APPLICATION SUMMARY The Applicant, JBS Enterprises, LLC, has requested to modify the approved final plat for Madelynn Estates Subdivision. The approved fmal plat was approved with 88 single-family residential building lots and 9 common lots. The applicant is requesting to modify final plat note number 3 to include the maintenance of Lot 1, Block 8 as a common lot for a community swimming pool. In addition, the applicant is requesting to modify note number 9 on the final plat to ensure the fencing adjacent to Lot 1, Block 8 meets the fencing standards set forth in the UDC. (See applicant's narrative for further details). 2. STAFF RECOMMENDATION Staff is recommends approval of the subject application. 3. PROPOSED MOTION Approval After considering all Staff, Applicant, and public testimony, I move to approve File Number MFP-10- 002, as presented in the staff report for the hearing date on May 26, 2010. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located on the west side of Locust Grove Road and approximately %2 mile north of McMillan Road, in the northeast '/ of Section 30, Township 4 North, Range 1 East. B. Owner/Applicant: BHH Madelynn Estates, LLC 1025 S. Bridgeway Place Eagle, Idaho 83616 C. Representative: Jane Suggs, JSB Enterprises, LLC Madelynn Estates Subdivision MFP - 1 - 200 Louisa Street Boise, ID 83712 D. Applicant's Statement/Justification: Please see applicant's narrative for this information. 5. PROCESS FACTS The subject application is for a modification to the final plat. By reason of the provisions of the Meridian City Code Title 11, Chapter 5, the City Council is the decision making body on this matter. A public meeting is required to beheld for this type of application. 6. LAND USE A. Existing Land Use(s): This property is asingle-family residential development in an R-4 zoning district. B. Character of Surrounding Area and Adjacent Land Use and Zoning: 1. North: Single Family Residential and Rural Residences in Ada County. 2. East: Single Family Residential. 3. South: Single Family Residential and an Existing Church. 4. West: Rural Residences in Ada County. C. History of Previous Actions: • The final plat (FP-06-030) for Madelynn Estates Subdivision was approved by the Meridian City Council on July 25, 2006. The fmal plat consists of 88 residential lots and 9 common lots. 7. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. 8. STAFF ANALYSIS The applicant is requesting to modify the approved final plat notes to include the maintenance of Lot 1, Block 8 as a common lot for a community swimming pool. The lot was originally platted as single family residential building lot. The requested modification also includes language to ensure the fencing for the subject lot meets the standards set forth in the UDC. The UDC requires proposed changes meet all current UDC standards. Because the applicant is modifying the notes to increase open space and add an additional common lot to the subdivision, staff believes the standards set forth in the UDC have been met. Further, Staff believes the proposed modification adds substantial value to the community and the project.
