required by ordinance; b. The use would be harmonious with and in accordance with the Comprehensive Flan but the Zoning Ordinance requires a conditional use permit to allow the use; c. The use is designer and is, apparently, to be constructed to be harmonious in appearance with the character of the general vicinity; that if the conditions set forth herein are complied with the use should be operated and maintained to be harmonious with the intended character of the general vicinity and should not change the essential character of the area; d. The use would not be hazardous nor should it be disturbing to existing or future neighboring uses if the conditions are met; that traffic will increase, but due to the limited number of times of use during the year the use should not present a problem; FINDINGS OF FACT AND CONCLUSIONS OF LAW - page 19. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit e• The property has sewer and water service already connected, but Applicant may have to pay additional fees for the use; f• The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community; g• If the conditions are met, the use should not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person,. property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Sufficient parking for the proposed use will be required to meet the requirements of the City ordinance; and i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 12. Because conditions may be placed upon the granting of a conditional use permit to minimize adverse impact on other development, it is recommended by the Planning and Zoning Commission that the following conditions of granting the conditional use be required, to wit: a. The conditional use, pursuant to the Zoning Ordinance, shall not be transferable to another owner or lessor of the subject property or to another property; b. The Applicant shall meet the requirements of the City Engineer's office, the Planning and Zoning Administrator, Meridian Fire Department, Meridian City Police Department and the Nampa & Meridian Irrigation District; c. The Applicant must meet and comply with the. comments, recommendations and requirements of the Ada County Highway District, which include, but are not limited to the following: (1) The Applicant dedicate 45 feet of right-of-way from the centerline of Linder Road abutting the parcel (20 additional feet) by means of a recordation of a FINDINGS OF.FACT AND CONCLUSIONS OF LAW - page 20. MERIDIAN JOINT SCHOOL DISTRICT NO. 2 - Conditional Use Permit final subdivision plat or execution of a warranty deed prior to issuance of a building permit, or other required permits, whichever occurs first; (i) The Applicant will be compensated for this additional right-of-way from available impact fee revenues in this benefit zone. REQUEST FOR A CONDITIONAL USE PERMIT FOR CONSTRUCTION OF EXPANDED BLEACHER SEATING, ACCESSORY STRUCTURES, AND MOVING OF TWO RELOCATABLE CLASSROOMS BY JOINT SCHOOL DISTRICT NO. 2: Corrie: I will open the public hearing and invite the School District's representative. Wayne Thowless, 1735 Federal Way, Boise, was sworn by the City Attorney. Thowless: Mr. Mayor, members of the council on behalf of the Meridian School District we are here to request conditional use approval of expanded bleacher seating at Meridian High School. The present bleachers at the varsity football, field and track seat approximately 380 people. It is the district's wish to be able to hold home varsity football games at that location. For that reason needs expanded seating to accommodate 3416 is the design capacity of the structures to be built on both the home side or the south side of the field and the north side or visitors side of the field. In conjunction with the bleacher seating itself additional fencing will be provided for crowd control, perimeter fencing on the north side of the site will be added. To relocatable classroom buildings that are presently on the south side of the football field are planned to be moved to the south side of the property. Some right of way improvements in accordance with ACRD conditions are planned along Linder Road on the east side of the site. As a separate project the Meridian Boosters are planning a two story press box and concessions building on the south side of the field which would be the home side. That too is shown on the site plans you should have before you. I am going to go over and. change the drawing from the overall site plan to the plan in the immediate vicinity of the track and football field and would stand for any questions. Corrie: Questions from Council? Tolsma: I have one, how are the restroom facilities are they going to be constructed on both sides of the ball field? Thowless: There are no rest rooms proposed to be constructed at this time in conjunction with the project. The high school 'Meridian City Council April 1, 1997 Page 26 Tolsma: (Inaudible) Thowless: There are a number of large rest room facilities within the buildings of the campus itself and it is the school district's intention and has been their practice at other campuses to bring in rental toilets to augment around the field and around the bleacher seating area those toilets within the permanent buildings on the campus. By way of comparison the gymnasium holds almost as many people as this stadium will hold and the gymnasium rest rooms as well as other rest rooms at the facility will be made available to the public as necessary and needed in addition to those rental toilets that the school district will be providing for major events held in the stadium. Corrie: Any other questions? Rountree: You indicated a two story announcers booth that is essentially what is there now. Thowless: Significantly larger than what is there now. Rountree: Height or floor space? Thowless: It will be