The revised easement I received from you 9/29/97 is satisfactory. It appears the Knotty
Pine property is granting an easement of its entire property for the purposes of parking
and drainage to the 1409 property. Is this your intention?
Please forward five copies of the latest revised plan to this department for stamping
"Approved." This will include two stamped copies for the contractor's use. Also, please
submit a copy of the recorded easement. I am enclosing the original for your use. The
plan will not be approved prior to receipt of a copy of the recorded easement.

Plans Review Comments
Dear Mr. Merkle:
I have reviewed the plans for the Hoyle Realty building on E. 1st Street. The location of the
site's driveway does not meet District policy. E. 1st Street is functionally classified as a minor
arterial street. District policy requires 105-feet of separation between driveways on this segment
of E. 1st Street. There is approximately 50-feet of separation between the site's existing
driveway and the driveway that serves the parcel to the north. There is another driveway on the
east side of E. 1st Street that is also within 50-feet of the site's existing driveway. The
existing/proposed driveway location does not meet District policy.
The applicant is the owner of the parcel to the north. Therefore the applicant will be required to
close the subject site's driveway and use the driveway to the north for access to E. 1st Street.
Replace the existing driveway on E. 1_st Street with curb. gutter and sidewalk to match existing
improvements.
OR
Enter into an agreement with the District to allow the closure of the existing driveway on E. 1st
Street upon the redevelopment of the abutting parcel to the north which will include the
construction of an internal driveway connection between the two parcels with a cross access
easement for the subject site to access E. 1st Street.

This cross access and/or through access easement (hereinafter "Easement") is granted this 17
day of July , 19~ by Richard W. Hoyle . an unmarried person
Grantor.
WITNESSETH:
Whereas, Grantor is the fee simple owner of property more fully described as follows, to wit:
A part of Block 4 of Amended Plat of F. A. Nourse's Third Addition to Meridian, according to
the Official Plat thereof filed in Book 7 of Plats at Page 299, records of Ada County, Idaho,
described as follows: Parcel #0431 of Block 4 of said F. A. Nourse's 3rd Addition Amended.
Whereas, the Grantor(s) pursuant to development application file number MSPR-5-97 has
requested access to E. 1st Street , a public street, in accordance with the
conditions of compliance for development application file number MSPR-5-97 ;and
whereas, a joint access easement is required as a condition of such access by the Ada County
Highway District (hereinafter "District") a Body Politic and Corporate of the State of Idaho,
between the above referenced parcel and the parcel identified as:
Apart of Block 4 of Amended Plat of F. A. Nourse's Third Addition to Meridian, according to
the Official Plat thereof filed in Book 7 of Plats at Page 299, records of Ada County, Idaho,
described as follows: Parcel #0500 Block 4 Meridian of said F. A. Nourse's 3rd Addition
Amended.
Now, Therefore, in consideration of the mutual covenants contained herein, and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the grantor
agrees as follows:
The recitals are acknowledged as true and correct and are incorporated herein as
covenants and agreements and are made a part hereof.
2. This Easement shall be binding upon the successors, heirs, executors, administrators,
personal representatives, or assigns of the parties and upon all persons acquiring an
interest thereunder, and shall be a covenant running with the title to the Grantor's land
hereinafter described until terminated provided herein.
3. The District shall have standing to enforce this Easement. In the event it shall be
necessary for the District to bring suit to enforce this Easement or for damages on
account of any breach of the Easement, or of any warranty, covenant, condition,
requirement or obligation contained herein, the prevailing party shall be entitled to
recover from the other, in addition to its damages, all legal costs and reasonable
attorney's fees as fixed by the Court, both at the trial and the appellate level.
4. Grantor hereby agrees to grant cross-access and/or athrough-access easement(s), to the
abutting property situated north of Grantor's property, pursuant to the requirements of
development application file number MSPR-5-97
5. The District agrees to make a good faith effort to require dedication of a reciprocal cross
access easement from the abutting properties on the north at such time as that property is
the subject of a development application over which the District has authority of review.
6. The Grantor agrees that at such time as the reciprocal cross access easement described in
5. above is required and obtained by the District that the driveway connection from
Grantor's property to E. 1st Street temporarily allowed by the District under development
application file number MSPR-5-97 will be closed.
7. The District shall not be liable for or responsible for any maintenance or repairs to the
Grantor's property.
8. This Easement and the provisions contained herein shall be construed, controlled, and
interpreted according to the laws of the State of Idaho, and all duly adopted ordinances,
regulations, and policies of the District now in effect and those hereinafter adopted.
9. The location for settlement of any and all claims, controversies, or disputes, arising out of
or relating to any part of this~Easement, or any breach hereof, shall be Ada County, Idaho.
10. The Grantor and the District agree to comply with the laws, rules, regulations and
requirements of all governing authorities having jurisdiction over the property described
above.
11. The Grantor will record this Easement, at its expense, in the Public Records of Ada
County, Idaho, where it shall encumber the property.
12. The Grantor hereby covenants and agrees that this Easement is specifically enforceable
because monetary damages would be insufficient to redress the denial of such
easement(s).
13. The Grantor hereby acknowledges that the Grantor has freely and voluntarily entered
into this Easement and has had the benefit of or been given the opportunity to receive the
advice of independent legal counsel for all negotiations in connection with the Easement.
14. The term of the Easement shall be for perpetuity, unless terminated jointly by the
Grantor, Grantee, and the District.
