I have not had a chance to locate the specific application you mentioned. However, based on your note I am still
trying to find our copy. I know you are up against the deadline on this, but I wanted to get you the following
information. The pathways are not currently patrolled except by our motorcycle officer. This usually occurs when
there has been a problem or a request for such, like down at Tulty park when we had some problems with
motorcycles using the pathway. Most often officers respond to problems and will get out and check the pathway
areas. If there is a visibility concern the only way to overcome it would be to light the area or keep it void of heavy
shrubbery or bushing plants. Most often the pathways are going to out of direct view or observation of officers in
the patrol car because most of the pathways do not parallel the roadway. As we get more pathways in town and
they become connected we will start to look at alternative patrol methods for the pathways -such as bikes, foot
patrols, AN's, etc. One alternative to security on the pathways is the use of open fencing concepts - that is a
solid fence of up to 4 feet in height with a lattice work at tre top up to the 6 foot level or just chain link fences.
This is not always popular with horns owners, but it is one way to provide a passive sense of security.

I'm sure you're leafing a bit swamped these days. Hope you're holding upl
I'm hoping you or one of your staff could comment on a development application. tt's called `Southern Springs°
and it's a commercial subdivision at the southeast comer of Merfdian and Ovedand. There's a public pathway
proposed along the Ten Mile Creek. We're requesting the pathway be constructed and the developer agrees. But
there may be some concern about visibility of your patrol officers onto the path itself. Will the officer on duty make
semi-routine trips into the devebpment to just keep an eye on the pathway from the vehicle? If so, do you
consider the proposed layout safe?
I would appreciate any written comment the PD can provide on this one for the August 7"' public hearing.

