RAMON YORGASON and MARILYN YORGASON, hereinafter referred to as "Declarant." ARTICLE I DEFINITIONS Section 1. "Association" shall mean and refer to CROSSROADS NEIGHBORHOOD ASSOCIATION, INC., its successors and assigns. Section 1.1 Incorooration by Reference. Any and all provisions contained in the Articles .of Incorporation and Bylaws of Crossroads Neighborhood Association, Inc., as amended from time to time are incorporated herein and made a part hereof. To the extent any provision of the Covenants, Conditions and Restrictions for Crossroads Subdivision conflicts, modifies, or amends any provisions of the above referdnced Articles of Incorporation or Bylaws incorporated herein, the provisions of this instrument shall control. Section 2• "Owner" shall mean and refer to the record owner, whether one or more persons or entities, of a fee simple title to any Lot which is part of the Properties, including contract sellers, but excluding those having such interest merely as security for the performance of an obligation. Section "Properties" shall mean and refer to that certain real property hereinbefore described and such additions thereto as may hereafter be brought within the jurisdiction of the Association. Section 4. "Common Area" shall mean all real property (including the improvements thereto) owned by the Association for the common use and enjoyment of the Owners. Section 5. "Lot" shall mean and refer to any plot of land shown upon any recorded CROSSROADS SUBDIVISION No. 5 DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS, Page 1 subdivision map of the Properties with the exception of any Common Area, if there is any. Section 6. "Declarant" shall mean and refer to J. RAMON YORGASON and MARILYN YORGASON, husband and wife, their successors and assigns if such successors or assigns should acquire more than one undeveloped Lot from the Declarant for their purpose of development. Section 7. "Phase" - Each parcel of land subdivided using the same name will be identified by a consecutive number beginning with No. 1 and will be known as a "Phase." ARTICLE H GENERAL COVENANTS, CONDITIONS, AND RESTRICTIONS Section 1. "Approval of Plans" - No building, fence, wall, structure, improvement, or obstruction shall be placed or permitted to remain upon any part of said properties unless a written request for approval thereof containing the plans and specifications, including exterior color scheme, has been approved in writing by the Architectural Committee. The decision to approve or disapprove proposed plans rests entirely with the Architectural Control Committee. Section 2. "Floor Area" The floor area of a one-story house in this Subdivision shall not be less than 1300 square feet on the ground floor. Two-story and tri -level homes shall have not less than 1600 square feet. For the purpose of the Covenants, eaves, steps, and open porches shall not be considered as part of a building, provided, however, that this shall not be construed to permit any portion of a building on a Lot to encroach upon another Lot. Plans must be approved by the Architectural Committee. No split entry homes, or moving of pre -built homes into the Subdivision, will be allowed. No residence shall be in excess of two stories above ground. Section 3 • "Garages" - All area requirements shall be exclusive of the garage area and shall be well -constructed of good quality Material and workmanship. All hawses shall have an enclosed garage which holds no less than two cars and no more than three. Section 4 "Value" - The appraised value of any residence shall exceed $100,000.00 based on January, 1997, values. Section 5. "Exterior Appearance" - Each house in this Subdivision shall have brick, stone, or stucco on the front exposure. As a minimum, brick, stone, or stucco shall be used on full -height columns on the sides of the garage or fall wainscot on the front of the house and garage. Builders are encouraged to use decorative windows with rounded tops, bay windows, or pop -out box windows if they are incorporated into the roof line. All plans must have the approval of the Architectural Committee. All Lots shall be provided with a driveway and a minimum of two off-street automobile parking spaces within the boundaries of each Lot. Section • "Roofs" - Broken roof lines, gables, hip roofs, etc., are strongly encouraged. Roofs must be of at least 4 in 12 pitch. No light colors of shingles shall be allowed. No gravel roofs will be allowed. Section 7 "Colors" - Exterior colors of earth tones or light blues or greys shall be encouraged for the body of the house. Bright or bold colors or very dark body colors shall be discouraged. Dark roof colors are encouraged. Approval of exterior colors must be obtained from the Architectural Committee. Section R. "Light Pole" - Each home is required to have a photo -sensitive pole light installed in the front yard within ten (10) feet of the property line, designed to switch on automatically at sunset and off at sunrise with a minimum bulb power of 40 watts. Completion is the specific responsibility of the Builder. Wiring must comply with the City's electrical code. (See City Ordinances) Section 9. "Landscaping" - Landscaping of front yard must be completed within' thirty CROSSROADS SUBDIVISION No. 5 DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS, Page 2 (30) days of substantial completion of home. Landscaping is to include sod in the front yard, and is to include both sides of the driveway. Rock or gravel may not be used to provide parking adjacent to driveways. There will be one ornamental tree of at least 1.5" caliper or pine tree of at least six (6) feet in height, five (5) five -gallon plants, and five (5) two -gallon shrubs. Berms and sculptured planting areas are encouraged. Grass shall be planted in the back yard within one year of occupancy. In the event of undue hardship due to weather conditions, the allowed time period for landscaping may be extended for a reasonable length of time upon written approval. of the Architectural Committee. Section 10. `Fences" - Fences are not required. If a fence is desired, plans for it shall be approved by the Architectural Committee prior to construction. Fences must also be approved by the City of Meridian which requires a building permit to build a fence. Fences shall be of good quality and workmanship and shall be properly finished and maintained. Chain link fences are not allowed. Any fence that is built along a lot line which is the boundary between a Lot and a Common Area must be made of a see-through material such as split rail or pole fence, and must not exceed forty-two inches (42") in height. Homes adjacent to walkways between lots which lead to Common Areas must have see-through fences such as split rail fence not to exceed forty-two inches (42") in height along the lot line between the Lot and the walkway. If a homeowner whose Lot is adjacent to a Common Area is concerned about the safety of young children and pets in their yard, they may attach inconspicuous wire netting on the inside of the fence. Fences along side lot lines and from the side lot