Pursuant to established procedure, NOTICE IS HEREBY GIVEN that the Meridian Planning and

The existing use is a retail store by the name of D&B Supply. The
present use of the subject property is a small area in the front
northwest corner of the parking lot. This area is not in use at this time,
and our use will not take any parking spaces from the said business.
Our proposed use is to provide an automobile emission testing van
for the residents of Ada County. We are already located just west on
Fairview at Locust Grove. The business where we are located is AMT
a used auto parts salvage and wrecking yard. The parking area of the
business is very small and traffic at the intersection makes it hard at
times for customers to access our business. We have also recently
purchased a new van that is very attractive and we wish to relocate at
D&B Supply which we feel is a more desirable location.
The subject property (D&B Supply) is desirable for this use because it
is very spacious and open. The corner of the parking area where we
will be located is away from parking lot entrances and will not inhibit
traffic flow in any way.
I agree to pay any additional sewer, water or trash fees or charges, if
any associated with the use of this property.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, at the hour of 7:00 p.m., on March 11, 1997, for the purpose of
reviewing and considering the Application of Idaho Air, for a Conditional Use Permit for
land located in a portion of Lots 8 through Lot 13 of Pleasant Valley Subdivision, Boise
Meridian, Ada County, Idaho, and which property is generally located at 1725 E.
Fairview Avenue. Application requests a conditional use permit to provide an
automobile emission testing station for the residents of Ada County.
A more particular legal description of the above property is on file in the City
Clerk's office at Meridian City Hall, 33 East Idaho Street, and is available for inspection
during regular business hours.
A copy of the Application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.

The Ada County Highway District (ACHD) staff has received and reviewed the application
and site plan for the item referenced above. This item will not be heard by the ACHD
Commission unless the site plan is changed in such a manner as to require Commission
review .
All future design plans and construction shall be in accordance with the Ada County Highway
District Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived in writing by the
District.

Corrie: Would you like to come up and give us a briefing on what you had there and
then we will go from there.
Hanson: Thank you Mayor and Councilmen, sorry about keeping you late here. Well,
basically I just want to move my van from the existing location ftom the Auto Salvage
there on Fairview, ATM and go right down to D and B. I think it is a more attractive
location, more room and I just don't like to be around a situation where they haul
wrecked cars around. So I have another van plus this on in Boise, I operate two of
them. I just want to have them at real nice shopping centers. It looks nicer and that is
basically why I applied for the conditional use. permit.
Corrie: Alright, Council, questions?
Rountree: Have you read the findings of fact and conclusions of law?
Hanson: Yes I have Mr. Rountree.
Rountree: Do you agree with those?
Hanson: Yes I do.
Bentley: You understand the signage issue?
Hanson: You might go over that one more time because I know there is, I am willing to
conform to any kind of a sign issue, although I do like to have something out that kind of
states that I am open. I can attach that to the van and take it in. The way we operate
right now is I don't like A-frame signs but I have in Boise a sign in Boise that is on a
pole. But it comes down every night. I don't know if that is something that would be
good. It would be real close to my van and come down each night.

Bentley: In a follow up, where are we at with telling them about the A-frames, D & B?
Don't they have signs out in the grass. It is kind of hard to tell him he can't do it when

Stiles: Because of their requirement for off street parking I think the applicant at first
thought was her property that went clear out to the road. In fact there is an 80 foot right
of way in there so clear to the sidewalk is ACRD right of way. It is a lot of dirt in
between the pavement (inaudible)

Egbert: I am the co-owner of Idaho Air along with Joseph Hanson who submitted the
application to you, he was unable to be here tonight so I am here to discuss the matter
with you and answer your questions. I will try to be brief. We have had an emission
testing van in the city of Boise for ten years, it is located near the corner of Fairview
and Five Mile. Avenue, in the shopping center there and we have been good tenants in
that shopping center and have not had any trouble during that period of time. Last fall
the citizens of Ada County voted on whether to continue the current emission testing
program or move to a new program and the vote was to continue, the public wanted to
continue with the current emission testing program. At which time. we decided to
purchase a second van which we did and located it in Ada County at the salvage yard
the ATW salvage yard which is actually only a couple hundred yards from the location
to which we wish to move our van. Quite frankly we wished a little more, little nicer
location for our service than the salvage yard and we located at D & B Supply and
proposed to them that we move our service into their parking lot which was not, the
portion of the parking lot which is never used for customers. They were in agreement
with that proposal. However they are in the City of Meridian which is the reason why we
came here for the approval before you tonight. Concerning the conurtents, the only
comments were by the City Engineer and Ms. Stiles. The first comment suggests that
the City of Boise licenses the emission vans for $180 a year was a bit of a surprise for
us since. we have never been billed for that in the last 10 year Mess they have
forgotten us. That would- be a bit of a surprise. We were the third emission testing van
licensed in Ada County so we have been there for quite a while. All of the other
suggestions are very reasonable and I really appreciate the tone of the suggestions.
They are not as a commandment but rather a willingness to work, requesting us to work
with the members of the Planning and Zoning Commission to make our emission
testing van more safe and more appealing to the public. We are happy to do that. So
that is all I have to say.

