A variance from the terms of this Ordinance shall not be granted by the Council unless and until
a written application for a variance is submitted to the Administrator and the Council. Provide
a written riairative containing, where applicable, the following outlined information:
1. Address of subject property. Ashford Greens Subdivision
2. Name, address and phone number of applicant. Brighton corporation ,

7. What is intended to be done on or with the property. Irrigation ditch has been tit e~
and has been approved by the primary ditch users with 2 manholes @ 500'spacing.
8. The district that pertains t0 the subject property. It is a private ditch, not belonging
to a major Irrigation District. Dean Langley & Brighton are primary users.

Ordinance. Has been designed and built according to good engineering practices.

LANGLEY IRRIGATION DITCH LOCATED IN THE ASHFORD
GREENS SUBDIVISION
Narrative:
Brighton Corporation is the owner and Developer of Ashford Greens Subdivision located
in Meridian, Idaho. The subdivision is generally located on the east side of Blackcat
Road approximately 1/2 mile North of Fairview (Cherry Lane). Brighton Corporation's

An irrigation ditch flows across Ashford Greens Subdivision from east to west, generally
from the existing west boundary of "original" Cherry Lane Golf Course, west to Blackcat
Raod. The owners of this irrigation ditch are Brighton Corporation and Dean Langley, a
Meridian resident who lives in the area where the subdivision is being developed. Dean's
address and telephone number is:

With the development of the subdivision and working closely with Mr. Langley, Brighton
Corporation tiled the irrigation ditch through the subdivision. The ditch at all times is
located in subdivision common area and parallel to public right of way which allows easy
access for maintenance and/or repair should the need arise.
Using good engineering practices in design and construction, Brighton Corporation tiled
the irrigation ditch, unaware of a City Ordinance restricting the distance between
manholes to 400'. The reasons for constructing and designing manholes which exceeds
the allowed 400 feet between them are as follows:
The ditch is placed in common area and adjacent to public right of way which
allows. excellent access to the ditch at all times for maintenance and repair. The
course of the ditch does not jog around and between lot lines and fences with

sharp angle points, which essentially results in limited or no access for cleaning
and repair equipment.
2. Modern cleaning equipment has the capacity to clean ditches of this size for up to
700 feet and greater. The company, Master Rooter, can clean up to a distance of
680 feet and Roto Rooter, by adding a second hose (coupling 2 hoses together)
has the capability of cleaning up to 720 feet. (Additionally, there is access to all
manholes which essentially reduces the cleaning distance by one-half of what it
would be with access at only one end.)
3. With fewer manholes/cleanout structures in the ditch, the flow characteristics
increase, which allow for more water to be passed through the pipeline.
4. Under the circumstances stated above, good engineering practices would not only
allow but encourage manholes at distances greater than 400 feet.
A set of design plans, which are also "as-built" plans are enclosed depicting the proposed
addition of one manhole (Irrigation Box 4A) and requesting from the City Council a
variance to allow for spacing of approximately 500 feet between Irrigation Boxes #3 and
#4 and between Irrigation Boxes #5 and $6.

As requested by Mr. Mike Tanner with Brighton Corporation, I am
writing this letter to verify the current status of our irrigation
water delivery through the Ashford Greens development on Black Cat
Road.
Since this past fall, Mike has worked with our family to determine
the best method of water delivery from the Eight Mile lateral. We
both saw advantages in co-mingling our two heads of water at the
headgate and then split our water back out at the delivery point
on Black Cat Road via a submersible weir.
At this time we are pleased with the 18 inch line that has been
installed along with the cleanout boxes and gate/measuring systems.
Mike has checked with us several times since the irrigation water
has been turned in this spring to discuss the performance of the
new pipeline. We have identified some minor "fine tuning" points
to work on as needed based on the ongoing performance of the
pipeline.
We are satisfied with the work of the Brighton Corporation and Mike
Tanner at this time and do not foresee any major concerns or issues
presenting themselves. Mike has assured us he will respond to any
issues that may need to be addressed as necessary.

has the capability of cleaning up to 720 feet. (Additionally, there is access to all
manholes which essentially reduces the cleaning distance by one-half of what it
would be with access at only one end.)
3. With fewer manholes/cleanout structures in the ditch, the flow characteristics
increase, which allow for more water to be passed through the pipeline.
4. Under the circumstances stated above, good engineering practices would not only
allow but encourage manholes at distances greater than 400 feet.
A set of design plans, which are also "as-built" plans are enclosed depicting the proposed
addition of one manhole (Irrigation Box 4A) and requesting from the City Council a
variance to allow for spacing of approximately 500 feet between Irrigation Boxes #3 and
#4 and between Irrigation Boxes #5 and $6.

