10. The subject property is adjacent to the new library property and would provide
22 additional parking places as well as pleasant surrounding plantings.
11. It is necessary to change the zoning to LO, because the existing R-4 zoning does
not permit the site to be used as a library. The library is a desirable land use and
the additional parking will assure th:t library patrons will park on the library site
rather than on the nearby side streets.
12. One map of scale one inch equals one hundred feet -see Attachment #5.
13. Thirty copies of map of scale one inch equals three hundred feet -see Attachment
#6.
14. List of mailing addresses of all property owners within 300 feet of the external
boundaries of the land being considered -see Attachment #7.

15. The Comprehensive Plan for the City of Meridian supports the new expanded
library which "will serve as the cultural, informational and receational center for
self-directed, lifelong learning in the community. " (7.1 U) A griority for the City
of Meridian is to provide adequate public parking for all facilities. Policy 7. SU
reads, "Adequate space for new library parking is a priority."
16. Check from the Meridian Free Library District in payment of the following fees:

ITEM #8: PUBLIC HEARING: REQUEST FOR A REZONE FROM R-4 TO L-O;
PARKING FOR NEW MERIDIAN LIBRARY BY MERIDIAN FREE LIBRARY DISTRICT:
Corrie: I would invite a member from the Library to come forward.
Tom Ensley, 1197 Main Street, Boise, was sworn by the City Attomey.
Ensley: We are requesting as noted a zone change on a piece of property. You are all
perhaps familiar with the new library that is under construction East of Linder Road and
East of 13"'. The property on Cherry Lane existing Library is sitting on about 2.2 acres
in the midst of a residential area. You entertained and approved a rezone change on
this I think it was last Fall of 1996 or 1995. The existing library facility as I said is under
construction due to be completed in another month or two. There are two drive ways off
of Cherry Lane that surround the (inaudible) with existing parking on the north and
south of the building. The library district is looking at purchasing additional parking
area. Of course which is our request tonight. Apiece of property that is just under a '/z
acre, actually it is 3.9 acres. It abuts to the East of the existing library property. There
are three (inaudible) to the East and one to the north. The property is L-shaped as you
can see Leisure Lane is a private lane is to the east of this property. We are not gong
to access onto Leisure Lane at all. What we are looking at is providing 21 additional
parking places one of which is a handicapped parking. It will access off of this East
drive way -and it will be landscaped around the perimeter. The cedar fence then
matches the fence that will be around the library property fence. It will be lit, it will be
(inaudible) grassed with trees around as you can see around the perimeter. Then off
the existing driveway a grassed area that will accommodate both the on site drainage
and will serve as a garden area or a green area for the library people. So we are
requesting that you approve this zone change.

Corrie: Council, any questions?
Bentley: Mr. Mayor, on the short piece of grass that you have that runs into Leisure
Lane, what do you propose to do to keep vehicles to drive through there?
Ensley: That will be fenced, there will be no access through the fence.
Bentley: And you lighting you are going to control?
Ensley: Yes, the same lighting that we are using on the library parking?
Bentley: Is your roof finished yet?
Ensley: Almost
Corrie: Thank you very much, is there anyone else from the public that would like to
enter testimony?
Terry Leighton, 1811 Leisure Lane, Meridian, was sv~rorn by the City Attorney.
Leighton: I have a few concerns and I would just like to go on record and maybe a
recommendation. My first one would be possibly to have the Library District consider
looking into possibly a couple of gates right here. I have concerns about that being so
isolated people parking back there and getting into trouble. I am about ready to have
the police come out because of people screwing around at the back of the library back
there. That is one of my concerns, another one I would just like to go on record as to
make sure the drainage would go into this controlled area and not go into where my
drain field is that I just had approved in the last year by Central District Health. I just
also want to go on record to say that it would be controlled like Mr. Ensley said as far
as no access to Leisure Lane because that vuould be a lot of traffic right by my master
bedroom. I had one other note here, I have a question as far as the fencing. I
understand they have to have a six foot fence to match around the library, but yet as far
as the City zoning requirements and up to roads, once they get within the setbacks you
have to be down a three foot high so I would like to have that answer on how that is
going to be addressed and whether they are going to keep that within that distance or
they are going to drop it down to 3 foot or what that is going to be. I thank you for your
time.
Corrie: Anybody else from the public that would like to enter testimony at this time?
Ensley: Let's see, the issue of the fence will be constructed strictly according to City
ordinance requirements as far as height and of course we do want it to match what is
going on, what is happening around the rest of the property. The other issue was the,
the parking lot will be fully designed to handle, again according to City ordinance, will