line to the front of the house may be built of wood, such as dog-eared cedar, and may be no more than six feet (6') in height. The last section (8- 10 feet) at the rear of the lot on the side lot line must taper down to the height of the back fence (not to exceed forty-two inches (42") where back lot line is a boundary line between said Lot and a Common Area. Fences shall not be built closer to the front of the lot than five feet (5') behind the front corner of the house on either side. Fences shall not extend closer than twenty feet (20') to the front street right of way. On corner lots, fences shall not be built closer than twenty feet (20') to any side street right of way without the express approval of the Architectural Committee. Fences must comply with City ordinances. The location of fences, hedges, high plantings, obstructions, or barriers shall be so situated as not to unreasonably interfere with the enjoyment and use of neighboring properties and streets and shall not be allowed to constitute an undesirable, nuisance, or noxious use. The determination of the Architectural Committee shall be binding on all parties as to whether an undesirable, nuisance, or noxious use exists. See "Dog Runs" Section 11) as they pertain to fencing requirements. See "Vehicle Storage" (Section 12) as it pertains to fencing and the amount of setback required if the vehicle height extends above the fence. Section 11. "Dog Runs" - Dog runs may be permitted along a side fence, but must be no closer than ten (10) feet away from the back lot line on lots that back up to a Common Area. Dog runs must be not more than 6' high, and they must be screened by a six foot (6') wood fence on the side lot line. Dog runs must be approved by the Architectural Committee before construction is begun. Section 12. "Vehicle Storage" - Parking of boats, trailers, motorcycles, trucks, truck - campers, and like equipment, or junk cars or other unsightly vehicles, and like items, shall not be allowed on any part of said properties nor on public ways adjacent thereto excepting only within the confines of an enclosed garage or other approved enclosure, and no portion of same may project beyond the enclosed area. Parking of automobiles or other vehicles on any part of the properties or on public ways adjacent thereto shall be prohibited except within garages, carports, or other approved areas. Garage driveways shall not be extended on either side for additional parking without first securing Architectural Committee approval. For the purpose of this Section, an approved area may CROSSROADS SUBDIVISION No. 5 DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS, Page 3 • 0 be beside the house but not on a street side and consist of a six (6) foot solid board fenced enclosure. If the height of the stored item is greater than the height of the front fence, the item must be stored two feet farther from the front fence for each part of a foot the item extends above the fence, and the item must be stored two feet(2') away from any side yard fence for each part of a foot it extends above said fence, but in no case will the item be allowed to be stored if its height is greater than nine feet (9') or length greater than twenty-five feet (25'). The Architectural Committee shall be the sole and exclusive judges of approved parking areas. Section 13. "Animals" - Keeping or raising of farm animals or poultry is prohibited. All dogs and cats or household pets kept on these premises shall be fed and cared for and shall be adequately fenced so as not to annoy or trespass upon the use of the property of others. Dogs shall not be allowed to run at large. No more than two (2) animals may be kept at one time, except that a litter of young may be kept until eight (8) weeks old. See "Dog Runs" (Section 11). Section 14. "Antennae and Satellite Dishes" - Installation of radio and/or television antennae or satellite dishes is prohibited outside of a building without written consent from the Architectural Committee which would require them to be screened from the street view. Section 15. "Setbacks" - No building shall be located on any Lot nearer than twenty (20) feet from the front line and fifteen (15) feet from the rear line nor nearer than five (5) feet per story to any side lot line. Section 16. "ACHD Sight Obstruction" - No fence, hedge, or shrub planting will be allowed which obstructs the 40 feet sight triangle at street intersections. Landscaping in this sight triangle area must be kept lower than three feet or above seven feet in height. Trees within that triangle must have the foliage line maintained at sufficient height to prevent obstruction of such site lines. Section 17. "Additional easements" - In addition to the easements shown on the recorded plat, an easement is further reserved five (5) feet on each side of all other lot lines for installation and maintenance of utilities, irrigation, and drainage. Within these easements no structure, planting„ or other material shall be placed or permitted to remain which may damage or interfere with the instal?tation and maintenance of the utilities or which may change the direction of the flow of the water through drainage channels in the easements. The easement area of each Lot and all improvements in it shall be maintained continuously by the Owner of the Lot, except for those improvements for which a public authority or utility is responsible. Section • "Construction Time" - Construction of any residences in the Subdivision shall be diligently pursued after commencement thereof, to be completed within twelve (12) months. Section . No building shall be moved onto the premises. e t' 0. "Type of Residence" - No shack, tent, trailer house, or basement only house, shall be used within the Subdivision for living quarters, permanent or temporary. Section 21. "Outbuildings" - Only one outbuilding per Lot will be allowed. All outbuildings shall be constructed of quality building material, completely finished and painted on the outside, and shall be of quality and character that will be in harmony with the other buildings op said properties. All outbuildings must be approved by the Architectural Committee. Section 22. "Offensive Items" - Nothing of an offensive, dangerous, odorous, or noisy endeavor shall be conducted or carried on, nor shall anything be done or permitted in said Subdivision which may be or become an annoyance or nuisance to the other property owners in said Subdivision. Weeds shall be cut to less than four (4) inches. Section 23. "Conducting Business on Properties" - No business shall be conducted on the above properties that cannot be conducted within the residence of the Owner. Any business conducted within residences in this Subdivision roust comply with City Ordinances and requires a conditional use permit. No signs shall be installed to advertise said business. No oil exploration or development of any nature or kind or mining exploration, development or structure shall be permitted upon the Lots in this Subdivision. Section 24. "Irrigation Water" - This Subdivision will have pressurized irrigation water