B. The applicant is proposing to construct two new drive-thru restaurants and commercial building. Drive-thru windows for commercial developments are typically problem areas for air quality. Auto emissions due to idling vehicles cause an important concern in larger cities. The proliferation of drive-thru windows will create similar future concerns in Ada County. Staff recommends that Meridian City review the current policy on drive-thru windows. C. The existing buildings at the side will be removed D. The exact location of the right-of-way line of the south side of Gem Avenue abutting this parcel is unclear. Staff recommends that curb, gutter and 5 -foot sidewalk be constructed on the full Gem Avenue frontage abutting the parcel and that the applicant coordinate the MCU -6-95 Page 2 location of these improvements with the District. E. Meridian Road from Franklin Road to East First Street is designed and planned for construction in FY 1997. F. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on April 11, 1995. The following requirements are provided to the City of Meridian City as conditions for approval: Site Specific Requirements: 1. Provide a deposit to the Public Rights -of -Way Trust fund at the District for required street improvements of 5 -foot wide sidewalk on Meridian Road abutting the parcel. 2. Construct a 7 -foot wide attached sidewalk on East First Street abutting the parcel. 3. Dedicate 30 -feet of right-of-way from the centerline of Meridian Road abutting the parcel (an additional 5 -feet). The owner will be compensated for this additional right-of-way from available impact fee revenues in this benefit zone. 4. The access point on East First Street shall be a minimum of 100 -feet from Gem Avenue measured from near edge to near edge or a median shall be constructed on East First Street. (Location and design to be coordinated with District staff.) Align access to site with Watertower Lane. 5. Construct curb, gutter, 5 -foot sidewalk and match existing pavement along Gem Avenue abutting the parcel. Coordinate the location of these improvements with the District. Standard Requirements: 1. Submit site drainage plans and calculations for review and appropriate action by ACRD. The proposed drainage system shall conform to the requirements of the City of Meridian and shall retain all storm water on-site. Public street drainage facilities shall be located in the public right-of-way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 2. A right-of-way permit must be obtained from ACHD for any street or utility construction within the public right-of-way. Utility cuts should be combined where practical to limit pavement damage. The District will need to see more detail in regard to your encroachment with the buildings, the closest one being at 23 feet. if this facility is piped correctly, the encroachment could be allowed although this would depend on the depth that the pipe will be buried and no information was furnished regarding that. This project will require a license agreement so we can do a final review on the proposal. If the engineers find this is acceptable then we will proceed with the license agreement for both the piping and the encroachment. I feel no further comment is necessary as this process takes several weeks for review and time is running short. The District requires that all work in District facilities be completed no later than 15 March prior to the water season. I doubt if there will be enough time to complete a project of this nature this year, but I will leave this up to you as to when you can get this information returned to the District. MOTION CARRIED: All Yea ITEM #12: REQUEST FOR A CONDITIONAL USE PERMIT FOR 2 DRIVE THRU RESTAURANTS BY RICK THOMAS: Kingsford: Mr. Caven are you representing him? Caven: Mayor and Councilmen I am here representing Rick Thomas on the conditional use that is before you for 2 drive thrus. I would like to clarify on page 38 of the planning and zoning commission comments that were made, I don't know if you can see the plat map over here, building "B" is the restaurant that we have the tenants for at this point. It was a little bit confusing in the comments here. It said Building "A" which is on the north side. I just wanted to clarify it is Building "B" that we have tenants for, building "A" we haven't filled and so the comment was made that this was a conceptual drawing or if this was the final except for that pad "A" that could turn into a might not end up a drive through it could end up with a full sit down restaurant. We would like to go ahead and get the conditional use for a drive thru and then change it to a sit down if that is the ultimate use for that. I just wanted to clarify that, that was a little mix up. It had in here that a 30,000 square foot retail building below was going to be a sit down restaurant, that is not going to be a restaurant (inaudible). I want to make one other comment on the findings of fact and conclusions of law page 9, item 7 and 8, item 7 states that we meet the requirements of Ada County Highway District and also the Nampa Meridian Irrigation District. We don't have a problem with that. It does coincide with number 8 however where the City has asked us or is not going to permit us vehicle access to Gem Avenue to the north. At this point we aren't requesting access, however we would like to see if we could strike number 8. East 1 st and Meridian Road as you know right now is kind of up in the