This Task Order is issued by City and accepted by the Engineer pursuant to the mutual promises,
covenant and conditions contained in the Master Agreement between the above mentioned panes
dated May 6, 2010.
BUD PORTER PATHWAY EXTENSION
(5 Mile Creek Pathway Segment F)
SCOPE OF SERVICES
PROJECT DESCRIPTION
It is our understanding that the project consists of the extension of the Bud Porter Pathway from its
current location at Meridian Road to the intersection of Fairview Ave. and Lakes Ave. There are
existing portions of asphalt pathway and concrete sidewalk that need to be integrated and
connected with the use of widening, bike lanes, signage and striping. Coordination with some
HOA's, Private Land Owners and ACRD is anticipated for these improvements and will be
completed by City of Meridian staff and The Land Group as a joint effort. Please see attached
exhibit '131' for a general description of the proposed survey areas and exhibit '132' for a general
description of the proposed improvements. Our detailed scope of services is as follows.
II. SCOPE OF SERVICES
Geneirall
In developing the various phases of the project documents, The Land Group, Inc. shall use its best
efforts to coordinate our services with other project design team consultants retained by the Client.
The Client shall be responsible to inform The Land Group, Inc. of those other consultants who the
Client has retained in respect to the project and with whom TLG's efforts shall be coordinated.
Survey: Task 1
Topwraphic Survey: Task 1A - The Land Group shall conduct a topographic survey of the
proposed route of the pathway extension. The survey will be limited to the location of sidewalk
edges, back of curb, pedestrian ramps, fence lines, existing trees and vegetation, etc. as
necessary to define the limits of work for the pathway improvements. The main corners of
permanent buildings or structures will also be located if their location is anticipated to be of
importance. Utilities, parking areas, drive lanes, sprinkler heads and controls, and other features
not pertinent to our design will not be located or shown as part of the survey.
Boundary Survey: Taste„ 1 B - The Land Group shall prepare a boundary survey which will exhibit
the property boundary on the topographic survey, based on information of public record and
property monuments found during the course of the field survey (Task 1A).
Programming and Schematic Design: Task 2
The Land Group shall attend one meeting at the project site to meet with City Parks & Recreation
Department personnel to develop the basic program for the bike path extension. This meeting will
also be utilized to assess the conditions of the extension route. The Land Group shall prepare a
Schematic Site Design for the pathway facilities and routing for review and approval by the Parks &
Recreation Department prior to proceeding with Task 3. We anticipate receiving review comments
on the schematic plan from Parks Department Staff prior to proceeding with Task 4.
Property Owner Coordination: Task 3
Coordination with ACHD: Task 3A - The Land Group shall coordinate with and obtain necessary
approvals through ACHD for the proposed Pathway Extension. The Land Group will meet with
ACHD staff to review the proposed alignment, pedestrian
crossings, striping and signage. We anticipate (3) meetings for this task. ACHD comments shall be
integrated into the Schematic Design Plan.
The Land Group shall discuss all options for the pedestrian crossing at Meridian Road with ACHD
staff including but not limited to in pavement flashers and or the HAWK pedestrian beacon signal
system. The design of in ground flashers and/or a HAWK signal system is not included in this
proposal. A separate proposal for those services can be submitted upon request.
The Land Group anticipates obtaining ACHD plan approval. However, Right of Way permits
required for construction are not included in this scope of work.
Coordination with HOA and Private Property Owners: Task 3B - The Land Group shall coordinate
with and obtain necessary approvals and easements from HOA and private property owners for
the proposed Pathway Extension. The Land Group will meet with impacted owners to review the
proposed alignment, pedestrian crossings, striping and signage. We anticipate (1) combined
meeting for this task with representatives from James Court Associates, Destiny Cove
Neighborhood Association Inc., Fairview Lakes LLC and Hopkins Financial Services LLC. Our
intent is to have a combined meeting with all impacted owners for this task and then make follow-
up
ollowup contact as necessary for the approvals and easements. This shall be a joint effort between
Parks Department Staff and The Land Group as a Parks representative must be present at all
meetings.
Leval Descriptions: Task 3C — The Land Group shall prepare all required legal descriptions
necessary for easement agreement documents required for Tasks 3A and 3B. We anticipate the
need for (3) legal descriptions for easements from the following; Destiny Cove Neighborhood
Association Inc., Fairview Lakes LLC and Hopkins Financial Services LLC.
