Pressure Irrigation
Dear Jim:
Nampa & Meridian Irrigation District has reviewed the pump station
details furnished for the above mentioned project. The pump
station and pumps appear to be adequate, thus if this portion of
the pressurized irrigation system is built according to the plans
that were reviewed, it will be adequate to meet the District's
requirements for this type of installation.
Nampa & Meridian Irrigation District does require a contract
between the developer or developers before the District can assume
control of the operation and maintenance of these facilities. If
this assumption is intended for the above mentioned project, please
have your client or clients contact Daren Coon, Secretary/Treasurer
of Nampa & Meridian Irrigation District, so that he can commence
with the paper work that is necessary.

AGREEMENT REGARDING IRRIGATION WATER
THIS AGREEMENT, made and entered into this ~~ day of

"DEVELOPER", and the CITY OF MERIDIAN, a municipal corporation
of the State of Idaho, hereafter referred to as "CITY".
RECITALS:
1. DEVELOPER is the owner and developer of ___ __~~`
Q G ~' Subdivision, hereafter referred to

as SUBDIVISION, a subdivision located in Meridian City, Ada
County, Idaho, more particularly described on Exhibit "A" hereto
and incorporated by this reference as if set forth in full herein.
2. DEVELOPER has obtained the approval of the preliminary
plat for SUBDIVISION and is seeking the approval of the final plat
for a portion of the SUBDIVISION, consisting of approximately
acres, more particularly described in Exhibit "B"
attached hereto and incorporated herein by this reference as if
set forth in full herein.
3. The portion of the SUBDIUISION now being applied for to
be finally platted consists of ~~ ~_ residential lots.
4. Under Meridian City Ordinance Section 11-9-606 B. 14.
(Ordinance No. 557 passed October 1, 1991) the DEVELOPER must
either install a pressurized irrigation system to each lot within
a residential subdivision and provide the water source or in the

alternative, this requirement may be waived by the CITY upon the
DEVELOPER either (a) deeding to the CITY land for a well, drilling
the well and placing the well on line with the CITY water system,
including the necessary pumps, piping, valves, pressure equipment,
water storage, and all other equipment and facilities necessary,
and which well depth and capacity are determined by the CITY, or
b) deposit, give and grant sufficient funds to the CITY to meet
the requirements of paragraph 4(a) and put the well on line with
the CITY water system. This latter option (b) may mean depositing
with the City sufficient funds or posting a letter of credit
payable to the CITY in a sufficient amount for the City to meet
the requirements of paragraph 4(a) to provide water for irrigating
the lots from the City's existing domestic water system.
5. This Agreement is in satisfaction of DEVELOPER's
AGREEMENT as a developer under the latter alternative set forth
in 4(b) above.
NOW, THEREFORE, in mutual consideration of the covenants
contained herein, the parties agree as follows:
1. DEVELOPER hereby agrees to pay to the City the sum of
FIVE HUNDRED DOLLARS ($500.00) per lot for each lot in that
portion of the SUBDIVISION that DEVELOPER is requesting a final
plat for, which sum is calculated at an approximate cost for the
CITY to meet the requirements of paragraph 4(b) to provide each
lot in the SUBDIVISION pressurized sprinkler irrigation water.
2. DEVELOPER hereby deposits or agrees to immediately post
PRESSURIZED IRRIGATION AGREEMENT

a letter of credit in the amount of $ ~4d ^__~r~

binding DEVELOPER and a surety acceptable to City, to pay any
obligations due under this Agreement.
3. The parties acknowledge that they are unable to
determine at this time what the actual cost to the City of
providing additional domestic water necessary to provide sprinkler
irrigation water for the lots in the SUBDIVISION will be and thus
are agreeing to enter into this Agreement and provide a letter of
credit in the above amount specified amount, which represents the
best estimate now obtainable that DEVELOPER, as the developer and
owner of the SUBDIVISION, would be obligated to pay towards
meeting the requirements of paragraph 4(a) to serve the
SUBDIVISION with pressurized sprinkling irrigation water.
4. The actual amount of DEVELOPER'S payment and
contribution towards a well system shall be determined by the
CITY'S Engineer, who shall calculate the total amount of the cost
to meet the requirements of paragraph 4(a) to provide irrigation
water for sprinkling in the SUBDIVISION. It is agreed that the
CITY engineer shall make a good faith effort to arrive at the cost
to DEVELOPER realizing that other subdivisions may be able to be
service out of one well; however it is also specifically agreed
that any well drilled by the CITY will not be drilled solely for
irrigation water purposes but shall be available to supply water
for the domestic water supply of the CITY.
5. DEVELOPER shall be obligated to, and agrees, to pay the
PRESSURIZED IRRIGATION AGREEMENT

