HomeMy WebLinkAboutJoint Powers Agreement with Meridian Fire Protection District for Fire Protection ServicesA G R E E M E N T U 4rl~a~ry THLS AGREEMENT, entered into this ~~ day of-D~e-em~r, 196 between the MERIDIAN FIRE PROTECTION DISTRICT, Party of the first part, and the CITY OF MERIDIAN, ADA COUNTY, IDAHO, Party of the second part, both parties hereto being duly organized agencies of government within the State of Idaho, W I T N E S SET H:- WHEREAS, the parties hereto have heretofore been operating jointly fire protection for the citizens of the City of Meridian and the residents of the Meridian Fire Protection District, and WHEREAS, the needs off' the district and the city reauires the construction of a new fire hall to be situated at the corner of Broadway and Meridian Streets in the City of Meridian, Idaho, and WHEREAS, the parties hereto desire to participate equally in the ownership of the land and the construction of the fire hall situated thereon, and WHEREAS, the City has heretofore purchased the land for the sum of X7,500.00, and WHEREAS, the City will build said building through its own facilities without bid or contract, the estimated cost of which for labor and materials is the sum of ~ ~.~, sore °°- f~-~-R~R~~'~• NOW THEREFORE, in consideration of the covenants herein con- tained, the .parties hereto mutually agree as follows: That each of the parties hereto will pay one-half of the tota cost including the land and construction, for the completion of said fire hall and that each of the parties hereto shall own an undivided one-half interest in the land and building situated thereon. It is mutually agreed that if it is necessary to borrow money to complete the construction of the fire hall, that both parties hereto will jointly negotiate a loan at the Idaho First National Bank, Meridian, Idaho, for a period of not to exceed one year, for the amount of money necessary to complete the construction of said building and that said loan shall be repaid out of the tax money received by each party hereto within one year. It is further agreed that at the time the entire cost of both land and building are paid in full, the City will deed to the District an undivided one-half interest in and to the said property It is further agreed that said property shall be jointly owned and operated for the mutual benefit of both the District and the City in providing to the citizens and residents of both the District and the City the maximum fire protection possible under the laws and ordinances relating to both of the parties hereto. THIS SPECIAL MEETING of the Mayor and the City Council of the City of Meridian, Ada County, Idaho, was held at the City Hall at Meridian, Idaho, at $:00 P.M. on January ~~ 1861. The meeting was called to order by the Mayor and Councilmen McGoldrick, Anderson, Brown and Mayes were present, constituting a full membership of the Council. The Mayor announced that the purpose of this meeting was to consider the. construction and financing of the new fire hall to be constructed in cooperation with the Meridian Fire Protection District. It was moved, seconded and unanimously passed that the City of Meridian enter into a joint contract with the Meridian Fire Protection District for the construction of a new fire hall to be situated on the property heretofore purchased by the City at the corner of Broadway and Meridian Streets in the City of Meridian, Ada County, Idaho, and that the cost of the purchase of the land and the rice for the construction of the building was the total sum of ~ ~£; .roo Q- one-half of which shall be paid by the Meridian Fire Protection District and the other half will be paid by the City of Meridian, and further, that the City and the District shall each own an undivided one-half interest in the land and the structure to be built thereon. It was further moved, seconded and unanimously passed that the City of Meridian, together with the Meridian Fire Protection District, negotiate a loan from the Idaho First National Bank, Meridian, Idaho, the sum of ~ 8' 7 Sa.~ o payable-one year from date out of the tax revenues for the taxiyear from the city and the district, which Hinds are to be used for the construction of said fire hall, and the officers of the City of Meridian are hereby authorized to execute the necessary instruments at said bank to complete said loan.
