The storage unit is currently an open covered storage area and applicant is proposing to enclose the space in order to house the site's radio equipment. Characteristics of the Property which make a Conditional Use Desirable- The subject property is within the Search Area map issued by U S WEST's engineering department. See attached Exhibit 5. Mini Storage locations work well for cellular facilities because they are in the business of renting smaller spaces on a long term basis and are typically located in commercially zoned areas. Reason for the request- The tremendous growth of the cellular industry has necessitated the addition of "capacity sites" to areas where cellular coverage is a~eady present. Due to the large number of new subscribers the system becomes overloaded and new sites are requires to add capacity to the system. The proposed facility will allow for expanded coverage in the immediate area around the site and will provide enhanced access to emergency and governmental services as well as the general public. The original system, consisting of a few sites placed at high points in Boise area, will eventually be replaced by a number of capacity sites which will be located at lower elevations. Interference problems between sites requires that the second generation of sites be carefully located so as not to interfere with conversations generated by other sites. The proposed location of this facility will provide the coverage requ~ed in the immediate area of Meridian and will not interfere with other facilities which are in operation or planned for the near future. Mailing list- A list of all owners within 300' of the proposed facility is included as Exhibit 6. ~ddHional Fees- Although the proposed facility will not require any sewer, water or trash service U S WEST will agree to pay any additional fees generated by the site. Power to the site will be separately metered and will be paid directly by U S WEST. The storage unit is currently an open covered storage area and applicant is proposing to enclose the space in order to house the site's radio equipment. Reason for the requeat- The tremendous growth of the cellular industry has necessitated the addition of "capacity sites" to areas where cellular coverage is already present. Our field personnel verified that the cased, 6-foot-diameter shaft was drilled to required minimum depth of 12 feet into the underlying dense, sandy gravel bearing soil. We also verified that the minimum required shaft diameter and shaft excavation bottom clean-out was accomplished. Our field technician verified the concrete steel reinforcement and obtained concrete cylinders for compressive strength testing. The 28-day compressive test results exceed the minimum 3,000 psi strength requirement. A copy of our inspection reports and 28-day concrete strength test results are included with this letter. Based on our observations and tests, it is our opinion that the drilled shaft foundation system was constructed in general accordance with the design plans and specifications. That at the • public hearing the Applicant's representative, Timothy McFadden, acquisition and zoning consultant for US West, stated that due to the tremendous growth of the cellular industry the need for additional "capacity sites" to areas where cellular coverage is already present, is necessary; that new subscribers are overloading the system which requires that new sites be added to add capacity, more frequencies, and more channels to the system; that based on some areas of topography, based on population, based on road or highway frontage and the availability of arterials, a search area is chosen; that the search area is approximately a mile across; that the coverage at this location will be approximately 4 to 6 miles; that the location of the proposed site is almost exactly in the middle of that search area, that being the. Public Storage of Meridian. - - -- 9. That the pole is made of steel, evenly tapered, with the ~~ base being 48 inches and the height being 100 feet; that these ~+ ~.~ i. .' poles are designed to withstand winds of 140 miles an hour; that it ;~ `',,t~l will be located at the north property line of the site ?~ approximately 3,600 feet west of Meridian Road. 10. That the sites at Table Rock and McMillan Road will have the lowering of their antennas and the direction changed with the addition of the four (4) to five (5) new sites; that these smaller facilities will give additional capacity as well as allowing US West to reduce the height; that the chance of multiple users on one pole is a possibility; that the site is on a long term lease with FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 3 US WEST CELLULAR • • the property owner and the addition of additional tenants is up to the property owner. 11. That the proposed location of this facility will provide the coverage required in the immediate area and will not interfere with other facilities already in operation. 12. That there is a proposed street that will be developed in the near future that will be going by the mini center where this pole will be located; that we do have opportunity to relocate the pole once the street proposal is approved, to relocate the pole away from the street corridor so as not to have to deal with any potential setback issues. 13. That there was no other testimony to this application. 14. That although sewer and water will not be required at this proposed facility, US West agrees. to pay any additional fees generated by the site; that the power to the site will be separately metered and paid directly by US West. 15. That the Ada County Highway District staff report commented that an anticipated east-west collector roadway will be constructed abutting this north property line as a westward extension of Corporate Drive from Meridian Road; that ACRD recommends the City of Meridian require the standard street setback which would be required if a street were abutting the north property line of this site. 16. That the City Planning Director, Shari Stiles, commented that the setbacks in the C-G zone are 15' front and 0' side and FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 4 US WEST CELLULAR • • back, with height limitation being 40', but that several pole signs exist within the C-G zone which are higher than 40'; that having never dealt with a "tower" issue like this, the Director is unsure of any FAA restrictions that may exist or whether a variance should be required. 17. That the Central District Health Department, City Fire Department, and Meridian Police Department submitted comments and they are incorporated herein as if set forth in full. 18. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property; 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian; 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho. FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 5 US WEST CELLULAR • • 4. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan, and Zoning Ordinance if a variance from the height restrictions is granted. c. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. f. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by ~ " reason of excessive production of traffic or noise. g. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, Uniform Mechanical Code, Uniform Electrical Code, the Fire and Life Safety Code, all parking and FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 6 US WEST CELLULAR • landscaping requirements; that the Applicant shall meet with Shari Stiles to work out an acceptable landscape plan. 6. That the Applicant shall meet all of the requirements of the Ada County Highway District, specifically including the required set-backs from any existing or proposed streets. 7. That the Applicant should be required to get a variance from the height restriction of 40 feet. McFadden: My name is Tim McFadden my office address is 11201 SE 8th Street, Bellevue, WA, I am an acquisition and zoning consultant for US West. Kingsford: Counselor, is this a public hearing, it was not dully noted on the agenda. Do we need to have a public hearing in that zone? Crookston: No McFadden: With regard to the findings of fact and conclusions of law, I have one correction that I would like to suggest and which is a typo in one comment or request. The correction is on page 3, paragraph 9, I believe there is an extra zero in there. This site has got to be 360 feet west as opposed to 3600 feet west of Meridian Road. The comment or the request that I have is on page 7, item #7, that the applicant would be required to get a variance from the Height restriction of 40 feet. The reason why I am requesting some action on that is that during apre-application meeting in discussions with staff the P & Z hearing there was no discussion or mention of a variance being needed. At the pre- application meeting, let me first of all tell you that I have done this work for 3 years, typically the height and the use are considered under a single zoning function being with the antenna height for us is a critical part of the use. In other words if you grant the use without giving us the height that we need for the antenna the use is basically non- functional to us. We have to have the height for the cellular antennas to get the coverage that we require. The second point was that the Meridian code, my reading of the Meridian code, subject of course to correct, on page 50.1, section 2-410, it seems to give an exemption for this type of facility from the height restriction because I will just read it to you. It says exceptions to height regulations, the height limitations contained in the zoning schedule of bulk and coverage controls do not apply to spires, belfries, (inaudible) pole antennas, water tanks, public utility power poles. This is a situation that we run into all of the time, because cellular is so new it is typically not called out by name in all but the very most recent zoning codes. But we are a public utility, we are regulated as a public utility and in some of the other jurisdictions that have added us to their zoning codes, amended the codes to include cellular uses they do it under the auspices or under the category of • • Meridian City Council October 17, 1995 Page 62 public utility. And typically treat us like power poles basically. Either high tension poles with a higher height where your typical telephone poles. So for that reason I would respectfully request that item #7 be deleted ftom the findings of fact. Other than that one item all of the other things are certainly in agreement to the company, we would certainly comply with every other regulation. Kingsford: Apparently they didn't photocopy the whole (inaudible) and he reads it accurately, the applicant should be required to get a variance from the height restriction of 40 feet is item 7 on page 7. Morrow: How high is it? McFadden: It is a 100 foot monopole which is about, it is the height, to give you an easy explanation, this is going to be almost identical in size and structure to the McDonald's sign. McDonalds sign is a segmented pole, the one that we are going to be using here I don't believe has any segments to it. In other words it is going to be a straight taper right up, it is basically going to look like a large steel telephone pole. Corrie: (Inaudible) McFadden: The only difference between that and the McDonald's sign is that the antennas will be smaller than they have. What that sign is sitting on is a monopole that is the industry term for it. Yerrington: What color are you going to paint it? McFadden: They come kind of slightly lighter than the color of that wall, a pale gray, we can paint them just about any color but that is the typical manufacturers color. A little bit lighter than that gray. The equipment, the facility will consist of, we are going to be renting one unit at the existing storage facility and enclosing what is now open storage and putting the radio equipment there and then putting the pole next to that storage unit. So the two way radio equipment will be in the enclosed storage unit and then the pole will be next to it. I might also add that there was some question that came up after we had applied concerning a road that is going to be going along the North property line. Our original diagram or site plan was submitted without knowing that and so on the original site plan we had suggested that the pole be located north of the building. Once we found out that road way was going in we instructed our architect and in fact I have an example here which is just a rough drawing. We got approval from the owner to move that pole from the north side around to the east side. We weren't quite sure how close the right of way was going to be to that facility, but it was never our intention to put that pole out close to the highway. So basically what I am saying is this is the north edge of the building, the edge CJ Meridian City Council October 17, 1995 Page 63 • of the roadway is going to go in here and the pole is going to be around on the east side of the building. Final plans would be submitted once approval is granted and like I said the architect has already drawn that up. Morrow: I have one other question, do these types of facilities interfere at all with any other electronics? McFadden: None whatsoever, that is a question that is commonly asked that is an FCC granted frequency and as 1 mentioned at the P & Z hearings, in some areas, in remote areas for instance Forest Service sites, you can have 5 or 6 users on one tower all transmitting at different frequencies and there are no problems. The most commonly asked question has to do with radio and T.V., it is a different wave length in fact we have a site over on the Olympia Peninsula we are mounting our facility on KSTW11's tower. We need a little, if there is more than one user on the tower you need 20 or 30 feet of vertical separation to keep the radio waves from interfering with each other but this does not affect surrounding radio or T.V. reception at all. Another question that was asked at the P & Z hearing just for your information was if this. tower would be lit, the answer is no. The FAA minimum requirement for lighting one of these is a 200 foot pole, the State of Idaho Department of Transportation requirements is 150, this is going to be well below that so it will not be lit. Kingsford: Any other questions of the Council. Smith: Mr. Mayor and Council members, Councilman Morrow brings a question to my mind, we have just recently converted our control system for our wells to a telemetric system, does that have any effect on our radio frequency? McFadden: We can certainly have our engineers confirm that but I can also tell you I have worked on other sites where we have located on water tanks as a permanent structure and they all of telemetry too and it