RESOLUTION AND ORDER OF REINSTATEMENT
ADA COUNTY
At the Board Meeting of 6 June 2000, Weick presented the following resolution and.
moved for its adoption:
WHEREAS, at the Board Meeting of 7 July 1992, the owners of the following described
property, Kent G. and Mary R. Barney, petitioned the Nampa & Meridian Irrigation
District for Exclusion of their water rights stating that the lands in-their present condition
are not agricultural as follows:

being listed in Nampa & .Meridian Irrigation District's delivery/water records as Eight
Mile Lateral, Tap No. 29792R, and
WHEREAS, at the Board Meeting of 7 July 1992, the Board of Directors voted
unanimously to grant the Petition for Exclusion, which Resolution for Order of Exclusion
was subsequently recorded at the Ada County Recorder's office on 10 July 1992 as
Instrument #9245791, and

WHEREAS, pursuant to Idaho Code 43-1120, "Where lands have been excluded from
an irrigation district under the provisions of this chapter and the owner or owners of the
excluded lands desire to receive irrigation water through an existing distribution
system; through a distribution system proposed to be constructed under authority of
section 43-329, 43-330A or 43-333, Idaho Code, or under any law authorizing a local
improvement district; pursuant to a lease executed under section 43-335 or 43-338,
Idaho Code; or pursuant to a contract. executed under section 43-730; Idaho Code",
and,
WHEREAS, a petition requesting reinstatement was received from the owner/owners of
said property, signed and acknowledged in the manner required for conveyances of

real property, and, _ - ~-- -
WHEREAS, said owner/owners, Phillip and Kandee Crust, have filed a Petition for
Reinstatement with the Irrigation District to reinstate said water right, described above.
NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THIS BOARD:
1. That. the water rights as stated above be placed on the lands stated
above and the land be reinstated to the Irrigation District as they were
previous to the exclusion.
2. That the President and Secretary of the Board be authorized and ordered
to execute an Order for the reinstatement of water rights to this property.
3. That the Order of Reinstatement of Water Right be filed of public record.
in the office of the Ada County Recorder and placed as a Minute entry of
this Board Meeting.
Wissel seconded the motion made by Weick, it passed unanimously and the
resolution was adopted.