be designed to handle all on site parking. There will be no run off. I have forgotten the
other question.
Tolsma: He was wondering about controlled access back there after hours, (inaudible).
Ensley: No, it is open at this point.
Rountree: We talked about that in the original hearing (inaudible) Chief had some
problems with that.
Morrow. (Inaudible)
Tolsma: The other issue is that fence. that he had on there. If they run back out to the
set back requirements you are going to end up with a three foot fence (inaudible).
Bentley: I have a question for Gary on. this fence, seeing that Leisure Lane is privately
owned and not in the City does the fence requirement apply as far as the height and
setback?
Smith: Councilman Bentley, as far as the requirements, it is in the City, it is a private
road way that is true. The main thing that we look at on these fences is that we don't
impede vision from the traveling public or from people backing out onto a roadway so
that they can see. We do have in places in the City where a 6 foot fence has been
constructed adjacent to a roadway but the access to that road way is restricted from the
lots. So it is basically a corridor fencing. There is no access from the lots onto the
roadway. When we get to an intersection street off of that con-idor road then we
require that the fence be reduced in height to comply with our ordinance. That is on a
public road. Now, I don't know what the set back requirements have been in that
subdivision. Property lines go to the center of the street. So if you are talking about a
setback from a property fine I am not sure where that is. I don't even know how
buildings permits were issued out there. It is an illegal subdivision and has been since
it began. But that is neither here nor there.
Bentley: But if the whole purpose of the fence in this issue is to keep people out of
there I don't think a three foot high fence is going to do them any good.
Smith: It is not going to keep pedestrian traffic out of there no. But I think you have to
be careful as to the location of that fence concerning Mr. Leighton's property adjacent
to it. I don't know where his driveway is, whether it is on that side of his residence or on
the other side, but he has to be able to see out of there when he comes out onto
Leisure Lane. If you are looking at access restriction only maybe a solid wood fence
isn't the type of fence that you want fiD build. Maybe you need to cronsider some type of
open fence that you can see through, I don't know. There is going to be landscaping in
there also

Morrow. Question, Gary, how wide is Leisure Lane currently, do we know?
Smith: I don't recall what the easement width is on it Counalman Morrow, I just don't
recall. It might be 40 feet wide, 20 foot on each side of the centerline.
Morrow. What keeps this from becoming a public street ultimately? Is it not (inaudible)
Smith: Wefl I don't think anybody wants it. As far as the~Highvway District is concerned
they wouldn't take it as a public street without significant improvement.
Morrow: Of course that improvement would have to be either done through an LID for
the property owners?
Smith: Yes
Morrow. The point of my question was going to be is if it is going to be improved to a
public street at some point in the future that may very well mean that the fence gets
moved back and forth anyhow if we allow the fence to come out to the I guess the
setback .line if you can determine where the setback line is. It seems to me like the
dilemma here is do you approve the fence at a lesser height because of the site issue
or do you move the fence back and allow it to be at the six foot height and if you move
it back at what point do you move it back from?
Smith: I think Councilman Morrow that from my standpoint it would be better to move
the fence back. Now, how far you move it back I don't know, I don't know how long that
finger of property is, how deep that finger of property is.
Ensley: It is 95 feet.
Smith: 95 feet, typically in platted subdivision areas the fences are located no more
than 20 feet or no closer than 20 feet for right of line for the street which is 25 feet from
the center of the road. That is in a platted subdivision. So, from the center of the road
is 45 feet back to fence, a 6 foot fence. I don't know in this case it would have to be
back that far. I am not, I am just not familiar with what is adjacent to it.
Morrow. Let me ask you this, is this maybe an issue that, I don't want to get hung up
on this issue, is this maybe an issue that could be dealt with at the staff level and make
that determination after doing some on site looking and meeting with Mr. Leighton and
getting some input from him and maybe walking the parcels of property and making the
determination where it ought to go?
Smith: Yes sir.