has never been a problem. Smith: And they were regular frequency controlled telemetry also. McFadden: Correct. Smith: I would appreciate it if you could check that for us and we can give you the frequency numbers. McFadden: What I will do is have our project engineer contact you directly to make sure the frequencies don't interfere. But to my knowledge that has never happened and I have worked on several tank sites. • Meridian City Council October 17, 1995 Page 64 Smith: Thank you Kingsford: Counselor, what is your reaction to his comment about #7 and the variance for height? Crookston: The reason I put that in there is because in our bulk coverage portion it says we have a 40 foot height limitation, I did not check the rest of the ordinance, I see this, he gave me a copy of this section 11-2-410 D, subsection 5, the only thing that 1 would reference there it says that they don't need, that statute of the ordinance doesn't apply where it says this structure will constitute a hazard to the safe landing and take off of aircraft at an established airport. I think we need to just make up a finding that it will not cause any problems. I don't have any information as to whether the McDonald's sign causes any problems or not. McFadden: If I can comment, we have a, US West has a full time employee who does nothing but FAA determinations which is what it is called. If this, and the reporting minimums that I quoted you the 150 feet for Idaho and the 200 feet for Washington for the FAA presume that there are no airports around. But the gentleman, AI Conquest is his name at US West that does our determinations the additional step that he has to go through is to check the FAA's for the lack of a better term pilot maps to confirm that there are no airfields within a certain radius around the site. If he finds one of those then we have to notify if it is under the 200 foot level. He did that in house determination, determined that there were no landing areas within the reporting, what they call a reporting area and therefore the tower would not need to be lit. So the answer to your question is it has been determined and it would not be a hazard to aircraft. Kingsford: That is in the (inaudible) don't we have a light on top of the tower Gary? Smith: No sir (inaudible). Kingsford: Any other questions on that? Crookston: 1 would just say that if he submits the report that he referenced. McFadden: I would be happy to provide it. Kingsford: What is your pleasure Council? ITEM #13: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A CELLULAR COMMUNICATION FACILITY BY US WEST NEWVECTOR GROUP, INC.: Johnson: I will now open the public hearing, is the applicant or his representative ready to address the Commission. Timothy McFadden, 11201 Southeast 8th St, Bellevue, WA, 98004, was sworn by the City Attorney. McFadden: I am an acquisition and zoning consultant for US West, I am the person that prepared the package that you have before you. US West is requesting permission conditional use permit to construct a cellular phone facility at the mini storage located on Meridian. The facility would consist of interior, there is currently covered storage there. What US West is proposing to do is to enclose one of those units with the radio equipment inside that enclosed unit and then put the pole with the equipment next to it with the equipment on it next to the building. This is for lack of a better term a second generation cellular site. By that I mean the first generation of cellular is typically found on the highest points around, for instance Table Rock and some of the 300 or 400 foot towers that they put in. The only way that the company or any cellular company can increase capacity is to add more sites. Given the explosive growth of the industry this is one of 4 or 5 sites that is going to be going in around the perimeter of the Boise area, the core area to increase capacity. From the standpoint of US West this is a fairly basic facility, there is nothing unusual about this one that you wouldn't find in any other cellular facility. The equipment room will contain 2 way radio equipment, and as I said the pole will have the antennas on top. We have, entered into an option to lease from the gentleman that owns the storage pending the obtaining of all the necessary permits. We would hope that once the permits if and when the permits are granted we would be able to move into construction as soon as possible. It is really all we have in the way of a presentation. Johnson: Thank you very much, are there any questions of Mr. McFadden? Rountree: Are there any specific cellular requirements that makes this site particularly good for you (inaudible). McFadden: My job is I am the real estate guy that goes out and finds it and does the permitting. The way the fifes are assigned to me is the engineering department based in Meridian Planning & Zoning Commission September 12, 1995 Page 9 miles. What I am saying is I have a search area for here, there is Sher one for an area around Eagle. There is a third one going in close to the Town nr~N_ As I said essentially what the first time around, what they did is went in and did the ao~e area to get initial coverage. What they call the coverage site. These are capacity sib; the system is over capacity and they are trying to add more frequencies more chars to the system. Crookston: You said there was a pole involved? McFadden: Correct Crookston: How tall is that? McFadden: 100 feet steel pole, very similar to the type of the McDanaki's pole. The single steel pole that would. go up that would have the antenna sitting on 1~ top. Hepper: Are there any other ones around the valley or would this be the.first? (Inaudible) McFadden: The gentleman speaking is Ron Smith the real estate manager for US West, again this kind of goes back, kind of dove tails with what I was tei~ng you before. The previous site, the earlier sites were all much taller, McMillan Road l think is a 200 footer, the one on Table Rock is of course because the topography is much hMgher than where we are now. The second generation poles will all be much shorter because they don't want to intertere you keep them down low so that their coverage area is smaller and they don't interfere with the other sites that are farther out. Most of the shorter poles are monopoles. Once you get up higher because of the wind loading and the problems with the elements you have to have either a self support or a guide tower which I am sure you have seen the ones with the wires coming out. So it is the next generation that v~'ll be predominantly monopoles. Crookston: So you are saying this would not have a guide wire? McFadden: That is correct, it will be basically just exactly like the pole that has the McDonald's or the Kentucky Fried Chicken sign on it. It will go into the ground with no wires. Crookston: How bid around is the pole? McFadden: At the base it is 48 inches. • Meridian Planning & Zoning Commission September 12, 1995 Page 10 Johnson: Any other questions? Thank you very much, this is a public hearing, is there anyone else from the public that would like to address the Commission? Ron Smith, 15115 177th Drive NE, Woodenville, WA, was swum by the City Attorney. Smith: There were a couple questions addressed to our plan and why we are locating or proposing to construct a cellular facility in~the City of Meridian. 