Dear Property Owner:
As a condition of the rezoning of the one acre (f) parcel at the northwest corner of Cherry Lane
and Ten Mile Road to a Limited Office (L-0? zone, the Meridian City Council approved the
rezoning contingent upon a site plan being approved for development ofthe property, with input
from the neighbors. To meet this requirement, the City Council will review this site plan during
its regularly scheduled meeting on Tuesday, April 15, 1997. The meeting will begin at 7:30 p.m.
Although this is not a noticed public hearing, your verbal or written questions or commerns will
be considered at the meeting.
Enclosed is an 8 '/z x I 1 site plan of the proposed office building. Detailed plans will be available

Dear Commissioners:
In December of 1994, James W. and Lois Jean Fuller requested rezoning of their
property at the northwest comer of Ten Mile Road and Cherry Lane from R-4 to L-O.
Also requested at that time was a conditional use permit to allow construction of a
convenience store. Although the City Council approved of the rezoning to L-O, the
request for a convenience store was denied. It was felt that an office would be a more
appropriate use of the property. A condition of the rezoning was that any use of the
property would undergo site plan review by the City Council with input from the
adjacent property owners. No additional public hearings were to be conducted.
On January 3, 1995, the Ada County Highway District Commission acted on the
rezone and conditional use applications for the property. The facts and findings acted
upon by the Commission approved aright-in/right-out access to Cherry Lane with
installation of a raised median on Cherry Lane paid for by the developer.
In March of this year, the City was approached with a proposal for a doctor's office at
this same location. Knowing that this was desirable from the viewpoints of the City
and the neighbors, the applicant proceeded with due diligence to ascertain conditions of
the rezoning so they could comply.

The City made available copies of the Commission's conditions of approval, as well as
comments of staff and other agencies, to allow them to design the site in accordance
with those approvals. Property owners near the site were notified and the site plan
review was scheduled for April 15, 1997. With input from the neighborhood, the
Council granted unanimous approval of the site plan. The project was well thought out
and welcomed to the neighborhood.
We have now learned that ACHD staff has made a determination that the curb cut on
Cherry Lane should be eliminated. An appeal of this determination was denied by the
ACHD Commission on May 15, 1997, with the simple statement that if they needed
two accesses, they should look for another site. This, is an extreme hardship on the
applicant. A foundation permit was issued on May 1, 1997, and construction has
commenced.. We request that you reconsider your denial of the request, and that you
honor the original requirements of the proposed convenience store, allowing aright-
in/right-out access to Cherry Lane, with construction of the deceleration lane and
median by the applicant.
The Meridian Fire Department is also requesting that the access remain open for access
and safety reasons. The site clearly functions better with two accesses, and the
applicant never had reason to believe that a curb cut approved for a convenience store
would not be acceptable for an office use.

On May 14, 1997, the Com>aaission denied the applicant's appeal of the prohibition of a
driveway on Cherry Lane. The Ciry of Meridian has written a letter to the Commissioners
citing the history of the parcel and requesting that the Commission apply the conditions of
approval for a previous development for the proposed office use (letter attached).
On January 4, 1995, the Commission reviewed an application for a rezone from R~ to L-O
to construct a convenience store/gas station on the subject site (report attached). The report
for that application contains the following Facts and Findings:
~l4 ...The optimrvn offset for access from an intersection of two arterials with a 3S mph
speed limit is 330-feet, This offset allows for stacking lanes for left turns to Ten Mile
Road and the grocery store and a transition between the stacking lanes.
One access to Cherry Zane is proposed with an offset of .i30-feet from the intersection
with Ten Mile Road and 125 feet from the intersection with Sugar Creek Drive. This
access interferes with the stacking lanes described above and leaves no designated
place of refuge for vehicles turning left into the proposed convenience store from
Cherry Lane, Therefore, staff recommends that the access be allowed for right-
in/righr-out turns only with a raised median installed on Cherry Lane paid for by the
developer.
ll5 One access to Ten Mile Road is proposed with an o,,~set of 227 feet from Cherry Lane.
Staff recommends that this access be shifted north 20 feet and the radii on the curb
returns be reduced from 30 feet ro IS feet.

