Deed and affidavit of legal interest attached. Legal description attached. 6. Property is currently in agricultural production and occupied with one single family dwelling and accessory buildings. 7. The applicant is proposing a 90-lot single family dwelling development. 8. Zoning District: R4 9. Vicinity Map attached. 10. Single family dwelling are proposed. The variances requested are unrelated to the building pads or setbacks. 11. List of property owners within 300-feet is attached. 12. Characteristics of the subject property which prevent compliance with Ordinance: An existing 15-inch concrete sewer line traverses the parcel in a north-south direction along the east boundary. The subdivision was designed to accommodate the existing sewer trunk line. The City Engineer requires a separate lot for any sewer line not within a public right-of--way. To satisfy this requirement a separate micro-path and sewer lot was designed in Block 3 (lot 9). This required a reduction of the frontage requirement on lot 19, Block 3 from 80-feet to 50-feet. This lot is excessively large with a square footage of 18,726.8. We believe the large lot size and the existing sewer location provides justification for a variance of the frontage requirement. A separate sewer lot (lot 6, Block 6) accommodates the existing sewer line. This sewer lot prohibits road frontage for lots 4 and 5, Block 6. We are proposing a shared driveway concept for these two lots. The 30-foot sewer lot would be paved and a perpetual ingress/egress easement for the two lots would be provided. A shared driveway access is a commonly used method of ingress/egress when accessibility is hindered. 970210\variance-app • The request for a variance of the maximum block length of 1,000-feet for Block 4 is justified since the configuration of the school site creates a long block. We have provided a micro-path (lot 10, Block 4) as a pedestrian connection for Block 4. The pathway would connect the elementary school with the subdivision. The intent of the maximum block length is to minimize the walking distance between blocks for pedestrians. By providing the micro-path a pedestrian connection has been provided. We request the City Council consider the facts and justifications provided for approval of the variance requested. 13. Ordinance requirements: Section 2-410(a) "Minimum Street Frontage 80"'. Section 9-605(e) "Blocks....blocks shall not be....more than one thousand feet (1,000') in length." Section 9-605(c) "Pedestrian Walkways: right-of--way for pedestrian walkways in the middle of long blocks may be required where necessary to obtain convenient pedestrian circulation to schools, parks or shopping area; the pedestrian easement shall be at least ten feet (10') wide. 14. If the request is not granted a hardship would be imposed on lots (Lots 18 and 19, Block 3) by creating a 34,998.6 square foot lot. Lots 3, 4 and 5, Block 6 would require consolidation creating a 28,555.4 square foot lot. This situation would dictate excessively large lots not consistent with the other lots in the development. If we were required to add a stub street to Block 4 to break up the block length this could potentially disrupt the site plan for the School District. Based upon the two access points and the fact that the school must be located in the southeast portion of the school parcel for sewerability, the additional stub street would connect to the play ground. A street intersecting the playground is not a preferable situation. 15. The unusual circumstances of this parcel are the existing sewer trunk line and the school parcel. 16. Typically a development is designed for a parcel which has no existing improvements (ie. Sewer) within its boundaries. The design was restricted by the existing sewer trunk and creative ideas were used to develop the property without disruption of the sewer trunk. The school parcel configuration was dictated by sewer depth and the needs of the School District (ie. width, depth and size). The school parcel location creates a long perimeter, therefore, the block length exceeds the maximum criteria. 17. A literal interpretation of the provisions of the ordinance would defy reason when one considers the effect of these requirements on the development as discussed in previous questions. 970210\variance-app • • 18. Special conditions attributed to the parcel are the existing sewer line and the elementary school parcel. 19. If the City Council were to grant the variance for the standards previously mentioned, it would not constitute a privileged treatment of the parcel. The problems associated with compliance with the ordinance are unique and would justify similar waivers for a project which encountered these issues. 20. The variance request is confined to standards within the Zoning Ordinance and not addressed in the Comprehensive Plan. 21. Fee attached. 22. The Applicant proposes to have a 50' street frontage on Lot 9 of Block 3, and proposes a shared drive-way concept for Lots 4 and 5 of Block 6 because of sewer easements. 6. The Applicant also proposes to obtain a variance from the maximum block length of 1,000 feet for Block 4, and argues that it is justified because the configuration of the school site creates a long block. The Applicant states that it has provided a micro- path (Lot 10, Block 4 j as a pedestrian connection for Block 4. The pathway would connect the elementary school with the subdivision. He further states that by providing the micro-path a pedestrian connection has been provided, which serves the same purpose for pedestrians as having a block of not more than 1,000 feet. 7. Becky Bowcutt, representing the Applicant, testified that the Applicant desires an exception to the 80 feet of lot frontage required in the R-4 zone and requests an easement to two of the lots. She indicated that there would be gates or ballads for the easement rather than 80 feet of street frontage. She also indicated that one of the block lengths in the subdivision was greater than 1,000 feet, but stated with the access of the school, by means of pedestrian accesses, the block is broken up. FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 2 • • 8. That the Applicant is the owner of record of the property. 