FOR GOOD AND VALUABLE CONSIDERATION, the receipt of which is
hereby acknowledged by the undersigned, INTERWEST DEVELOPMENT
CORPORATION, an Idaho corporation and the developer and subdivider
of Chateau Meadows East Subdivisions and a corporation in which
the undersigned, A. LEON BLASER, is a stockholder, and A. LEON
BLASER, the undersigned individual, both hereafter referred to as
.GUARANTORS, hereby guarantee unto the CITY OF MERIDIAN,
unconditionally, that the drainage pipe or pipes which are placed
along the south lot lines of Lots 9 through 20, Block 1, Chateau
Meadows East No. 1 Subdivision and Lots 21 through 24, Block 2,
of Chateau Meadows East Subdivision East No. 2. Subdivision, and
will carry the historical flows capable of reaching Chateau
Meadows East Subdivision No. 1 and No. 2; and the GUARANTORS
additionally guarantee and warrant the construction workmanship
and the materials on said waste pipe and/or pipes for one year
after the construction was completed which was on or about
February 10, 1992.
This guaranty is a continuing guaranty, binding upon the
undersigned, their successors, heirs and legal representatives,
The undersigned hereby expressly waives notice of acceptance
of guaranty, presentment, protest, demand, notice of default or
error in construction. The GUARANTORS do hereby not only
guarantee as above stated they also guarantee and promise that,

in the event that the pipe and/or pipes referenced above are not
capable of carry the historical flow of irrigation or waste water
that historically drained into the land that is now subdivided
into Chateau Meadows East Subdivisions they will replace the pipe
and/or pipes with larger, or additional, pipe and/or pipes such
that all of the historical flow will be able to drain through said
pipe and/or pipes.
The GUARANTORS do not guarantee the historical flow of the
pipe and/or pipes if the failure to carry the flow is caused by
action, or in-action of the lot owners of the above described
lots; nor are the Guarantors guaranteeing to the City of Meridian,
nor shall they be liable to the City of Meridian, for any
contingent liabilities.
When the undersigned are two or more in number, their
obligation hereunder shall be joint and several.
It is understood and agreed that the undersigned are
guarantors and sureties, and that this contract shall be construed
and interpreted under and by virtue of the laws of the State of
Idaho.
This guarantee shall be enforceable for a period of five
years from the date below.r~

Dear Gary,
The estimated capacity of the existing 15" C.P. under Dixie Ln. is 120
miner's inches. Frog the southeast corner of the CME (Chateau Meadows East
subdivisions the pipe gradient is 0.0040; the gradient with 18"
additional head upstream is 0.00517; and with the full head, 2.9'
additional before Dixie Ln. overtops, the gradient is 0.00626.
At the 0.0040 grade the system capacity is approx. 123 miner's inches, i.e.
in excess of the existing capacity of Dixie Ln. At full allowable head the
capacity is 154 miner's inches, or 28$ greater than the existing Dixie Ln.
pipe. This does not take into account the 400 feet of field drain system
surrounding the easterly portion of the pipe.
This system is built to exceed the capacity of the upstream system to
deliver water to the CME property. The subject system was subjected to
construction damage prior to last irrigation season. This is a known fact.
The property East of Dixie Ln. was subjected to flooding (including the
over-topping of the road) prior to any subdivision construction on the
pro t This has been testified to b the upstream propert owners. The
rigation/waste water system installed wi carry ouvs in excess of
those historically capable of reaching the property. To the best of my
knowledge this meets the intent and the letter of Idaho water law ~~
As you well know, all construction work carries a one year warranty by
the contractor. This work is no exception and is warranted by Bitteroot
Construction.

they will pay the costs incurred.

RE: Chateau Meadows Subdivision #1
Inter west Development Corporation, in order to obtain building
permits prior to completion and acceptance of off-site
improvements agree to the following conditions:
1. All sewer and water appurtenances; such as manholes,
water risers, water meter tiles, sewer stub service lines, fire
hydrants, water line blow-offas, etc. shall be protected by
anchored barricades (barrels) from all traffic.
2. No water meter or occupancy permit shall be issued until
all sewer, water, curb and gutter, sidewalks, and street paving
are completed and accepted. Each building permit and water
assessment application shall so note.
3. On-site construction vehicle traffic to access
construction sites using back lot access roads and are
specifically prohibited from subdivision roads until paving is
complete.
4. A Letter of Credit shall be issued in favor of the City
of Meridian in the amount of $12,000 to assure completion of the
sewer and water within the subdivision (10,000) and a variance
from or installation of street lights (2,000).
5. A Stop Work Order shall be issued by the City of
Meridian for any and all house construction if any of the above
conditions are deficient and remain in effect until compliance.
