MEMORANDUM OF AGREEMENT AND CROSS-DEPUTIZATION FOR
THE BOISE POLICE DEPARTMENT, THE GARDEN CITY POLICE DEPARTMENT AND
THE MERIDIAN CITY POLICE DEPARTMENT
WHEREAS the Boise City Police Department, the Garden City Police Department and the
Meridian City Police Department have entered into a Memorandum of Agreement to permit
officers of each jurisdiction to exercise peace officer authority in the jurisdictions of the others
through cross-deputization; and
WHEREAS the Boise City Police Department, the Garden City Police Department and the
Meridian City Police Department desire to enter into a Memorandum of Agreement providing for
police action where police action is necessary or should otherwise be taken; and
WHEREAS it is necessary that Boise City Police officers, Garden City Police officers and
Meridian City Police officers be granted lawful authority to exercise the powers of police officers
within the jurisdiction of the others and such cross-deputization is necessary and desirable;
NOW THEREFORE, the Boise City Police Department, the Garden City Police
Department and the Meridian City Police Department agree and understand as follows:
I.
CONDITIONS OF AUTHORIZATION
It is intended that in situations where police action is necessary or should otherwise be taken, each
agency is authorized to respond and take appropriate police action within the jurisdiction of the
others.
It is agreed that Boise City Police officers, Garden City Police officers and Meridian City Police
officers be granted lawful authority to exercise the powers of police officers within the jurisdiction
of the others.
All POST-certified full-time paid employees of the Garden City Police Department and the
Meridian City Police Department are hereby appointed and deputized by the Boise Police Chief as
Special Police inside the City of Boise, with full jurisdiction within the Boise City limits. This
appointment is pursuant to Boise City Code 3-01-04.
All POST-certified full-time paid employees of the Boise City Police Department and the
Meridian City Police Department are hereby appointed and deputized by the Garden Police Chief
as Special Police inside the City of Garden City, with full jurisdiction within the Garden City
limits. This appointment is pursuant to Garden City Code 1-8-3:C.

All POST-certified full-time paid employees of the Boise City Police Department and the Garden
City Police Department are hereby appointed and deputized by the Meridian Police Chief as
Special Police inside the City of Meridian, with full jurisdiction within the Meridian City limits.
This appointment is pursuant to Meridian City Code 1-807.
The Criminal Investigative Unit of each agency shall have primary jurisdiction for follow-up
investigations of crimes committed within the corporate limits of that agency's city. Each agency
within the MOU may follow-up crimes which originated within the corporate limits of their
jurisdiction, even though such follow-up may include investigation within the corporate limits of
either of the other jurisdictions. If an investigation discloses any crime committed within the
corporate limits of one of the other agencies, the officer leading the investigation will immediately
notify that agency's Detective Unit and cooperate with the other agency. Thereafter, follow-up
and investigation will be the responsibility of the agency that has primary jurisdiction.
II.
STANDARDS OF CONDUCT
Each police officer shall maintain the standards of professional conduct required by the officer's
current departmental policies and procedures.
It shall be the sole duty and responsibility of the officer's employing agency to determine if there
has been a breach of professional standards. Each agency shall have the responsibility to notify its
own officers of restrictions of jurisdiction or peace officer status due to a breach of professional .
standards or other action that would limit peace officer authority for the officer.
Where an officer-involved shooting/deadly force incident occurs within the city limits of one
agency by an officer of the other agencies, the agency with primary jurisdiction and the agency
involved in the incident will conduct a joint investigation, with oversight by the Idaho Department
of Law Enforcement, Bureau of Investigation.
III.
MEDIA RELEASES
As a general guideline, media information will be released by the agency with primary jurisdiction.
However, this guideline is not intended to limit any of the agencies from describing or withholding
information regarding their participation in the situation. The Boise City Police Department, the
Garden City Police Department, and the Meridian City Police Department, are encouraged to
consult with one another prior to media releases.

IV.
LIABII,ITY
The employing agency shall be responsible for any liability arising from the acts of its employees
participating in this Memorandum of Agreement, including but not limited to worker's
compensation, claims, and causes of action.
IV.
AMENDMENT, DURATION, AND TERMINATION OF AGREEMENT
This Memorandum of Agreement may be amended by agreement of all parties. This agreement
shall remain in full force and effect until terminated upon thirty (30) days written notice by any
party.

A RESOLUTION APPROVING A MEMORANDUM OF AGREEMENT
AND CROSS-DEPUTIZATION BETWEEN THE BOISE CITY POLICE
DEPARTMENT, THE GARDEN CITY POLICE DEPARTMENT, AND
THE MERIDIAN CITY POLICE DEPARTMENT, PERMITTING
OFFICERS OF EACH JURISDICTION TO EXERCISE PEACE
OFFICER AUTHORITY IN THE JURISDICTIONS OF THE OTHERS
THROUGH CROSS-DEPUTIZATION IN FURTHERANCE OF A
MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF BOISE,
THE CITY OF GARDEN CITY AND THE CITY OF MERIDIAN, AND
AUTHORIZING THE MAYOR AND THE CHIEF OF POLICE TO
EXECUTE THE AGREEMENT; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS the City of Boise, the City of Garden City, and the
City of Meridian have prepared a Memorandum of Agreement
between the Boise City Police DEPARTMENT, the Garden City
Police DEPARTMENT, and the Meridian City Police DEPARTMENT,
to provide police action where police action is necessary and
should otherwise be taken; and,
WHEREAS to further such goal a Memorandum of
Agreement is necessary to permit officers of each jurisdiction to
exercise peace officer authority in the jurisdictions of the others
through cross-deputization;

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND
COUNCIL OF THE CITY OF MERIDIAN CITY, IDAHO:
Section 1. That the agreement by and between the City of
Boise City, the City of Garden City, and the City of Meridian City,
a copy of said agreement marked Exhibit °°A" attached hereto
and incorporated herein by reference, be, and the same is
hereby, approved as to both form and content.
Section 2. That the Mayor and City Clerk be, and they
hereby are, authorized to execute said Agreement for and on
behalf of the City of Meridian City.
Section 3. That this Resolution shall be in full force and
effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Meridian City, Idaho,