9. Bruce Freckleton, Assistant to the City Engineer, commented that due to the fact that the City Council has already approved the Preliminary Plat for the subdivision, the variance issue is really a mood point. He additionally states that the variance appears to be justified due to the sewer alignment and proposed school site plan shown. 10. The Nampa & Meridian Irrigation District commented that a land use change/site development application is required for review prior to final platting, and stated that all laterals and waste way must be protected, all municipal surface drainage must be retained on -site, if any surface drainage leaves the site the Nampa & Meridian Irrigation District must review the drainage plans, the Applicant must comply with Idaho Code 31-3805, and that it is recommended that irrigation water be made available to all developments within the Nampa & Meridian Irrigation District. 11. The Central District Health Department submitted a response and it did not indicate any objection to the variance. 12. The Meridian Fire Department and the Meridian Police Department submitted comments and they did not object to the variances. 13. That no people appeared at the hearing objecting to the variance .application. FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 3 • CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice of the proposed subdivision to owners of property within 300 feet of the external boundaries of .the Applicant's property. 2. That the City has authority to grant variances pursuant to Section 11-2-419 of the Zoning Ordinance and pursuant to Section 11-9-612 of the Development Ordinances. 3. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Subdivision and Development Ordinance and upon the record submitted to it and the things upon which it may take judicial notice. 4. That the Council may take judicial notice of its own proceedings, those of the Planning and Zoning Commission, governmental statutes, ordinances, and policies, and of actual conditions existing within the. City and the State. 5. That the following provision of Section 11-2-419 A, of the Zoning Ordinance, is noted which is pertinent to the Application: 11-2-419 A. The Council may authorize in specific cases a variance from the terms of this Ordinance or from the Subdivision and Development Ordinances as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this Ordinance would result in unnecessary hardship. A variance application does not go to the Commission unless directed by the Council. 6. That the specific requirements regarding a variance that must be evidenced and found by the City Council are as follows: 11-2-419 C. FINDINGS A variance shall not be granted unless (as a result of a public hearing) the Council makes a statement of supportive reasons based directly on the evidence presented to it which supports conclusions that the mentioned standards and conditions of this Ordinance have been met by the applicant and unless all of the following exist: 1. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would clearly be impracticable or unreasonable; 2. That strict compliance with the requirements of this Ordinance would result in~ extraordinary hardship to the owner, subdivider or developer because of unusual topography, other physical conditions or other conditions which are not self- inflicted, or that these conditions will result in inhibiting the achievements or the objectives of this Ordinance; 3. That the granting of the specified variance will not be detrimental to the public's welfare or injurious to other property in the area in which the property is situated; 4. That such variance will not have the effect of altering the interest and purpose of this Ordinance and the Meridian Comprehensive Plan. 7. That there would be a specific benefit or profit, economic gain or convenience to the Applicant, if the Application is granted, in that the Applicant would not have to meet the FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 5 • ordinance requirements that other developers have to meet, particularly in near and adjacent areas, including the required maximum lot frontage of 80 feet and the maximum block length of 1,000 feet. 8. That regarding Section 11-2-419 C it is specifically concluded as follows: a. That there are special circumstances or conditions affecting the property .such that the strict application of the provisions of the street frontage and maximum block length Ordinances would clearly be unreasonable, in that the lots have restricted ability to meet the street frontage requirement due to reasons beyond the Applicant's control. The variance of the 1,000 foot maximum block length is caused by the placement of the school but Applicant has provided pedestrian access that breaks up the length of the block for pedestrian purposes. The requested deviations from the Ordinance are not substantial. b. That strict compliance with the requirements of the maximum 1,000 foot block length requirement would result in extraordinary hardship to~the applicant, because of the school which shall be constructed adjacent to Applicant's .property and because Applicant placed pedestrian accesses into and out of the school property, the granting of the variance would be reasonable and prudent. The granting of the variance on the 80 feet of street frontage would also be reasonable because sewer easements, not placed by the Applicant, cause the lack of ability to meet the 80 foot. requirement. c. That the granting of the specified variances would not be detrimental to the public's welfare or injurious to other property in the area in which the property is situated. d. That such variance would not have the effect of altering the interests and purposes of the 80 foot street frontage requirement or the 1,000 foot block length of the Zoning Ordinance. 