air what is going to happen with those streets. My understanding is that it is a concept drawing right now for traffic going both ways on both streets. I guess there are some talks with the City of Meridian about making that a one way going north on East First and a one way going south on Meridian Road. So that could affect our piece of property and how the internal flow of traffic is affected. So we would like to keep it open as a possibility to put an access across the Eight Mile Lateral to Gem Avenue in the future if the road designs around the property are changed and affect our traffic flow on the site. Right now they don't affect it • Meridian City Council May 16, 1995 Page 58 • in a negative way so we don't need it, but we may need it in the future. And Shari can talk to you, she talked to ACHD also. They are not opposed to the access across the Eight Mile to Gem Avenue. I believe it was put in there because of the comments made by the bowling alley that they had an agreement with ACHD that they could park there. Well to my knowledge ACHD is not in the business of reserving parking spots on public right of way for people. So you can talk to Shari she talked to ACHD to that effect and if you have any questions in that regard. Other than that, that is all we have. Kingsford: Questions of the Council for Mr. Caven? Yerrington: I have one question, how about the Eight Mile Lateral, tiling that ditch. We are talking about tiling it through the golf course in a 48 inch tile how about that section there? Caven: The staff report, we have to go through a variance process for that which we have filed and it has to come before this Commission, Council here. Talking with Planning and Zoning and with staff it has not been a requirement to tile laterals over 48 inches in diameter. Talking to the Irrigation District they are not requesting that it be tiled, the estimate is it would be a minimum of 48 probably up to 61 inches in diameter. Staff and the irrigation district are not recommending tiling of that lateral. It has not been tiled to the east through the Corporate Park to the east of us and it hasn't been tiled to the west. Kingsford: Any other questions or comments? What is the Council's pleasure? Corrie: Mr. Mayor, I guess I have one comment for Walt, you said (inaudible) Morrow. Well, my comment was I did not want to see this or any other development along those properties interfere with the completed designs that, for Franklin Road, East 1st, Waltman Lane project. This has ingress/egress off of both East 1st and Meridian Road which would work with that configuration. Now then obviously the actual development here would have to be with that design data. We should be seeing that as a City Council for the final design within a matter of the next few weeks. I know that the engineering company was substantially behind schedule, it was my understanding, and Gary correct me here if I am outside, but it is my understanding that the ACHD is doing the final review of those plans subject to the final printing. We will see a short presentation before us and my comments would still hold that the development of this property would not interfere with that design. Caven: Bell Walker Engineers is doing that road design, they work for us also. The set backs and the property that they need has been taken into consideration in this project for the widening and the giving up of the property that they need for the roads. • Meridian City Council May 16, 1995 Page 59 Kingsford: Is there a motion on the findings? • Morrow. Shearer: I just wanted to be sure that this includes a drive thru, a drive in window portion of this thing so we don't have to come back for something. Michael Caven, 6874 Fairview Avenue, was sworn by the City Attorney. Meridian Planning & Zoning Commission April 11, 1995 Page 38 Caven: Chairman and members of the Commission we have reviewed your staff report, we don't have any objections. We do need a clarification on item #2 page #2, it talks about the need for a request for a variance for tiling the Eight Mile Lateral. From my understanding there is not an ordinance speaking to the size of laterals and the need for tiling. It is my understanding the position has been on laterals 48 inches or more in diameter that has not been made to tile those. So I assume that is why the need to require us to go through a variance on that. Johnson: You are right about the practice, it still requires a variance request. The variance request is granted by the City Council not by us. Anything else? Caven: Yes, I had another question and this is regarding Ada County Highway District, I have not had a chance yet to sit down with them, we spoke briefly this evening about some ideas, but they are requiring the curb, gutter and sidewalk and asphalt on Gem Avenue. Which our property does not abut to that road. And so there is some question in that regard to us being responsible for the curb, gutter and sidewalks and asphalt on Gem Avenue. There is 80 feet of separation, there is some question of who owns the 80 feet between my property and Ada County. If it is the irrigation district, if it is Ada County Highway District. I think we can get with Ada County and the irrigation district and work something out along these lines but that was a concern of ours. That would be all we had. Johnson: Any questions of Mr. Caven? Hepper: I have a question, is this a concept here or is this the actual layout? Caven: It would be