Contact with Nampa & Meridian Irrigation District shall be by Parks Department Staff.
Construction Documents: Task 4
Layout and Construction Details: The Land Group will provide the final site drawings which indicate
the required final location, sizing and layout of all proposed pedestrian crossings, ramps, striping,
asphalt pavement, concrete pavement, landscape repairs, etc. The Land Group will provide
necessary construction details demonstrating the required construction of those site elements
specified. The Land Group shall provide all required written specifications required for the
construction of the project.
Landscape Improvements: The Land Group will prepare plans and details necessary for the
installation of landscape improvements adjacent to the pathway from the existing park to the Grace
assisted living center. The intent of these improvements is to provide for a minimal maintenance
requirement but create an aesthetically pleasing edge of the pathway. The Land Group will
provide typical notes, details and cross sections for the repair of impacted landscape areas in lieu
of plan drawings.
Biddingand Site Construction Observation: Task 5
The Land Group shall assist the Parks & Recreation Department throughout the bidding and
construction of the project including the following services when requested by the Owner;
Biddina: Task 5A
1. Project Bidding
a. The City shall create the front end contract documents, advertise for Bids and
provide the contract documents for pick-up, conduct prebid meeting, and bid
opening.
b. The City shall prepare the Contractor's contract and acquire appropriate signatures
and provide written notice to proceed.
c. The Land Group will answer contractor's questions during bidding and prepare
clarifications and addenda as required.
d. The Land Group will assist the staff in preparing the written scope of work.
2. Review and approve, or take appropriate action on, material and product submittals,
substitutions and "or equal" submittals and shop drawings.
3. Render interpretations or clarifications necessary for the proper execution or progress of the
work.
4. All communication with the Contractor shall be documented in written form and transmitted
to the Owner.
Construction Observation: Task 5B
The Land Group will provide on-site observation during construction and provide necessary plan
interpretation to provide a level of Owner confidence regarding the construction's conformance to
the design. This construction observation by The Land Group is not intended to take the place of
proper construction quality control testing and inspection. We anticipate this will consist of site
visits when requested by the Owner, anticipate (4) site visits. The Land Group will provide the
following on-site Construction Observation Services when requested by the Owner:
I. Attend pre -construction conference.
2. Visit the project site to become familiar with the progress and quality of construction and to
determine, in general, if the construction is proceeding in accordance with the design intent
and conforming to the construction documents. The Land Group shall not be responsible
for the safety of the construction site, construction means, methods, techniques, sequences
or procedures and shall not be responsible for the Contractor's errors or omissions or
failures to cavy out the work in accordance with the contract documents.
3. Provide site observation walk-through and prepare "punch list" of items to be corrected
and/or completed before project maintenance period can commence.
4. All communication with the Contractor and site visits shall be documented in written form
and transmitted to the Owner for distribution.
Ill. EXCLUSIONS TO SCOPE OF SERVICES
The Land Group provides other professional services in addition to those described above. Unless
described above and specifically included in this proposal, services including but not limited to the
following are not included in the proposed fee and shall be charged as Additional Services if
required;
1. Geotechnical investigation and soils report.
2. Discovery or removal procedures for hazardous waste, subsurface debris, wells,
underground tanks, Federally -listed species or archaeological artifacts.
3. Materials testing.
4. Water rights review or application.
5. Construction Management Services.
6. Architectural design and Structural design.
7. Arborist Report.
8. Permit, plan checking, inspection and other agencies fees, including Utility
services/connection and application fees.
9. Making revisions in drawings, specifications or other documents, or preparing change
order documents, when such revisions are due to causes beyond the control of our
firm.
10. Design revisions after securing Owner approvals to proceed. If design revisions are
requested, The Land Group will perform the additional services after receiving written
authorization.
11. Construction Staking.
When specifically requested, work not described above shall be performed as additional services
in accordance with our attached Schedule of Rates.
TIME OF PERFORMANCE
This Task Order shall become effective upon execution by both parties, and shall expire upon
completion of the agreed upon services. Design services under this Task Order #10117a shall be
completed no later than July 16, 2010.
COMPENSATION
A. Total and complete compensation Ivor this Agreement shall not exceed $16,514.00 excluding
travel expenses. Fees will be billed monthly fior completed tasks only, per the foil wing schedule
of values.
