Preliminary Plat Condition Clarification

We appreciate your approval last night of our annexation, preliminary plat, and
Conditional Use Permit applications for the Tuscany Village project. The letter is to
request clarification on the condition stated by Mr. Nary in his motion for approval of the
preliminary plat regazding cost sharing of the 10" sewer extension in Victory Road.
As stated on the record, our offer was to enter into a private cost sharing agreement with
Quasar Development to build a 10" sewer line from the 2T' sewer line located interior to
our site to the intersection of Locust Grove and Victory Road.
We believe Mr. Nary's motion was to share in the cost of the 10" sewer line from our
property boundary to the intersection of Locust Grove and Victory Road.
If Quasar Development does not wish to enter into a private cost sharing agreement, we
will satisfy the standard full-frornage condition policy to extend the 10" sewer line
beneath the Ten Mile Drain at our east property boundary at our sole cost. Quasar or any
other development could subsequently connect to the sewer line within the right-of--way
of Victory Road.
We believe the benefit of the agreement would be to utilize one contractor on a time-
certain schedule to build the entire segmem from the existing 2T' line, perform the drain
crossing, and extend the line to the intersection in one effort. Tn addition, only one road
closure and pavement replacement would be required.
We plan to testify at the public hearing for Sageland Development regarding this issue. If
required, we would also request our Findings be pulled from the Consent Agenda to
clazify the matter. Please advise us how to proceed.
