Dear City Council:
On behalf of Mr. Dick Messersmith, Dick Messersmith, Inc., I respectfully request that you grant
the vacation of Gentry Way and the public utilities, drainage and irrigation easements lying
adjacent to Gentry Way in Amended Magic View Subdivision. The enclosed map indicates the
dedicated street right-of--way and easements in this vacation request.
This vacation request was initiated because the Idaho Department of Transportation vacated the
access to Eagle Road when the Eagle Road connector was constructed and the street now dead
ends. The only access is on Allen Street. Gentry Way is not occupied nor improved with street
improvements such as sidewalks, curb and gutter, and asphaltic pavement.
This request is submitted to you in accordance with the vacation procedures set forth by the state
of Idaho and the city of Meridian.

Mayor Corrie:
Please find attached to this memo an Ordinance repealing the above
Gentry Way public right-of-way. Please be advised that this matter needs to be
considered by the City Council because the City has a water line in this easement
and the ACRD would not grant the vacation that Ordinance 775 purported to vacate
without the payment of appraisal fee and the original applicant for the vacation
refused to pay the fee. I also understand from Bruce Freckelton that the City will
need this water line to connect and service parcels on the east side of Eagle Road.

ORDINANCE NO.
BY COUNCIL MEMBER
AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO, REPEALING
ORDINANCE NO. 775 VACATING THE PUBLIC RIGHT-OF-WAY KNOWN
AS GENTRY WAY AND THE EXISTING 10 FOOT WIDE PUBLIC UTILITY,
DRAINAGE AND IRRIGATION EASEMENT ADJACENT TO GENTRY WAY
IN LOT 12 AND LOT 13, AMENDED MAGIC VIEW SUBDIVISION, A
SUBDIVISION IN ADA COUNTY, IDAHO AND RECORDED IN THE
RECORDS OF ADA COUNTY, STATE OF IDAHO; AND PROVIDING AN
EFFECTIVE DATE; AND DIRECTING THE CITY CLERK TO RECORD THIS
ORDINANCE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Ordinance No. 775 vacating the public right-of--way known
as Gentry Way and the existing 10 foot wide public utility, drainage and irrigation
easement adjacent to Gentry Way in Lot 12 and Lot 13, Amended Magic View
Subdivision, a Subdivision in Ada County, Idaho and recorded in the records of Ada
County, State of Idaho, as instrument #97092909, be and the same is hereby
repealed.
SECTION 2: All ordinances, resolutions, orders or parts thereof in conflict
herewith are hereby repealed, rescinded and annulled.
SECTION 3: SAVINGS CLAUSE: This ordinance does not affect an action or
proceeding commenced or right accrued before this ordinance takes effect.
SECTION 4: DATE OF EFFECT. This ordinance shall be in full force and
effect within one (1) month after its passage, approval and publication, according to
law.
SECTION 5: At such time as this ordinance is in full force and effect the City

pursuant to a request by Brad Hawkins-Clark in his memo to me dated 05/07/99, a

AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO, REPEALING

EFFECTIVE DATE; AND DIRECTING THE CITY CLERK TO RECORD THIS
ORDINANCE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Ordinance No. 775 vacating the public right-of--way known
as Gentry Way and the existing 10 foot wide public utility, drainage and irrigation
easement adjacent to Gentry Way in Lot 12 and Lot 13, Amended Magic View
Subdivision, a Subdivision in Ada County, Idaho and recorded in the records of Ada
County, State of Idaho, as instrument #97092909, be and the same is hereby
repealed.
SECTION 2: All ordinances, resolutions, orders or parts thereof in conflict
herewith are hereby repealed, rescinded and annulled.
SECTION 3: SAVINGS CLAUSE: This ordinance does not affect an action or
proceeding commenced or right accrued before this ordinance takes effect.
SECTION 4: DATE OF EFFECT. This ordinance shall be in full force and
effect within one (1) month after its passage, approval and publication, according to
law.
SECTION 5: At such time as this ordinance is in full force and effect the City
Clerk is herein directed to record this ordinance.

