The applicant did not submit consent of the legal owner of the property, B.W., Inc., but did submit an Option Purchase Agreement executed by R&M Homes (Russ Conger), who is leasing the house to the Womacks. The Option Agreement clearly states the Buyer (R&M Homes) received a copy of the Restrictive and Protective Covenants and agreed to comply with the terms and conditions contained therein. Dan Torfin of Dennis Baker & Associates called me to inform me that their covenants do not allow businesses within Danbury Fair and they will enforce those covenants. Although the City could grant the conditional use permit, it is not likely the homeowners association will allow it. The Covenants, Conditions and Restrictions for the subject subdivision specifically state: " No lot or commas area shall be used for the conduct of any trade, business or professional activity.