higher and it will be much larger. Bentley: I have a question on your sound system, are you going to have speakers on both sides? Thowless: I don't believe so. The sound system that is in use presently will be continued to be used. I don't believe the district has any intention of changing that, is that correct. Mr. Carberry with the school district indicates that the sound system presently in use will remain in use and will be mounted on the new press box structure when it is completed which will be on the south side of the field. Bentley: You don't think the (inaudible) is going to be too loud (inaudible) without having speakers on both sides? Thowless:. Based on the experience at Eagle High School where a similar amplification system is used I don't think so. But what is too loud and what isn't too loud for adjacent neighbors is subjective so I can't really comment on that. Corrie: Any questions? Anyone else from the public that would like to issue testimony at this time? Alloys Schelekeway, 2090 West Pine, Meridian was sworn by the City Attorney. Meridian City Council April 1, 1997 Page 27 Schelekeway: I own the property directly to the west of the proposed stadium and we have a wooden fence and as of I can see of it there are no plans to replace that with chain link. Currently during high school there are some problems with kids going over into my pasture and smoking and hiding behind that wooden fence. That is during the daylight hours so a night time football game I can't imagine the parties that will be going on in my pasture with the wooden fence to high behind. I would like to see them put the higher chain link fence as a buffer zone between my property and the stadium. The noise is kind of a concern for me to because my property some day will be a subdivision too and there is no buffer zone between. The Vineyards behind that property has a canal and some distance behind that. But (inaudible) on my property some day will be right up against the football field area there with a small volley court in between. So I am concerned about the noise and the kinds of speakers they will have too which was already been brought. But mostly the fence and the wooden fence that is just a place to hide behind. That is it. Corrie: Question Mr. Tolsma? Tolsma: Have you thought of a (Inaudible) Schelekeway: That doesn't seem to deter (inaudible) if I got a mean one then it would deter me too. Corrie: Anyone else from the public that would like to issue testimony at this time? I will close the public hearing? Council, questions or discussion? Morrow. Mr. Mayor, I would have a question for Mr. Carberry in terms of I would like to hear a response to the issue with the fence and the policing of the kids whether it be chain link or solid. How do you propose to handle that issue? Corrie: At this time I will reopen the public hearing. Carbeny: Mr. Mayor, members of the council, first of all I wasn't aware that the students were hanging out behind the fence. That would be a concern and we will be sure to inform the administration at Meridian High School that is taking place. We have never really considered what we would call the west property line fence but we will certainly look into that. I am not even sure what kind of condition that fence is in at this time. But we will sure entertain a chain link fence if that is a requirement. All of these games will have the necessary security being building administration and the Meridian police department as well as our SRO's that will be assigned to pa#rol parking lots adjacent areas and areas such as have been mentioned here. I can only say we have really not looked into that fencing area, but we would certainly entertain to do that. Corrie: Any further questions or testimony that you need. 'Meridian City Council April 1, 1997 Page 28 Crookston: I just have one question, I just wondered whether' or not Mr. Carberry was going to go back to coaching so he could get into that stadium. Corrie: At this point I will close the public hearing. Morrow. Point of discussion Mr. Mayor, I think I would like to see in the findings of fact and conclusions from my perspective a short statement discussing the fence issue and the policy. of whether it be a chain link fence of a wood fence and the district handling people that may be on the adjoining properties doing whatever it is they want to do. I would like to see that in the findings of fact addressing that so .that it does have the administration look into it, Rountree: Do we want to add that or do we want to amend the cun'ent findings with the testimony and response that we have received at this hearing and press on? Morrow. Well I don't have any problem with the findings as they are done, I would like, and I don't think there was substantial testimony that changes the findings as prepared for us by P ~ Z. I would like to see it amended to incorporate some verbiage that handles the issue with respect to the fencing on the west property tine. Crookston: Mr. Mayor, I just have a comment, the city has no control whatsoever on any property that the school does. not own that is, let's call it in back of the fence. That is all the comment that I have. Morrow. I don't disagree with that but I guess position is by virtue of the school wanting to have the conditional use permit I think one of the stipulations of a conditional use permit ought to be that they control their kids on other folks property. If they can't control their kids on other folks property then maybe they ought not to have those kids there. Crookston: To my knowledge I don't think the school has any control over what the kids do on someone else's property. I agree with you but t see now way to require the school. to control that. It would be advisable and nice if they could do it but legally I don't think the