Corrie: Would that meet with your approval?
Ensley: Yes, I think we are flexible.
Leighton: (Inaudible) I just was wondering if there is going to be any more addressed
about the gates, it kind of just got stopped as far as (inaudible).
Corrie: Gates, that was one of your questions.
Ensley: Again as I say we are fairly flexible, I think they would just assume not have
gates because they just assume not have public access back there. But again we are,
whatever the City is going to require.
Morrow. Mr. Mayor, I believe his question was with respect to gates on the entrance to
the parking lots so people couldn't gain access to the parking lot after hours if
understood Mr. Leighton's questions.
Leighton: (Inaudible)
Ensley: !think they v~rould rather not, that would not be very desirable for someone to
have to go out and open and close gates that wouldn't be a normal operation and it
would be somewhat of a hardship for them to have to control gates on their own
property:
Morrow. Mr. Mayor, Chief Gordon, would you refresh my memory and the Council's
memory, you testified in the original hearings on this proposal for the main building
conceming the gates, gating off the area around so there wouldn't be after hours
access. You were opposed to the gating off, could you refresh my memory in terms of
the reasons for that please?
Gordon: Just that the access for the patrol cars would be limited also. We would have
to, the officers would have to leave their cars to go back and check the area.
Morrow. Thank you
Corrie: Any further testimony from the public? Council any further questions, concerns,
dialogue? I will close the public hearing at this time, Council there are findings of fact
and conclusions with this I believe.
Morrow. Mr. Mayor, I have a question for the Counselor, the issue conceming the fence
and what we talked about earlier, a solution to the problem is not in the findings of fact
as prepared for us (inaudible).

Crookston: Yes you can.

stipulating that the fence that borders Leisure Lane be negotiated between the City

and that the fence group do an on .site resolution of that problem.

Corrie: At this time I will open the public hearing and invite the representative from the
Antique, craft and collectible shop.
Eugene Peters, 1323 N. Meridian Street, Meridian, was sworn by the City Attorney.
Peters: Mr. Mayor and Councilmen, upon meeting on November 8"' with the Planning
and Zoning Commission we have agreed to and are in the process of drawing up plans
right as we speak, detailed plans in regard to the parking in the back of this property.
We have agreed to do our best to comply with the lighting and so an. As I get these
plans drawn up I will submit them to Shari in the office to where we can make sure they
are approved. Because of the time of the year of course we haven't stepped forward
and gotten very far on this. It has been under snow and everything else but we met with
Ada Asphalt in regard to measuring and doing things like that as far as how we would
pave it. I plan on getting an engineer in there to come up with or help us agree on a
design for the drainage and to make sure it drains on our own property. ~As far as
lighting goes, I think I know what I have to do there and I will make sure that with going
through Shari again there. I think I just have to put a small light in the back so it doesn't
interfere with the neighbors. In regard to one of the Council or Planning and Zoning
Commissioners had a concern about turning around. I have measrred all of that out
and like I say I don't have the drawing exactly together yet but there will be plenty of
turn around room back there once I move that fence forward. The aAey way is now 15
feet wide and they have requested going 12 feet wide with paving. Then where my
property starts I am going to push that fence to the east to where we will have a 44 or
45 foot area in the back. It will be very similar parking arrangement as the All State
Insurance company up the street. They have their full back yard pared. This, you
have to come in past. one of our other neighbors to get to it but there w~l still be room to
get in and turn a car around rather easy and go back out. It would sure be nice if the
City would pave that alley for me. Anyway, that is kind of where it stands at this time.

Johnson: At this time I will open the public hearing and invite the applicant or the
applicant's representative to address the Commission.
Tom Ensley, 1197 Main Street, Boise, was sworn by the City Attorney
Ensley: It was last winter, I think it was in January or February that I met with you on the
new library facilities on Cherry Lane. I don't know if you can see this, on Cherry Lane.
That facility is now under constnaction and this is the existing building with parking at front
and back. The request tonight is to, the District has the option to purchase a piece of
property to the east of their existing facility. It is located off of the private Leisure Lane that
accesses to Cheny Lane. It is a piece of property that is 130 feet by 108 feet and then it
legs over 32 foot wide leg extends over to Leisure Lane that is to the east. The purpose
of the purchase or and the rezone request is to provide additional parking for the new
facilities. This would accommodate 21 parking places, it wou~~ be accessed strictly from
the library site itself with 2 accesses in and out within the existing driveway. There is a
driveway that goes around the building and this would be on the east side driveway. It
would impact the existing facilities in no way other than just accessing off through curb
cuts. The property would be of course landscaped and fenced according to the City
ordinances with the green area. It would- be two fold providing a green space for the library
facilities itself also then it will serve as the drainage for the on site drainage. Then there
will be a.buffer of trees and landscaped area around the perimeter of the parking. This leg
area would not provide, we are not planning for access to Leisure Lane. We would use
this as a greenbelted area also. I think that is (inaudible).
Johnson: Okay, thank you very much, are there any questions of Mr. Ensley? Anybody