As requested by Mr. Mike Tanner with Brighton Corporation, I am
writing this letter to verify the current status of our irrigation
water delivery through the Ashford Greens development on Black Cat
Road.
Since this past fall, Mike has worked with our family to determine
the best method of water delivery from the Eight Mile lateral. We
both saw advantages in co-mingling our two heads of water at the
headgate and then split our water back out at the delivery point
on Black Cat Road via a submersible weir.
At this time we are pleased with the 18 inch line that has been
installed along with the cleanout boxes and gate/measuring systems.
Mike has checked with us several times since the irrigation water
has been turned in this spring to discuss the performance of the
new pipeline. We have identified some minor "fine tuning" points
to work on as needed based on the ongoing performance of the
pipeline.
We are satisfied with the work of the Brighton Corporation and Mike
Tanner at this time and do not foresee any major concerns or issues
presenting themselves. Mike has assured us he will respond to any
issues that may need to be addressed as necessary.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 p.m., on August 19, 1997, for the purpose of reviewing and considering
the Application of Brighton Corporation, for a Variance for land located in Section 3,
T.3N, R.1 W, Boise Meridian, Ada County, Idaho, and which property is generally
located'/ mile North of Fairview (Cherry Lane) on the east side of Btack Cat Road. The
Application requests a Variance from the irrigation ordinance to allow a distance of
approximately 500 feet between two manholes on the piped Langely Irrigation Ditch,
rather than 400 feet as allowed by the Ordinance.
A more particular legal description of the above property is on file in the City
Clerk's office at Meridian City Hall, 33 East Idaho Street, and is available for inspection
during regular business hours.
A copy of the Application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.

The above entitled Application came on for public hearing August 6, 199?, at the hour of ?:30
o'clock p.m., the Petitioner appearing through 1Vlike Tanner; the Meridian City Couna'1 having dui
considered the evidence presented and the matter, makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use Permit was published for two (2)
consecutive weeks prior to the said public hearing scheduled for August 6, 199?, the first publication of
which was fifteen (16) days prior to said hearing; that the matter was duly considered at the August 6,
1997, hearing; that the public was given full opportunity to express comments and submit evidence; and \
that copies of all notices were available to newspaper, radio and television stations. That copies of all

2. That notice of public hearing is required to be sent to property owners within S00 feet of the
external boundaries of the land being considered pursuant to 11-2-416 E., 11-2-419 D., and 11-9-612 B. l.b
of the Revised and Compiled Ordinances of the City of Meridian; that his requirement has been met.
S. That the property is located within the City of Meridian; it is located near Black Cat Road
between Ustick and Cherry Lane; the parcel is part of a parcel of property that was annexed by the City
over fourteen years ago.

4. The application for the variance stated that the request was to waive the Ordinance
requirement requiring aocese,/cleaaout bones at a maximum of four hundred feet (400 spacing; that the
developer is Brighton Corporation.
b. That the Applicant submitted a variance request to be aIIowed not to meet and comply
with Meridian Ordinance 11-9.60b M, which specifically states in part as follows:
"11-9-806 M, PIPING OF DITCHES
... The pipeline shall have a sloped bar-grated inlet structure and accesaJcleanout boxes at a
maximum of four hundred feet (400 spacing and at all single points of the pipeline. ..
8. That the Applicant submitted a variance request as required by 11-2-418 and stated that
the characteristics preventing compliance with having the cleanout bones with a maximum of four hundred
feet (400 spacing between the hoses were that it was not aware of the requirement, that the bones were
already constructed and in place; that the Applicant has agreed to put is one cleanout structure and then
request a variance for two other distances that exceed the ordinance requirement by 100 feet each;
therefore the cleaaout bones would be at 600 feet separations.
7, Mme Tanner also stated that it was good engineering practices to lengthen the distance
between the cleanout hoses if there is access and the ability to access for repair and maintenance and
there is equipment that can go sin to seven hundred feet for cleaaout purposes.
8. That the ditch carries water that is, or will be, used for pressurized irrigation.
9. That the City Engineer, Gary Smith, in response to a question from Councilman Rountree,
stated that the variance would not, and does not, pose a technical problem.
10. There was no other public testimonyy given.
CONCLUSIONS
1. That all the procedural requirements of the Local Planning Act and of the Ordinances of
the City of Meridian have been met including the mailing of notice to owners of property within 300 feet
of the external boundaries of the Applicant's property.

2. That the City has authority to giant variances ptn~suant to Section i1-2-419 of the Zoning
Ordinance and pursuant to Section 11-9-612 aF the Development Ordinances.
3. That the City Council has judged this application by the guidelines, standards, criteria, and
policies contained in the Subdivision and Development Ordinance upon which it may take judicial notice.
4. That the Couna'1 may take judicial notice of its own proceedings, those of the Commiseuon,
governmental statutes, ordinances, and policies, and of actual conditions e~dsting within the City and the
state.
6. That the following provision of Section 11-9-806 M, PIPING OF DITCHES, is noted, which
is pertinent to the Application:
"1'he City may waive this requirement for caverin~ such ditch. lateral or canal if it Ends that the
uublic vuroose reauirin¢ such will not be served in the individual case."
6. That the specific requirements regarding a veu lance that must be evidenced and found by the
City Council are as follows:
"No variance shall be favorably acted upon by the Councd unless there is a finding, as a result of
a public hearing, that all of the following exist:
a. That there are such special circumstances or conditions affecting the property that the
strict application of the provisions of this Ordinance would be clearly impracticable or
unreasonable; in such cases, the subdi~rider shall first state his reasons is writing as to the
specific provision or requirement involved;
b. That strict compliance with the requirements of this Ordinance would result in
extraordinary hardship to the subdivider bec~iuse of unusual topogiaphy, the nature or
condition of adjacent development, other physical conditions or other conditions that make
strict compliance with this Ordinance umreasonable under the circumstances, or that the
conditions and requirements of this Ordinance will result in inhibiting the achievement or
objectives of this Ordinance.
c. That the granting of the specified variance w~71 not be detrimental to the public welfare
or in41urious to other property in the area in which the property is situated;
d. That such variance w~71 not violate the provisions of the Idaho code; and
e. That such variance will not have the effect of nuIlifying the interest and purpose of this
Ordinance and the Comprehensive Development Plan.
8. That there does appear to be a specific benefit or profit, ecariomic gain or convenience to the
Applicant if this variance is granted.