MacCoy: Your contact with D & B, was that Rod Schneider?
Egbert: Yes, it is Mr. Schneider.
MacCoy: You realize that he is doing this month by month, that was okay with you?
Egbert: Yes we have had that agreement for 10 years with the Plartation shopping
center and that seems to work nicely for us.
MacCoy: I didn't know (inaudible) not that Rod is going to throw you out into the street
but are you going to be back in there in another 6 months?

Johnson: This is not a public hearing, will the applicant address the Commission.
Eddy: My name is Tom Eddy, I am from Pacific Land Surveyors at 290 Maple Grove
Road in Boise. This is misleading. This is a vacation of an easement on the west
boundary of Lot 36, Block 1. There has been a lot line adjustment made when Lot 36
was platted in Haven Cove No. 5 it was a large lot, some 14,000 square feet. Then
when Haven Cove No. 5 was platted there was a smaller lot adjacent to Lot 36 which is
Lot 50 I believe it is. The plan was to combine the two and make, to combine the lots
and make 2 8,000 square foot lots with the lot line adjustment. Well Haven Cove No. 5
put an easement on the west boundary of Lot 36 and we are here to vacate that
easement, there are no utilities in it. We put a utility easement on the lot line
adjustment which makes the two lots 8,000 square feet (inaudible).

Following are comments to be considered during your review of this project:
The applicant is currently stationed in Ada County in front of the salvage yard on Fairview
Avenue. As the City has no formal process for approval of these vans, and all uses on the
D&B property were contingent upon obtaining a conditional use permit, the Applicant
was requested to submit this application. Boise City licenses auto-emission test vans on a
yearly basis for $1 S0.
2. As Fairview Avenue is an entrance corridor to the City, the existing landscape setback
shall not be encroached upon.
3. Signage will receive design review by P&Z star; no signage shall be erected without a
permit. A-frame (sandwich boards) and other temporary signs shall not be permitted. If
the application is approved, a condition should be that signs not in compliance with the
conditional use permit can and will be removed by the City upon 3 days notice to the
applicant. The signs currently in use at the present location will not be permitted.
4. The proposed location of the van could lead to traffic conflicts once the property to the
west is developed. The proposed customer path would leave only 9' between the
customer path and existing striped parking spaces. The van should be located further
away from the existing driveway access on Fairview Avenue.
This conditional use permit shall be subject to review by the City Council upon notice to
the Applicant.

The above entitled application for a conditional use permit
having come on for public hearing on March 11, 1997, at the hour of
7:00 o'clock p.m., William Egbert for the Applicant appearing in
person, the Planning and Zoning Commission of the City of Meridian
having duly considered the evidence and the matter makes the
following Findings of Fact and Conclusions of Law:
FINDINGS OF FACT
1. A notice of a public hearing on the conditional use
permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for March 11, 1997, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the March 11, 1997 hearing;
that the public was given full opportunity to express comments and
submit evidence; and that copies of all notices were available to
newspaper, radio and television stations.
2. The property which is the subject of this application is
located within the City of Meridian at 1724 East Fairview Avenue,
Meridian, Ada County, Idaho. The legal description of the property

is included in the application, and by this reference is
incorporated herein as if set forth in full.
3. The Applicant is not the owner of record of the property.
The record owner of the property is Schrandt Family Limited
Partnership, and it has consented to the application for the
Conditional Use Permit.
4. Pursuant to the application, the Applicant intends to use
a small portion of the northwest area of the parking lot on the
property to operate an automobile emission testing van. This area
is not presently in use, and the Applicant's use of the area will
not decrease the number of parking spaces of the business located
at the property.
5. The property is currently zoned (C-G) General Retail and
Service Commercial. The (C-G) General Retail and Service
Commercial is described in the Zoning and Development Ordinance,
11-2-408 B. 12. as follows:
SC-G) General Retail and Service Commercial: The purpose
of the (C-G) District is to provide for commercial uses
which are customarily operated entirely or almost
entirely within a building; to provide for a review of
the impact of proposed commercial uses which are auto and
service oriented and are located in close proximity to
major highway or arterial streets; to fulfill the need of
travel-related services as well as retail sales for the
transient and permanent motoring public. All such
districts shall be connected to the Municipal Water and
Sewer systems of the City of Meridian, and shall not
constitute strip commercial development and encourage
clustering of commercial development.
6. Ordinance 677 of the City of Meridian pursuant to which
the property was annexed into the City of Meridian and zoned (C-G)
General Retail Service Commercial provides in part, "that the

