The applicant, Walker Family Trust, requests Certificate of Zoning Compliance (CZC) approval to
modify the site plan approved with CZC-08-094. The proposed site plan changes include restriping the
parking stalls in front of the building from 90 degree stalls to 60 degree stalls. This proposed change will
decrease the number of parking stalls on the site from 31 to 28. In addition, safety signage is proposed
throughout the site to help facilitate pedestrian and vehicular traffic and reduce the amount of vehicular
congestion caused by the approved drive-through establishment (CUP-09-006). The subject site is located
at 2959 N. Eagle Road.
DECISION
The applicant's request for CZC is approved with the conditions listed in this report.
Note: This is not a building permit. Prior to any construction, you should contact Building Services at
(208)887-2211 to verify if any additional permits and/or inspections will be required
Site Specific Conditions of Approval
1. The site plan prepared by BRS Architects, dated 09/15/10, labeled SD1.3, is approved (stamped
"approved" on 09/15/10 by the City of Meridian Planning Department) no changes.
2. The site plan shall not be altered without prior written approval of the City of Meridian Planning
Department. The applicant shall contact the Planning Department for an inspection to verify all
changes approved on the site plan have been completed.
Process Conditions of Approval
No signs are approved with this application. Prior to installing any signs on the property, the
applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3
Article D and receive approval for such signs.
2. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The project is subject to all current City of Meridian ordinances and any applicable conditions of
approval associated with this site (CUP-09-006; CZC-08-094 and DES-08-028).

3. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.
4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
5. The applicant shall comply with the outdoor lighting provisions as set forth in UDC 11-3A-11.
6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangle consistent with the standards in UDC 11-
3A-3B.
7. The applicant shall have an ongoing obligation to comply with any applicable specific use
standards for adrive-through establishment as set forth in UDC 11-4-3-11.
8. The applicant shall have an ongoing obligation to maintain all pathways.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has
not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure/site
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until
September 15, 2011.
CITY COUNCIL REVIEW
The applicant, Director, or a party of record may appeal this decision or a condition of approval by
requesting City Council review of this decision. All requests shall be filed in writing with the Planning
Department within fifteen (15) days of the date of this report and comply with the provisions of UDC 11-
SA-6B.

CZC MODIFICATION
NARRATIVE
The parking lot will be modified to transition from 90 degree parking to 60 degree parking to help
promote the one way drive-way. There will be painted signage on the parking lot indicating separate
"drive-thru"and "thru-traffic" lanes. A painted "stop-bar" will be painted on the parking lot near Jimmy
Johns sign board to help promote an open drive aisle for safety.
SIGN PERMIT
NARRATIVE
There will be five (5) freestanding signs placed upon Pad A at Mason Creek. The signs will include the
following:
1) Upon entrance into Mason Creek from Eagle Road, turning into the front parking area of Pad A,
one (1) free standing sign stating "More Parking in Back" will be placed near the southeast
corner of the sidewalk area.
2) Turning right into the parking area on the east side of the building, one (1) freestanding sign
"Drive-Thru Customers Keep Right" will be placed near the south-east park of the entrance.
3j Turning right into the parking area of Pad A, one (1) freestanding sign stating "One Way" with an
arrow pointing north, will be placed on the eastern side of the property (near Eagle Road).
4) One (1) freestanding "Stop" sign will be placed east of Jimmy Johns sign board to eliminate drive
thru customers blocking the "thru-traffic" lane.
5) One (1) freestanding sign stating "Do Not Enter" will be placed near the northwest corner of the
property at the end of the drive-thru lane indicating one way traffic.