city can require them to something for which they have no control over. Rountree: I believe our ordinances require perimeter fencing (inaudible) I think that would be applicable to this application and that is really all you can. ask the school to do is to put in appropriate fencing. Crookston: That is correct, what happens behind the fence it is not on the school property I don't think the school has any control over that. The city police might that is true. Corrie: Well you can put it as a condition of the conditional use permit that they have a chain link fence on the property to take care of that part of it and keep the kids on their side. Lorin Saunders, 688 East Sugarberry Drive, Eagle, was sworn by the City Attorney Saunders: When 1 first came to the Planning and Zoning for this rezoning I had tried previously to develop the property because it is in an apartment area I couldn't do the R-4 zoning because no one would build houses there that (inaudible) they didn't they could sell them in that area. I approached the Planning and Zoning staff on this and they recommend that I request an R-15 zoning. Since they have done that I, (inaudible) didn't know what zonings were available to me but since I have been given approval by the Planning and Zoning I have done some research on if. It was the right suggestion for me because it is very hard under the homes that we want to develop that (inaudible) duplexes the size we want to develop which require a two car garage and at least 800 square feet to get at least 8 units in an acre. We can probably do it under the R-15 zoning. There are some side benefits as well, I have talked to some realtors since that time and they have indicated the people who buy these units don't -want to be involved in a lot of yard work. So by being able to cluster the (inaudible) like that it gives the whole project a little more open space and the common area seems to be a little more visible, just a nicer project. So, I do appreciate the recommendation and that is why I am seeking the zoning. t have a couple of questions that are found on, in pages of the review by the City staff to you gentlemen. First on page 2, item 6, I have already mentioned that we can't develop it under R-4 it is just too big of houses and be able to sell it. In order for me to proceed any further on it I need to get some zoning changes in order to get financing to do the project. We have, towards the bottom of that page the Ada County Highway District has indicated that they prefer the Broadway Street not go straight through. The Broadway Street would cover most of the drainage ditch that goes down through that area by turning Broadway south and then going over to the back end of the property. When people would go down Broadway it would make that whole area would be a nice park area for Broadway on through the property where Broadway would extend otherwise. Meridian Planning & Z~g Commission March 11, 1997 Page 6 MacCoy: I have some corrections to make to the facts, page 4, the paragraph just above 8 there, it says additional fencing would be constructed (inaudible) to keep spectators blank, it should be "ofP' of the track, off is missing. On page 8, under paragraph 13, the applicant (inaudible) second sentence down, "the applicant is proposing at a minimum (inaudible) mixed path" etc. it seems to me that there is a sentence left out here. Johnson: Well let's read it here, "the applicant is proposing at a minimum compacted gravel or road mix pathway around. the west end of the football track field to the visitors bleachers", is there something you wanted to add to that? Do you think it reads clumsily? MacCoy: I think it reads clumsily, I think something was dropped out. I was just raising the question that maybe any of us. Johnson: It reads all right to me. Borup: I didn't have any question on it either. MacCoy:. On page 21, we have been pretty good about listing out the ADA requirements and this one here I haven't been able to find that spoken to. It says in fact on E about $/ the way down would be a logical place to put it. That is where we have been putting them. Johnson: It could be inserted in there as probably technically it is in there with all ordinances of the City of Meridian. MacCoy: Well we have been previously adding that as a line item. Johnson: We can certainly add that if you wish to do that and make that change at this time. Should we make that number one, after included but not limited to, would that be all right? MacCoy: Yes Johnson: So we will come up with the proper ADA wording there. Anything else? If not I will ask for a motion? Wayne Thowless, 1735 Federal Way, Boise, was swum by the City Attomey. Thowless: Mr. Chairman, members of the Commission on behalf of the Meridian School District I would. like to briefly give you an overview of the proposed project at Meridian High School. The High School currently at the varsity football field and track has a bleacher unit with a seating capacity of approximately 380 seats. The School District, the Board of Trustees has made the decision that the district needs to rely less on .Bronco stadium for home football games and hold the majority of the home games within the district at the home school field. That necessitates a significant expansion of seating at the high school. The proposal before you is to expand that bleacher seating to a total of 3416 seats. The parking lot at the high school has a capacity of 855 spaces and at a ratio of one parking space per 4 bleacher seats which is a well established ratio in jurisdictions around the country that would allow a total seating capacity of 3420. We are just under that. I am going to step over tp the drawing here and explain a bit more about the project. At the high school locatted basically at the comer of Linder and