undersigned a parcel' of land in Meridian Business Park. The agreement is conditioned upon,
among other things, their obtaining approvals necessary for the proposed bar use.
Please consider this as the undersigned's consent to the application by the Martells for the
related rezone and conditional use approvals, subject to the understanding that consent to the

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, at the hour of 7:00 p.m., on November 12, 1997, for the
purpose of reviewing and considering the Application of William & Lynn Martell, for a
Conditional Use Permit for approximately .93 acres of land located in the North 120
feet of Lot 7 & 8, Block 1 of Meridian Business Park, Boise Meridian, Ada County,
Idaho, and which property is generally located at Bower and East 5t" .The Application
requests a Conditional Use Permit for a bar and lounge.
A more particular legal description of the above property is on file in the City

during regular business hours.

SUBJECT: Request for Rezone from I-L to C-G with Conditional Use Permit for a Baz/Lounge
on 0.93 Acres by William and Lynn Martell
We have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
ANNEXATION & ZONING:
1. Applicant is proposing to rezone only a portion of two existing lots in the Meridian Business
and Industrial Park. A Lot Line Adjustment Survey will need to be prepared for approval by
the Meridian City Engineer and recorded prior to rezoning this property.
2. Anew legal description needs to be submitted prior to rezoning that reflects the adjusted lot
lines and makes reference to the recorded Lot Line Adjustment Survey. A copy of the legal
description that applies to the rezoned property, stamped "Review Approval", will be
forwazded to the City Attorney for his use in prepazation of the applicable Ordinance.
3. Applicant is required to rezone the property in order to place a bar on this property, as such
use is expressly prohibited in the I-L zone.
CONDITIONAL USE PERMIT
1. The plat for Meridian Business and Industrial Park shows an easement for the Hunter Lateral
running diagonally across the corner of Lot 8. In addition, the irrigation easement on the
westerly boundary does not appeaz to be the 40-foot width shown. Vacation of the existing
easement could be accomplished during processing of the Lot Line Adjustment Survey.
2. Revise site plan to conform to ACRD requirements and show centerlines of roadways,
property lines, existing adjacent easements, and all existing ~.nd proposed utilities. The

property boundaries shown on the site plan do not appear to be correct. A letter of approval
from ACHD will be required prior to issuance of a building permit.
3. City Ordinance Section 11-9-605.G. requires that 20-foot-wide planting strips be placed next
to incompatible features such as highways, raikoads, commercial or industrial uses to screen
the view from residential properties. Properties west of the proposed project aze residential.
As the Hunter Lateral has been piped within a 40-foot-wide easement along the entire
western boundary, it is unknown whether any landscaping besides lawn will be permitted in
this azea, so alternative buffering techniques should be considered. The Applicant is to
provide a minimum six-foot-high screening fence or wall along this western boundary. A
revised plan detailing a planting strip as approved by the P&Z Commission is needed prior
to action on this proposal. Detailed landscaping plans, including species and sizes of all
plants, will be required prior to submitting an application for building permit.
3. A minimum of one (1) three-inch (3") caliper tree per 1,500 square feet of asphah is required
per City Ordinance Section 11-2-414.D. Provide calculations of asphalt areas and locate
appropriate trees on site plan.
4. Provide fire access in accordance with the Uniform Fire Code and Meridian Fire Department
policies.
5. A screened trash enclosure is to be provided per City Ordinance. Provide details with any
application for building permit. Coordinate dumpster site locations with the City's solid
waste contractor, Sanitary Services, Inc. Locate dumpsters so as not to impede fire access.
6. Applicant to provide curbing and underground sprinkler system for all landscaped areas.
7. All driveway and parking areas shall be paved, with all driveway accesses approved by the
Ada County Highway District. Paving, striping and signage of pazking lot to be in accordance
with Meridian City Ordinance and the Americans with Disabilities Act. Driveway widths and
pazking stall lengths do not meet the requirements of City Ordinance Section 11-2-414; i.e.,
25-foot-wide driveway aisles with 9'x19' stalls and 23'x9' stalls for parallel parking stalls.
Revise site plan to conform with Meridian City Ordinance. Graveled driveways, pazking, and
access will not be allowed.
8. A drainage plan designed by a State of Idaho licensed architect or engineer is required and
shall be submitted to the City Engineer with calculations (Ord. 557, 10-1-91) for all off-street
parking areas. All site drainage shall be contained and disposed of on-site. Adjacent to the
northerly boundary of the platted lots lies a 5'x216' seepage bed which collects and disposes
of drainage from Bower Street. The seepage bed lies within an easement that needs to be
detailed on the site plan to determine where planting of trees will be permitted.