1 have a map here that I will share with you. This is our growth plan map for what we consider Southern Idaho. There are a number of sites that we are adding. I will just pass it around, it will kind of show you where we are developing. Johnson: Are you prepared to leave that with us because that is what happens here? Smith: Yes, you can have it. The map is at a scale that would not be considered proprietary information for a competitor. So if it was in public files it would not create any problems for us. The reason we are adding additional cells is Tim explained it quite well is that we have a site that is over on Table Rock we also have a cell site that is not too far from here that is a guide tower. We will be lowering the height of the antennas on those sites or turning them a different direction so that they won't be serving certain areas. So we will be building a site over in Kuna, we will be building one in Meridian. They are fairly evenly spaced. There will be also one over in the Eagle area, over off of Franklin by the Ada County Public Safety Facility. And then there will be one in the Glenwood area. These are much smaller facilities, they are typically 80 to 100 feet tall in height. This will fill in the areas and give us additional capacity as well as allowing us to reduce the height of these antennas that are on our existing facilities. We also added one to a bank building . in downtown Boise was a roof mount. So we are adding a number of facilities in this region so that we could provide phone service to the customers that are n:quiring additional capacity because the growth of this region has been quite phenomenal from a population standpoint. There is. quite a high demand for our services. So in order for us to meet the demand from the customer from the public we have to have these additional facilities. In the staff report there was one question about the location of the pole. There is a proposed street that will be developed in the near future that will be going by the mini center. The staff requested that if this proposal is approved that we would work with the staff to relocated the pole. We have discussed it with the site owner and we do have the opportunity to relocate it away from the street corridor so we would not have to deal with any of the potential setback issues that were addressed in the staff report. So we have already looked into that item. This pole here will be slightly shorter than the McDonald's pole that is presently something over 100 feet. This will be less this will be 100 feet. It will be just a little bit shorter than a pole that is already out there. Crookston: Are you talking about the pole that is at the Meridian McDonald's? • Meridian Planning & Zoning Commission September 12, 1995 Page 11 Smith: The Meridian McDonald's I don't know if it is in the City of Meridian, the McDonald's that is right up there. I am not sure where the corporate limits are. This pole will look just like that with the exception that it is an evenly tapered pole versus, their pole is tapered but it is segmented so it looks like stacked pipes, ours will be an evenly tapered one. Crookston: How many companies are providing cellular service so that we might be able to tell how many poles vNe might be looking at in the future. Smith: Well, right now there are 2 cellular licenses in every market in the United States. The FCC just recently issued new licenses for what they called PCS, it is a personal communications, it is a wireless technology it would be virtually the same as cellular it just operates at different frequencies. They have issued two licenses for every market in the United States also. Right now there are currently 4 licenses out there, I don't know if any of the PCS companies have started doing any work in this area yet or not. How much demand will they have for the City of Meridian, I couldn't tell you. This site here wilt take care of our needs for many years. Crookston: There is noway that you can have more than one signal coming to that pole? Smith: Well, there are a number of radio frequencies that we assign to that one communications site because we have our radios and computers in there to receive and transmit signals. That cell site is connected to our switch whic~t takes care of interconnection to whether it is coming from a wire line telephone or it is going long distance or it is going to another cellular phone. So there is a set of frequencies that we use there but it is limited. So, we have a site that we built in Caldwell, there we're fortunate enough that there was an existing structure that had the correct height for us and we mounted our antennas on a water tank that was in the proper location. There is another one that we are doing in Nampa that is with Union Pacific they have a tower down there. We were fortunate that there was an existing within the design search area right from the engineering propagation models they dictate where the sites need to be when you start adding additional sites or splitting the cells. So once you have all of these sites they all have to kind of talk to each other just overlap slightly. But you can't use the same frequencies where they happen to overlap or you will get static or dropped calls. Did that answer your question? Crookston: Pretty much, 1 am looking down the future. I suppose is there a possibility there would be more than iwo licensed business that could have these poles in the future? Smith: As I indicated right now there are a total of four. Our competition which is now called AT&T Wireless on the other side of your town they have quite a large pole I don't know, it looks to me to be around 300 feet tall. I can't see where they would probably be putting anothe#- one in. I can't speak for the other two companies becuase they haven't started doing autything in this region. So. it would be reasonable to assume they might come and ask ~! for some type of permit whether it be attaching to an existing structure or putting in a !r~rv pole. They may not even need to use the City or apply or build a facility within your cacporate limits. Crookston: If they are on differen# fir+squencies is there any chance that there could be multiple users on one pole? Smith: Yes, and we do (inaudible) I~cations, that has happened. It is possible, the things that you have to look at is the aesthetics and that is how much bulk will the pole have when you add additional antennas to it. The other would be the design of the pole, the poles are designed to sustain a substantial winds for safety factor. Also, once we put a facility up on the air we want to make sure that np matter what kind of disaster occurs we would still be able to provide phone service dam an emergency stand point and. for safety. The towers have a rather rigorous design: standard that they are set up for. For example in Florida when they had the severe ~rricanes there were no poles that were lost down there. That is not our system but it is itr~asically how the cellular companies are designed. These poles are designed to sustain continuous winds of 140 miles an hour with the assumption you have evenly formed raa~iiolites over the whole tower of 1/2 inch so you get this incredible loading. It is possible to put other people on there we just have to know kind of in advance that we should put ar stronger tower in (inaudible) for our own personal use. The other thing they would have to do is be able to make sure that the