annexation and zoning is subject to the conditions referenced in
the Findings of Fact and Conclusions of Law as adopted by the
Meridian Council on the request for annexation and zoning." The
Findings of Fact and Conclusions of Law adopted by the Meridian
Council for annexation and zoning of the property states in part at
paragraph 13. of the CONCLUSIONS, ". any use or development of
the property shall only be allowed as a conditional use with design
review." Consequently, a conditional use permit for the operation
of an automobile emission testing van at and upon the property is
required.
7. Conditional Use Permit is defined in the Zoning and
Development Ordinance as follows: "Permit allowing an exception to
the uses authorized by this Ordinance in a zoning district."
8. The Assistant to the City Engineer, Hruce Freckleton, and
the Planning and Zoning Administrator, Shari Stiles, submitted
comments which are incorporated herein as if set forth in full.
Their comments included, but are not limited to, the following:
a. The Applicant is currently stationed in Ada County
in front of the salvage yard on Fairview Avenue. As the
City has no formal process for approval of these vans,
and all uses on the D & B property were contingent upon
obtaining a conditional use permit, the Applicant was

D & B Supply agreed with their proposal to move to its property.
Because the property is in the City of Meridian, they are seeking
the conditional use permit to operate the emission testing van at
the property. With regard to the comments of City staff, the
licensing fee by the City of Boise is a surprise to them. They
have never received a bill for such fee in the ten years they have
operated. All of the other comments are reasonable and they are
happy to work with the City to meet the comments and requirements.
11. In response to questions of Commissioner MacCoy, Mr.
Egbert testified substantially as follows. Their contact person at
D & B Supply is Rod Schneider. They understand that the agreement
with D & B Supply is on a month to month basis. This type of
agreement with Plantation Shopping Center has worked well for them.
They certainly hope to be good tenants for D & B Supply.
12. In response to questions of Commissioner Borup, Mr.
Egbert testified substantially as follows. As long as they know
what is acceptable, they do not have a problem with the signage
requirements.
13. There was no further testimony given at the hearing.
CONCLUSIONS OF LAW
1. All the procedural requirements of the Local Planning Act
and of the Ordinances of the City of Meridian have been met
including the mailing of notice to owners of property within 300
feet of the external boundaries of the Applicant's property.

2. The City of Meridian has authority to grant conditional
uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of
the Revised and Compiled Ordinances of the City of Meridian.
3. The City has the authority to take judicial notice of its
ordinances and proceedings, other .governmental statutes and
ordinances, and of actual conditions existing within the City and
state of Idaho.
4. The City of Meridian has authority to place conditions on
a conditional use permit and the use of the property pursuant to
67-6512, Idaho Code, and pursuant to that section conditions
minimizing the adverse impact on other development, controlling the
duration of development, assuring the development is maintained
properly, and on-site or off-site facilities may be attached to the
permit; that 11-2-418 (D) authorizes the City to prescribe a set
time period for which a conditional use may be in. existence.
5. Section 11-2-418 D. states as follows:
In approving any Conditional Use, the Commission and
Council may prescribe appropriate conditions, bonds, and
safeguards in conformity with this Ordinance. Violations
of such conditions, bonds or safeguards, when made a part
of the terms under which the Conditional Use is granted,
shall be deemed a violation of the Ordinance and grounds
to revoke the Conditional Use. The Commission and
Council may prescribe a set time period for which a
Conditional Use may be in existence.
6. The Commission has judged this application for a
conditional use upon the basis of guidelines contained in Section
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian and upon the basis of the Local Planning Act of 1975,
Title 67 Chapter 65, Idaho Code, the Comprehensive Plan of the City