9. Applicant is to obtain a certificate of occupancy prior to opening for business.
10. All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City
of Meridian Zoning and Development Ordinance, the Uniform Sign Code, and shall receive
design approval of the Planning & Zoning Department. A-frame and other temporary signs
and banners will not be permitted and will be removed upon 3 days notice to the Applicant.
Sign permits are needed for all signage. The revised site plan needs to indicate all signage.
11. All building construction shall be in compliance with the Americans with Disabilities Act
(ADA) and all required Uniform Codes.
12. Applicant shall supply the Public Works Department with anticipated sewer and water usage
for analysis in determining assessment fee to be charged. Assessment fees will be determined
during the plan review process. A re-assessment agreement will be entered into with the
Applicant prior to issuance of a certificate of occupancy.
13. Provide parking lot lighting plans to the Meridian Public Works Department. Illumination of
the site shall be designed to not cause glare or adversely impact neighboring residential
properties, as determined by the City of Meridian.
14. Sewer and water services are stubbed into the property off of Bower Street. The treatment
capacity of the Meridian Wastewater Treatment Plant is currently being evaluated. Approval
of this application needs to be contingent upon our ability to accept the additional sanitary
sewage generated by this project.
15. Water service to this project is contingent upon positive results from a hydraulic analysis by
our computer model.
16. Provide signage for handicapped accessible stalls in accordance with ADA.
17. The conditional use, if approved, shall be subject to review upon notice to the applicant.

Facts and Findings:
A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting conditional use approval to construct a 4,050-square foot bar and lounge on Lots 7
and 8, Block 1 of Meridian Business Park. The` applicant is also requesting a rezone from I-L
(Industrial) to C-G (General Commercial). The'0.93-acre site is located on the southwest
corner of Bower Street and 5th Street. This development is estimated to generate 136
additional vehicle trips per day based on the Institute of Transportation Engineers Trip
Generation manual.
B. The application and site plan received by the City of Meridian and submitted to the District on
October 23, 1997, have been reviewed by'the ACHD Development Services staff and
conforms to applicable District standards/policy,'' or can be made to conform with the change(s)
to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by the ACHD Commission unless the site
plan is changed in such a manner'as to not conform with District standards/policy or an appeal
of the Development., Services staff decision is submitted as described within the Standard
Requirements outlined below.
The following requirements are provided as recommendations for conditions of approval to the City of
Meridian:
Site Specific Requirements:
1. Construct a 24 to 30-foot curb cut driveway on Bower Street located 37-feet east of the western
boundary. Delineate the driveway by using extruded curb, landscaping, bearms or any other
approved method by the District. Coordinate the delineation of the driveway with District
staff.

2. Construct a 24 to 30-foot curb cut driveway on Bower Street located 50-feet east of the back of
curb of 5th Street. Delineate the driveway by using extruded curb, landscaping, bearms or any
other approved method by the District. Coordinate the delineation of the driveway with
District staff.
3. Utility street cuts in the new pavement are not allowed unless approved in writing by the
District. Contact Construction Services at 345-7667 (with file number) for details.
4. Graveled driveways abutting public streets create maintenance problems due to gravel being
tracked onto the roadway. Pave the driveways their full required width of 24 to 30-feet to at
least 30-feet beyond the edge of pavement of Bower Street.
5. As required by District policy, restrictions on the width, number and locations of driveways,
shall be placed on future development of this parcel.
6. No access to 5th Street is proposed with this application and none are approved. _ _.
7. Other than the access points specifically approved with this. application, direct lot or parcel
access to Bower Street is prohibited.
Standard Requirements:
This decision of the Development Services Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by an owner of property within 300-feet of
the parcel within 15 calender days from the date of this report. The request shall specifically
requirement would result in a substantial hardship or- ineduitX. The request will be heard by
the District Commission at an evening meeting within 20 calender days of the District's receipt
of the appeal letter. The appellant will be notified of the date and time of the Commission
meeting.
2. After ACRD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two days of the action
and shall include a minimum fee of $110.00. The request for reconsideration shall specifically
identify each requirement to be reconsidered and include written documentation of data that
was not available to the Commission at the time of it's original decision. The request for
reconsideration will be':'heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.

3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein..
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the: applicant or its successors in
interest advises the Highway; District of its intent to change the planned use of the subject
property unless awaiver/variance of said requirements or otherlegal relief is granted pursuant
to the law in effect at the time the change in use is sought.
8. No change in the terms and conditions of this a}~proval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized'representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.

Conclusion of Law:
1. ACRD requirements are intended to assure that the proposed use/development will not place
an undue burden on the existing vehicular and pedestrian transportation system within the
vicinity impacted by the proposed development.