CROSSROADS SUBDIVISION No. 5 DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS, Page 4 • provided for irrigating landscaped areas. This pressurized water will not be potable, drinkable, and will not meet safe drinking water standards established, from time to time, by the federal, state, and/or local governments. S—ection 25. "Sewer Locations" - All bathroom, sink, and toilet facilities shall be located inside the dwelling house or other suitable appurtenant building and shall be connected by underground pipe to wet line sewer connection lines which have been provided to each Lot. ecti 26. "Signs" - No sign of any kind shall be displayed to public view on any building or building site on said properties except a professional sign of not more than five (5) square feet advertising the property for sale or rent by an owner to advertise the property. If a property is sold or rented, any sign relating thereto shall be removed immediately, except that a "Sold" sign may be posted for a reasonable period following the sale. Notwithstanding any provision to the contrary, signs of any and all sizes and dimension may be displayed by the Declarant, without limitation thereto, on Lots owned by said Declarant. The Declarant, or the Neighborhood Association, may display a sign of any size and dimension, without limitation thereto, for subdivision identification. Section 27. "Waste Disposal" - No Lot or building site included within this Subdivision shall be used or maintained as a dumping ground for waste material. Incinerators are not permitted. Receptacles for storage of trash, garbage, etc., shall be maintained in a sanitary and clean condition. Section 28. "Construction Equipment" - No machinery, building equipment, or material shall be stored upon site until the Builder is ready and able to immediately commence construction. Such building materials must be kept within the property line of such building site upon which the structure is to be erected. Section 29. "Damage to Improvements" - It shall be the responsibility of the Builder of any residence in this Subdivision to leave street, curbs, sidewalks, fences, tiled irrigation lines, if any, and utility facilities free of damage and in good and sound condition at the conclusion of the construction period. It shall be conclusively presumed that all such improvements are in good sound condition at the time building is begun on each Lot unless the contrary is shown in writing at the date of conveyance or by date of possession, whichever date shall first occur, which notice is addressed to a member of the Architectural Committee. Section 30. The "Architectural Committee's" decision is fmal and binding on all issues. Section 31. "Common Area" - The Common Area to be owned by the Association at the time of the conveyance of the first Lot is described as follows: Lot 1 Block 1, Lot I Block 2, Lot 1 Block 3, Lot I Block 4, Lot 1 Block 5, Lot 8 Block 9, and Lot 1 Block 10 of Crossroads Subdivision No. 1, and Lot 26 Block 9 and Lot 13 Block 10 of Crossroads Subdivision No. 2, and Lot 13 Block 7 of Crossroads Subdivision No. 3, and Lot 10 Block 6 of Crossroads Subdivision No. 4, Lot 30 Block 6 and Lot 27 Block 7 and Lot 1 Block 13 of Crossroads Subdivision No. 5 Boise Meridian, Meridian, Ada County, Idaho. These Common Area Lots will be maintained by the Neighborhood Association. e tin 2 "Annexation" - It is intended that additional phases of Crossroads Subdivision may be annexed or included within the jurisdiction of this Declaration by Declarant without approval of the Lot Owners. Common Areas included in annexed phases are for common use of Lot Owners in all phases of the Subdivision and will be maintained by the Crossroads Neighborhood Association, Inc. Section 33. "City and County Ordinances" - Should these Covenants, Conditions and Restrictions be more restrictive than City and County ordinances, these Covenants shall control. In the event that the City or County ordinances should be more restrictive than these Covenants, the City or County ordinances shall control ARTICLE III ARCHITECTURAL CONTROL "Architectural Committee" - A committee of three persons shall act as an Architectural Committee and shall, prior to any new construction in said Subdivision, be furnished with one set of CROSSROADS SUBDIVISION No. 5 DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS, Page 5 detailed plans and specifications of any proposed building to be located in said Subdivision and shall be allowed fifteen (15) days to review said plans, drawings, and specifications. If said Committee shall approve the proposed building, or any modification or alteration thereot they shall so indicate by the dating and signing of the set of plans by a member of the Committee, and their approval shall be construed as full compliance with the provisions of these Covenants. Said Committee shall have sole discretion to determine what shall be substantial compliance with said Covenants. ARTICLE IV SOLAR ACCESS All lots in this Subdivision are subject to the Boise City Solar Access Code requirements as represented by these special restrictions: Section 1. "Solar Access Definitions." Exempt e • Any pre-existing vegetation as defined in Section 2, Paragraph B, or any vegetation included on the list of solar friendly vegetation kept by the City of Boise's Public Works and Community Planning and Development Departments. Shade: That portion of the shadow cast by the shade point of a structure or vegetation which exceeds the 11.5 foot fence at the solar lot line at solar moon, January 21. F. Shade Point: That part of a structure, tree or other object, on a shade restricted lot, CROSSROADS SUBDIVISION No. 5 DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS, Page 6 which casts the longest shadow (the most Northerly shadow) when the sun is due South on January 21st at an altitude of twenty-six (26) degrees above the horizon, except a shadow caused by a narrow object such as a chimney, antenna, utility pole, wire, etc. G. Shade Point Height: The vertical distance or height measured from the average elevation at the solar lot line to the shade point. If the shade point is located at the North end of a ridge line of a structure oriented within 45 degrees of a geodetic East-West line with a pitch which is flatter than 6 feet (vertical) in 12 feet (horizontal), the shade point will be the cave of the roof. If such a roof has a pitch which is 6 feet in 12 feet or steeper, the shade point will be the peak of the roof. H. Shade Restricted Lot: Any lot within the subdivision that is Southerly of and adjacent to a solar lot. These lots have some restriction on vegetation types and structure height. I. Solar Friendly Vegetation: A tree or other vegetation which is included on the solar friendly vegetation list kept by the City of Boise's Public Works and Community Planning and Development Departments. J. Solar Lot: A lot which has the following characteristics: 1. The front lot line is oriented within thirty (30) degrees of a geodetic East/West bearing; 2. The lot to the immediate South has a North slope of ten (10) percent or less; 3. Is intended for the construction of an above -ground inhabited structure. K. Solar Lot Line: The most Southerly boundary of a solar lot: the line created by connecting the most distant Southerly corners of the solar lot. L. Solar Setbacks: The minimum distance, measured perpendicular in a Southerly direction, from the center of the solar lot line to the shade point of a structure or to restricted vegetation based upon its height at maturity on the shade restricted it. Section 22• "Solar Access Covenants, Conditions and Restrictions." A. Shade Restriction: Each lot within the subdivision which is classified as a Shade Restricted Lot shall have the following restriction: Any structure or restricted vegetation (solar unfriendly) cannot cast a shadow higher than an imaginary fence 11.5 feet above the solar lot line on solar noon of January 21st when the sun is at an angle of 26 degrees above the horizon. This sun angle at noon on January 21 causes structures, vegetation, and other objects to cast a shadow twice as long as their height. The height of the shade point of a structure on the shade restricted lot is limited to 19 feet at the 15 foot rear yard zoning setback in order that the 11.5 foot high "solar fence" at the North property line of the Shade Restricted Lot is not exceeded. These standards assure that a structure built to the 15 foot rear yard zoning setback, on the Solar Lot located to the North, will not be shaded more than 4 feet above grade on its South wall on January 21 at solar noon. B. Pre -Existing Vegetation+• Restricted vegetation (solar unfriendly), which existed when the subdivision was platted is exempt from the provisions of these covenants, conditions and restrictions. Any lot which would be shaded beyond the allowed shade limit by such vegetation shall not be classified as a Solar Lot. C. Sloe Exem12tion: Any lot with an average finished grade sl* along the North- South lot dimension greater than ten (10) percent shall be exempt from the terms and conditions of these covenants, conditions and restrictions. D. Solar Setbacks: Each separate structure and item of restricted vegetation shall have a solar setback dependent on and calculated by its shade point height. Sectio "Solar Access Rights, Duties and Responsibilities." A. Solar Access Rights, The owner(s) of solar lots shall have a right to unobstructed solar access in accordance with these covenants, conditions and restrictions. B. Solar Access Duties: The owner(s) of any Shade Restricted Lot shall not build, install, or otherwise allow a structure or non -solar friendly tree on that lot to cast more shade at a solar lot line than permitted under these Solar Access Covenants, Restrictions and Conditions. - ARTICLE V GENERAL PROVISIONS Section 1. "Enforcement" - Enforcement against any person or persons violating or attempting to violate any covenant herein after ten (10) days notice thereof in writing served on the offending party shall be had by any property owners either at law or equity. In the event of judgement against any person for such, the Court may award injunction against any person for such violation, require such compliance as the Court deems necessary, award such damages, reasonable counsel fees, and Court costs as may be suffered or incurred, and such other or further relief as may be deemed just and equitable. Any Owner, shall have the right to enforce, by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens, and charges now or hereafter imposed by the provisions of this Declaration. Failure by any Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter. Section 2. "Severability" - Invalidation of any one of these covenants or restrictions by judgment or Court order shall in no wise affect any other provisions which shall remain in full force and effect. Ste.. "Amendment" - This Declaration may be amended during the first thirty (30) year period by an instrument signed by not less than sixty-seven percent (67%) of the Lot Owners. Any amendment must be recorded. Section 4. V;ir.��il� MEMBERSHIP AND VOTING RIGHTS Section "Membership" - Every Owner of a Lot which is subject to assessment shall be a member of the Association. Membership shall be appurtenant to and may not be separated from ownership of any Lot which is subject to assessment. Every person or entity who is a record owner (including contract sellers) of a fee or undivided fee interest in any lot located within said property shall, by virtue of such ownership, be a member of the Association. When more than one person holds such interest in any occupied Lot, all such persons shall be members. The foregoing is not intended to include persons or entities who hold an interest merely as security for the performance of an obligation. The Association shall maintain a member list and may require written proof of any member's lot ownership interest. The financial reports, books, and records of the Association may be examined, at a reasonable time, by any member of record. Section 2. "Voting Rights" - The Association will have two classes of voting memberships. Class A M mbershin: Class A members shall be the Owners of Lots, with the exception of the Declarants. The vote applicable to any Lot being sold under a contract of sale shall be exercised by the contract vendor unless the contract expressly provided otherwise and the Association has been notified, in writing, of such provision. Voting by proxy shall be permitted. Class B Membership: Class B members shall be the Declarants. The Declarants shall be entitled to six (6) votes for each lot of which Declarants are the record owners. The Association shall have the right to suspend any voting rights for any period during which any assessment against said member's property remains unpaid for a period not exceeding sixty (60) days for each infraction of its published rules and regulations. Section 3. "Officers and Directors" - At an annual meeting called pursuant to notice as herein provided for the establishment of annual assessments, a Board of Directors of the Association shall be elected by ballot of those attending said meeting or voting by proxy. There shall be three Directors elected to serve for a period of one year. Section 4. "Common Area Matters" - The Association shall have the right to dedicate or transfer all or any part of the Common Areas to any public agency authority, or utility for such purposes and subject to such conditions as may be agreed to by the members. No such condition or transfer shall be effective unless authorized by members entitled to cast two-thirds (2/3) of the votes at a special or general member's meeting and an instrument signed by the Chairman and Secretary has been recorded in the appropriate county deed records, agreeing to such dedication or transfer, and a written notice of proposed action is sent to every member not less than ten (10) days nor more than fifty (50) days prior to such dedication or transfer; provided that the public agency accepts such dedication or transfer. ARTICLE VIII COVENANT FOR MAINTENANCE ASSESSMENTS Section 1. "Creation