the actual layout pretty close. We have one of the restaurant sites is spoken for and the 30,000 square foot building is actual the thing that might change is if we get a sit down restaurant instead of a drive thru restaurant on the other pad. But at this time we would like to show the drive thru on that side. Hepper: Okay, Buildingis the one that you've got leased or a tenant for? Caven: I think we flip that, and we flip that to the north side so that would be where oh it is Building A I didn't get it changed on the plat. Hepper: Would that be a sit down restaurant or fast food? Caven: It is a combination, we have a sit down restaurant on half of the building and the fast food on the other half. Hepper: And the landscaping that you have drawn in there would that be indicative of 0 • Meridian Planning & Zoning Commission April 11, 1995 Page 39 what you are going to do? Caven: Yes and that was worked out with your planning staff and the set backs and so forth. Johnson: Did I understand you to say that you do have a tenant then locked up or is that kind of? Caven: We are in negotiations subject to the outcome of what is happening through the process. We have people that have signed intents. Johnson: You are not prepared at this time to tell us Wendy's is coming to Meridian? Caven: No Johnson: We have everything else we might as well have a Wendy's. Any other questions of Mr. Caven? Rountree: On your concept you show, it looks like the sidewalk wrapping around the eight Mile Lateral over to Gem Avenue, is that in your plans? Caven: No, that was engineered from Seattle, it has that on the drawing. Our property line ends before the bridge on the south side of the bridge and that is what we have proposed that it would end. Rountree: You also have a note on the concept a proposed future location of possible future bridge across Eight Mile Lateral. Caven: Right, if that, if we were to move forward at this point we are not wishing that access across there. At the point that if we did then we would feel some responsibility for curb, gutter and sidewalk and the improvement of Gem Street because then we would be attached to road. But at this point we don't have, we are not asking for that access. It is not often on a concept or anything else that we get that we actually get a landscape plan with species listed, but I would recommend that you have Seattle architect look at something other besides Red Maple (inaudible). Johnson: Thank you Michael, is there anyone from the public that would like to discuss this? Gene Quinteri, 2710 Laurelhurst Drive, Boise, was sworn by the City Attorney. Meridian Planning & Zoning Commission April 11, 1995 Page 40 Quinteri: When we expanded our bowling lanes in 1985 we received permission from the Ada County Highway District to improve the South 29 feet of the Gem Street (End of Tape) right of way for parking for our bowling patrons. This we have done and that was given to us in 1985. The only thing we object to I think the development of the property across is very fine. We have one concern,. and the drawing shown on this plot plan they gave us, under item 4 of that plan it shows a culvert or bridge across the Meridian or Nampa Meridian Irrigation District canal. If that were limited to a 6 or 8 foot foot bridge we would have no objections. But if it is going to be 30 to 40 foot in length to provide both ingress and egress in the area across the canal that would eliminate some 4 or 5 parking spaces for us which are critical to us. We would like to go on record as objecting to that portion of the plot only. We are not objecting to the drive thru windows. Johnson: Thanks Gene, are there any questions of Mr. Quinteri on that? Are there any references from our agencies with respect to the foot bridge or bridge? Rountree: I think ACHD made mention that if access point, page 3, item 4 specific site requirements. Well, that is E. First, so they don't speak to that item specifically. Johnson: Did you seen anything in there about that other than just the drawing? Quinteri: No other objections to the plot. Johnson: Thanks Gene, does anyone else have any objections? Is there anyone else from the public? Seeing no one I will close the public hearing at this time. Shearer: Jim, I think we ought to ask the developer whether he is thinking a foot bridge there or. Rountree: He said he wasn't thinking of anything (inaudible). Johnson: Feel free to ask him if you want to ask him a question Mr. Shearer. Shearer: My only question was if you do put that bridge in is that going to be a foot bridge or a drive (inaudible). Caven: Well, if we put it in the decision will be made to put it in if it needs to be access for vehicles. At this point we see no need for vehicle access. We wouldn't request a foot bridge. Johnson: Thank you, the public hearing has been closed. This is a request for a conditional use permit so it would take findings of fact and conclusions. Meridian Planning & Zoning Commission April 11, 1995 Page 41 Shearer: Mr. Chairman, I move we have the Attorney prepare findings of fact and conclusions of law for this project. Crookston: Yes Johnson: This is from Jean Gasaway at Roylance and Associates, PA, assuming she has the right to do that. Shearer: I move we table that to a date certain. The City's policy has been to require 90' on all section line roads. 2. A variance needs to be requested for tiling of the Eight Mile Lateral. My recommendation would be that, if the variance is granted, no fencing be required in lieu of tiling as it would serve no useful purpose. 