property owner where we are at becuase we don't buy the site we put the site on a long term lease that the property would be willing and able to accommodate an extra tenant in their facility. I can't speak for the property owner. Crookston: What I was looking at vas we have had situations arise where people wondered why the pole was put there, l am not saying (inaudible) but tall poles even radio FM/AM type radios in their distribution system. I am just trying to see what is down the line to say that there is a possiblity of comt~ining that maybe with (inaudible) beneficial interest. Smith: That could be something that you could add to a condition if you so desire, hopefully you would approve our a~tication. But that virould not be an uncommon requirement. There are other agencies~at do that. We do (inaudible) locations with other companies other businesses. For example Ada County Public Safety the project that we are doing there is a joint venture where we build a tower and they get to use a majority of the tower for the new corhmunications #hat Ada County will be putting in for police and fire and their court systems and they will be using that pole for that as well as we will be on. Setbacks in the C-G zone are 15' front and 0' side and back. Height limitation in the C-G zone is 40', but several pole signs exist within the C-G zone that are higher than 40'. Having never dealt with a "tower" issue such as this, I am unsure of any FAA restrictions that may exist or whether a variance should be required. All such districts shall be connected to the Municipal Water and Sewer systems of the City of Meridian, and shall not constitute strip commercial development and encourage clustering of commercial development; 5. That the Applicant is not the owner of record of the property; that the owner of record, being the owner of Public Storage of Meridian, is Richard M. Phillips; that the owner has submitted a consent to this application. 6. That the property is currently used for Public Storage of Meridian. 7. That the proposed use by the Applicant is to construct and install a cellular communication facility consisting of a monopole antenna structure and an equipment space to be located in an existing mini storage facility at Public Storage of Meridian. FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 2 US WEST CELLULAR 8. That at the public hearing the Applicant's representative, Timothy McFadden, acquisition and zoning consultant for US West, stated that due to the tremendous growth of the cellular industry the need for additional "capacity sites" to areas where cellular coverage is already present, is~necessary; that new subscribers are overloading the system which requires that new sites be added to add capacity, more frequencies, and more channels to the system; that based on some areas of topography, based on population, based on road or highway frontage and the availability of arterials, a search area is chosen; that the search area is approximately a mile across; that the coverage at this location will be approximately 4 to 6 miles; that the location of the proposed site is almost exactly in the middle of that search area, that being the Public Storage of Meridian. 9. That the pole is made of steel, evenly tapered, with the base being 48 inches and the height being 100 feet; that these poles are designed to withstand winds of 140 miles an hour; that it will be located at the north property line of the site approximately 3,60, feet west of Meridian Road. 10. That the sites at Table Rock and McMillan Road will have the lowering of their antennas and the direction changed with the addition of the four (4) to five (5) new sites; that these smaller facilities will give additional capacity as well as allowing US West to reduce the height; that the chance of multiple users on one pole is a possibility; that the site is on a long term lease with FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 3 US WEST CELLULAR • the property owner and the addition of additional tenants is up to the property owner. 11. That the proposed location of this facility will provide the coverage required in the immediate area and will. not interfere with other facilities already in operation. 12. That there is a proposed street that will be developed in the near future that will be going by the mini center where this pole will be located; that we do have opportunity to relocate the pole once the street proposal is approved, to relocate the pole away from the street corridor so as not to have to deal with any potential setback issues. 13. That there was no other testimony to this application. 14. That although sewer and water will not be required at this proposed facility, US West agrees to pay any additional fees generated by the site; that the power to the site will be separately metered and paid directly by US West. 15. That the Ada County Highway District staff report commented that an anticipated east-west collector roadway will be. constructed abutting this north property line as a westward extension of Corporate Drive from Meridian Road; that ACRD recommends. the City of Meridian require the standard street setback which would be required if a street were abutting the north property line of this site. 16. That the City Planning Director, Shari Stiles, commented that the setbacks in the C-G zone are 15' front and 0' side and FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 4 US WEST CELLULAR back, with height limitation being 40', but that several pole signs exist within the C-G zone which are higher than 40'; that having never dealt with a "tower" issue like this, the Director is unsure of any FAA restrictions that may exist or whether a variance should be required. 17. That the Central District Health Department, City Fire Department, and Meridian Police Department submitted comments and they are incorporated herein as if set forth in full. 18. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property; 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian; 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards ender which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The-use should be harmonious with and in accordance with the Comprehensive Plan, and Zoning Ordinance if a variance from the height restrictions is granted. c. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. f. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. g. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major. importance. 5. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, Uniform Mechanical Code, Uniform Electrical Code, the Fire and Life Safety Code, all parking and FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 6 US WEST CELLULAR landscaping requirements; that the Applicant shall meet with Shari Stiles to work out an acceptable landscape plan. 6. That the zoning of General Retail and Service Commercial, (C-G) is defined in the Zoning Ordinance at 11-2-408 B. 11. as follows: (C-G) General Retail and Service Commercial: The purpose of the (C-G) District is to provide for commercial uses which are customarily operated entirely or almost entirely within a building; to provide for a review of the impact of proposed commercial uses which are auto and service oriented and are located in close proximity to major highway or arterial streets; to fulfill the need of travel-related services as well as retail sales for the transient and permanent motoring --- -- - _ public. _All _ uch ..districts- shall--=-be-:.