Broadway Avenue :rTY CLERKS OFF CE Meridian, ID 83642 RE: MDA-10-003 -Modification to Development Agreement for Kleiner Park Honorable Mayor and City Council, The Ada County Highway District Commission respectfully requests that the Meridian City Council defer action on MDA-10-003 (Modification to Development Agreement). Two of the three proposed modifications to this Development Agreement (Items 4(c) and 4(d)) are related to existing public streets or unopened ACHD right-of-way. As proposed, the modifications conflict with ACHD policies and previous actions. To avoid placing the applicant in the position of receiving conflicting requirements from the two agencies, ACHD would recommend that these issues be heard with the Kleiner Park Certificate of Zoning Compliance (CZC) application to provide the full context of the issues to the deliberations. If an action must be taken on MDA-10-003 prior to submittal of the CZC application, ACHD requests that items 4(c) and 4(d) be approved as previously proposed without the requested modifications. The representative for the park project (Parametrix) has indicated that a CZC application will be submitted to the City in March, and then forwarded to ACHD for review and comment. Our staff has worked with Parametrix for the last several months with regard to recommended roadway requirements and layouts in association with the proposed park site, but would like the opportunity to work with your staff to determine the best solution to these issues for both agencies. Additionally, the Commission would like the opportunity to hold a public meeting on the Kleiner Park CZC application and hear public testimony on these issues prior to any decisions being made about the ACRD rights-of-way.