else, anybody have any questions. This area in front there that is just lawn and sidewalk?
Ensley: This area here, that would be lawn area, grassed and trees and shrubbery and
sidewalk. Probably they will use it in the operation of the library, they will have some story
hours out there and so forth.
Johnson: Any picnic tables anything like that planned?
Ensley: Not necessarily, could perhaps be, it is really just kind of open at this point. It is
just kind of (inaudible)
Johnson: Thank you very much, I guess we have no questions unless you do Mr. Oslund?
Oslund: I just have one that I was thinking about, is this needed to meet your parking
requirements for the main development or that is already met?
Ensley: No, we were required to have 75 we have 77 on the site. But it is obvious that
additional parking will be needed, particular in he meeting room and so forth as the facility
get into full swing, they will. Additional parking would be most convenient.
Borup: Was this property split off from an existing lot or was it already that configuration?
Ensley: It is that configuration right. There is a lot here, there is a lot here on the corner
and then when (inaudible)
MacCoy: I think it would make good sense, I have been up there and driven and walked
the whole thing. I thought it was a good direction to go for you people because you have
a chance to use that land.
Crookston: Mr. Ensley, what type of guarc~ng or buffer or whatever are you going to do so
the people cannot gain. access off of Leisure lane?
Ensley: It will be fenced, as the rest of the fence around the property, it is a cedar, 6 foot
cedar fence.
Johnson: If there are no further questions from the Commission could you tum that around
so the public could see that. This is a public hearing, is there anyone else that would like
to come before the Commission, now is the time to do it. Any questions?

Leighton: I have a few concerns basically about the fencing and stuff being a cedar and
also the access (inaudible).
Johnson: You need to address us and speak into the mic because we pick it up and then
we transcribe it. So I would appreciate it, questions directed to us please.
Leighton: My concerns are the fencing which were addressed, the 6 foot cedar. And the
buffer zone, is this 30 foot leg which was addressed as being the flood plain control or for
the parking or is the back part where I see the little area. How are we going to be
guaranteed that this buffer is going to be fenced and controlled? Those are my questions.
Johnson: Okay, is that all you had Terry? Thank you, is there anyone else here from the
public that would like to come forward at this time? We will try to gather all of the
information, all of the testimony in questions and try to answer all of the questions at once.
Denise Crabtree, 1927 Leisure Lane, was sworn by the City Attorney.
Crabtree: I am very relieved to see that you are not going to use Leisure Lane. I had
stopped at the library one night and understood from what they said that they were real
happy that they could have another out for the library could just use Leisure Lane. So I am
very relieved to see that is not going to happen. but, I don't want people just walking down
here it is still a private lane and we need to be careful about how we, there is not really
much room for pedestrians if there is entry way for pedestrians in there it needs to be
considered for their safety too. That is what I would like to add.
Johnson: Thank you, anyone else? Mr. Ensley, would you like to comment perhaps on the
questions brought up by Mr. Leighton?
Ensley: I believe we did answer the one about the green belt area, we will be using this
(inaudible) to accommodate the ~n site drainage. There will be-a fence around the entire
property so there will be no access to it then from other than the library itself of course
from the parking area and from the library site will be the only access to that. Is there
another question?
Johnson: There were just some concerns not really questions.
Ensley:.) should answer that there will be no pedestrian traffic, (inaudible)
Johnson: Well there is nothing in your design that encourages any additional traffic at all,
Leisure Lane pedestrian or otherwise that I can see. Thank you very much, one last shot,

Bolton: I was just concerned about the lighting on that, like at night and stuff because I live
right there in the corner.
Johnson: That is your only concern? Thank you, do you have another question Terry?
Leighton: This is a question just to you guys basically. I don't know the legality or the
zoning but could a person if they lived near that purchase that leg to control that access
maybe and save the library district some. money of the fence and all of that and the
buffering system. If a person was to come just straight off, because that attaches to my
yard if I could just make that part of my yard is what I am thinking for that 32 foot.

Johnson: The property that is now owned by who, which property are you talking about
(inaudible)
Leighton: (Inaudible)
Johnson: You would have to talk to the owners of the property. They have an option on it
which I assume they are not the owner yet (inaudible).

Johnson: Can it be split I would think it could be, I don't know. Anybody else have
anything? Do you know enough about the lighting at this point, because I know we have
(inaudible).
Ensley: We really haven't gone to that point yet but it will match the lighting on the, it will
of course r~3quire some lighting for night use. The lighting is designed to be a down tight
and we have been very sensitive about that not (inaudible) our project is surrounded by
residential.