-connected- -~o the Municipal Water and Sewer systems of the City of Meridian, and shall not constitute strip commercial development and encourage clustering of commercial development; 5. That the Applicant is not the owner of record of the property; that the owner of record, being the owner of Public Storage of Meridian, is Richard M. Phillips; that the owner has submitted a consent to this application. 6. That the property is currently used for Public Storage of Meridian. 7. That the proposed use by the Applicant is to construct and install a cellular .communication facility consisting of a monopole antenna structure and an equipment space to be located in an existing mini storage facility at Public Storage of Meridian. FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 2 US WEST CELLULAR • 8. That at the public hearing the Applicant's representative, Timothy McFadden, acquisition and zoning consultant for US West, stated that due to the tremendous growth of the cellular industry the need for additional "capacity sites" to areas where cellular coverage is already present, is necessary; that new subscribers are overloading the system which requires that new sites be added to add capacity, more frequencies, and more channels to the system; that based on some areas of topography, based on population, based on road or highway frontage and the availability of arterials, a search area is chosen; that the search area is approximately a mile across; that the coverage at this location will be approximately 4 to 6 miles; that the location of the proposed site is almost exactly in the middle of that search area, that being the Public Storage of Meridian. 9. That the pole is made of steel, evenly tapered, with the .,5~ < base being 48 inches and the height being 100 feet; that these Vi.:~ l -.' poles are designed to withstand winds of 140 miles an hour; that it ,s ?~~~~~ will be located at the north property line of the site approximately 3,600 feet west of Meridian Road. 10. That the sites at Table Rock and McMillan Road will have the lowering of their antennas and the direction changed with the addition of the four (4) to five (5) new sites; that these smaller facilities will give additional capacity as well as allowing US West to reduce the height; that the chance of multiple users on one pole is a possibility; that the site is on a long term lease with FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 3 US WEST CELLULAR • • the property owner and the addition of additional tenants is up to the property owner. 11. That the proposed location of this facility will provide the coverage required in the immediate area and will not interfere with other facilities already in operation. 12. That there is a proposed street that will be developed in the near future that will be going by the mini center where this pole will be located; that we do have opportunity to relocate the pole once the street proposal is approved, to relocate the pole away from the street corridor so as not to have to deal with any potential setback issues. 13. That there was no other testimony to this application. 14. That although sewer and water will not be required at this proposed facility, US West agrees to pay. any. additional fees generated by the site; that the power to the site will be separately metered and paid directly by US West. 15. That the Ada County Highway District staff report commented that an anticipated east-west collector roadway will be constructed abutting this north property line as a westward extension of Corporate Drive from Meridian Road; that ACHD recommends the City of Meridian require the standard street setback which would be required if a street were abutting the north property line of this site. 16. That the City Planning Director, Shari Stiles, commented that the setbacks in the C-G zone are 15' front and 0' side and FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 4 US WEST CELLULAR • back, with height limitation being 40', but that several pole signs exist within the C-G zone which are higher than 40'; that having never dealt with a "tower" issue like this, the Director is unsure of any FAA restrictions that may exist or whether a variance should be required. 17. That the Central District Health Department, City Fire Department, and Meridian Police Department submitted comments and they are incorporated herein as if set forth in full. 18. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property; 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian; 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan, and Zoning Ordinance if a variance from the height restrictions is granted. c. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. f. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. g. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. Is there anyone here representing the applicant? It is a possibility Mr. Jewell is coming, he told our City Clerk that he might be a little late. It would be my recommendation that we defer this to the end of our agenda. ITEM #13: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A CELLULAR COMMUNICATION FACILITY BY US WEST NEWVECTOR GROUP, INC.: Johnson: I will now open the public hearing, is the applicant or his representative ready to address the Commission. Timothy McFadden, 11201 Southeast 8th St, Bellevue, WA, 98004, was swum by the City Attorney. McFadden: I am an acquisition and zoning consultant for US West, I am the person that prepared the package that you have before you. US West is requesting permission conditional use permit to construct a cellular phone facility at the mini storage located on Meridian. The facility would consist of interior, there is currently covered storage there. What US West is proposing to do is to enclose one of those units with the radio equipment inside that enclosed unit and then put the pole with the equipment next to it with the equipment on it next to the building. This is for lack of a better term a second generation cellular site. By that I mean the first generation of cellular is typically found on the highest points around, for instance Table Rock and some of the 300 or 400 foot towers that they put in. The only way that the company or any cellular company can increase capacity is to add more sites. Given the explosive growth of the industry this is one of 4 or 5 sites that is going to be going in around the perimeter of the Boise area, the core area to increase capacity. From the standpoint of US West this is a fairly basic facility, there is nothing unusual about this one that you wouldn't find in any other cellular facility. The equipment room will contain 2 way radio equipment, and as I said the pole will have the antennas on top. We have entered into an option to lease from the gentleman that owns the storage pending the obtaining of all the necessary permits. We would hope that once the permits if and when the permits are granted we would be able to move into construction as soon as possible. It is really all we have in the way of a presentation. Johnson: Thank you very much, are there any questions of Mr. McFadden? Rountree: Are there any specific cellular requirements that makes this site particularly good for you (inaudible). McFadden: My job is I am the real estate guy that goes out and finds it