3. That the property is zoned C -G, General Retail and Service Commercial, which requires a conditional use permit for a drive through sales window; the Application requests approval of two drive through sales windows at restaurants adjacent to East First Street. 4. That the General Retail and Service Commercial District is described in the Zoning Ordinance, 11-2-408 B. 11. as follows: (C -G ) General Retail and Service Commercial: The purpose of the (C -G) District is to provide for commercial uses which are customarily operated entirely or almost entirely within a building; to provide for a review of the impact of proposed commercial uses which are auto and service oriented and are located in close proximity to major highway or arterial streets; to fulfill the need of travel -related services as well as retail sales for the transient and permanent motoring public. All such districts shall be connected to the Municipal Water and Sewer systems of the City of Meridian, and shall not constitute strip commercial development and encourage clustering of commercial development. 5. That the use proposed by Applicant is a specifically allowed conditional use in the Zoning Schedule of Use Control, 11- 2-409 B. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 2 6. That the location of the property is between East First Street and Meridian Road, south of the Eight Mile Lateral and Gem Street. 7. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. 8. That the owners of record are Harold E. Thomas and Rick E. Thomas and they have requested the conditional use and consented to the Application. 9. That the Applicant's representative, Mike Craven, testified regarding the comment from the Planning Director, Shari Stiles, having to do with a variance request for tiling the Eight Mile Lateral; that his understanding of the City's position has been on laterals 48 inches or more in diameter have not been made to tile. Commissioner Johnson stated that it still requires a variance request and that the City Council grants them. 10. Mike Craven also questioned the comment from the Ada County Highway District (ACHD) regarding the curb, gutter and sidewalk and asphalt on Gem Avenue; that their property does not abut to that road; that there is 80 feet of separation and questioned who owned the 80 feet, if it is the irrigation district or the Ada County Highway District. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 3 0 • 11. Mr. Craven testified that one of the restaurant sites has been spoken for and the 30,000 square foot building is actually the one which might change to a sit down restaurant instead of a drive- thru restaurant on the other pad, but at this time they are showing the drive-thru on that side; that at some future point the concept of a footbridge across the Eight Mile Lateral would be considered, thereby having some responsibility for curb, gutter and sidewalk and the improvement of Gem Street, but at this point, the Applicant is not asking for that access. 12. That Gene Quinteri testified regarding the improvements he made of the South 29 feet of his property when the expansion of the bowling lanes occurred; that his only objection to this application would be to the size of foot bridge planned; that a 30 to 40 foot bridge would provide both ingress and egress in the area across the canal causing four ( 4 ) to five ( 5 ) parking spaces to the bowling lanes to be eliminated; that he would not object to a six (6) or eight (8) foot access and wants to go on record as objecting to that portion of the plot only; that he is not objecting to the drive-thru windows. 13. That no other public testimony was given. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 4 14. The 3.8 -acre site is located at the southwest comer of E. First Street and Gem Avenue. This development is estimated to generate 3,120 additional vehicle trips per day. Roads impacted by development are: GEM AVENUE - Local Street with no pathway designation shown - No available traffic count E. Staff recommends that curb, gutter and 5 -foot sidewalk be constructed on the full Gem Avenue frontage abutting the parcel and that the applicant coordinate the MCU -6-95 Page 2 i location of these improvements with the District. E. Meridian Road from Franklin Road to East First Street is designed and planned for construction in FY 1997. F. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on April 11, 1995. The following requirements are provided to the City of Meridian City as conditions for approval: Site Specific Requirements: Provide a deposit to the Public Rights -of -Way Trust fund at the District for required street improvements of 5 -foot wide sidewalk on Meridian Road abutting the parcel. Standard Requirements: Submit site drainage plans and calculations for review and appropriate action by ACRD. Contact Construction Services at 345-7667 (with application file number) for details. MCU -6-95 Page 3 3. A request for modifica ion, variance or waiver of any requirement or policy outlined herein shall be made, in writing, to the Manager of Engineering Services within 15 calendar days of the original Commission action. We have had a long term interest in the Boise valley, we looked here in the late 70's for some opportunities. I was raised in the Nampa area and get back frequently visiting family. So we have kept an eye on the Boise valley. With what