Johnson: I will now open the public hearing and ask Eugene Peters or his representative
to address the Commission.
Eugene Peters, 1323 N. Meridian Street, was sworn by the City Attorney.
Peters: Pretty much what I submitted is what we have been planning. Basically the
property at 1323 N. Meridian Street the east side of this street, the entire east side is
already zoned C-C. Eventually the entire street we understand is going to run south on a
one way basis. Perhaps over the next few years, I am not really sure exactly when. But
we as owners, or we are in the process of buying the home have considered this option
of changing it to rezone it to be for business and we have stepped forward rather slowly
in deciding what we want to do with it. We are just in the process of making these plans
as we are standing here. We have received all of our papers like for the requirements I
mean from Ada County Highway district, what they would require in regard to parking in
the back. We have agreed with them to pave and make a parking lot out of the back off
of that alley way. Therefore there wouldn't be any gravel or dust problem. As well as, I just
received today, we have been out of town for a couple ~ aeks, but I just received from City
of Meridian this morning the requirements from Planning and Zoning from you folks. I went
through them and I am seeing what we have to do there in regard to striping that parking
lot as well as putting in handicapped. We certainly would do our best to abide by that. I
have talked with neighbors I don't know if I have any neighbors that have any concerns on
this or not. I have talked with most of them. I guess that is pretty much it other than what
you have on paper. I don't have a chart or map or anything, I have never done this before
(inaudible) didn't know what I was supposed to bring in. That is probably pretty much it
what you have in front of you.

SUBJECT: Rezone Request from R-4 to L-O at 1729 Leisure Lane by Meridian Free Library
District
The Meridian Free Library District is requesting a rezone to L-O to permit construction of
additional parking for the new Library building. We have reviewed this submittal and offer the
following comments, for your information and consideration as conditions of the Applicant during
the hearing process:
Any existing irrigation/drainage ditches crossing the property to be included in this
project, shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by
the appropriate irrigation/drainage district, or lateral users association, with written
confirmation of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
Determine the seasonal high groundwater elevation, and submit a profile of the subsurface
soil conditions as prepared by a soil scientist with the development plans.
4. Parking and striping shall meet the requirements of Meridian City Ordinance. All parking
areas are to be paved (no gravel). Handicap parking spaces are to be provided in
accordance with the Americans Disabilities Act. Other parking stalls are required to be 19'
deep with a 25' driveway. A drainage plan designed by a State of Idaho licensed architect
or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for
all off-street parking areas. All site drainage shall be contained and disposed of on-site.
5. A minimum of one 3" caliper tree is required for every 1,500 square feet of asphalt. All
landscaping is to be provided with an underground sprinkling system.

6. Buffering of adjacent residential properties is required (fencing and landscaping) per City
Ordinance 11-2-410.B.3 and 11-2-414.D.Z.c.

The above entitled matter having come on for public hearing
' November 12, 1996, at the hour of 7:30 o'clock p.m., the
Petitioner's representative, Tom Ensley, appearing, the Planning
and Zoning Commission of the City of Meridian having duly
considered the evidence and the matter makes the following Findings
of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Rezone
Application was published for two (2) consecutive weeks prior to
the said public hearing scheduled for November 12, 1996, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the November 12, 1996,
hearing; that the public; was given full opportunity to express;
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations;
2. That this property is located within the City of Meridian
and which property is described in the application which
description is incorporated herein; the Applicant is the owner of

the property; that the property is now zoned R-4; that Applicant is
requesting a rezone to L-O Limited Office; that the property is
within close proximity to existing homes and schools; that the
proposal for the property is to be used as part of the Meridian
Library.
3. That the Applicant has previously submitted an
application for a rezone for the property to the west upon which
the Applicant is constructing a library.
4. That the Applicant, in the initial application, state the
use of the land was to build a public library, together with
parking facilities.
5. That the proposed zoning amendment is consistent with the
Meridian Comprehensive Plan.
6. That a public library is permitted use in the L-O
District; the Limited Office Zone requires a conditional use permit
for the operation of a library, which is the use the application
requests; that such use requires a conditional use permit in any
zone where allowed.
7. That the L-0 District is described in the Zoning
Ordinance, 11-2-408 B. 5 as follows:
(L-O'; LIMITED OFFICE DISTRICT: The purpose of the (L-O)
District is to permit the establishment of groupings of
professional, research, executive, administrative accounting,
clerical, stenographic, public service and similar uses.
Research uses shall not involve heavy testing operations of
any kind or product manufacturing of such a nature to create
noise, vibration or emissions of a nature offensive to the
overall purpose of this district. The L-O District is
designed to act as a buffer-between other more intense non-
residential uses and high density residential uses, and is
thus a transitional use. Connection to the Municipal Water