Pine the existing football field and track are behind or to the north of the main complex of buildings. tt is proposed that about 2/3 of the seating capacity would be on the home side of the field or the south side closest to the buildings of the high school Approximately 1/3 of the seating capacity would be on the .visitor side or north side of the field and track. There is an existing grass berm on that north side of the field which would be leveled to accommodate the new bleachers on that side. The field lighting for the track and the football field as you may be aware has already been constructed by the district so the project before you this evening is simply an expansion of the bleacher seating, a proposal to build a permanent and larger than presently exists concessions building and press box structure. In order. to accommodate the new bleacher seating on the south side of the field the relocation of two relocatable classroom buildings from the north side of the high school complex to just south of the parking lot north of Pine Street behind the existing pre-school building. There is currently no fencing of any type along the north boundary of the school property. It is Meridian Planning & Z~ng Commission February 11, 1997 Page 31 proposed as part of this project that a 6 foot chain link fence be constructed along this entire north property line behind the visitor bleachers and the visitor side of the field. Additional fencing would be provided within the track and football field complex itself to keep spectators off of the field and off of the track and also to segregate the visiting crowd from the home crowd to hopefully alleviate or minimize problems. In a nut shell that this the proposal of the school district. I would like to if I could before responding to questions, address the staff report which we and the school district have reviewed. The most significant item in that staff report is the question about toilet facilities for this bleacher expansion project. There are of course ample toilets within the Meridian High School complex, the permanent buildings. However the district has found from experience that opening their full facility for home football games or other major events that might be held in the stadium is very problematic from both a security standpoint and a maintenance and janitorial standpoint. Eagle High School as you may be aware developed a similar project to this approximately a year ago. This past fall held a series of home games there in a stadium with roughly the same seating capacity. At Eagle High School there is a permanent exterior restroom with doors that open to the outside of the building adjacent to the football field with four toilets in the men's room and four toilets in the women's room. At the home games the district augmented those permanent facilities with rental toilets and the exact quantity of those rental toilets varied from game to game but the principle indicated it ranged between 5 and 7. He also indicated, has indicated to us that seemed perfectly adequate for the crowds on hand. At least one. of those home games was absolutely sold out and the bleachers were filled to capacity. In the staff report, mention is made of some toilet ratios out of the uniform plumbing code for assembly and gathering type spaoes or facilities and a calculation was done by staff using those ratios out of the plumbing code and on page 4 of that staff report what the assessment is if you were to go with those plumbing code ratios the requirement would be for a total of 35 toilets between the two or divided between the two sexes. The school district feels based on their experience at Eagle High .School that is excessive. What the school district would like to propose is that a total number of toilets more in line with wfiat they have found with what is adequate at Eagle High School be provided for events being held in the stadium and those toilets not be required at least all of them to be permanent and not all to be handicapped accessible because the district would like to meet some of that facility need with rental toilets as opposed to a .large building permanent structure that would have that total number of plumbing fixtures in it. The district is certainly willing to open one or more of its buildings with permanent and accessible toilet rooms in it to crowds in addition to the rental toilets provided. But does feel the number of fixtures as proposed I the staff report is excessive. I would stand for any questions that you have. Johnson: Well since we are on that subject specifically for the maximum capacity they are looking at 21 water closets for females and 6 water closets for mails and 8 urinals. So combinations thereof would work. 1 have a question conc:eming the existing facilities that are somewhat adjacent to the track now. It is my understanding there are Meridian Planning & Z~g Commission February 11, 1997 Page 32 some on the eastern end of the building there are also some through the ag shop, is that correct? Thowless: Yes, there are restrooms that could be made available in the tower level of the gym and that is on the west side of the complex. And in the vo-ag building which is on the north side of the high school complex actually that is one of the closest buildings to the track and the football field. Johnson: I understand the problem of opening that up without some sort of control you would have to have that. But if those facilities were avail~le what would that do to the numbers in terms of the numbers presented here, I am not familiar with those facilities. Thowless: If both of those restrooms were opened up you would have more rest rooms more permanent rest rooms than they have been using at Eagle but not as many as proposed I the staff report. I don't have an exact fixture