This Task Order is issued by the Owner and accepted by the Consultant pursuant to the mutual
promises, covenants and conditions contained in the Master Services Agreement between the
above named parties, dated January 24, 2007.
SCOPE OF SERVICES

RULEMAKING SUPPORT
BACKGROUND
The Idaho Department of Environmental Quality (IDEA) is in the negotiated rulemaking process
of modifying Idaho's Rules for the Reclamation and Reuse of Municipal and Industrial
Wastewater (Reuse Rules). The text of the Reuse Rules is drafted as a Negotiated Rule by
IDEQ in conjunction with a negotiating committee made up of persons having an interest in the
development of this rule. Negotiated Rule Draft No. 1 was published on April 7, 2010 and a
meeting regarding this draft was held on April 27, 2010 to discuss draft rule revisions.
Negotiated Rule Draft No. 2 was published on May 20, 2010 and a meeting regarding this draft
will be held on May 27, 2010. The public comment period for Negotiated Rule Draft No. 2 ends
June 3, 2010. Upon conclusion of negotiations, DEQ intends to publish a proposed rule (i.e.,
revised draft Reuse Rules) for public comment in the summer of 2010 and then present the final
proposal to the Idaho Board of Environmental Quality for adoption of a pending rule in the fall of
2010. The proposed rule tentatively is planned to be published in the August 2010 Idaho
Administrative Bulletin with a public comment period set for August 4, 2010 to September 1,
2010. If adopted by the Board, the pending rule will be reviewed by the 2011 Idaho Legislature.
The draft Reuse Rules will likely impact the City's reclaimed water program. Therefore, it is
important for the City to understand proposed modifications to the Rules, how these
modifications affect the City and appropriately comment during the public comment periods.
PROPOSED SCOPE OF SERVICES
The proposed scope of Consultant services is to conduct the following task. Consultant will
commence with these services upon notice to proceed.
TASK 100 - RULEMAKING SUPPORT
Objective
Attend IDEQ rulemaking meeting, prepare comments on Negotiate Rule Draft No. 2 pertinent to
the City's reclaimed water program, and conduct review meeting with City staff.
Approach
• Review Negotiated Rule Draft No. 2.

• Prepare draft comments on Negotiated Rule Draft No. 2 with regard to the City's reclaimed
water program.
• Attend the May 27, 2010 IDEQ negotiated rulemaking meeting.
• Prepare meeting notes for the IDEA rulemaking meeting.
• Conduct half-day review meeting with City staff to review Negotiated Rule Draft No. 2 draft
comments and solicit feedback from City staff.
• Prepare final draft of comments after review meeting for City's submittal to IDEQ.
Assumptions
• One Consultant staff member will attend the May 27, 2010 IDEQ rulemaking meeting.
• Up to two Consultant staff members will attend the half-day review meeting with the City.
• City will respond to Consultant Negotiated Rule Draft No. 2 comments at the half-day review
meeting.
• Final draft of comments will be submitted to IDEQ by City.
• Scope of services only relates to comments for Negotiated Rule Draft No. 2; comments and
support for additional drafts issued by IDEQ or the Proposed Rule would require a task
order amendment.
City Input
• Review and comment on Negotiated Rule Draft No. 2 comments developed by Consultant.
• Attend half-day meeting with Consultant.

Consultant will invoice City for professional services described in this task order on a time and
materials basis. For the activities described in the Scope of Services, Consultant estimates a
professional services fee not to exceed the amounts described in the table above without written
authorization from the City.