and Sewer System of the City of Meridian is a requirement~n
this district.
8. The City Planning and Zoning Administrator has, or may,
submit comments regarding the rezone request which are, or shall
be, incorporated herein as if set forth in full herein.
9. That the Assistant to the City Engineer, Bruce
Freckleton, has, or may, submit comments regarding the rezone
request which are, or shall be, incorporated herein as if set forth
in full herein.
10. That comments from the Nampa & Meridian Irrigation
District, the Meridian City Police and Fire Departments, and
Central District Health Department were submitted and they are
incorporated herein as if set forth in full; that the Nampa &
Meridian Irrigation District, in the initial rezone Application,
stated that all laterals and waste ways must be protected; that
municipal surface drainage must be retained on site; that the
District requires that a Land Use Change/Site Development
application be filed for review prior to final platting.
11. Tom Ensley testified that the parking area would be 130'
x 108' in size, would have 21 parking spaces, and would extend to
Leisure Lane; he also commented that there would be no access from
Leisure Lane; that the area would be fenced and landscaped; that
there would be appropriate drainage; that it was not a necessary to

Leisure Lane-was not going to be used for access; her additional
comment was that she didn't want people using Leisure Lane.
14. Tom Ensley commented later that there would be no
pedestrian traffic and that lights would not shine on the adjacent
residential property.
15. Corby Dolton testified that he had concerns over the
lighting.
16. There was no further comment made by the public.
coNCZUSioNs
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicants'
property.
2. That the City has the authority to take judicial notice
of its own ordinances, other governmental statutes and ordinances,
and of actual conditions existing within the City and State.
3. That the City of Meridian has authority to place
conditions upon granting a zoning amendment.
4. That the City has judged this Application for a zoning
amendment upon the basis of guidelines contained in Section 11-2-
416 of the Revised and Compiled Ordinances of the City of Meridian

5. That Section 11-2-416 A. states in part as follows:
"When the public necessity, convenience, general welfare or
zoning and development practice require, the Council may
amend, supplement, change, or repeal the regulations,
restrictions, and boundaries or classification of property as
well as the regulations and provisions of this Ordinance."
6. That 11-2-416 (R) of the Revised and Compiled Ordinances
of the City of Meridian sets forth standards under which the City
shall review applications for zoning amendments; that upon a review
of those requirements and a review of the facts presented and
conditions of the area, the Planning and Zoning Commission
specifically concludes as follows:
(a ) The L-0 zoning would be harmonious with and in accordance
with the Comprehensive Plan.
(b) The area included in the proposed zoning amendment is
intended to be developed in the fashion that would be
allowed under the proposed new zoning.
(c ) That the property, if designed and used as allowed in the
L-O District and as it presently exists, would be
designed and constructed to be harmonious with the
surrounding area, which is developed in the R-4 fashion.
(d ) The L-0 use would not be hazardous-";:o the existing or
future .uses of the neighborhood.
(e) L-O development would not create excessive additional
requirements at public cost for public facilities and
services and would not be detrimental to the economic
welfare of the community.
(f) The proposed use would not involve uses, activities,
processes, materials, equipment or conditions of
operation that would be detrimental to any person,

property or the general welfare of the area, however #,he
traffic would be increased more than it would be under R-
4 development.
(g) Development in the L-O district, and particularly as
planned by the Applicant, would produce the heaviest
traffic increase during the week with only the minimum
seen on Saturdays and Sundays.
(h) That a rezone would not result in the destruction, loss
or damage of any natural or scenic feature of major
importance.
(i) The proposed zoning amendment is in the best interest of
City of Meridian.
7. That the City has judged this Application for a zoning
amendment upon the basis of guidelines contained in Section 11-2-
416 of the Revised and Compiled Ordinances of the City of Meridian
and upon the basis of the Local Planning Act of 1975, Title 67
Chapter 65, Idaho Code, the Comprehensive Plan of the City of
Meridian, and the record submitted to it and the things of which it
can take judicial notice.
8. It is further concluded that the comments, recommendation
and requirements of the Assistant to the City Engineer, if made,
will have to be met and complied with.
9. That the comments and requirements of the Planning and
Zoning Administrator, if made, shall be met and complied with.
10. That the requirements of the Nampa & Meridian Irrigation
District, shall be met.
11. That all ditches, canals, and waterways shall be tiled as
a condition of rezone and if not so tiled, the property shall be
subject to de-annexation.
12. That proper and adequate access to the property is

buffering to residential properties and traffic on Cherry Lane.