We received a Notice of Hearing letter from the City of Meridian regarding the property
southeast of Meridian and Overland Roads. The Land Group, Inc. is seeking Preliminary Plat
approval of 11 building lots on 10.97 acres in a C-G zone for a project called Southern Springs.
Nearly five (S) years ago we built our home on a lot that backs up to the proposed project. We
have concerns about the commercial concept of this property and the fact that they are wanting
to put eleven (1 1) business on this acreage. This seems quite excessive to us. Our largest
concern being the noise factor of 1 1 building lots on property that backs up to our home. We are
concerned not only with the noise factor, but also lights which are on all night, businesses which
are open all night, delivery trucks, auto emission pollution and noise as they idle at fast food
restaurants, etc. We are worried about increased traffic and the noise that would bring with it
and possible crime with more populated areas. Also, it is dangerous to leave Caldenvood and
drive onto Meridian Road. Putting in 11 businesses would only dump more vehicles onto our
roads and cause a dangerous situation. Already that intersection is dangerous and adding that
many more would only cause more danger.
Our home is located at 1771 5. Marsh Wood Place in the Running Brook Estates. Our home
and all of our neighbors homes that back up to this proposed project could be severely impacted
with increased traffic, noise, lighting etc. and we wish to state our concerns and be heard. It
would seem to us that there should be some type of city ordinance that would protect us from
having businesses in our back yards so to speak. We feel we need a barrier whether it be a wall,
evergreens, fence, etc. or a burm to protect us not only from the noise but the lights and all that
will come with the development of commercial property on this acreage. This proposal intends to
alleviate the peace and quiet that we have experienced living here and keep us from living in the
way that we have grown accustomed over the years.
Do they intend, or are they required to erect a retaining wall or what exactly is their plan to
not negatively impact our peace and quiet and the wildlife that frequents the area that we chose
when building in this subdivision? Do they plan to landscape the area or will there be noisy
parking lots with delivery trucks at all hours of the day and night? Secondly, what type of
commercial buildings are they seeking to erect? I suppose we would not have a problem with
quiet office type buildings but would definitely have a problem with fast food restaurants, service
stations, car washes and those types of commercial property. With meeting with the developer
and then at the planning and zoning meeting which took place ,none of these concerns have
been answered. They all seem to have the attitude that it is all about the almighty dollar, all
about them, and the rest of us be damned. Our feelings are quite to the contrary and at the risk
of sounding like a 5`" grader, we as residents were here first and feel they should take our
feelings into consideration. Our way of life should not be negatively impacted because someone
else wants to make a lot of money. The noise factor from Meridian Road is already really bad and
we really do not want to see increased noise and traffic in our own backyards due to building
parking lots, etc. out our backdoor. Our home was built so that our bedrooms and living area
are all at the rear of our house which is the side that backs up to this proposed project. That is
definitely a large concern for us as well as for our neighbors. We do not want our privacy and
safety negatively impacted.
We always knew that something would eventually go in to this field and definitely regret that
the time has come but we also feel that since we have all been here, have made our homes here
and are raising our children in what we considered a safe, low key area, that we should not be
negatively impatted by this proposed plan and someone else's wishes to make money.. We
would hope that our way of life, our needs and our considerations would be taken into account
when putting this project together. We would hope that our concerns and frustrations can be
addressed and hopefully put to rest and that the developer be willing to listen to us, hear our
concerns and take the type of action that would make everyone happy. Unfortunately that does
not seem to be the case. We met with the developer at a neighborhood meeting before the
Planning and Zoning meeting took place and they were unwilling to assure us that we would be
protected from such a large development. In fact, the last words out of their mouth's when they
left the meeting was "sorry to ruin your solitude". This tells us that they have no plans to even
begin to compromise or make us happy. Bottom line that we got from his comments were, we
don't care, we don't have to. Bottom line for us is that we have been here longer, we also pay
property taxes and a project of this magnitude should not be taken lightly. We are going to be
severely affected and each and everyone of us living along Ten Mile Creek will be affected
negatively if they are allowed to build the proposed plan and not take us into consideration. We
want some type of barrier from the commercial property to our residential property. We want a
division of such so that we feel we have our privacy and are not negatively impacted by this
project. We really do not feel this is asking too much. Nowhere in Meridian, Eagle or Boise have
we seen a commercial development go in that they did not erect some type of barrier to divide
the two and I believe we should not be the exception to the rule so that the developer can make
more money. If not done correctly and to the satisfaction of the homeowners that border this
property, we potentially could suffer great monetary losses when we decide to sell our homes and
this would be very unfair to impact us in a negative way. If, on the other hand, the developers
were willing to give us at least a 6-8 barrier of some type, I believe we could more readily accept
the development of this property and feel good about it going in. At this point all we see is the
negative factors of residential abutting commercial property without any barrier or divider.
Besides the noise, increased traffic and the congestion this could cause, we also would like to
see the wildlife that lives in and near the creek protected and saved. We have enjoyed the ducks
and the pheasants and the quail that frequent that area and would not wish to lose that because
of a commercial project.
We also would really like to know the developers intentions for keeping our backyards quiet
and private as they are now. This is probably the biggest concern to us. We do not want bright
lights, big, noisy delivery trucks and businesses that are open all night that generate a lot of
traffic, noise and pollution. The other concern would be having our property values go down
because of the negative impact this project could cause. Are there any guarantees with this
project that our property values will not be negatively impacted when we decide to sell?

I am voicing my concern about the eventual traffic at the corner of
Overland and Meridian Roads. We already have a number of fastfood
places approaching this intersection, plus added traffic from the
Golds Gym. It is often a problem between 4:00 pm and 6:00 pm getting
out of Country Terrace and Meridian Greens.
Mountain View High School is now open, to allow Souther Springs to have
11 building lots some for fastfood is going to start another Eagle Road
and to much congestion at this corner.
Please help us with this. There are some very nice homes in this area
and they were here first.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Avenue, Meridian, Idaho, at the
hour of 7:00 p.m. on September 9, 2003, for the purpose of reviewing and considering
the application of The Land Group, Inc. for Preliminary Plat approval of 11 building
lots on 10.97 acres in a C-G zone for Southern Springs generally located on the
southeast corner of Meridian Road and Overland Road.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. fo 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials
presented at public meetings shall become property of the City of Meridian. Anyone