count for those. The school district would be willing and actually fully intends to provide rental toilets in addition just so that the walk is not as long especially from that visitors side of the field all the way to those permanent buildings. There are some people that legitimately would find it dift'ICUIt if not impossible to use the portable type of toilets. But for many people that would serve them just fine. And so the district understands that and at least one location a permanent and handicapped accessible facility would need to be made available and is willing to do so. Johnson: You have addressed your comments specifically toward football, do you see any other use that might necessitate or handling crowds of this magnitude? Thowless: The bleachers would also be used on occasion for track meets, track meets and football games would be the two principle uses of the facility. There may and this would be a very remote instance but there may be an occasion where some other special event might be held there but that would definitely r~o# be a typical occurrence. By and large the football game crowds would be probably the only ones that would actually fill to capacity the bleacher seating. Johnson: And we are talking what five or 6 of those annually? (Inaudible) Thowless: We have both a representative from the district and from the high school here that might be better able to answer questions about policies and use of the facility. Johnson: We can defer that then. On the, we don't like to be compared to Eagle but since you brought it up, because we are tougher than Eagle,. is there a projection or is there thinking down the road that maybe if we permitted temporary use I mean use of temporary facilities like the rental units, port-a-potties, that might be a short term solution down the road with funding or we might be build some more permanent facilities or are we restricted there in terms of space to build any permanent restrooms? Meridian Planning & Z~g Commission February 11, 1997 Page 33 Thowless: Additional permanent rest rooms to serve the field and the bleachers is definitely in the long range thinking of the district and the school. One thing that I have not addressed yet and when I am finished with this question I would like to is the issue of the press box and concessions facility that is proposed. That will not be constructed with district funds but will be constructed as a project of the Meridian High School boosters. On the ground level of that facility there have been discussions about possibly incorporating some permanent rest rooms there. That would not nearly be the number of total fixtures. as proposed in the staff report or even the total number of fixtures that Eagle is currently using but it would be a step in the right direction. Still additional permanent toilets might be constructed at some point in the future on the visitor side of the field. There are no concrete plans however at the present time to do that. The Board of Trustees has given no direction in that matter. It is simply a discussion item at this time. If I might go back over to the drawing I have a schematic design for the press box and concessions facility that is being planned at Centennial High School, the design and specifics of the structure to be built by the boosters at Meridian high is still in the formative stages and so I show you this just to give you some concept of what the general scope of what this press box and concessions structure will be. But it should be noted for the record that this is not the specific design that we may end up with at Meridian High School. Johnson: Let's quickly stay with this subject and see if the Commissioners have any questions if they don't then we can move on. Oslund: Thank you Mr. Chairman, I have a code of questions. How do you intend then to serve the handicapped users in the visitor area for restrooms? Thowless: They would at the present time have to use one of the restrooms in the main building. Oslund: So they would have to go around the track, around the fence, and I don't see anything in here that looks like a sidewalk, are there any sidewalks that would be on the outer separation? Thowless: We are proposing at a minimum compacted gravel or road mix pathway around the west end of the field to the visitor side bleachers. Oslund: How about in terms of noise, obviously there is going to be an increase in noise here are you proposing any mitigation for noise? Thow~ess: No, there is really no effective noise mitigation measures that the district could possibly afford. I mean basically the only thing possible is to build a huge barrier or sound wall which would be cost prohibitive for the district or to entirely enclose the facility which of could would likewise be prohibitive. Meridian Planning & Z~g Commission February 11, 1997 Page 34 Oslund: The auto occupancy that you have 4 per vehicle, what is the source of that number? Thowless: That is a ratio that is fairly typically used for high school gymnasiums and other assembly, the auditoriums and things of that nature at secondary schools. That is the ratio for example that Boise City uses. Ostund: Did you check it all with like ITE, the ITE parking .generation manual? Thowless: No Oslund: That is all I have MacCoy: To go back about what Greg brought up about the handicapped and the visitor section. You mentioned a path or walkway which is gravel. Thowless: It is a mixture of compacted sand and gravel, it creates a very hard surface that water can percolate through so it doesn't become muddy or rutty like typical topsoil or sod or turf would in wet conditions. MacCoy: I am concerned about somebody in a wheelchair type trying to get through there and that is pretty if it is not compact it becomes quite a job to do that. I had another one I