of the Lien and Personal Obligation of Assessments" - The Declarant, for each Lot owned within the Properties, hereby covenants, and each Owner of any Lot by acceptance of a deed therefore, whether or not it shall be so expressed in such deed, is deemed to covenant and agree to pay to the Association: (1) an initial assessment, or set-up fee, for each Lot, payable at closing, and (2) annual assessments or charges, and (3) special assessments for capital improvements, such assessments to be established and collected as hereinafter provided. The annual and special assessments, together with interest, costs, and reasonable attorney's fees, shall be a charge on the land and shall be a continuing lien upon the property against which each such assessment is made. Each such assessment, together with interest, costs, and reasonable attorney's fees, shall also be the personal obligation of the person who was the Owner of such property at the time when the assessment fell due. However, the personal obligation for delinquent assessments shall pass to his successors in title. Section 2. Gene Smith: Mr. Mayor if I could make a short presentation. Crossroads No. 5 is the fifth continued development within the Crossroads Development which is located east of Eagle and South of Fairview Avenue. I did receive, we did receive staff s comments dated February 27th to Mayor and Council. I have provided my response to those comments, I had those delivered today to the City Clerk as well as engineering and planning and zoning. I believe you each have a copy of my .response. Basically we agree with all of the comments, there are one or two items that I would like to discuss with you for clarification if nothing else. Under site specific comments, item 3, in the memo that was addressed to you concerns permanent perimeter fencing is required to be placed along the northerly exterior subdivision boundary prior to obtaining building permits. Temporary fencing shall be installed along the entire westerly boundary to contain construction debris prior to obtaining building permits. The letter of credit, cash or appropriate bonding will be required for this items prior to signature of plat. We have no problem with installing the permanent perimeter fencing along the northerly boundary but we would like to propose a variation and I know that there has been a lot of discussion and a lot of concerns over the temporary fencing for the debris and so forth. I would like to propose a trial if you will something that we are doing in some of the other developments that Mr. Yorgason with Capital Development is doing in some of the other developments around the valley and that is posting notices for the contractors to maintain their job sites to clean up the debris and I have a couple pictures of these notices. These have been very effective they have been working. I don't believe that the temporary snow fencing is doing any better of a job than what these notices are doing. I would like to propose that we be allowed to try this on a trial basis for this phase of the development to see if this is an effective means to control the debris. The second item that I would like to discuss with you briefly would be site specific comment number 5 also located on page 2. This has to do with lots frontage of lots of corner lots and in particular it, I would tike to request a waiver for lot 26, block 7. 1 believe you each have a copy of the plat, it is corner lot at Caucus and Florence. It is probably the largest lot within this phase of the development. I would like to request a waiver to . allow the house orientation to be either toward Caucus or Florence as the builder may opt. The frontage for this particular development according to the minutes of what was that Shari the Planning and Zoning minutes or the City Council minutes I don't recall. The minutes refer to minimum 70 foot of frontage. My interpretation of the ordinance states that the only thing that is required is a minimum street frontage. It doesn't say a minimum street frontage (End of Tape) short side of the lot that the house would be facing to the center of the return. We are 66 feet on this particular lot we have a total street frontage around the corner of 170 feet. So I am just requesting that we be allowed, that waiver to orient the house either direction on that particular lot. All of the other issues I have addressed and I believe are satisfactory to staff. 'Meridian City Council March 4, 1997 Page 13 Corrie: Council questions? Morrow: Mr. Mayor, I would like to hear the comments from staff concerning those two proposals. Smith: Mr. Mayor and Council members, I will address the request for the waiver on lot 26 block 7 frontage. Gene is right when he said that is a standard that I have established as I read the ordinance that requires whatever zone we are dealing with a certain street frontage. On corner lots I have simply taken half of the return curve and applied that to side of the lot, to each street frontage of that lot .in order to come up with that to meet that minimum frontage. If the configuration of the subdivision is such that It is very difficult to meet that minimum on one side or the other of the lot then I requested that the developer's engineer, land surveyor show by arrow or by some designation on the plat which way the house should sit on the lot and that would be the front of the house. That would be designated as the front therefore that would be the frontage of the lot and it would meet the ordinance then whatever the zone designation required. The other side of the lot would not be a front therefore it could be whatever the dimension would be. Morrow: And your thought about this particular proposal given the 66 feet and the 104 feet on the other side. Smith: Well I guess if I am going to have a standard I am going to have a standard. It is either going to be 70 feet or it is going to have to be designated that the front is not 66 foot dimension is the 104 foot dimension. That is just a standard that I set up as far as how I read the ordinance. That is my opinion of how the ordinance is written. Although the ordinance doesn't say that you can't designate on the plat a front of house direction. I have accepted that as an alternative to having both front lot lines meet the required minimum. So that one could be less than what the zoning ordinance requires as long as the front of the house was designated towards the lot lines that did meet the minimum required ordinance dimension. Morrow. Gary, follow up question, in this particular case or in any case with a corner lot then if the face the front of the house is say on the 70 foot side and the side of the house is on the 100 foot side the required set back on the 100 foot side ends up to be the same 20 feet as on the front of the house is that not correct? Smith: That is correct Morrow. And so would not on something like this the possibility of side entry garages or whatever somewhat mitigate the front footage in terms of the 66 feet or 70 feet or whatever? Is there some flexibility within the ordinance for that determination. 