has been happening recently with the growth in Boise and watching the Eagle interchange which we consider a very prime intersection for development and with St. Luke's happening and bringing sewer closer to the interchange we decided last fall it was a good time to look at Boise again and commenced looking for property which we could do a commercial development. We recently have worked on a couple commercial developments retail development which are similar to the one we are proposing. With your indulgence I would like to show you about 15 slides the City staff suggested because we are an unknown quantity it might be of interest to you the type of projects we have done historically, how we have done them, etc. I think I can run through these in 3 or 4 minutes. C • BEFORE THE MERIDIAN PLANNING AND ZONING COMMISSION WILD SHAMROCK PARTNERSHIP CONDITIONAL USE PERMIT AT EAST FIRST STREET AND MERIDIAN ROAD RICK THOMAS MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing April 11, 1995, at the hour of 7:30 o'clock p.m., the Petitioner appearing through Mike Craven, the Planning and Zoning Commission of the City of Meridian having duly considered the evidence and the matter makes the following Findings of Fact and Conclusions: FINDINGS OF FACT 1. That a notice of a public hearing on the Conditional Use Permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for April 11, 1995, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the April 11, 1995, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 1 U 2. That the property is located within the City of Meridian; the property is described in the application which description is incorporated herein. 11. as follows: ( C -G) General Retail and Service Commercial: The purpose of the (C -G) District is to provide for commercial uses which are customarily operated entirely or almost entirely within a building; to provide for a review of the impact of proposed commercial uses which are auto and service oriented and are located in close proximity to major highway or arterial streets; to fulfill the need of travel -related services as well as retail sales for the transient and permanent motoring public. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 2 0 • 6. That the location of the property is between East First Street and Meridian Road, south of the Eight Mile Lateral and Gem Street. 7. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. B. 10. Mike Craven also questioned the comment from the Ada County Highway District (ACRD) regarding the curb, gutter and sidewalk and asphalt on Gem Avenue; that their property does not abut to that road; that there is 80 feet of separation and questioned who owned the 80 feet, if it is the irrigation district or the Ada County Highway District. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 3 • 11. Mr. Craven testified that one of the restaurant sites has been spoken for and the 30,000 square foot building is actually the one which might change to a sit down restaurant instead of a drive- thru restaurant on the other pad, but at this time they are showing the drive-thru on that side; that at some future point the concept of a footbridge across the Eight Mile Lateral would be considered, thereby having some responsibility for curb, gutter and sidewalk and the improvement of. Gem Street, but at this point, the Applicant is not asking for that access. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 4 • • 14. That the City Planning Director and Assistant City Engineer submitted comments regarding this application and they are incorporated herein as if set forth in full.. 15. That off-street parking, paving and striping, all signage and sidewalks shall be provided in accordance with City Ordinances. 15. That sewer and water assessments shall be determined during the building plan review process; that sewer and water service to the site shall be coordinated with the Public Works Department and that a drainage plan shall be submitted for all off- street parking areas; that water service is contingent upon positive test results from a hydraulic analysis. 17. That a 90 foot road right-of-way is required on Meridian Road; that a variance needs to be requested for tiling of the Eight Mile Lateral and if granted, that no fencing be required in lieu of tiling as it would serve no useful purpose; that eleven (11) feet of landscaping will remain when and if the Ada County Highway District takes the full right-of-way on East First Street; that the parking spaces shall be 9' x 19' with a 25 foot driveway width with designated spaces along Meridian Street for compact spaces if dimensions remain as shown and that applicant should negotiate license agreement with Nampa -Meridian Irrigation District to allow FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 5 • landscaping within the Eight Mile Lateral easement for aesthetic purposes. 18. That the Meridian Police Department, Meridian Fire Department, Central District Health and the Nampa Meridian Irrigation District they are incorporated herein as if set forth in full. 19. That The Ada County Highway District (ACRD) submitted site specific requirements, and they are incorporated herein as if set forth in full, and which include providing a.deposit to the Public Rights -of -Way Trust fund to the District for required street improvements of 5 -foot wide sidewalk on Meridian Road abutting the parcel, constructing a 7 -foot wide attached sidewalk on East First Street abutting the parcel, constructing curb, gutter, 5 -foot sidewalk and match existing pavement along Gem Avenue abutting the parcel, the dedicate 30 -feet of right-of-way from the centerline of Meridian Road abutting the parcel (an additional five (5) feet), and sidewalks shall be provided in accordance with City Ordinance. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 6 within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian. 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho. 4. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan but the Zoning Ordinance requires a conditional use permit to allow the use. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 7 C. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use will be required. i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, Uniform Electrical Code, the Uniform Mechanical Code, the Fire and Life Safety Code, all parking and landscaping requirements. 6. That the drive way for drive-in window shall not be used for deliveries nor shall it be allowed to impose or impede on other uses in the area. FINDINGS OF FACT AND CONCLUSIONS OF LAW - THOMAS PAGE 8 • 7. That the Applicant shall meet the requirements of the Nampa & Meridian Irrigation District and the Ada County Highway District. 8. That if the Applicant desires to place a pedestrian bridge across the Eight Mile Lateral the City would have no objection to that, but there shall be no vehicle access from Gem Street to the parcel. Combustible Gas Indicator (CGI) readings were within acceptable levels prior to removing the USTs from the subsurface soils. Two (2) separate excavation pits were dug to expose and remove all four (4) of the USTs. Excavation pit number one (1) containing three (3) of the USTs two (2) one thousand (1,000) gallon and the' five hundred sixty (560) gallon. The excavation was approximately fourteen feet (141) wide by seventeen feet (17.1) long with a depth of approximately nine feet (9') below ground surface. Visible signs of petroleum contamination (staining & discoloration) were detected in the subsurface soils directly under the former UST locations of excavation pit number one. The petroleum contaminated soils were photographed and removed, detectable readings were also noted with field screening equipment. Approximately forty (40) to fifty (50) yards of petroleum contaminated soils were excavated and removed. The Petroleum contaminated soils were stockpiled in the South West corner of the property. Groundwater was not encountered in either of the excavation )its during the UST decommissioning activities. Excavation pit number two (2) containing one (1) one thousand (1,000) gallon heating oil tank was approximately seven feet (7') wide by approximately nine feet (9') in length, with a depth of approximately six feet (6') bgs. No visible signs of petroleum contamination (staining & discoloration) were detected in the subsurface soils. All four (4) of the USTs were of bare steel construction with heavy corrosion, after careful external examination of the UST, corrosion holes were noted in the Waste oil UST, no visual holes were observed or noted in other USTs. The USTs were hauled to Pacific Recycling by Weast Excavation. Please see Appendix B for UST decommissioning documents. SAMPLE COLLECTION Soil samples were collected and placed directly into laboratory prepared 4 oz glass containers with teflon lined lids. Soil samples were delivered to Alchem Laboratory in Boise, Idaho, under standard chain-of- .ustody procedures. The soil samples were analyzed for total petroleum hydrocarbons by EPA Method TPH-8015 and EPA Method 418.1. Three soil samples were collected from excavation pit number one (1) soil sample number MTC -TP -1 was collected from the East wall center bottom, soil sample number MTC -TP -2 was collected from the bottom center, and soil sample number MTC -TP -3 was collected from the West side bottom. One soil sample was collected from excavation pit number two (2) in the bottom center. The laboratory analytical results are presented in Table 1, while the Alchem Laboratory report is enclosed in Appendix C. Please see Figure 3 for a soil sample location map. TAB 50 I . This area had been used for steam cleaning of vehicles. The area is approximately fifteen wide by ten feet long, the soils were placed in the petroleum contaminated soils stockpile. CONCLUSIONS The presents of petroleum hydrocarbon in the subsurface soils was detected by laboratory analytical equipment, as well as the Petrol Services field detection equipment. Approximately fifty (50) to sixty (60) yards of petroleum contaminated soils were removed. Cleanup / verification soil samples were collected form the UST excavations, laboratory analytical results indicated that Idaho State cleanup levels were obtained. A level one environmental audit of the subject property was conducted by J -U -B ENGINEERS, Incorporated. After a review of this report it appears that the environmental concerns relating to the subsurface soils have been addressed. The lead base paint and the asbestos materials are of no environmental concern until removal and or disposal. The observations and interpretations presented in this report are based on Petrol Services field screening procedures and the soil sample analytical laboratory reports prepared by Alchem Laboratory. The petroleum contaminated soils stockpile should be turned and tilled on a weekly bases for the duration of the