of Meridian, and the record submitted to it and the things of which
it may take judicial notice.
7. 11-2-418(C) of the Revised and Compiled Ordinances of the
City of Meridian sets forth the standards under which the Planning
and Zoning Commission and the City Council shall review
applications for Conditional Use Permits. Upon a review of those
requirements and a review of the facts presented and the conditions
of the area and assuming that the above conditions or similar ones
thereto would be attached to the conditional use, the Planning and
Zoning Commission concludes as follows:
a. Pursuant to the conditions for the annexation of the
property a conditional use permit is required;
b. The use would be harmonious with and in accordance
with the Comprehensive Plan and the Zoning Ordinance;
c. The use will be operated and maintained to be
harmonious and appropriate in appearance with the
existing and intended character of the general vicinity,
and if the Applicant complies with the conditions set
forth herein the use would be operated and maintained to
be harmonious with the intended character of the general
vicinity and should not change the essential character of
the area;
d. The use should neither be hazardous nor should it be
disturbing to existing neighboring uses if the conditions
are met. When the neighboring property to the west is
developed, dependent upon the type of development of said
property, traffic conflicts may arise, but due to the
location of the use such potential traffic conflicts
should not be a problem;
e. The use will be served adequately by essential
public facilities and services;
f. The use would not create excessive additional
requirements at public cost for public facilities and
services and the use would not be detrimental to the
economic welfare of the community;

g. If the conditions
involve a use, activity,
conditions of operation
person, property or the
excessive production of
glare or odors;
are met, the use should not
process, material, equipment or
that would be detrimental to
general welfare by reason of
traffic, noise, smoke, fumes,
h. The location of the use will have vehicular
approaches so as not to create an interference with
traffic on surrounding public streets; and
i. The development and uses will not result in the
destruction, loss or damage of a natural or scenic
feature of major importance.
8. As conditions may be placed upon the granting of a
conditional use permit to minimize adverse impact on other
development, it is .recommended. by the Planning and Zoning
Commission that the following conditions of granting the
conditional use be required, to wit:
a. The conditional use, pursuant to the Zoning and
Development Ordinance, shall not be transferable to
another person or to another property;
b. The Applicant shall meet the requirements of the City
Engineer's office, the Planning and Zoning Administrator,
Meridian Police Department, Meridian Fire Department,
Central District Health Department, and the Nampa
Meridian Irrigation District, which requirements
specifically include:
1. As Fairview Avenue is an entrance corridor to the
City, the Applicant or its use shall not encroach
upon the existing landscape setback;
2. All signage shall be subject to design review and
approval by Planning and Zoning staff;
3. No signage shall be erected without a permit;
4. A-frame (sandwich board) and other temporary signs
shall not be permitted as part of the conditional
use permit;
5. Upon three days notice to the Applicant, any signs
in violation of the ordinances of the City of

Meridian, the conditions hereof, or other
requirements can and shall be removed from the
property by the City;
6. The signs currently used at the present location of
the emission testing van shall not be permitted;
7. The emission testing van shall be located away from
the existing driveway access on Fairview Avenue to
permit appropriate access, as determined by the
City of Meridian; and
8. Any other items deemed necessary by the City Staff.
c. The conditional use permit shall not be restricted to a
period of authorization but shall be subject to annual
review, or more often if conditions warrant, upon notice
to the Applicant.
9. The above-conditions are concluded to be reasonable and
the Applicant shall meet these conditions.
10. It is recommended that if the Applicant meets the
conditions stated above that the conditional use permit be granted
to the Applicant.

TEN MILE SQUARE BY ALBERTSON'S INC.:
Johnson: I will now open the public hearing and invite the applicant or the applicant's
representative to address the Commission.
Gordon Anderson, 3979 W. Aspen Creek Court, Meridian, was sworn by the City
Attorney.
Anderson: I work for WH Pacific, we represent Albertson's Inc. What we have here is a
subdivision that we submitted two years ago, got a one year extension on it and that
expired March 21 ~`. Part of the reason that the extension expired was dealing with
some easements on the property trying to get that drafted up between the neighbor to
the west and tried to get everything together and get this finalized but time just ran out
on us. But what we are asking is for approval of a two lot subdivision, lot 1 would be
another commercial site lot and we previously obtained a zero lot line variance between
lots 1 and 2. This site currently is built up at the new Albertson's store and there is
parking on a majority of lot 2, part of lot 1. All the public utility easements and private
easements are shown on the copy of the preliminary and the final. These consist of an
access easement to the property to west. A private water line easement and a private
sewer line easement to that parcel. Also near the southerly part of lot 2 is an easement
for the Eight Mile Lateral and also an easement for the power transformer in the back of
the building. There will be a strip of land dedicated to ACHD (inaudible) along Ten Mile
for additional right of way. Proposed use for lot 1 is going to be a small retail building, I
really don't know what the plans are. I think there was something submitted to the City
on that. Can I answer any questions?
Johnson: Any questions of the applicant's representative?
Fitzgerald: Mr. Chairman I do have one question. You had mentioned there was some
issues regarding easements with your neighbor to the west from Albertson's Inc. Has
that all been resolved and settled?
Anderson: By the time this plat is signed and recorded it will all be signed and recorded.
I know that the documents have been written up, I don't know if all parties have signed
them yet. To the best of my knowledge the previous conditions of approval stated that
there would have to be easements in place. I was kind of assuming that would be the
case again. But I don't know if I saw that on any of the City's comments. Gary did you