'Meridian City Council March 4, 1997 Page 14 Smith: Well I guess if you want to put a house pad on the plat and say this is going to be a side entrance house we could do that. Say that the side entrance shall be off of that side street. I think we are getting away from what the plat is really intended to do. Even having arrows on the plat on the lot designating which way the front of the house is going to situate is probably a ways away from what the plat was really intended to do. 1 understand what you are saying Councilman Morrow and the answer to your question is yes it would be but how do you track this. I don't know. I just try to make it as generic as possible so that it is easy to follow for whoever may buy the lot. Morrow. Well I guess from my perspective trying to think this. through with this particular lot and this subdivision is that there are several scenarios by which someone might opt to build a house a homeowner or whatever in terms of where it faces and its frontage and whether it is a front entry garage or a side entry or whatever the case may be. I guess the question in my mind is that something that clearly has these kind of footages do we necessarily need to designate one side as being the front or the other. Should that be a decision that is left up to the buyer of the lot or the homeowner of the lot. Smith: Well I guess my attitude was that I was interpreting the ordinance that the, and I can't be specific at this point but the ordinance says that the lot shall have a frontage of so many feet, in an R-4 zone I believe it is 70 feet. I don't know how you interpret that for a corner lot because you don't know which way the house is going to face when the plat comes in for final approval. Morrow. Well actually Gary there is another scenario here is the house could be diagonally placed on the corner and so then where is the front. That is not uncommon on a corner lot. House sits back, it is diagonally faced to approach that the front of the house faces or the center of the front of the house faces the center of the curve. So then what becomes the front. Smith: Well I guess maybe you will need to tell me then how wide do you want to make that side lot. Do you want it 40 feet, 30 feet, I don't know. I guess we could get it down as skinny as you want but I can truthfully say up to this point in time for plats this is the first time a developer has not chosen to designate a direction on a lot for a house frontage. I have never realized that it was a problem. Yorgason: Ramon Yorgason with Capital Development, maybe for a little bit of clarification it might help us on this one. Normally we have an R-4 zone this is an industrial mixed used zone and it is a.;PUD so it really is a different kind of zoning than we normally are working with. So that might give us a little more, we are not governed by the same restrictions that are on a regular R-4 zone. We do have with a PUD a lot of flexibility. Morrow. I guess Shari your part of the question is to address the fencing issue or the fencing proposal as opposed to the signs and then also the PUD issue. Meridian City Council March 4, 1997 Page 15 Stiles: As far as the fencing is concerned I guess if they want to try this on a trial basis and if it doesn't work the City give them notice and have them go ahead and fence it. There is a lot of debris out there right now and a lot of people dumping their concrete out there and it looks like some of the dead end streets might be good party places right now. That is where the majority of the trash is coming from I think. I have no problem with that. As far as the PUD normally a PUD would come through as a conditional use permit. At the time the PUD is approved it would be, you would know what all of those uses were. In this case 320 acres were approved as a PUD with absolutely 0 plans of what would be within that PUD. Then after the fact the plat comes through, it does appear that they attempted to meet the 10% requirement but other than that I wouldn't say that it went through a conditional use permit process for this process for this particular plat. The representations made by the applicant's representative were that they would be minimum of 70 foot frontage, minimum 8,000 square foot lots. I believe that was at the City Council level. If the City Council feels it appropriate to allow a 66 foot frontage on one lot I suppose that would be within your discretion since it is a PUD. But you can either accept it or not. I don't think that we can dictate that the house is going to have the garage on the 100 foot side. It would be nice if it would but Council needs to decide if they want to allow a 66 foot frontage in a development where they said the minimum would be 70 feet. Morrow. Mr. Mayor, if I may respond to that, it seems to me like and I am not in favor of changing the 70 foot frontage issue, I think that is primarily designed for straight on lots. In a corner lot situation I can think of at least 3 or 4 scenarios by which a homeowner would choose to locate his house where the frontage could be spanning the corner. Now we are making a decision here as I understand it that the frontage is based to the center of the arc on or the radius of the lot in the curve. But under certain circumstances and to capitalize on views and those kinds of things a homeowner may want to locate the house so that it essentially faces both streets. You could use a reverse L, you can use side entry garages and so on and so forth. So I am not convinced in my mind that on a comer lot that we ought to be saying that the frontage is 70 feet measured from the center of the curve because there are lots of scenarios that people could have that they wish their home to be. And I guess that is a topic that we as a Council need to address to get some guidance on corner lots as to what frontage does mean. So that is a point of discussion from my perspective. Gary? Smith: Mr. Mayor, Councilman Morrow, one other thing that I would like you to take into consideration on whatever you do tonight on this subject and for future. Is that typically homeowners are fighting a battle of having a big enough backyard on a comer lot to the extent that we get a substantial number of requests for variances to situate fences inside the side yard set back so that they have a big enough back yard. I don't know in this particular case if this is a problem or not but historically corner lots have been problems. Once they situate a house and they whack off a 20 foot setback on two sides of the lot they don't end up with much back yard and the next thing we know is that the `Meridian City Council March 4, 1997 Page 16 property owner is in here requesting a variance to set their fence out in the setback, the side street setback. So I think that is something that I would like you take into consideration. I would be happy to enforce your directive on these corner lots. Rountree: I guess I take the position to hold fast with the 70 foot frontage and I would like to them orient to the long side in this particular instance. I think we are making a major issue