summer. This fall a composite soil sample should be collected and analyzed in order to comply with the Idaho Health and Welfare - Division of Environmental Quality requirements. LIMITATIONS This report has been prepared to summarize the information and data concerning the limited soils investigation in the vicinity of the former petroleum storage and dispensing equipment. The field work described within this report was conducted in accordance with generally accepted professional practices for the nature and conditions of the subsurface investigation. This report is intended to describe the field activities and observation of the Meridian Truck Center facility located at 519 East 1st Street, Meridian, Idaho, no other warranty, expressed or implied, should be understood. The subject property is zoned CG (General Retail and Service Community). -5- i 9 - The The property is located between Meridian Street and East First north of the intersection of the two in the City of Meridian. It is the north portion of the ground . known --as -the John -and Arvella Dobaran property. The location of the property is in the Southwest Quarter of the Northwest Quarter, Section 18, Township 3 North, Range 1 East of the Boise Meridian in Ada County, Idaho. The site location is shown on the map in the appendix. A site sketch is also included indicating important features discovered during this audit. The property legal description is included with the 50 -year title search report in the Appendix. The property is borderedon the west• by- Meridian Street and on the east by East First Street. The north edge of the property is next to the Eight Mile Lateral Canal that is followed by Gem Street. The south border is adjacent to the south portion of the Dobaran Property which was divided off earlier this year. The property is divided into two parcels, the truck shop and parking area on the east and north and the old farm yard on the west. The site plan sketch in the appendix illustrates the approximate location of the important features on the property. The truck shop parcel has a gravel truck and trailer parking area on the south. An asphalt Ariveway•runs•along the -east edge from the south edge to the building area. The two main buildings lie north of the gravel parking area. The largest building is approximately 7050 square feet and houses an office area and the truck shop. The building has a concrete floor and is constructed of steel frame, siding, and roofing. There is a masonry block wall between the office and show area. The building is insulated with fiberglass batt insulation. A vent pipe and inlets to an -6- underground tank are visible next to the north edge of this building. The second building lies to the west across an asphalt driveway. The building houses. an automotive repair garage and secured storage area. The building has a steel frame and siding and concrete floors. Vents and inlets to underground storage tanks are located in the driveway between the buildings. A chain link fence runs along the west side of the second building, separating the truck area from the barnyard. North of the buildings is a gravel area which is divided by driveways. The area adjacent to the largest building is used for automotive parking and miscellaneous storage. The area near the northwest corner is used for washing of trucks and parts. The area north of the second building is used for old truck part storage. There is a considerable amount of oil staining in this area and across the gravel driveway to the east. The center of the area north of the main building is used for truck parking and truck component storage. A city sewer system manhole is located at the southwest corner of this area. The area along the east border is used for truck parking.= The truck parcel turns to the west along the north border. This area has been used as a storage area for fill soil materials. Along the east edge where it joins with the rest of the truck parcel, is located a loading ramp and wood wellhouse structure. At the southeast corner along the fence that separates this area from the farmyard, are located many empty 55 gallon drums. The labels indicate that these were used to hold petroleum products. There is a pile of oily sawdust near the barrels. A wooden cattle shed extends past the .fenceline from, the barnyard into the truck area near the barrels. The barnyard has numerous old wood frame structures. These include a house, garage/storage shed, small storage shed and large barn. The buildings have wood shingle roofs and the barn has a steel roofing added over top. The house has a concrete foundation and partial basement. None of the buildings have insulation. There -7- L is one section of insulated water pipe in the house basement that could be asbestos containing material. The house and barn wire is old and may have asbestos containing insulation. The paint on the buildings could be lead based. South - Undeveloped lots and single family residence followed by Kentucky Fried Chicken Retail Outlet. North - 8 -Mile Lateral Canal followed by Gem Street and Bowling Alley. West - Meridian Street followed by rental business storage lot, single family residence and vacant lot. East - East First Street followed by Commercial development ground. The property is served by public and private utilities providing sewer, water, electricity, telephone, and natural gas. Most of the utilities serve the property from along Meridian Street. Electricity is provided