can't think of it. Johnson: That is okay, we can come back to it, Mr. Borup do you have anything before he moves on. Thank you, go ahead and move on. Thowless: On both the home side and visitor side of the field there are some bleacher sections which are ten row and some which are fifteen row. The fifteen row tend to be closest to the 50 yard line. On the home side of the field behind the 15 row section of bleachers a press box structure of masonry or concrete base something like you see here is proposed with the (Inaudible) press box approximately 20 feet above grade. The press box itself would be approximately 40 feet long, S foot deep, fully enclosed with glass windows and be used for announcing score keeping coaching purposes. There would be a small camera platform on the roof. The press box would be accessible from both the aisles of the bleachers as well as stair to grade on the back side. Within the masonry or concrete base would be a concessions area. That concessions area depending on how the boosters decide they want to go with the project if it was developed with water and sanitary facilities they would actually do some preparation of snack items in there such as roasting hot dogs, popping popcorn, etc. If the boosters decide that plumbing that concession structure is cost prohibitive or undesirable for some other reason by health department regulations all that would be dispensed out of that concessions window would be fully prepackaged items that don't Meridian Planning & Z~g Commission February 11; 1997 Page 35 require any handling of food stuff by the people working in there. These elevations just give you a very basic idea, side views of that structure and bleacher seating coming off of it and front. The rear view with the concessions facility at grade and the front view facing the field showing the windows and the press box above the bleacher seating. Again, I need to reiterate that this is a concept that is being used in Eagle and there may be some variations when we are all said and done with exactly what takes place at Meridian this should be very close to this. Johnson: Do you have anything further to add? Thowless: I think that takes care. of my comments. Again we do have a couple of representatives from the district that may wish to make some comments. Johnson: If they wish to make comments at this time they may or may after the testimony from the public whichever they wish to do. Okay, is there anyone from the public that would like to address this application? Jim Reed, 3977 Thorn Creek-Court, Meridian, was sworn by the City Attorney. Reed: There were a couple of questions raised a minute ago about the bathroom facilities. I would like to show you where those exactly are on that one drawing. Johnson: Since there is no one from the audience that (inaudible) Reed: The bathroom facilities that are in the buildings that we would use would be in the gymnasium right here at the north end of the gym. It would be in the Ag building approximately right here and there is also, a comment was mentioned about the visitors handicapped access and there is bathroom facilities in the auto shop building. Visitors side here would be a little more convenient as far as accessibility. Johnson: I have a question to ask that I just don't know the answer to. On the rental facilities do they make, because I have never seen them, do they make handicapped facilities that are on a portable basis? (Inaudible) (Inaudible) Johnson: Anything else Jim? Reed: There was mention of the home games and there would be 3 varsity home games. We currently play sophomore games and freshmen games, have track meets. By far the bigger crowds would be the varsity football games and we just have 3 of those. Oslund: Three games per season then? Meridian Planning & Zr~g Commission • February 11, 1997 Page 36 Reed: That is how many this year, there might be four, vary a little bit. There would never be very many varsity football games. Johnson: Those games are played I assume all in the evening? Reed: The varsity football games would be in the evenings. Johnson: Not on Saturdays. Reed: They are in the evening, Friday night at our high school is when they would be played. Oslund: At what time? Reed: 7:00 Oslund: To? Reed: 9:30 or 10:00 Oslund: So by 10:00 things are pretty much wrapped up? Reed: Yes, they would be done and I think the plans we have right now would be to clear the crowd and shut the lights down and come in the next day for clean up. Johnson: Thank you, any other questions you have of the applicant? Mr. Carberry did you have anything to add at this point? Jim Carberry, 3283 Raindrop Drive, Boise, was sworn by the City Attorney. Carberry: I v~uld simply like to speak on behalf of Joint School District No. 2 Board of Trustees. We are all very excited to bring varsity football back to the City of Meridian. As you know we have been successful in doing that in the Eagle area, .I don't want to compare Meridian to Eagle I have heard some comments on that this evening but we are (inaudible) has been extremely exciting for us to do that. We have we of the Meridian school district and especially Meridian High School has been using as you know Bronco stadium since the late 70's. The use of the Bronco stadium has become more and more of a problem, not only for Meridian High School but for Centennial high school as well. As you realize that as this treasure valley grows the growth in traffic grows along with it. It is a hair raising exper~nce sometimes driving from the Meridian area to Broadway Avenue and Bronco stadium. We have lots of parents out there that are very concerned about that in fact some are so concerned that they won't allow children to go to these games. Now you are talking a 25 to 30 minute drive to the Meridian Planning & Z~g Commission