Thank you foi sending me the list ofquestions and issues regarding the proposed Silver ' ,
_ " Creek project. Lee and I met earlier this week to discuss tho issues and •questions posed
iu .your September 11''h letter, and we have come up with the following answers:

0&M of Water and Sewer Systems
As you are already aware, we are developing a piece of land outside ol'Nampa that has its
own well and has a pzessure sewer service connection to. the City of Nampa's sewer
system. We can provide you v~ith a copy of the. Q&M agreements for both of the water
and sewer services.
We will work with an independent water serviccprovider to provide operation and
maintenance of the well and compliance with DEQ until such tiTrtc as the City wishes to
take ownership of the well.
Billing for sewer service canbe Simplifiedby charging s~werto the I3OA and "then the•
" .HOA wilbbe responsible for collecting individual sewer fees,.
• Negotiation of well ownership transfer
The City of Meridian will be given the fast right ol'refusal in purchasing thc.well, and at
the time that the city wishes to.purchase the well it will be made available to the Cily for
fait market value (as established by an independent party or parties). We will be
-responsible for obtaining and holding the, water rights'for the wells, in addition co being
responsible for legal fees associated with a possible water rights, piotest:

We believe chat the City has the right, per State Code, to participate as a third parry to a
development agreement and`thai you have the ability to'operate a distinctly separate
water system. VJc will provide a service provider Cooperate and maintain, the water

Liability of Water System
_ Like all wells in the City of Meridian, lha proposed well might be unable to product the,
required fire flows, plus domcstiafire Clow after several years of opcration...If the-well is
still-ownbd by Lee Ce~~ters and a problem occurs with the well-the liability to fix or
correct the problem will be. his. if the City, who will have approved the designand
operation of the well, takes ownership of the well al some point, the liability will be the

City's, but at that point it should be connected as part of thelarger municipal water
system for redundancy..
Dual Connection Yrcvention
We can prohibit dual conncckions to the water system by CC&Rs and through the
development agreement.
Pressurized Irril;ation -
A pressurized irrigation system within the subdivision will be utiliring surface water,.
Fire Protection -
Wehave spoken to Joe Silva about fire protection and he has indicated that fire flowwill
need3o be a minimum of 1;p00.gpm.for the neighborhtibd, as long as the houses within"
the subdivision do not exceed 3,600 square feet. ~ ~ '
Enforccinent ~ • .
The City can enforce the provisions of the llevelopment A~eement in several ways,