out of one that. If they orient to the long street whether they skew it a little bit on that lot or not they are still oriented to the long frontage and hold by that. Either that or we will see every corner lot we will have to make an exception for. I agree with Gary's point as far as the fences go. If you have a long skinny lot and you orient on the skinny side front then you have a very skinny long back yard and people want to put the fence on the street. With the 20 foot setback with the fence they don't have much backyard by ordinance. Morrow. I think with the 20 foot setback either way on a corner lot you have (inaudible). Rountree: As far as the sign goes, yes let's give it a try and if it doesn't work condition it in such a way that the fence goes in. Corrie: I can attest to corner lots having problems with 20 foot setbacks, I have one. Council, I guess we have the final plat, how do you want it to be worded. Morrow. Mr. Mayor, I had one additional question under general comments under number 5, it says plan for pressurized irrigation has been submitted to Nampa Meridian, the approval will be submitted prior to signature of the final plat. Gene, do you know what the status of that approval is by Nampa Meridian? Gene Smith: (Inaudible) Morrow. And you don't have a time frame as to when that signature might be forthcoming, thank you. Mr. Mayor, I would move that we approve the final plat for Crossroads Subdivision No. 5 by Capital Development with the exception under item 3 site specific comments that we allow the trial of a interior sign as proposed by the applicant and that we not require the temporary fencing between the phases if we have sufficient complaints, from the neighboring property owners then the Council would require that the separation temporary fence be put in place while the phase is under construction. Itis indicated that all storm water drainage will be retained on site, this meets the requirements of the Nampa & Meridian Irrigation District. The irrigation system is a continuation of the previous Crossroads system and the pumps need to be checked to insure that the entire system will function as needed. K we do have adequate pumps installed, the system should function correctly. We do, however, need an addendum for Crossroads No. 5 prior to final acceptance of this project. Please contact the District's attorney, Ms. Laura Burri at 342-4591 and ask that she prepare this addendum so we can complete our review. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions, as prepared by a soil scientist, with street development plans. 4. Submit an approval letter from the entity having jurisdiction over design and construction of the pressurized irrigation system. Provide a copy of the common area calculations, with reference to lot and block, to the City Clerk's office. The total area of all common open space shall equal or exceed ten percent (10%) of the gross land area of the planned development. Common open space shall mean land area exclusive of street rights-of-way, buildings, parking areas, structures, and appurtenances except those improvements which are accessible and available to all occupants of the private units within the planned development. 12. The Ada County Highway District is requiring that a paved roadway be constructed to Fairview Avenue at this time. As this final plat will bring the total buildable lots within the subdivision to 192, this roadway is needed to provide a secondary access. No building permits should be issued until this roadway is complete. We also find that this development is located in census tract 103.11 and in the attendance zone for Spalding Elementary School, Lake Hazel Middle School and Meridian High School. Using the above information we can predict that these homes, when completed, will house 12 elementary aged children, 9 middle school aged children, and 9 senior high aged students. This development will cause additional overcrowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also at capacity. The cost per student for newly constructed schools, excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and $10,000 per middle or high school student. Even though, we are in a difficult position and need you help in dealing with the impact of growth on schools, we will approve this subdivision. My reply will address your concerns in the same order as presented. GENERAL COMMENTS 1. Any irrigation/drainage ditches within this plat will be piped. 2. N/A. To my knowledge, there are no existing domestic wells on this parcel. 3. Seasonal high ground water has been determined per the attached. 4. Pressurized irrigation for this phase is proposed to be owned and maintained by Nampa - Meridian Irrigation District. (NMID). 5. Plans for the pressure irrigation have been submitted to NMID. This approval will be submitted prior to signature of the final plat. 6. According to FIRM Panel No.'s 160180-0002A and 160001-0251 C, this development is not within a flood plain. 7. The approval letter from the street naming committee is attached. SITE SPECIFIC COMMENTS 1. Agree. 2. I have attached an exhibit which identifies the lot areas for this phase of the development. In all cases, the lots either meet or exceed the 8,000 square foot requirement. 3. As in previous phases, a permanent perimeter fence will be placed along the northerly boundary. However, I would like clarification as to the requirement for temporary fencing along the westerly boundary. This is adjacent to existing phases withing the same development. It has been my understanding in past projects that the temporary fencing was being required adjacent to unlike uses. 4. The lots in question have been revised to meet the minimum frontage of 70 feet. (See attached.) 5. As discussed, I would like to request a waiver for Lot 26, Block 7 to allow the house orientation to front either N. Caucus or E. Florence. The frontage is approximately 66 feet on Florence and 104 feet on Caucus for a total of 170 feet of street frontage. 6. The 5 -foot P.U.E. will be added. The 10 foot P.U.E. will be moved if our request to change the house orientation is denied. 7. Three backhoe pits were examined, one at each potential storm drainage location, to determine seasonal high groundwater depth, impermeable to water restrictive soil layers, soil textures and colors (indicators of soil drainage class), and depth of rooting. The water table that occurs in the subdivision area fluctuates in depth, seasonally. It is at the most extreme (deepest depth) in mid -winter through early spring (November - April), and at its most shallow level in late summer/early fall (mid August - mid October), after being recharged by the seasons irrigation. My examination of the three backhoe pits showed current free water depths (water table , to be at 136" below the normal ground surface in pit TH1; 138" below the normal ground surface in pit TH2; and 137" below the normal ground surface in pit TH3. The date of examination, 1/21/97, should be at a time when the seasonal high groundwater has dropped to its lowest level. Canal water and irrigation activities are not being carried on at this time. Soil colors (as indicators of water table level). appear to be slightly gleyed with a few mottles to depths within 84" to 88". These soil colors and mottles indicate that the seasonal water table can and usually does rise to these levels in the late summer/fall time of the year. A monitoring well (PVC pipe) was installed in pit TH3 and should be monitored for water table depth once each week September 1 - November - 1. v m r1. 