In accordance with UDC 11 -5A -3F and UDC 11-5A-6, you have the option to have this decision reviewed by City Council. All City Council Reviews shall be filed in writing to the Planning Department within fifteen (15) days after the date of this letter. The request will be forwarded to the City Council to conduct a public hearing. The application should specify the grounds upon which the review is filed. You have until April 15, 2011 to obtain the City Engineer's signature on the Final Plat contingent upon the above provisions being met. APPLICATION SUNIMARY The applicant, Joint School District No. 2, has requested approval of a 12 month time extension to obtain the City Engineer's signature on the final plat for Education Campus Subdivision No. 2. The preliminary plat for Education Campus Subdivision No. 2 was approved by the Meridian City Council on April 15, 2008. A final plat application has been approved by City Council but the City Engineer has not yet signed the plat as required by UDC 11-6B-7 within 2 years of approval of the preliminary plat. Per the conditions of approval, the preliminary plat would otherwise expire on April 15, 2010. Because the Applicant is unable to meet the time requirements specified in Unified Development Code (UDC) 11-6B-7, a time extension is requested. The Applicant states in the application narrative that the construction drawings have been completed and approved by all governing agencies. The final plat has been signed by central District Health Department and Ada County Highway District. The construction of the infrastructure (sewer, water, pressure irrigation and private street) is complete with the exception of landscaping, which has been delayed due to weather. The District prefers not to bond for the landscape improvements. Therefore, an extension is requested. The subject property is located on the southeast corner of E. Leigh Field Drive and N. Locust Grove Road, in the SW % of Section 32, T.4N., R.IE. H. STAFF RECOMMENDATION Staff recommends approval of a 12 -month time extension to obtain the City Engineer's signature on the final plat for Education Campus Subdivision No. 2 to expire on April 15, 2011. III. STAFF ANALYSIS The City of Meridian's Unified Development Code (UDC 11 -6B -7C and UDC 11 -5B -6F) allows the Director to authorize one administrative time extension to obtain City Engineer's signature on a final plat, not to exceed 18 -months, when the applicant files a written request for an extension prior to the expiration of the approved preliminary plat. The applicant has met the necessary deadline by filing a written request before the preliminary plat expires. Additional time extensions up to 18 -months may be granted if approved by City Council. Prior to the approval of the time extension, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11 -6B -7C). In addition, the City Council provided staff with guidelines to use when evaluating time extension requests. These guidelines are meant for guidance and not as a mandate. Staff has reviewed the aforementioned guidelines provided by City Council in relation to this project and believes the project complies with current provisions of the UDC.
