RE: Proposed Silver Creek Subdivision
Dave,
As we discussed at the Pre-Council meeting Tuesday night, the Public Works
Department had a list of unresolved questions remaining when City Council decided
earlier this year to not make a recommendation of approval to Ada County for the
proposed Silver Creek project. While the Public Works Department had made some
preliminary investigation into sewer flaws and capacity at the Bear Creek lift station, we
did not proceed any further after City Council's decision. As I was directed, I am
fonnrarding to you a list of questions and issues regarding the Silver Creek project.
SEWER
• Total number of units proposed and schedule (Silver Creek}
• Current flow information at Bear Creek Lift Station (City -1 week) -completed
• Current flow in receiving sewer from lift station (City -1 week) -completed
• Off-Peak pumping calculations (Silver Creek) - still a part of proposal?
• Maintenance requirements of sewage storage facility (City research) - 2 weeks
• Computer modeling (City - 2 weeks)
• Operation & Maintenance agreement for lift station -standard agreement
available but may need modification since outside City
Total time for sewer evaluation estimated at six weeks.
WATER
• Layout of entire development for modeling purposes (LC -1 week)
• Computer modeling (City -1 week)
• What are DEQ requirements for community water system regarding two
supplies? (Silver Creek)
Total time far water evaluation estimated at-two weeks.
OTHER QUESTIONS AND ISSUES
• Public Works-and Attorney review of draft water facility O & M agreement. Must
address following issues:
o Obligations regarding monitoring and reporting requirements to DEQ
o Costs (O&M and repair)
o Default provisions (who steps in? DEQ?)
• Preparation of sewer system O & M agreement. Is City of Meridian O & M of
collection system part of current proposal? Must address following issues:
o Obligations regarding monitoring and reporting requirements to DEQ
o Costs {O&M and repair)
• Negotiation of well ownership transfer (initially or in future?)
o Who holds water right? Is there any value associated with it?
o Need for two wells? Who pays legal fees for possible water right protest?
• Development (and/ornon-development) agreement which must include following:
o City review and approval of all sewer and water facilities prior to
construction.
o Payment of all review and inspection fees for water and sewer facilities
o Reimbursement for well review
o Future annexation notification (i.e. plat note, deed restriction & ?)
o Well construction specifications or reference to them
o Well, water right and well lot transfer. Costs? Right of first refusal?
o County building permit issuance. (Non-build and non-occupancy
agreements)
• Does City have authority to operate distinctly separate water system?
• What happens if well does not produce required fire flow plus domestic after a
couple of years? Whose liability?
• Does City have authority to prevent dual connections? I.e. sprinkler system
hook-ups.
• Will there be separate PI system utilizing surface water?
• Assume the City does not object to County project and it proceeds and the City
executes' anon-development/development agreement with the developer. How
does Public Works staff enforce standards? What are penalties in the
agreement? If we cannot come to agreement on the well construction, transfer of
ownership issues, operations agreements, etc., what happens? Project will have
already been approved by Ada County. The City no longer signs plats on non-
annexed property.