and does the permitting. The way the files are assigned to me is the engineering department based in • • Meridian Planning & Zoning Commission September 12, 1995 Page 8 some areas of topography based on population, based on road or highway frontage, not highway frontage but the availability of arterials choose a search area and it is typically a circle or a series of circles that is drawn on a topographic map. So what they give me is a search area map and then a specification sheet that tells me how much of a leased area they need and how big of a pole they need. The location that we are talking about is almost exactly in the middle of that search area. The search area is approximately a mile across. The mini-storage is almost exactly in the middle of it. So I gu2ss the answer to your question is there is some room for movement but in order to obtain the coverage that they need it has to be within that search area. Going back to my earlier point about this being a secondary site, the biggest problem that the engineering department has in siting these second generation sites is making sure they don't have interterence from or create interference for the sites that are already there. So siting the second generation sites is a little bit tougher than the first one. Consequently the search areas are typically smaller. Rountree: What would constitute interterence? McFadden: What we are basically talking about are FM signals so if you have, for instance the facility that is over on McMillan Road northeast of here, if that facility and this facility we are talking about would be on the same wave length operating at the same frequencies they would intertere with each other. The way that cellular works, the only way it works system wide is to be able to reuse frequencies. So what they would do if you have 4 or 5 cells let's give you an easy example, along t34, maybe every 4th cell would be using the same frequencies and they would be far enough away that they wouldn't be intertering with the 4th cell out that is using the same frequency. There are an extremely limited number of frequencies that have been assigned by the FCC and because of the way the system works there is only a limited number of telephone calls that one of these sites can handle. So consequently if you need more capacity in the system that is why you need more sites. Rountree: I think you indicated when you made your presentation that this would be one of four sites that your company would be interested in. McFadden: That I am aware of yes. Rountree: In the entire Treasure Valley? McFadden: Correct Rountree: The critical area around this one is just one mile? McFadden: The search area is one mile, the coverage area will go out probably 4 to 6 • • Meridian Planning & Zoning Commission September 12, 1995 Page 9 miles. What I am saying is I have a search area for here, there is another one for an area around Eagle. There is a third one going in close to the Town mall. As I said essentially what the first time around, what they did is went in and did the core area to get initial coverage. What they call the coverage site. These are capacity sites, the system is over capacity and they are trying to add more frequencies more channels to the system. Crookston: You said there was a pole involved? McFadden: Correct Crookston: How tall is that? McFadden: 100 feet steel pole, very similar to the type of the McDonald's pole. The single steel pole that would go up that would have the antenna sitting on the top. Hepper: Are there any other ones around the valley or would this be the first? (Inaudible) McFadden: The gentleman speaking is Ron Smith the real estate manager for US West, again this kind of goes back, kind of dove tails with what I was telling you before. The previous site, the earlier sites were all much taller, McMillan Road I think is a 200 footer, the one on Table Rock is of course because the topography is much higher than where we are now. The second generation poles will all be much shorter because they don't want to interfere you keep them down low so that their coverage area is smaller and they don't interfere with the other sites that are farther out. Most of the shorter poles are monopoles. Once you get up higher because of the wind loading and the problems with the elements you have to have either a self support or a guide tower which I am sure you have seen the ones with the wires coming out. So it is the nexf generation that will be predominantly monopoles. Crookston: So you are saying this would not have a guide wire? McFadden: That is correct, it will be basically just exactly like the pole that has the McDonald's or the Kentucky Fried Chicken sign on it. It will go into the ground with no wires. Crookston: How bid around is the pole? McFadden: At the base it is 48 inches. • • Meridian Planning & Zoning Commission September 12, 1995 Page 10 Johnson: Any other questions? Thank you very much, this is a public hearing, is there anyone else from the public that would like to address the Commission? Ron Smith, 15115 177th Drive NE, Woodenville, WA, was sworn by the City Attorney. Smith: There were a couple questions addressed to our plan and why we are locating or proposing to construct a cellular facility in the City of Meridian. I have a map here that I will share with you. This is our growth plan map for what we consider Southern Idaho. There are a number of sites that we are adding. I will just pass it around, it will kind of show you where we are developing. Johnson: Are you prepared to leave that with us because that is what happens here? Smith: Yes, you can have it. The map is at a scale that would not be considered proprietary information for a competitor. So if it was in public files it would not create any problems for us. The reason we are adding additional cells is Tim explained it quite well is that we have a site that is over on Table Rock we also have a cell site that is not too far from here that is a guide tower. We will be lowering the height of the antennas on those sites or turning them a different direction so that they won't be serving certain areas. So we will be building a site over in Kuna, we will be building one in Meridian. They are fairly evenly spaced. There will be also one over in the Eagle area, over off of Franklin by the Ada County Public Safety Facility. And then there will be one in the Glenwood area. These are much smaller facilities, they are typically 80 to 100 feet tall in height. This will fill in the areas and give us additional capacity as well as allowing us to reduce the height of these antennas that are on our existing facilities. We also added one to a bank building in downtown Boise was a roof mount. So we are adding a number of facilities in this region so that we could provide phone service to the customers that are requiring additional capacity because the growth of this region has been quite phenomenal from a population standpoint. There is quite a high demand for our services. So in order for us to meet the demand from the customer from the public we have to have these additional facilities. In the staff report there was one question about the location of the pole. There is a proposed street that will be developed in the near future that will be going by the mini center. The staff requested that if this proposal is approved that we would work with the staff to relocated the pole. We have