According to the attached letter from the City of Meridian, in March of 1997, the City of
Meridian "was approached with a proposal for a doctor's office at this same location.
Knowing that this was desirable from the viewpoints of the City and the neighbors, the
applicant proceeded with due diligence to ascertain conditions of the rezoning so they could
comply. The City made available copies of the Commission's conditions of approval, as wel!
as comments of staff and other agencies. Property owners near the site were notified and the
site plan review was scheduled for April 1S, 1997.°
Chronological history:
The applicant called staff to diswss access to the parcel. On February 2S, 1997, staff
visited the site and determined that the site had insufficient frontage on Bather Cherry
Lane or Ten Mile Road for aright-in/right-out driveway that meet the District's
current required offset of 220-feet from the intersection. Staff told the applicant that
staff could support a variance for a driveway on Ten Mile Road aligned with a
driveway to a church on the east side of Ten Mile Road, but staff would recommend
that access to Cherry Lane be denied.
• The applicant verbally stated his objection to staff regazding the access restriction on
Cherry Lane. Staff responded that the applicant should make a written request for the
access and once staff made a written denial of the driveway, the applicant could appeal
staff s denial to the Commission.
• The applicant made a written request for a driveway on Chesxy Lane that is dated
March 7, 1997, but stamped received by the District on Apri14, 1997.
• On April 15, 1997, the City of Meridian reviewed and approved the site plan for the
proposed doctor's office.
• On Apri123, 1997, District staff wrote a letter to the applicant denying the requested
access to Cherry Lane.
• On Apri128, 1997, the applicant wrote a letter appealing staff s decision to the
Commission.
• On May 1, 1997, the City of Meridian issued a foundation permit.
• On May 14, 1997, the Commission denied the appeal.
It should be noted that the City of Meridian reviewed and approved the site plan for the
proposed doctor's office on April ZS, 1997, at which time, the applicant was already aware
that ACRD staff was not supportive of the driveway to Cherry Lane, It does not appear that
the applicant made this information available to the City of Meridian. Staff continues to
support a single driveway to the site from Ten Mile Road, without access to Cherry Lane.

The applicant is appealing staff s decision to deny a driveway on Cherry Lane that does not
comply with District policy. This application is being reviewed through the building permit
process. Attached are three letters, one from the applicant requesting the driveway, one from
staff denying the driveway, and another from the applicant appealing staff s decision.
The site is located at the northwest corner of Ten Mile Road and Cherry Lane. The applicant
is proposing to construct a medical .office building with a driveway~on Ten Mile Road and a
driveway on Cherry Lane. ,Staff has approved a driveway oa Cherry Lase in alignment with
an existing church driveway on the east side of the street. This driveway will likely be
restricted to right turns in the future due to its proximity to Cherry Lane. The applicant is
concerned about the ability of future customers to access the. site from directions other than
southbound on Ten Mile Road ~ ~ ••
The site has 165-feet of frontage on Cherry Lane, which is insufficient frontage to .allow either
a full access driveway offset 440-feet west of Ten Mile Road or a right-inlright-out driveway
22U-feet west of Ten NSile Road. This is an intersection of two arterials. •Staff does not
support a variance for a driveway on Cherry 7 ane. The applicant should consider choosing a
different lot, if the applicant would like additional access points.

The site is located at the northwest corner of Ten Mile Road and Cheery Lane. The dwelling that was at
site has been removed. A l7-foot wide curb cut was constructed on Cherry Lane for the dwelling. The
cut was for the existing residential use, if a new development is proposed for the site, the driveways will
revaluated for compliance with District policy.
Staff has reviewed your request for a curb cut driveway on Cherry Lane both through apre-application
meeting and again with your written request. You have requested a curb cut driveway, located 134-feet
of Ten Mile Road. As stated in your letter, the requested curb cut does not meet the required District ofi
from Ten Mile Road of 440-feet for a full access driveway or 220.feet for aright-inlright-out driveway.

submitting a written response that specifically identifies why staffs determination would result in a subs
hardship or inequity. The written request shall be submitted to the District within 2 weeks of the date of
letter.