9. That in regard to the first paragraph of 11-2-419 A, FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 6 which is quoted above, it is specifically noted that it states, in part, as follows: The Council may authorize in specific cases a variance from the terms of this Ordinance or from the Subdivision and Development Ordinances as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this Ordinance would result in unnecessary hardship. 10. That it is specifically concluded that the Application for the variances should be granted: a. In the case of the required street frontage, the street frontage on the lots for which the variance is requested was not established by the Applicant, but only established because the lots are large and they abut up against a sewer line easement. b. Because the block length in excess of 1,000 feet will be, or has been, provided with pedestrian accesses so that pedestrians may pass through the longer than 1,000 foot block to gain access to the school grounds. 11. The City has in the past granted similar variances as requested by the Applicant but has also denied such variances; each application must stand on its own merits and the granting of one variance is not a precedent for granting others. At this time I will open the public hearing. Becky Bowcutt, 1111 S. Orchard, Boise, was sworn by the City Attorney. Bowcutt: This is a request for a variance on the Dakota Ridge Subdivision, it was discussed and heard as a preliminary plat during the last City Council meeting. We are requesting a variance of the 80 foot lot frontage on three lots. This lot 18 here, Lot 18 Block 3, Lot 4 and 5 of Block 6. For the members that were not present 1 think Councilman Bentley was absent, we have this micropath coming in at an angle in order to give this particular lot the adequate frontage requirement. Staff recommended that we straighten this lot out, we have also got a sewer thank line that is existing that runs down through this property that goes into the Lake at Cherry Lane. Staffs comment was the thought that it would be a good compromise in order to keep this pathway straight. Secondly the fact that this lot is 16,271.8 square feet so it far exceeds the 8,000 square feet. These two lots the sewer line comes through here, we have to keep a separate lot for that trunk line. It is a 15 inch concrete sewer main. Therefore keeping that in a separate lots prohibits us from trying to get any frontage out onto the public right of way. Ada County Highway District did review this concept of a shared driveway, they consented to it based on the fact that we would have this as a separate lot under the ownership of the association and a perpetual ingress/egress easement to run with the land would be forever granted to these two lots so they could never be denied access tot their property. Our intent is to pave, it is 30 feet wide we would pave it and then we would put curb and gutter. to keep our drainage coming back into the street so it doesn't sluff to the lots or to the south to the Lake at Cherry Lane. One of the questions from Meridian City Council • August 5, 1997 Page 9 one of the residents who lives in the Lake at Cherry Lane was they did not want to promote vehicular access because they too have a similar lot right here. The solution that we have for that is either one we gate it and put some type of city approved lock on the gate or two we use like a ballard system so people could go through there with a bicycle or walk through that area but no vehicular traffic would go down into the lake at Cherry Lane. The other variance we are requesting is we have this one particular block right here that staff basically counts all of this as the block length. Obviously it does exceed 1,000 feet. In staff s review they stated that a micro path was placed here for the future elementary site that does break that block up. In your ordinance it talks about long blocks and the utilization of micro paths to provide pedestrian access in a long block. So we have done that here, but we do technically need a variance to the staff. Those are the issues that we are asking you to act on this evening. Do you have any questions? Rountree: Just for the record Becky would you state that the frontage on those two lots for the variance really meets the City requirements I terms of the lot sizes it is just a matter of it is a private access as opposed to a public access. Bowcutt: That is correct, lot 4 is 9,270.6 square feet, Lot 5 is 9,554.4 We have 80 feet of frontage and 84 feet of frontage. Basically what we are looking for is to temporarily occupy this building. Our lease agreement is a month to month basis. We basically agree with everything on staffs recommendations. Idid have one comment on the parking path and the asphalt drive into the building. I think you are all aware that Ada County is planning a major intersection improvement this fall. They will be taking most of the front yard and side yard out. We would just like to hold off and see what Ada County does to that. Also it is probably going to be moved anyway. That was the only question we had. Corrie: Questions of the Council? Rountree: Mr. Mayor, you indicated it was a temporary usage that you may be out by fall or you may be in for 2 to 3 or 4 years? Nichols: It is a month to month lease. The owner has not indicated any plans in the future for that site but that could change on a month to month basis. We don't have any objection to doing any of the site improvements. We would just basically like to wait until Ada County is done.. We will pave the driveway at that time and put in a parking lot. Boesiger, Inc. Due to the fact that Council has already approved the preliminary plat, the variance issue is really a moot point. The variance appears to be justified due to the sewer alignment and proposed school site plan shown.