9. That with regard to the specific evidence that must be found it is concluded as follows:
a There are special circumstances or conditions affecting the ditch that the strict application
of the provisions of this Ordinance would be clearky impracticable or unreasonable.
b. That strict compliance with the requirements of this ditch tiling Ordinance requiring
spacing of 400 feet between cleanout boxes would result is extraorduiary hardship to the
Applicant. espeaal~y since it was found that there would be no technical problems with the
wqy Applicant constructed the separation between the cleanout hoses and with what the
Applicant agreed to do.
c. That the grantiag of a variance would not be detrimental to the public's welfare or
poesib~y injurious to the public.
d. That the granting of this variance would not violate the Idaho Code.
e. That the variance would not have the effect of altering the interests and purposes of the
ditch tiling Ordinance which is included is the Subdivision and Development Ordinance
for safety purposes.
10. That it is concluded that the Application for a variance from 11-9-606 M, PIPIIJG OF
DITGZiES, should be granted.

The lateral in question as shown on the plat is the Eight Mile Lateral. The easement of the
Eight Mile Lateral is SO feet; 2S feet from the center each way.
The Nampa & Meridian Irrigation District operates and maintains the Eight Mile Lateral and
we request the variance not be allowed as the District would not be able to reach a plug if we
allowed further distance between clean-out and turn boxes.
If you are referring to the Langely delivery lateral, the Nampa & Meridian Irrigation District
has no comment as this is a private wateruser lateral beyond our point of delivery. If you are,
in fact referencing the Eight Mile Lateral we will need to have a license agreement in place.

Corrie: Is there a representative from Brighton Corporation here tonight?
Mike Tanner, 12426 W. Explorer Drive, Boise, was sworn by the City Attorney.
Tanner: Mayor and Council this is kind of a clean up measure from a ditch that we tiled
last fall with phase one of Ashford Greens Subdivision. At the time we put it in we were
not aware that there was an ordinance relating to maximum distances between
manholes or clean out structures in pipelines, an ordinance by the Council. We found
that out with phase 2 and we do have in working with Mr. Gary Smith the City Engineer
we have agreed to put in one manhole, an additional manhole or clean out structure and
then request a variance from this Council for two other distances to exceed the
ordinance by 100 feet approximately a piece. In other words to be 500 feet between
clean out structures rather than an ordinance mandating 400 feet. Reasons for that or
two or three and I would just like to share that with you. Number one we have a pipe line
in a ditch that is fully accessible on it entire length. And Tallimore Blvd. which is the
major blvd. going in from Black Cat Road all the way back to the east to the club house
this irrigation ditch is tiled in the common area just right adjacent on the south side of

this right of way. Fully accessible for cleaning, for repair, for whatever purposes. So it is
not a situation where wee have a ditch that winds between back yards, it jogs at lot lines,
it is difficult to get into and t think that is the .major reason maybe why the ordinance
would speak to a 400 foot length. .Another reason is that the flow characteristics with
less clean outs, less manholes, are increased the losses are actually reduced, it is
capable of carrying more water. This is good of course for all the users in the ditch. We
actually get a better pipeline. It is good engineering practices to lengthen those
manholes if you have access and the ability to access for repair and maintenance of the
ditch. We do have cleaning equipment now that will go sic to seven hundred feet,
standard by any of our Roto-Rooter, Master Rooter services that can access that right
there at Talimore Boulevard and clean that from manhole to manhole. And additionally I
would say that this is something that is approved and acceptable by both of the users
on the ditch. Those two users are Mr. Dean Langley and Brighton Corporation because
we have co-mingled our waters and we carry our pressure irrigation water in this ditch
down to where we divide it and we pressurize it and we pump it through our pressure
irrigation system and divide it there with Mr. Langley. We have worked well with him,
he, we certainly have let him know fully what is going on and tried to take care of him
and all of his irrigating .interests. He has been pleased so far with everything that we
have done. So we do feel like Mayor and Council that this is under these circumstances
it is a good situation, now a bad situation, kind of a clean up item from this past phase
and we ask your approval on this particular variance.

Rountree: I had a question of staff, Gary does this pose a technical problem?
Smith: No it doesn't.