1 have reviewed the staff analysis of the proposed Family Physicians site on the northwest corner of
Ten Mile Road and Cherry Lane in Meridian, Idaho with the current owner who desires to locate
their office on this property. The owner wishes to pursue an appeal of staff determination to the
ACHD Commission. .
This site will be accessed by motorists from all four legs of the intersection of Cherry Lane and Ten
Mile Road. A single entryway off Tea Mile would cause difficult traffic movements and general
confusion to drivers trying to make it to their medical appointments. ~As shown in the attached
diagram, motorist from three legs of the intersection would be required to hold in the center
northbound lane on Ten Mile while waiting for southbound traffic to clear, then cross two lanes, plus
the stacking lane for traffic twining east onto Cherry Lane. Additionally if a future right in right out
is enforced, az stated in your letter, motorist would only be able to access the site while heading
south on Ten Mile Road.
In conclusion, the applicant feels the restrictions presented by ACRD sta$'will cause a hardship to
both the clients trying to access the site and the general traffic flow. Therefore they desires to make
these improvements to the site to enhance their accessibility and the general traffic flow on adjoining
streets and requests the Districts approval..

The purpose of this letter is to determine ACRD procedures to request commission level approval
of an access to the proposed Family Physicians site on the northwest corner of Ten Mile Road and
Cherry Lane in Meridian, Idaho.
There is currently a curb cut on Cherry Lane constructed at 17 feet wide and we are proposing to
widen it to 30 feet. After preliminary review by ACHD sta$ it has been determined that because the
site has only I65 feet of frontage on Cherry Lane, we do not meet the Districts criteria of 220 feet
from Ten Mile Road, to allow a full turn entry.
This site will be accessed by motorise from all four legs of the intersection of Chevy Lane and Ten
Mile Road. A single entryway off Ten Mile would cause di$'icult traffic movements and general
confusion to drivers trying to make it to their medical appointments. As shown in the attached
diagram, motorist from three legs of the intersection would be required to hold in the center
northbound lane on Tea Mile while waiting for southbound traffic to clear, then cross two lanes,
plus the stacking lane for traffic turning east onto Cherry I:ane. Additionally motorist anticipating
an entry on Cherry Lane and not finding one would have to turn around and make the approach again
to look for the Ten Mile entry;
The proposed driveway would be:
a: 30' wide.
b: Located 134 if from the intersection of Cherry Lane and Ten Mile Road, as measured from
the west curb on Ten Mile to the east side of our driveway.
In conclusion, the applicant desires to make these improvements to the site to enhance their
accessibility and the general traffic flow on adjoining streets and requests the Districts approval. .

width of 30-feet with 15-foot radii and that the access on
Mile Road be limited to a maximum width of 40-feet with
foot radii to accommodate simultaneous left and right tt

In October, 1996, Dr. Geoffrey Swanson met with this Board to present preliminary drawings and
specifications for a medical facility on the former Fuller property. In November, 1996, he presented more
detailed information on the proposal at a general meeting of all Homeowners. All of the forty-plus
attendees recognized the desirability of the proposed facility and several expressed appreciation for the
opportunity to comment--before construction. Dr. Swanson answered all questions and took all comments
into consideration.
On Macch 27, 1997, Dr. Swanson presented the updated plans to the Boazd. We were very pleased with
the building design, placement on the lot, and landscaping and Dr. Swanson was very amenable to our
suggestions to modify the lighting. We believe this facility will be esthetically pleasing and provide a
valuable service to the azea.
Although individual homeowners may suggest modifications at the April 15th public hearing, this Boazd
supports construction of the facility and recommends that it be approved.

Yaka: My name is Clinton Yaka, office address 1087 W. River Street in Boise,
representing Family Physicians of Meridian. I can point out at this time that Dr. Jeff
Swanson is in the audience if there are any questions for him. We are requested by
Ms. Stiles to be here to answer any questions on our site plan for the physicians office
on Cherry Lane and Ten Mile.
Rountree: Do you have an elevation of the building? I have one more question, what is
the approximate square footages and how many offices?
Yaka: It is approximately 6500 square feet, there are tentatively 3 doctors with the
potential of four.
Rountree: That is all 1 have.