Ree Repeal of Vacation Ordnance for Gentry Way
Bill,
On 11/5/97, the Ctiy Counai approved an ordnance to vacate the right-af~n-ay for Gentry WaY in the
Magic vew Subdivision (west of Eagle Rd., east of Allen St). However, ACHD did not appnwe the
vacation. Steve Amold in the ACHD Development Services Division tdd me that ACHD supported the
vacation in prinapai but, due to the applicant's refusal to pay ACHD fair market value for the land, the
application was withdrawn. The ACHD Commission dd not conduct a hearing on the application.
Preliminary plans are being drawrwp to develop the parrrel to the north of Gentry (adjacerrt to the south
of Texaco) which may take one aa~ss off of Gentry. Also, Public Works is planning to run utilities
underneath Gentry to service Hdiday Inn Express. So, the City ordinance is obviously null and vdd at
this point.
REQUEST: Can you initiate the process to repeal Ordnance #775?

Please find attached to this memo an Ordinance repealing the above
Gentry Wav public right-of-~vav. Please be advised that this matter needs to be
considered by the City Council because the City has a water line in this easement
and the ACRD would not grant the vacation that Ordinance 7 i 5 purported to vacate
without the payment of appraisal tee and the original applicant for the vacation
refused to pay the fee. I also understand from Bruce Freclcelton that the City will
need this water line to connect and service parcels on the east side of Eagle Road.

WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest of
said City to vacate the public right-of-way known as Gentry Way and
a portion of the utility, drainage and irrigation easement adjacent
to Gentry Way in Lot 12 and Lot 13, Amended Magic View Subdivision.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
Section 1: That pursuant to Section 50-1306A Idaho Code
and Section 11-9-611A, Revised and Compiled Ordinances of the City
of Meridian, specifically, and Title 50, Chapter 13, Idaho Code,
generally, the City of Meridian, having held the required hearing
and it appearing that proper notice of said hearing was given and
there being no objection, hereby vacates public right-of-way known
as Gentry Way and the existing 10 foot wide public utility,
drainage and irrigation easement adjacent to Gentry Way in Lot 12
and Lot 13, Amended Magic View Subdivision; a subdivision in Ada
County, Idaho and recorded in the records of Ada County, Idaho.
Section 2: WHEREAS, there is an emergency therefor, which
emergency is hereby declared to exist, this Ordinance shall take
effect and be in full force from and after its passage, approval
and publication as required by law.

Johnson: So this is a request for a vacation but not a public hearing is that correct? No
public hearing required this is just a request for a vacation?
Stiles: Yes
Johnson: Is Mr. Messersmith here or a representative?
Jacobs: Keith Jacobs, this piece of right of way Gentry Way doesn't have utilities in it,
no improvements over that land access to Eagle Road has been terminated by the
transportation Department of Idaho. The only access out of this property these two
properties would be back to Allen Street and we are just requesting that we vacate this
right of way and then proceed onto the Highway District.
Johnson: Makes sense to me, any questions of Mr. Jacobs?
MacCoy: I have one, looking at your map that was submitted with your material, I am
assuming after figuring out all of these lines and everything that it is 13 and 14 you are
talking about, 12 and 13.
Jacobs: 14 is part of the right of way now (inaudible).
MacCoy: Okay 12 and 13 which you have decided that you don't care to spend the
-money to go ahead and hook those up and just not develop those two pieces of
property is that the reason you are not going to do it?
Jacobs: As I understand it the property owners, there are tv+ro property owners the
owners of tot 13 and lot 12 wish to vacate this and apparently pool their resources and
either market or develop it as a unit. The remnant part of Lot 13 is such an odd shape
that it makes it advantageous to put the two together and that is what the hope is to
vacate that right of way and then they will have more land to develop. It is a dead end
street.

MacCoy: I see that, I was curious as to the reasoning behind this, I realize what they
have done to you here and you have already answered my question about the highway
going through because when I asked you about number 14 and how you were going to
handle that one.
Borup: I kind of have the same thing the line there showing the freeway that intersects
through Lot 13 isn't that what you just explained?
Jacobs: That is right yes that is the right of way.
Borup: Jacksons is on lot 11?
Jacobs: Lot 11 I believe yes.
Johnson: Thank you Mr. Jacobs, what would you like to do on the vacation request?
Borup: I move we grant the request for vacating Gentry Way.
Johnson: What we actually do is recommend they grant it to the City Council.
Borup: I move that we recommend to the City Council they grant the vacation of Gentry
Way in the Magic View Subdivision.
MacCoy: Second
Johnson: Moved and seconded we recommend to the City Council that the vacation be
granted, all those in favor? Opposed?
MOTION CARRIED: All Yea
Johnson: One further motion?