PARKING FOR NEW MERIDIAN LIBRARY BY MERIDIAN FREE LIBRARY DISTRICT:
Johnson: At this time I will open the public hearing and invite the applicant or the
applicant's representative to address the Commission.
Tom Ensley, 1197 Main Street, Boise, was sworn by the City Attorney.
Ensley: It was last winter, I think it was in January or February that 1 met with you on the
new library facilities on Cherry Lane. I don't know if you can see this, on Cherry Lane.
That facility is now under construction and this is the existing building with parking at front
and back. The request tonight is to, the District has the option to purchase a piece of
property to the east of their existing faality. It is located off of the private Leisure Lane that
accesses to Cherry Lane. It is a piece of property that is 130 feet by ~~ feet and then it
legs over 32 foot wide leg extends over to Leisure Lane that is to the east. The purpose
of the purchase or and the rezone request is to provide additional parking for the new
facilities. This would accommodate 21 parking places, it would be accessed strictly from
the library site itself with 2 accesses in and out within the existing driveway. There is a
driveway that goes around the building and this would be on the east side driveway. It
would impact the existing facilities in no way other than just accessing off through curb
cuts. The property would be of course landscaped and fenced according to the City
ordinances with the green area. k would be two fold providing a green space for the library
facilities itself also then it will serve as the drainage for the on site drainage. Then there
will be a buffer of trees and landscaped area around the perimeter of the parking. This leg
area would not. provide, we are not planning for access to Leisure Lane. We would use
this as a greenbelted area also. t thir~c that is (inaudible).

else, anybody have any questions. This area in front there that is just lawn and sidewalk?
Ensley: This area here, that would be lawn area, grassed and trees and shrubbery and
sidewalk. Probably they will use it in the operation of the library, they will have some story
hours out there and so forth.
Johnson: Any picnic tables anything like that planned?
Ensley: Not necessarily, could perhaps be, it is really just kind of open at this point. It is
just kind of (inaudible)
Johnson: Thank you very much, I guess we have no questions unless you do Mr. Oslund?
Oslund: I just have one that I was thinking about, is this needed to meet your parking
requirements for the main development or that is already met?
Ensley: No, we were required to have 75 we have 77 on the site. But it is obvious that
additional parking will be needed, particular in he meeting room and so forth as the facility
get into full swing, they will. Additional parking would be most convenient.
Borup: Was this property split off from an existing lot or was it already that configuration?
Ensley: It is that configuration right. There is a lot here, there is a lot here on the comer
and then when (inaudible)
MacCoy: I think it would make good sense, I have been up there and driven and walked
the whole thing. I thought it was a good direction to go for you people because you have
a chance to use that land.
Crookston: Mr. Ensley, what type of guarding or buffer or whatever are you going to do so
the people cannot gain access off of Leisure lane?
Ensley: It will be fenced, as the rest of the fence around the property, it is a cedar, 6 foot
cedar fence.
Johnson: If there are no further questions from the Commission could you tum that around
so the public could see that. This is a public hearing, is there anyone else that would like
to come before the Commission, now is the time to do it. Any questions?

