Smith: Mr. Mayor, Council members, Councilman Morrow, it is an old sewer line that has been there since I guess the late 50's maybe. The upper end of this sewer line dead ends behind Giesler automotive. It crosses through this property and eventually dumps out into Meridian Road. So, the length. that they will be abandoning will be rerouted onto Taylor and then into Meridian and into a manhole. The length of line downstream from this abandoned section will just remain in place and continue to serve, I think there are two homes along the west side of Meridian Road. Morrow: So you have no objections to this? Smith: No we don't, that is fine. Corrie: At this time I will close the public hearing. Morrow: Mr. Mayor, I guess a question with the Council, I do business with Berta Neely, I do have an account there, I don't know if that constitutes a conflict but my suspicion is that (inaudible) state for the record (inaudible) and have the address the issue. (inaudible) that being the case then, Mr. Mayor I would move that we instruct the City Attorney to prepare an ordinance to vacate the sewer easement as requested. Tom Eddy, 290 North Maple Grove, Boise was sworn by the City Attorney. Eddy: Mr. Mayor and Council, I-would like to clarify it is a request for a vacation of an easement on the west boundary of Lot 36, not a vacation of the west boundary of lot 36. Lot 36 is a large lot, some 14,000 square feet. Lot 50 of Haven Cove No. 5 is a smaller lot. Combining the two makes two 8,000 square feet lots. We want to vacate this ease and then we prepared a lot line adjustment to make 2 8,000 square foot lots. Eddy: My name is Tom Eddy, I am from Pacific Land Surveyors at 290 Maple Grove Road in Boise. This is misleading. This is a vaca~on of an easement on the west boundary, of Lot 36, Block 1. There has been a lot line adjustment made when Lot 36 was platted in Haven Cove No. 5 it was a large lot, some 14,000 square feet. Then when Haven Cove No. 5 was platted there was a sma~er lot adjacent to Lot 36 which is Lot 50 I believe it is. The plan was to combine the two and make, to combine the lots and make 2 8,000 square foot lots with the lot line a~ustment. Well Haven Cove No. 5 put an easement on the west boundary of Lot 36 and we are here to vacate that easement, there are no utilities in it. Burgess: I am Tim Burgess I am with Civil Survey Consultants at 1530 West State Street. This request is for a sewer line that runs. north south about the midpoint of a lot at the northwest corner of Meridian Road and Taylor. That is where the new NAPA auto parts store will be constructed. Unfortunate~r the building goes right on top of the sewer. So we are proposing to relocate the sewer to Taylor or in the public right of way of Taylor and down the public right of way of Meridian to an existing manhole and abandon the pipe that would be under the buil~ng. Johnson: Thank you, questions? Borup: There is a pipe there now? Burgess: Yes Borup: Is it an active line? Burgess: Yes, it was built, well the easement was recorded in 1955. So it has been there for a long time. Borup: And are they just doing dirt moving there on site now at this point. MOTION CARRIED: All Yea ITEM #19: REQUEST FOR A VACATION OF WEST BOUNDARY OF LOT 36, BLOCK 1 HAVEN COVE SUBDIVISION NO. 5 BY PACIFIC LAND SURVEYORS: Johnson: This is not a public hearing, will the applicant address the Commission. .Eddy: My name is Tom Eddy, I am from Pacific Land Surveyors at 290 Maple Grove Road in Boise. This is misleading. This is a vacation of an easement on the west boundary of Lot 36, Block 1. There has been a lot line adjustment made when Lot 36 was platted in Haven Cove No. 5 it was a large lot, some 14,000 square feet. Then when Haven Cove No. 5 was platted there was a smaller lot adjacent to Lot 36 which is Lot 50 I believe it is. The plan was to combine the two and make, to combine the lots and make 2 8,000 square foot lots with the lot line adjustment. Well Haven Cove No. 5 put an easement on the west boundary of Lot 36 and we are here to vacate that easement, there are no utilities in it. We put a utility easement on the lot line adjustment which makes the two lots 8,000 square feet (inaudible). Johnson: Thank you, questions? MOTION CARRIED: All Yea ITEM #20: REQUEST FOR A VACATION OF SEWER EASEMENT BY BERTA NEELY (NAPA AUTO PARTS): Johnson: Yes sir. Burgess: I am Tim Burgess I am with Civil Survey Consultants at 1530 West State Street. This request is for a sewer line that runs north south about the midpoint of a lot at the northwest comer of Meridian Road and Taylor. That is where the new NAPA auto parts store will be constructed. Unfortunately the building goes right on top of the sewer. So we are proposing to I-elocate the sewer to Taylor or in the public right of way of Taylor and down the public right of way of Meridian to an existing manhole and abandon the pipe that would be under the building. Johnson: Thank you, questions? Borup: There is a pipe there now? Burgess: Yes Borup: Is it an active line? Burgess: Yes, it was built, well the easement was recorded in 1955. So it has been there for a long time.. Borup: And are they just doing dirt moving there on site now at this point. Burgess: Well unfortunately we didn't realize that sewer line was there until after they had started moving that dirt in. So it was late in the game that we found that.