Stiles: Because of their requirement for off street parking I think 'the applicant at first
thought was her property that went clear out to the road. In fact there is an 80 foot right
of way in there so clear to the sidewalk is ACRD right of way. It is a lot of dirt in
between the pavement (inaudible)
Williamson: Yes originally I was under the impression.that was part of our property and
that was the reason for (inaudible)
Fitzgerald: I have one quick question, are there any open ditches or swimming pools
or open water on the property?
Williamson: No

Egbert: I am the co-owner of Idaho Air along with Joseph Hanson who submitted the
application to you, he was unable to be here tonight so I am here to discuss the matter
with you and answer your questions. I will try to be brief. We have had an emission
testing van in the city of Boise for ten years, it is located near the corner of Fairview
and Five Mile Avenue, in the shopping center there and we have been good tenants in
that shopping center and have not had any trouble during that period of time. Last fall
the citizens of Ada County voted on whether to continue the current emission testing
program or move to a new program and the vote was to continue, the public wanted to
continue with the current emission testing program. At which time we decided to
purchase a second van which we did and located it in Ada County at the salvage yard
the ATW salvage yard which is actually only a couple hundred yards from the location
to which we wish to move our van. Quite frankly we wished a little more, little nicer
location for our service than the salvage yard and we located at D & B Supply and
proposed to them that we move our service ,into their parking lot which was not, the
portion of the parking lot which is never used for customers. They were in agreement
with that proposal. However they are in the City of Meridian which is the reason why we
came here for the approval before you tonight. Concerning the comments, the only
comments were by the City Engineer and Ms. Stiles. The first comment suggests that
the City of Boise licenses the emission vans for $180 a year was a bit of a surprise for
us since we have never been billed for that in the last 10 year unless they have
forgotten us. That would be a bit of a surprise. We were the third emission testing van
licensed in Ada County so we have been there for quite a while. All of the other
suggestions are very reasonable and I really appreciate the tone of the suggestions.
They are not as a commandment but rather a willingness to work, requesting us to work
with the members of the Planning and Zoning Commission to make our emission
testing van more safe and more appealing to the public. We are happy to do that. So
that is all I have to say.

MacCoy: Your contact with D & B, was that Rod Schneider?
Egbert: Yes, it is Mr. Schneider.
MacCoy: You realize that he is doing this month by month, that was okay with you?
Egbert: Yes we have had that agreement for 10 years with the Plantation shopping
center and that. seems to work nicely for us.
MacCoy: I didn't know (inaudible) not that Rod is going to throw you out into the street
but are you going to be back in there in another 6 months?
Egbert: I hope that is not the case, we certainly want to be good clients and good
tenants for him.

month to month agreement would answer the problem if there is a conflict with property

ITEM #19: REQUEST FOR A VACATION OF WEST BOUNDARY OF LOT 36, BLOCK
1 HAVEN COVE SUBDIVISION NO. 5 BY PACIFIC LAND SURVEYORS:
Johnson: This is not a public hearing, will the applicant address the Commission.
Eddy: My name is Tom Eddy, I am from Pacific Land Surveyors at 290 Maple Grove
Road in Boise. This is misleading. This is a vacation of an easement on the west
boundary. of Lot 36, Block 1. There has been a lot line adjustment made when Lot 36
was platted in Haven Cove No. 5 it was a large lot, some 14,000 square feet. Then
when Haven Cove No. 5 was platted there was a smaller lot adjacent to Lot 36 which is
Lot 50 I believe it is. The plan was to combine the two and make, to combine the lots
and make 2 8,000 square foot lots with the lot line adjustment. Well Haven Cove No. 5
put an easement on the west boundary of Lot 36 and we are here to vacate that
easement, there are no utilities in it. We put a utility easement on the lot line
adjustment which makes the two lots 8,000 square feet (inaudible).