February 11, 1997 Page 37 stadium. Other concerns of course is that it is a fairly large fee for our district to pay to rent and lease Bronco stadium. We would like to get out of that. Other concerns of course are scheduling. Currently we are scheduling 6 high school football teams into Bronco stadium. Once Boise opens their fourth huh school it will be seven. We are currently playing as you probably have heard and heard the screams many times playing Thursday night football games in Bronco stadium. We are even anticipating if we don't construct our facilities and get out of there that we will have to go to Thursday night double headers. Now realize that some of those Thursday night double headers, the first game would start at 6:15 the second game may start as late as 9:00 and that is on a school evening and we don't think that is conducive to high school football. Keep in mind that the Board of Trustees does not say that activity programs are the other half of education but they do play a very vital role in the total education process. Our kids and by saying that our students and our spectators are becoming disjointed with the football program. Granted we haven't had a great successful season for a few years, that may have attributed to some of that. But at the same time the drive to Bronco stadium, the Thursday night games, the late double headers have added to it also. For crying out loud we have to keep in mind that schools have to be a part of those students, students have to be part of the schools. Research has told us for years that students are more successful if they take pride in their school and they take part in their school. And because of those various reasons Hre would like to bring a facility back to Meridian High School so that we can play varsity football games here in the City of Meridian. Currently this coming season we would play about 3 varsity football games. If we got into a playoff later in the season that may be a fourth. Each year the number of varsity games will vary according to the home schedule. Some years there may be as many as five, this coming year for instance there may be only three. So that will vary. With that I would thank you for the opportunity to speak to you. I would turn it over to you and any questions that you might have. Johnson: Thank you, any questions for Mr. Carben~? Thank you, is there anyone else that would like to comment this evening? Greg Meyet, 795 West Overland Road, Meridian, was sworn by the City Attorney. Meyet: I guess I am go over for a minute with this thing. Well like I guess I have just written down some things about this. When like even at junior varsity or even like sophomore games I have seen people standing up out of the stands because the stands are filled because there is not only like other students but there is like their parents and all of that. I have seen people stand up because of that. wth the toilets, if they were opened up there would be an inconvenience with the further wise. Because it is like farther away and if they had the toilets then it would be more of a convenience if they were closer. With the inconvenience of the BSU games, if it was more convenient more people would come and then they would pay for the, more people would pay for concessions and it would be easier to raise funds for other school activities. Not just for like football games or sports but even academic needs such as Meridian Planning & ~g Commission February 11, 1997 Page 38 debate. Like traveling needs for competitions and stuff. About the wheelchair issue if they see that the track or that the pathway is not I guess up to the recommendations for that person in the wheel chair then they are probably just going to stay off to the south side if they wanted to. If they are more womed about themselves than just what side of the track they are on. I was tike looking at the thing and the bleachers are right beside the track and if like with the pathway if it is not as good as the wheelchair people see fit then can I am sure even with the rule that you are not supposed to be on the track I think they would let the people with wheelchairs use that track to get to the facilities were in the Ag building or the other building. I was _ thinking, speaking of debate because I am in it, we made over a $1000 in one night working concessions and that has helped us a lot to get to our competitions and stuff. If there was like, in our basketball stadium we have quite an amount of bleachers in there and with all the people we get a lot of concessions. So if there are more people with the other games that are outside by the field then 1 am sure we can raise a lot of money for that. That is all I have. Johnson: I have a question, not so much a question but just a comment and I guess a question. Under the current concession situation at Bronco Stadium now don't you have to share that revenue with another organization like Marriott or whoever it happens to be, Fine Host or whatever. Isn't a percent of that doesn't come to you that would come to you if you had the concessions at Meridian? In other vwrds you would get a bigger share? Meyet: I am not sure, I haven't worked concessions at BSU but if that was true, yes. Johnson: I am pretty sure (Inaudible) anyway you did a good job, Mr. MacCoy probably has a question for you about the wheelchair. MacCoy: On the wheelchair which you have already heard and spoken to, is that track a, one of the new type tracks. I have not seen this track and I know a lot of tracks are cushioned tracks which would make very good travel for a wheelchair or are they cinder track. Meyet: I am not sure what it is made out of. MacCoy: So really would you say we should go ahead and build a wa&way around there that a wheelchair can use so we wouldn't (inaudible) Meyet: Yes it