by Idaho Power Company from overhead lines along Meridian Street. Telephone service is provided by U. S. West and natural gas by Intermountain Gas, both from underground lines along the east side of Meridian Street. Sewer and Water are provided by the City of Meridian. The Dobaran property is served by lines that enter from the north along Gem Avenue. A sewer manhole is located near the center of the north portion of the Dobaran parcel. The water line parallels the sewer line from Gem Avenue to the buildings. There is also a 12" water main that runs along the Meridian Street right-of-way that could service this parcel. -8- 9 - The The surface drains to the north and west. Drainage water was ponded up in the northwest portion of the site at the time of the visit. An irrigation pipeline emerges near the fence west of the smaller shop building. It empties into a ditch that flows through. the center of the barnyard. The soil survey for Ada County classified the native soil as Elijah Silt Loam. This classification has a soil depth of over 60 inches with a hard pan layer at about 12 inches. The slope of this soil is from 0 to 2 percent. EVIDENCE OF WASTE nTSPOSAL There is considerable evidence of waste oil dumping on the north side of the smaller shop building leading up to the northwest corner of the main shop. Some soil staining is evident south of the small shop also. A pile of oily sawdust is located near the discarded drum area on the north central portion of the lot. Small oil spots that have leaked from the trucks are located throughout the site. Numerous used truck and automotive parts are also scattered about. The Idaho Department of Health and Welfare Division of Environmental Quality records indicate that 6 instances of groundwater contamination by petroleum products have occurred within 1 mile of the facility. All of these have been reported to have been cleaned up to the levels established by the Idaho Department of Health and Welfare Division of Environmental Quality. DEQ knows of no other instances of groundwater contamination in the area. -9- i Well logs on file at the Idaho Department of Water Resources show the groundwater level in wells near the property is around 20" below the ground surface. There are 2 wells on the Dobaran property. One in the pasture area of the barnyard area and one near the north edge. No information on these wells was available. The Idaho Department of Health and Welfare, Division of Environment has no record of underground storage tanks on the subject property. There is evidence that at least 2 tanks of unknown size are located on site. The standpipes and vent north of the main shop indicate a tank is probably located there. The 3- vents/inlets located between the buildings, indicate at least one tank is located there. One cap has "unleaded regular" printed on it showing this was probably used for gasoline storage. One former tenant remembered that there are two tanks located here. The current tenant does not use any of the tanks. We were unable to contact the property owner to see if he has information on the tanks. -10- L - The purpose of this section was to gain insight on the historical land usage of the property to date. The research efforts included: Reviewing State, County, and City regulating permits and records; interviewing people familiar with the site; investigating utility company past tenant records; and other archival records. The following summarizes the research findings. Boise Title Company, Boise, Idaho, assembled a chain of title (see Appendix) which lists the change of property ownership. The City of Meridian Planning and Zoning Department was contacted and documents reviewed to determine current and past zoning. The property is currently zoned CG (General Retail and Service Community). The site was developed from native desert to farmground. It was later divided and developed for commercial operations. Aerial photographs from 1975 to the present show the land has had the current improvements on it for at least the last 19 years. During that time it has been used as a farm equipment dealership and for a truck repair shop. -11- .. .. .,_ ---.T.._. . _... •.. ..+w+r.... _. _.-aw+, v .0^ ^Po^.". -a ...v:.... ,•,.-W.+a' .I T'-iCeC'+.I-n .Trr CONCLUSIONS Based on research; site surveys, and interviews with persons associated with the parcel, .the following conclusions were developed. The oil staining on the ground surface is a problem that needs to be addressed.. The soil should be tested to determine if cleanup is required and to what extent. This should be accomplished as a part of a Level II Environmental Audit at the site. The oily sawdust should be cleaned up and its effect on the soil beneath it determined. The underground tanks should be located and their current use status determined. If the tanks have been temporarily closed for more than 12 months, they must be permanently closed according to the methods of Subpart G of Section 280 of the Code of Federal Regulations. The possible lead base paint on the farm buildings may have to be addressed if the buildings are demolished.-Current requirements for disposal vary in each county. The possible asbestos containing material on the pipe in the house may be a small enough quantity that it could be removed and disposed of without falling under regulatory guidelines. -12- East Side Office Portion of Large Shop L . wad/Y I South Side of Large Shop Building -13- ■ R _ _a tea. r .2^ • ..