discussed it with the site owner and we do have the opportunity to relocate it away from the street corridor so we would not have to deal with any of the potential setback issues that were addressed in the staff report. So we have already looked into that item. This pole here will be slightly shorter than the McDonald's pole that is presently something over 100 feet. This will be less this will be 100 feet. It will be just a little bit shorter than a pole that is already out there. Crookston: Are you talking about the pole that is at the Meridian McDonald's? • Meridian Planning & Zoning Commission September 12, 1995 Page 11 Smith: The Meridian McDonald's I don't know if it is in the City of Meridian, the McDonald's that is right up there. I am not sure where the corporate limits are. This pole will look just like that with the exception that it is an evenly tapered pole versus, their pole is tapered but it is segmented so it looks like stacked pipes, ours will be an evenly tapered one. Crookston: How many companies are providing cellular service so that we might be able to tell how many poles we might be looking at in the future. Smith: Well, right now there are 2 cellular licenses in every market in the United States. The FCC just recently issued new licenses for what they called PCS, it is a personal communications, it is a wireless technology it would be virtually the same as cellular it just operates at different frequencies. They have issued tviro licenses for every market in the United States also. Right now there are currently 4 licenses out there, I don't know if any of the PCS companies have started doing any work in this area yet or not. How much demand will they have for the City of Meridian, I couldn't tell you. This site here will take care of our needs for many years. Crookston: There is noway that you can have more than one signal coming to that pole? Smith: Well, there are a number of radio frequencies that we assign to that one communications site because we have our radios and computers in there to receive and transmit signals. That cell site is connected to our switch which takes care of interconnection to whether it is coming from a wire line telephone or it is going long distance or it is going to another cellular phone. So there is a set of frequencies that we use there but it is limited. So, we have a site that we built in Caldwell, there we're fortunate enough that there was an existing structure that had the correct height for us and we mounted our antennas on a water tank that was in the proper location. There is another one that we are doing in Nampa that is with Union Pacific they have a tower down there. We were fortunate that there was an existing wrthiri the design search area right from the engineering propagation models they dictate where the sites need to be when you start adding additional sites or splitting the cells. So once you have all of these sites they all have to kind of talk to each other just overlap slightly. But you can't use the same frequencies where they happen to overlap or you will get static or dropped calls. Did that answer your question? Crookston: Pretty much; I am looking down the future. I suppose is there a possibility there would be more than two licensed business that could have these poles in the future? Smith: As I indicated right now there are a total of four. Our competition which is now called AT&T Wireless on the other side of your town they have quite a large pole I don't know, it looks to me to be around 300 feet tall. So it is outside your corporate limits. That • • Meridian Planning & Zoning Commission September 12, 1995 Page 12 is a guide tower. They have a facility that will cover the Meridian area. I can't see where they would probably be putting another one in. I can't speak for the other two companies becuase they haven't started doing anything in this region. So it would be reasonable to assume they might come and ask you for some type of permit whether it be attaching to an existing structure or putting in anew pole. They may not even need to use the City or apply or build a facility within your corporate limits. Crookston: If they are on different frequencies is there any chance that there could be multiple users on one pole? Smith: Yes, and we do (inaudible) locations, that has happened. It is possible, the things that you have to look at is the aesthetics and that is how much bulk will the pole have when you add additional antennas to it. The other would be the design of the pole, the poles are designed to sustain a substantial winds for safety factor. Also, once we put a facility up on the air we want to make sure that no matter what kind of disaster occurs we would still be able to provide phone service from an emergency stand point and for safety. The towers have a rather rigorous design standard that they are set up for. For example in Florida when they had the severe hurricanes there were no poles that were lost down there. That is not our system but it is basically how the cellular companies are designed. These poles are designed to sustain continuous winds of 140 miles an hour with the assumption you have evenly formed radiolites over the whole tower of 1/2 inch so you get this incredible loading. It is possible to put other people on there we just have to know kind of in advance that we should put a stronger tower in (inaudible) for our own personal use. The other thing they would have to do is be able to make sure that the property owner where we are at becuase we don't buy the site we put the site on a long term lease that the property vuould be willing and able to accommodate an extra tenant in their facility. I can't speak for the property owner. Crookston: What I was looking at was we have had situations arise where people wondered why the pole was put there, I am not saying (inaudible) but tall poles even radio FM/AM type radios in their distribution system. I am just trying to see what is down the line to say that there is a possiblity of combining that maybe with (inaudible) beneficial interest. Smith: That could be something that you could add to a condition if you so desire, hopefully you would approve our application. But that would not be an uncommon requirement. There are other agencies that do that. We do (inaudible) locations with other companies other businesses. For example Ada County Public Safety the project that we are doing there is a joint venture where we build a tower and they get to use a majority of the tower for the new communications that Ada County will be putting in for police and fire and their court systems and they will be using that pole for that as well as we will be on. So it will be a multi user. That is not uncommon, that happens in a number of jurisdictions. • Meridian Planning & Zoning Commission September 12, 1995 Page 13 We operate in 14 states. Crookston: You operate in the US West states, the states they operate in. Smith: Correct, and so we probably have a couple thousand of these sites currently operating throughout our markets. There are a number of jurisdictions that will and have required (inaudible) location. We will accomodate the other people. Johnson: Any other questions of Mr. Smith? Are you aware of any publications on this subject? Would you make sure that Mr. Crookston gets on that mailing list. You wanted to address the Commission or did you get your questions answered?