would be better than (inaudible). MacCoy: One last part of that. Since this is a highly talked about project, this whole thing the bleachers and everything else, there seems to be a lot of school en#husiasm over this thing. Is there any student involvement in any of this material, like could they Meridian Planning & Z~g Commission February 11, 1997 Page 39 for example take on building a walkway or something and helping out? Or is that off limits to you people. Meyet: I am sure most kids would do it if they got paid for it Johnson: What we are talking about here is volunteer work. The people sitting up here in front of you are atl volunteers, we don't get paid with the exception of the attorney on the end. He is the only one that gets paid. Meyet: It depends on the student, I wouldn't really know. I am pretty sure there would be a few students that would be willing to help out. If they wanted a track like this which I think a lot of students would then I think they would help out. Johnson: I think if we wanted it bad it enough you could get plenty of students to help you out, I think you need to just test those waters. I think you will get a good response. MacCoy: Thank you very much Johnson: Anyone else? Alloys Schlekeway, 2090 West Pine, Meridian, was swum by the City Attorney. Schlekeway: I have some concerns with one I don't quite agree with four to one as far as parking is concerned. That will clog the streets I think. Four to one is reaching a bit to where it tends to be closer in between 3 to 1 and 2 to 1 in my opiinion. (End of Tape) my property borders, it would be the west boundary. The concern that I have is night time activities at the school tend to bring kids and 1 don't know, they can easy do smoking and chewing and drinking and stuff off of school property where they can't do it on school property because they get in more trouble for on school property. So they tend to go to buffering zones and typically a lot of kids smoke behind the fence. There is a wooden fence between the Ag shop there and the thing there. With that fence being wooden and completely hidden from the bleachers with the lights out there and the darkness behind the fence would tend to me add a zone for that kind of behavior and that is something that I wouldn't like on my property. They mentioned about putting a chain link fence on the north boundary but nothing on the west boundary. So I am concerned that wood fence is not much left of it. I have no buffer between that and my property. This will definitely change the value of my property oct that side with that much noise and that kind of activity because to develop that and people aren't going to want that exactly in their backyards so those lots would not be worth as much against that boundary. So that is a concern for me also. MacCoy: Do you think four times a year is too much? Meridian Planning & Z~g Commission February 11, 1997 Page 40 Schlekeway: I don't see four times a year, I see that many games a year but I also see the freshmen, the varsity squads, the sophomore games, the different squads. They are talking just the main games, I am talking other games and other schools like Kuna and different schools that don't have as good facility will wind up coming and using the better facilities for different tournaments. When tournaments are held in this area typically they go to different areas. So A-4 and stuff like that. So there is definitely, I know right now the plans are just for Meridian use but it always expands in the future. So I can see this being used 10, 15, to 20 times a year. That might be an exaggeration but I think they are part of and 4 or 5 (inaudible) those are my major concerns. Well a traffic light on Linder and Pine was one other one but I think that is already being address by Ada County on that. Johnson: We wouldn't have any jurisdiction over that anyway. I have a question, I am always interested when people talk about their property values going down. Have you talked to you Realtor about that or is this just your conjecture. We hear this but we never know the source of that comment. Schelekeway: That is my personal opinion as someone that is involved in the industry Johnson: Any further questions? Thank you, is there anyone else? Is there anyone representing the applicant that would like to respond to any of those concerns, about Kuna using the t'teld or whatever or maybe the fencing. Reed: Right now, we have no plans to let other schools use that facility. Now we are going to take great pride in taking care of that facility so we don't practice on that field, we practice on the west practice field. So, to let other schools come in and use it would be prohibitive of our goal there. The fence, at games the security will be, vue will have all the vice principals, we will have police, we will have our student resource officer from the school. So we will have heightened security. We don't want to cause problems with the neighborhood that is the last thing vwe want to have. So we are going to have more than enough security. We may have some varsity football coaches as added security. There are no guarantees on some of that where kids go, but security helps and I think the fencing that we have planned right now will help to where if you enter the home side then you. are on the home side you can't go into that west side open area. Now the visitors would enter and walk around the vuest side to the visitors side, they would have access to that fence and that field and stuff. The majority of the crowd on the home side would be fence in area, like 1 said added security. Johnson: Any other questions for Mr. Reed? Give me your opinion now as an educator and being in the profession for a long time do you think you have to pay kids to get them to help on a community project like this?
