Waste Disposal Wells Stream Channel Protection Geothermal Resources We have received a well drillers report indicating that a well was drilled for you in NEkSE14 of S. 12 , Township 3 N. , Range 1 E. , B.M., Ada County. A review of our records indicates that you have not filed an application for a permit to appropriate the public water of the State of Idaho. Since March 25, 1963, an application has been required prior to construction of a well and a valid permit must be obtained before groundwater may be diverted. The only exception to this requirement is a well drilled for stock -watering or single family household use and water used for all other purposes, including irrigation of one-half acre of land in connection with the household use where the total use does not exceed 13,000 gallons of water per day. If you have already filed an application, which we over -looked in the review of our records, please advise us of the number of the application or the name under which the application was filed. However, if you have not yet filed the required application, you should do so as soon as possible. You may obtain the forms upon request from this office. Enclosed is an affidavit form which must be used to submit the required proof of beneficial use. If you have not fully completed your project, and you have not previously received an extension of time, you may request an extension of time provided the delay is for rea- sonable cause as indicated in Section 42-204, Idaho Code, amended. If you have been prevented from proceeding by a governmental agency or by litigation, more than one extension of time can be granted. Other types may be approved upon written application to the Department stating the description of the device and how you intend to use it. if the device that you install is not a standard type, you should obtain an extra copy of the rating table for this office. FLEENOR Assistant Director MAKING PROOF OF BENEFICIAL USE HOW TO MAKE PROOF In order for a permit holder to fulfill the conditions of the permit and obtain a. water license, he must submit proof of application of water to beneficial use on or before the date set forth in his permit. Each permit holder will be notified 60 days prior to the date set for such proof. In order for the proof to be valid, it must be received by the Department on or before that date. Proof is made upon a form which is available from the Department. It is very important that you complete this form completely and accurately. The information that you give on the form will enable the Department to make a field examination which is necessary before the license can be issued. The information you enter on the proof form should be an indication of. the actual development of your project. This development must also correspond to that described by the permit. If- 'i aes project -have been made, you should apply to amend your permit to include the actual development. Ap- plication for amendment forms are available from the Department on request. WHAT TO DO IN CASE YOU HAVE NOT COMPLETED THE APPLICATION OF WATER TO BENEFICIAL USE If you have not been able to complete the application of water to beneficial use within the time allowed, due to reasons beyond your control, you may apply to the Department for an extension of time. However, in order for an application for exten- sion of time to be considered, it must be filed prior to the date on which proof of beneficial use is due. Each application for extension of time is considered on its own merit. WHAT TO DO IF YOU FAIL TO MAKE PROOF OF BENEFICIAL USE ON TIME If you have applied the water to beneficial use, but were unable to submit proof of application of water,to beneficial use on or before the date set for such proof and,, your permit has lapsed, you may petition the Department within 60 days from the date that a notice of lapsing was sent to you to reinstate your permit. In order for the Department to reinstate a permit, you must show reasonable cause why such permit should be reinstated. Submission of proof of beneficial use within 60 days will automatically be considered by the Department as cause for reinstatement. The priority of all reinstated permits will be advanced a time equal to the number of days that such showing is subsequent to the date set for proof. After 60 days, there is no way in which the Department can reinstate a permit. ISSUANCE OF LICENSE After the Department has completed an examination of your proof and if it appears that you have complied with the terms of the permit, the Department will issue a water license. The license becomes prima facia evidence of a water right. The license will include the maximum rate of diversion, the total annual volume of water which may be diverted, the period of the year during which you may use the water,the nature of use to which you may apply the water, the priority which you have estab- lished, and any other conditions of the water right. INSTRUCTIONS FOR FILING PROOF OF APPLICATION OF WATER TO BENEFICIAL USE 1. Give the name and post office address of the permit holder. If the person mak- ing proof is other than that person who originally applied for the permit, that person must either be an elected official of the company, a general partner of a partnership, must have been assigned the permit from the original owner, or must have a valid power of attorney from the permit holder on file with the De- partment of Water Administration. 2. Give the number of the permit upon which you are making proof. 3. Give the date of priority which you wish to establish. That priority normally is the date upon which the Department received the application. This can be found on the top line of the back page of the permit. 4. Describe the source from which you have appropriated the water by giving the _ name and location of the - paint of_.div-exsion -as des€ -r' -i -bid -by-40acre--suhd-ivds-ions ---- of the Federal Land Survey. 5a. Describe the amount of water in cubic feet per second or acre feet and the use to which you have applied the water, and the period during the year which you have been using the water. 5b. Give the total amount of water you have appropriated. This will not necessarily be the amount shown on the permit, but should be determined accurately by meas- urement. eas- urement. 5c. Describe how and by whom the measurement of the amount of water appropriated was made and give the name of the person making the measurement. This person should be someone who has a recognized ability and the necessary training to make such a measurement. 6. If you convey water through facilities owned by persons other than yourself, complete Item #6a and #6b. 7a. Describe the means by which you divert the water. 7b. Describe the type of measuring device which you have installed and if the de- vice is not a standard device, attach to the proof form a rating table which will allow the Department- "the -- device or being stored in the reservoir. 8. Describe any uses you may have other than irrigation. 9. Describe the acreage which you have irrigated by listing the number of acres irrigated in each 40acre tract. 10. Remarks. Sign and date the form and have your k ignature acknowledged by a Notary Public. For permits involving the irrigation of one (1) acre or more, obtain a copy of an aerial photograph of the property in question, if they are available, from your local Agri- cultural Stabilization and Conservation office. That map should clearly show the lands you irrigate and the section corner near the lands being irrigated.
