Headway Cour Local commercial street with no pathway designation 170-feet of frontage 60-feet existing right-of--way (30-feet from centerline) Headway Court has not been improved. The District is in process of reviewing an application to vacate the right-of--way for Headway Court. If the vacation is approved, there will be no requirements for street improvements. If the vacation is not approved, this site's frontage on Headway Court will be required to be improved to the standard required in the District's report for the preliminary plat of Central Valley Corporate Park. B. The project is proposed to be developed on a portion of Lot 1, Block 6, Central Valley Corporate Park No.2 (proposed Lot 17, Central Valley Corporate Park No.6), abutting Progress Avenue. C. No direct lot access is proposed from Progress Avenue. The site plan proposes two driveways on Headway Court and 9 parking stalls with direct perpendicular access to Headway Court. If Headway Court is not vacated, the parking stalls would need to be eliminated and the driveways would need meet the District's offset requirement of 50- feet and driveway width requirements. D. Additional access is proposed on the south side of the parcel. As part of a larger development proposal to be reviewed in the future, a private road or driveway is proposed along the site's south boundary to create a 4-legged intersection with Progress MCU1595. WPD Page 2 Avenue and Cent~Drive. The private road would prov~access to the subject site and a major wholesale grocery store to be located southeast of this site. The proposed grocery store has not yet been reviewed by the District. Changes in the design of the Progress/Central intersection are required to modify the existing 3-legged intersection into a 4-legged intersection. These changes are discussed below. E. The original master plan for the Central Valley Corporate Park included a mix of commercial, office, and light industrial land uses. A master plan traffic study was conducted and the roadway system was designed to meet the anticipated traffic needs. Under the original land use plan the Central Valley Corporate Park was estimated to generate approximately 16,000 daily vehicle trips. F. The revised land use plan for the project includes the same land uses of commercial, office, and light industrial; however, the commercial component for the revised plan is much larger than anticipated in the original plan. A master plan traffic study was conducted and the roadway system was designed to meet the anticipated traffic needs. A pathway system was developed with a paved pathway or sidewalk on one side of the streets. A revised land use plan for Central Valley Corporate Park has been submitted and estimates approximately 19,700 daily vehicle trips to be generated. Because of the increase in the amount of commercial development, the District has been requiring the construction of sidewalk on new development in Central Valley Corporate Park. When the District originally approved Central Valley Corporate Park Subdivision, it was intended to have a higher mix of light industrial uses. Sidewalks were not required on the streets because of the industrial uses. Because the subdivision is actually developing with commercial, retail, and food service businesses, staff recommends that sidewalk be required on the street(s) abutting this site. G. The original subdivision was planned with a "T" type intersection for the Central Drive/Progress Avenue location with a stop sign on the two Progress Avenue approaches. The intersection has been constructed as "T" type intersection and operates without any traffic control. The current traffic volumes do not justify the installation of stop signs. H. Staff required an updated traffic study to identify the impacts of the proposed changes in land use and to justify the revised roadway network. The key findings of the revised traffic study include: i. The revised traffic volumes show approximately 13,000 eastbound daily vehicle trips at the proposed 4-legged Central Drive/Progress Avenue intersection, most of them related to the proposed major grocery store. ii. Because of the heavy east-west traffic flow, Traffic Services has determined that the Central Drive/Progress Avenue intersection will require stop signs at the Progress Avenue approaches. iii. The intersection of Central Drive/Progress Avenue will require a free eastbound right-turn lane to southbound Progress Avenue. A high volume of traffic (405 pm peak hour trips) is anticipated at build-out conditions for the eastbound MCU 1595. WPD Page 3 right-turn~e. This added turn lane is needed to ~imize delay for the higher volume movements and allow the intersection to operate at an acceptable level of service. Staff has determined that the added right-turn lane is an essential element of the intersection and that the new driveway approach (e.g. the fourth leg of the Central/Progress intersection) should not be permitted unless this added turn lane is developed. iv. Left turns should be prohibited on Central Drive for the existing driveways located less than 150-feet east of E. 1st Street. v. Central Drive should be widened to 6 traffic lanes. I. The added right-turn lane will require additional right-of--way from the restaurant property at the southwest corner of the Central/Progress intersection (McDonalds). The applicant has submitted a letter of intent from the restaurant owner that supports the sale of the needed right-of--way under specific conditions. Staff recommends that the right-of--way for the turn lane be required with this application at no cost to the District to ensure the ability to construct the right-turn lane in the future. The existing median on Central Drive should be extended to a point approximately 180-feet east of the East First Street stop bar. This median is needed to control left- turn movements at the two westerly driveways on Central Drive. This will prohibit left turns in/out of the McDonald's store at a driveway located less than 110-feet from