Leighton: I have a few concerns basically about the fencing and stuff being a cedar and
also the access (inaudible).
Johnson: You need to address us and speak into the mic because we pick it up and then
we transcribe it. So I would appreciate it, questions directed to us please.
Leighton: My concerns are the fencing which were addressed, the 6 foot cedar. Md the
buffer zone, is this 30 foot leg which was addressed as being the flood plain control or for
the parking or is the back part where I see the little area. How are we going to be
guaranteed that this buffer is going to be fenced and controlled? Those are my questions.
Johnson: Okay, is that all you had Teny? Thank you, is there anyone else here from the
public that would like to come forward at this time? We will try to gather all of the
information, all of the testimony in questions and try to answer all of the questions at once.
Denise Crabtree, 1927 Leisure Lane, was sworn by the City Attorney.
Crabtree: I am very relieved to see that you are not going to use Leisure Lane. I had
stopped at the library one night and understood from what they said that they were real
happy that they could have another out for the library could just use Leisure Lane. So I am
very relieved to see that is not going to happen. but, I don't want people just walking down
here it is still a private lane and we need to be careful about how we, there is rat really
much room for pedestrians if there is entry way for pedestrians in there it needs to be
considered for their safety too. That is what I would like to add.
Johnson: Thank you, anyone else? Mr. Ensley, would you like to comment perhaps on the
questions brought up by Mr. Leighton?
Ensley: I believe we did answer the one about the green belt area, we will be using this
(inaudible) to acxommodate the on site drainage. There will be a fence around the entire
property so there will be no access to it then from other than the library itself of course
from the parking area and from the library site will be the only access to that. Is there
another question?
Johnson: There were just some concerns not really questions.
Ensley: I should answer that there will be no pedestrian traffic, (inaudible)
Johnson: Well there is nothing in your design that encourages any additional traffic at all,
Leisure Lane pedestrian or otherwise that I can see. Thank you very much, one last shot,

Corbey Bolton, 1727 Leisure Lane, was sworn by the City Attorney.
Bolton: I was just concerned about the lighting on that, like at night and stuff because I live
right there in the corner.
Johnson: That is your only concern? Thank you, do you have another question Terry?
Leighton: This is a question just to you guys basically. I don't know the legality or the
zoning but could a person if they lived near that purchase that leg to control that access
maybe and save the library district some money of the fence and all of that and the
buffering system. If a person was to come just straight off, because that attaches to my
yard if I could just make that part of my yard is what I am thinking for that 32 foot.
(Inaudible)
Johnson: The property that is now owned by who, which property are you talking about
(inaudible)
Leighton: (Inaudible)
Johnson: You would have to talk to the owners of the property. They have an option on it
which I assume they are not the owner yet (inaudible).
Leighton: (Inaudible)
Johnson: Can it be split I would think it could be, I don't know. Anybody else have
anything? Do you know enough about the lighting at this point, because I know we have
(inaudible).
Ensley: We really haven't gone to that point yet but it will match the lighting on the, it will
of course require some lighting for night use. The lighting is designed to be a down light
and we have been very sensitive about that not (inaudible) our project is surrounded by
residential.
Johnson: Okay, we need that on the record and we appreciate you putting that there.
Anything else, any questions by the Commissioners? If not then I will close the public
hearing at this time. What would you like to do.
MacCoy: Mr. Chairman, I move that we have the attorney prepare findings of fact and
conclusions of law on this.

Johnson: We have a motion for the City attorney to prepare findings of fact and

Johnson: Does anybody have any idea what we did here tonight, or have a question about
what we did? This is the first step, findings of fact will be at our next meeting on December
10 and then if those are approved it will move directly to the City Council and you will have
another opportunity to talk to them on a public hearing.
ITEM #10: PUBLIC HEARING: REQUEST FOR A REZONE FROM R-4 TO C-C FOR AN
ANTIQUE, CRAFT AND COLLECTIBLE SHOP BY EUGENE PETERS:
Johnson: I will now open the public hearing and ask Eugene Peters or his representative
to address the Commission.
Eugene Peters, 1323 N. Meridian Street, was sworn by the City Attorney.
Peters: Pretty much what I submitted is what we have been planning. Basically the
property, at 1323 N. Meridian Street the east side of-this street, the entire east side is
already zoned C-C. Eventually the entire street we understand is going to run south on a
one way basis. Perhaps over the next few years, I am not really sure exactly when. But
we as owners, or we are in the process of buying the home have considered this option
of changing it to rezone it to be for business and we have stepped forward rather slowly
in deciding what we want to do with it. We are just in the process of making these plans
as we are standing here. We have received all of our papers like for the requirements I
mean from Ada County Highway district, what they would require in regard to parking in
the back. We have agreed with them to pave and make a parking krt out of the bads off
of that alley way. Therefore there wouldn't be any gravel or dust problem. As well as, I just
received today, we have been out of town for a couple weeks, but I just received from City
of Meridian this morning the requirements from Planning and Zoning from you folks. !went
through them and I am seeing what we have to do there in regard to striping that parking
lot as well as putting in handicapped. We certainly would do our best to abide by that. I
have talked with neighbors I don't know if I have any neighbors that have any concerns on
this or not. I have talked with most of them. I guess that is pretty much it other than what
you have on paper. I don't have a chart or map or anything, I have never done this before
(inaudible) didn't know what I was supposed to bring in. That is probably pretty much it
what you have in front of you.