1997. to confirm my findings. 1] 0 All three test pits had weakly cemented to indurated hardpans and compacted layers in the soil profile, overlying extremely gravelly (over 65 % by volume) and cobbly, loamy sands. Construction of the storm drain facilities should include excavation through these restrictive layers down to the extremely gravelly and cobbly loamy sands. DEFINITIONS. In this Agreement certain words appear which have the following meaning: "Owner" or "owners" mean 'the owner (s) of the land to which irrigation water will be distributed by the urban irrigation system that is the subject of this Agreement. "Plans" means drawings or diagrams graphically showing the work to be done. "Specifications" means the statements describing the materials, dimensions, and workmanship for the work to be done. The parties have further entered into an Addendum to Construction Contract for Urban Irrigation System in Crossroads Subdivision Phases 1, 2 and 3 to add Crossroads Subdivision No. 4 on the 21st day of January, 1997, recorded in the records of Ada County, Idaho on the 24 day of January, 1997 as instrument number 97005597. The parties also entered into an Addendum to Construction Contract for Urban Irrigation System in Crossroads Subdivision Phases 1, 2 and 3 on the 22nd day of August, 1997, recorded in the records of Ada County, Idaho on the 8th day of September, 1997 as instrument number 97073075. The parties hereby affirm as unchanged the terms, ADDENDUM TO CONSTRUCTION CONTRACT FOR URBAN IRRIGATION SYSTEM IN CROSSROAD SUBDIVISION NOS. 5 AND 6 - Page 2 • conditions and requirements set forth in the prior agreements except as a result of the provisions of this Addendum. S. START OF WORK TO COMPLETION. Owner will begin the work within 90 days after the date of this Addendum. However, Owner must first obtain the necessary insurance and permits. STATUTORY REQUIREMENTS OF IDAHO CODE § 43-3308. The following provisions are included in this Addendum as required by Idaho Code § 43-330B. A. The cost of construction of the pressurized irrigation system has been, or shall be, paid in full by Owner. B. Any portion of the cost of construction that is not paid upon completion of construction by the Owner or Owners, or by a third party on their behalf, shall constitute a lien against the lots in Crossroads Subdivision Nos. 5 and 6, securing payment of the balance of the construction cost and payment of interest on any deferred installments of the construction cost. C. The balance of the construction cost, if any, shall be included in the assessments levied by Nampa & Meridian Irrigation District against each lot in Crossroad Subdivision Nos, 5 and 6, based upon the ratio that the acreage in each lot bears to the total acreage in all lots in the subdivisions. F. If the pumping station andpipeline serving the Crossroads Subdivision Nos. 5 and 6 also serve other lands, the cost of the pumping station and pipeline has been, or will be, apportioned by Nampa & Meridian Irrigation District to all lands which are planned to be served by the pumping station, so that each acre of irrigable land to be served by the pumping station will be assessed and required to pay the same amount. G. The Owner hereby grants to Nampa & Meridian Irrigation District an easement for the installation, operation, maintenance, repair and replacement of those portions of the pressurized irrigation system. The location of the easement shall be determined by the location of the pipelines and other facilities, as finally installed, the width of the easement in connection with each pipeline shall be no less than five (5) feet on either side of the centerline of each pipeline, for a total of ten (10) feet. 7. OWNERSHIP OF DISTRIBUTION SYSTEM. The pressurized irrigation system constructed under this Addendum shall be the property of, and shall be owned by, Nampa & Meridian Irrigation District. S. OPERATION AND MAINTENANCE BY NAMPA & MERIDIAN IRRIGATION DISTRICT; ASSESSMENTS FOR OPERATION AND MAINTENANCE. As provided in Idaho Code 5 43-330F, the pressurized irrigation system constructed under this Addendum shall be operated, maintained, repaired and replaced by Nampa & Meridian Irrigation District, and Nampa & Meridian Irrigation District may levy and collect annual ADDENDUM TO CONSTRUCTION CONTRACT FOR URBAN IRRIGATION SYSTEM IN CROSSROAD SUBDIVISION NOS. 5 AND 6 — Page 4 s assessments against each lot served by the irrigation system to defray the cost and expense of such operation, maintenance, repair or replacement. The Board of Directors of Nampa Meridian Irrigation District shall apportion to each lot in Crossroads Subdivision Nos. 5 and 6 a portion of the cost of operation, maintenance, repair and replacement of the irrigation system, on the basis of the ratio between the acreage in that lot and the total acreage in all lots in Crossroads Subdivision Nos. 5 and 6. 9. WATER QUALITY. Owner shall not make any cross -connection or tie in between pipes or conduits carrying domestic water supplied by any public or private water service system, and any pipes, conduits or fixtures containing or carrying any used water, irrigation water, or any water or substance from any other source whatsoever, without prior approval of Nampa & Meridian Irrigation District. Notwithstanding anything to the contrary hereunder, Nampa & Meridian Irrigation District has previously approved the cross - connection or tie in between the pressurized irrigation system and the potable water system of the City of Meridian to facilitate the delivery of water to Crossroads Subdivision Nos. 5 and 6 for extended season water before and after the normal irrigation delivery season. 10. SUPPLEMENTAL WATER. NO LIABILITY FOR LACK OF WATER. Supplemental water (water provided both before and after the regular irrigation season) to this subdivision may be provided by the City of Meridian. All costs associated with supplemental water shall be a cost of operation, maintenance, repair or replacement. Irrigation water or water from the City of Meridian may not be available due to drought, harsh weather conditions, governmental actions or other causes. The District shall have no liability to any lot owner, tenant or others for any damages to, or loss of lawns, landscaping or the like caused by lack of water. 11. ENTIRE AGREE16M. This Addendum and the Agreement entered into between the parties contains the entire agreement between the parties hereto with respect to the subject matter of this Agreement. 12. GOVERNING LAW. This Addendum shall be construed under, and governed by, the laws of the State of Idaho. 12. BINDING EFFECT.
