To whom this may concern:
Gowland Johanson Zimmerman Architecture is pleased to represent the Presiding Bishop for Church of Jesus Christ of
Latter-day Saints, a Utah Corporation Sole in the application for a Development Agreement Modification. The proposed
property is currently parcel #51224314512- a portion of the northeast'/< of the southwest'/4 of section 24, township 3
north, range 1 west- physically located on the west side of S. Stoddard Road across from Kodiak Drive (entrance of Bear
Creek No. 1 Subdivision), Meridian, Idaho. The property is owned by Tuscany Development and will be purchased by
the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter-day Saints, a Utah Corporation Sole.
Currently the DA-1061511232 states: 19. BINDING UPONSUCCESSORS: This agreement shall be binding upon and
inure to the benefit of the parties' respective heirs, successors, assigns and personal representatives, including "City's "
corporate authorities and their successors in off ce This Agreement shall be binding on the "Developer" and/or
"Owners" of the "Property", each subsequent owner and any other person acquiring an interest in the "Property".
Nothing herein shall in any way prevent sale of alienation of the "Property ", or portions thereof, except that any sale of
alienation shall be subject to the provisions hereof and any successor owner or owners shall be both benef ted and bound
by the conditions and restrictions herein expressed. "City" agrees, upon written request of "Developer" and/or
"Owners'; to execute appropriate and recordable evidence of termination of the Agreement if "City'; in its sole and
reasonable discretion, had determined that "Developer" and/or "Owners" has fully performed
The intent of this Development Agreement Modification- as required by UDC 11-SA-2- will be for the requested
Termination of the Development Agreement for Parcel Five Twelve Phase I (see attached legal description & exhibit) if
"City" in its sole and reasonable discretion, has determined that "Owners" have fullxyerformed asper Conditions
imposed per The City of Meridian throughout the Land Entitlement Process included in PP-09-002, CUP-09-013, DES-
09-034, and FP-10-002.
In essence. once the Final Plat records, Parcel Five Twelve will no longer be subject to the Development
Agreement.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-SA-5.