cost as determined above and it is specifically agreed that if the
cost is less than $500.00 per lot the CITY shall either draw on
the letter of credit only that amount sufficient to pay the actual
cost determined by the CITY engineer or the DEVELOPER may pay that
amount in cash to the CITY and the letter of credit shall be
returned to DEVELOPER. It is further specifically agreed that if'
the $500.00 per lot is insufficient to pay the actual costs as
determined by the City Engineer, DEVELOPER shall pay, and hereby
agrees to pay, to the CITY any difference between the $500.00 per
lot, as posted in the letter of credit, and the actual cost of
meeting the requirements of paragraph 4(a) as determined by the
CITY Engineer.
6. The City Engineer, acting on behalf of the City, shall
make such determination and calculation as soon as is reasonably
practical and shall notify DEVELOPER in writing of his
determination. DEVELOPER shall pay the amount due under this
Agreement to the City prior to obtaining any building permits for
the construction of homes in the SUBDIVISION.
7. Prior to final platting of any other lots in said
SUBDIVISION, DEUELOPER agrees to meet the requirements of
Ordinance 11-9-606 6. 14.
8. That in the event that either party to this agreement
pursues legal action to enforce the terms of this agreement the
prevailing party shall be entitled to their attorney fees, court
costs, and out of pocket costs.

9. This Agreement may be recorded evidencing the agreement
of the parties and to act as an encumbrance on the above described
property
10. This Agreement shall run with the land and shall be
binding on the heirs, executors, and assigns of the parties
hereto.

At the Meridian City Council Meeting held April 21, 1992, the
Council adopted Resolution #145,' which set the fee for
contributions by developers to a well fund in lieu of pressurized
irrigation system $371.00 per lot. The final plat in Tract
Subdivision #1 that was approved by the City. of Meridian is far
39 single family building lots.
We would appreciate receiving your remittance in the amount of
X14,469.00 (39 x $371.00) for the necessary contribution to the
new well fund. We will return your prior deposit when this is

On February 20, 1992, the Commissioners of the Ada County Highway Dis-
trict (hereafter called "District") approved the Preliminary Plat as stated
below
FACTS & FINDINGS:
1. Tract is a 300-lot single family residential subdivision located on the
west side of Locust Grove Road, north of Chateau Drive . Eight con-
struction phases are planned over the next nine years; 14,650-feet of
new public streets are planned.
2. Locust Grove is designated a minor arterial street on the 2010 Urban
Functional Street Classification Map requiring a minimum 66-foot right-
of-way and 52-foot street section with 4 traffic lanes.
Locust Grove Road has 50-feet of right-of-way and is improved with
24-feet of paving.
3. This application was tabled on December 5, 1991, by the District Com-
mission pending receipt of a traffic study which .has recently been
submitted . Staff is putting this application back on the agenda for
consideration and approval subject to conditions . Pertinent parts of
the traffic study are attached .
4. The preliminary plat shows a planned collector street extending from
Locust Grove down through the middle of the subdivision with just one
lot (Lot 2, Block 5) taking access to it.
5. This application is scheduled for public hearing by the Meridian City
Council on February 18, 1992. The Meridian Planning and Zoning Com-
mission reviewed and approved the preliminary plat on December 10,
1991.
6. There are stub streets planned to connect to the north, west, and

abutting parcel (8 additional feet) .
2. Construct curb, gutter, 5-foot sidewalk and match paving on Locust
Grove abutting parcel. Improvements shall be constructed to a 52-foot
back-to-back street section.

1. Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and" policies .
2. Dedicated streets and drainage systems shall be designed and construct-
ed in conformance with District standards and policies.
3. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACRD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
4. Provide written approval from the appropriate irrigation/drainage dis-
trict authorizing storm runoff into their system.
5. Locate obstructions (utility facilities, irrigation and drainage appurte-
nances, etc.) outside of the proposed street improvements. Authoriza-
tion for relocations shall be obtained from the appropriate entity.
6. Continue existing irrigation and drainage systems across parcel.
7. Submit three sets of street construction plans to the District for review
• and appropriate action.
8. Submit site drainage plans and calculations for review and appropriate
action by ACHD . The proposed drainage system shall conform to the

requirements of Boise City Code Section 9-20-8.5 and shall retain all
storm water on-site.

11. A right-of-way permit must be obtained from ACRD for all street and
utility construction within the public right-of-way. Contact Quality
Control at 345-766? (with zoning file number) for details.
12. A request for modification, variance or waiver of any requirement or
policy outlined herein shall be made, in writing, to the Manager of
Engineering Services within 15 calendar days of the original Commission
action. The request shall include a statement explaining why such a
requirement would result in substantial hardship or inequity.

submitted . Staff is putting this application back on the agenda for
consideratic r. and approval subject to conditirns. Pertinent parts of
the traffic a :udy are attached .
4. The prelim.r~+iry plat shows a planned collector street extending from
Locust Gro ~ _; down through the middle of the ~~ubdivision with just one
lot (Lot 2, I;;.eek 5) taking access to it.
5 . This applic s I'. ion is scheduled for public heari:a#; by the Meridian City
Council on F'~E:bruary 18, 1992. The Meridian F:lanning and Zoning Comes
mission re~,~i::wed and approved the preliminary plat on December 10,
1991.