Corrie: Anybody else? Anybody else, Shari or staff? This is just a request just a review
at this point.
Morrow: The issue is from my perspective I don't have any problem with either the
elevation, the design or the site plan. I guess the question is Shari what specifically do
you want from us in terms of this proposed project?
Stiles: Councilman Morrow, Mayor and Council, the decision by the Council when this
came through for the rezone when they proposed a conditional use permit was that it
would receive site plan review with input from the neighbors. As I really didn't have
another forum to do that I thought it would be best if it was in the public forum and have
anybody in the neighborhood that wished to make comment on it to be able to do that.
Bentley: Mr. Mayor, have the neighbors been notified on this?
Stiles: Yes
Corrie: I guess my next question is are there any neighbors out here that want to say
anything?
Matthews: My name is Linda Matthews, the question I have is with the fencing, my east
end of my backyard is up against their west property end property. I am going to have to
move my fence, my fence is over the line mainly because the trees are right on the line.
My question is when and what kind of fencing is going to go up?
Yaka: It will be a six foot high cedar fence to manage the existing fence that is there
now.
Matthews: When would that go up because I need to take mine down and my question
is I really don't want to take mine down until that one goes up.
Yaka: We will take it down for you and put it up.
Matthews: At the same time, as soon as you take mine down you will put that one up?
Then also I had a question with the lighting. I don't know the hours of operation for this,
is this just like 8 to 5.
Rountree: Doctors hours.
Swanson: Most of the time the hours would be 8 to 5, there is probably the potential
with the way that society is become double income we might- run hours to 7:00 but that
would probably (inaudible) unless there is an emergency or somebody needs to be
seen late in the evening.

Swanson: Not at least in the foreseeable future.
Matthews: As far as lighting then it would be just like a security type of lighting?
Swanson: Yes, just enough for security around the building, it is not going to be another

Swanson: I am going to try and leave those there and we will make a decision on which
side of the trees to put the fence.

Rowhand: My name is Jerry Rowhand I live at 3255 W. Woodmont. I would just like to
thank Dr. Swanson for being as candid and open with the neighbors and working with
the neighbors on this project. We are all for it. I wish that we could have better
neighbors in the City actually like Dr. Swanson coming and wanting to get involved with
the neighbors, make sure that everybody .is happy and to try and convenience
everybody and make this a good project and make it work. I think we can live with the
dust in the construction and all of that for the sake of being a good neighbor. Thank you.

Shelton: My name is Ken Shelton; I live at 3225 W. Woodmont Drive in Meridian. Mr.
Mayor and Councilmen, Mr. Crookston, Mr. Berg and ladies and gentlemen I would like
to express my appreciation to Dr. Swanson for having met with the Cherry Lane Village
Homeowners Association and those residents in Cherry Lane Village. He has been
very candid, during the initial design phase of his project several concerns which we
expressed to him have been satisfied I believe to the majority of our residents. Lighting
the general design of the structure and its aesthetics were discussed and they offered to
build us a new fence between the 'residents and the building property. The aesthetic
design of the building will fit in quite well with our Cherry Lane Village residential project.
The lighting scheme, as early or as late as this afternoon I have spoken with Mr. Leslie
Stith of Engineering Consultants and he has assured me that it will not be offensive, that
it will be security oriented and reflect in no way to intrude on the neighbors. Again I
would like to thank Dr. Swanson for his concern and I believe he will be a welcome

neighbor in our neighborhood. So therefore I would like to give my full support to this
project. Thank you.

Croft: Vernon Croft, I live at 3410 Woodmont Drive, on four separate occasions Dr.
Swanson has met either with the homeowners association general membership meeting
or the Board of Directors. We are 100% behind this particular project because it fills the
bill for the corner lot at Ten Mile and Cherry Lane. Again my appreciation to Dr.
Swanson for all of his support.
Corrie: Anyone else from the public? I would like to thank the public for forgiving me for
not bringing this up earlier. Council, Mr. Bentley?
Bentley: I have one question for the developer. On the signage, I notice on the map you
are going to have a sign by the street, what are we looking at?
Swanson: Probably we are going to look at a 4 or 5 foot monument sign out front. I
haven't decided yet whether we do something that is backlit or have a light shining on
the sign. Something small, a monument sign.
Morrow: Follow up question Mr. Mayor, are you describing a sign that I am very familiar
with on Ustick just east of Milwaukee there is a couple of three or four dental offices that
have monument signs that are low profile. Are you familiar with those signs.
Swanson: Ustick east of Milwaukee, I am not sure I am familiar with those. But they are
a standard professional office sign, about as high as the podium is.
Morrow: I believe that is what you are describing because each of those offices, Clint
are you familiar with those, did you guys draw those and that is what he is referring to.

association do anything but complain about lots of stuff. So it is a tribute to you Vem