East 1st Street. (The location does not meet current District standards). The median will need to be reduced in width to 4-feet. K. The application as proposed will create a 4-legged intersection at Progress Avenue and Central Drive; however, construction of the eastbound right-turn on Central Drive, extension of the median in Central Drive, and reconstruction of Central Drive to 6 traffic lanes will not be necessary until traffic volumes exceed 4,000 vehicle trips per day on Progress Avenue south of Central Drive or 2,000 vehicle trips per day on the new driveway on the east side of Progress Avenue (aligned with Central Drive). L. With the proposed revisions, the transportation system will be adequate to accommodate additional traffic generated by this proposed development. M. This application was scheduled for a public hearing by the Meridian Planning and Zoning Commission on September 12, 1995. District staff has not brought the application forward to the Commission until the requested traffic study was received and the resulting findings and recommendations could be finalized. The following requirements are provided to the City of Meridian as conditions for approval: Site Specific Requirements: No direct lot access is proposed or approved from Progress Avenue. MCU1595. WPD Page 4 2. Receive approval the vacation of Headway Court from District. If the vacation of Headway Court is not approved, submit a revised site plan to Development Services to be reviewed and approved by the Commission. Utility street cuts in the new pavement on Progress Avenue will not be allowed unless approved by the District Commission. 4. Construct 5-foot wide concrete sidewalk on Progress Avenue abutting the site. 5. Construct a 41-foot curb return approach with 15-foot radii on Progress Avenue in alignment with Central Drive. This driveway shall be paved 40-feet wide and a minimum of 30-feet beyond the sidewalk on Progress Avenue. 6. Two stop signs should be installed at the applicant's expense on the two Progress Avenue approaches. 7. Dedicate by warranty deed up to a 65-foot x 65-foot right-of--way triangle (or appropriate curve) at the southwest corner of Progress Avenue and Central Drive to keep street improvements within the public right-of--way prior to District approval or issuance of any right-of--way work permits. The owner will ~ be compensated for this additional right-of--way. 8. Obtain a letter from the owner of McDonald's restaurant stating that they understand and agree that their northern driveway on Progress Avenue will be eliminated in the future. 9. Aright-of--way permit must be obtained from ACRD for any street or utility construction within the public right-of--way. Utility cuts should be combined where practical to limit pavement damage. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by an owners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 4. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when driveways are not being shared with the adjacent property. 5. Construct pedestrian ramps on the corner of all street intersection in compliance with Idaho Code, Section 40-1335. 6. Dedicate a 20' x 20' right-of--way triangle (or appropriate curve to keep street improvements within the public right-of--way) at all intersections abutting and/or within the development prior to issuance of building permit (or other required permits). 7. Continue existing irrigation and drainage systems across parcel. 8. Provide written approval from the appropriate irrigation/drainage district authorizing storm runoff into their system. 9. If street improvements are proposed, locate obstructions (utility facilities, irrigation and drainage ditches and appurtenances, etc.) outside of the public right-of--way, as may be required by the District. Authorization for relocations shall be obtained from the appropriate entity. 10. Locate proposed sign(s) out of the public right-of--way and out of the clear-vision sight- triangle of all street and driveway intersections. 11. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street name signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. Provide a clear vision sight triangle at all street intersectio• Within this trian le no g obstruction higher than 36-inches above the top of pavement will be allowed, including landscaping, berms, fences, walls or shrubs. The triangle shall be defined by the long leg measured down the centerline of any collector 350-feet; and the short leg measured down the centerline from the collector street curb line 20-feet. Provide notes on the plat and street construction plans of these restrictions. 13. Submit three sets of street construction plans to the District for review and appropriate action. 14. Provide design data for proposed access to public streets for review and appropriate action by ACRD. 15. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 16. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACHD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 17. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 18. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District .prior to District approval for occupancy. Exley: Mr. Mayor and members of the City Council, my name is Landon Exley, I am a representative of Sandpiper Restaurants and a partner in this particular project. We are here tonight seeking your approval for our CUP for a full service restaurant, lounge and micro-brewery. The location of the project of the facility is in Central Valley Corporate Park, it is a portion of lot 1, block 6 in the C-G zone. The parcel consists of 1.06 acres or approximately 40,000 square feet. The square footage of the restaurant is approximately 7000 square feet. It will seat approximately 228 people. We have on site parking for 63 cars which is 163% of the required plus of our own (inaudible) we are going to build 40 additional spaces on the commercial parking lot across the drive way on the east side of the restaurant. In the Central Valley Corporate Park in this area they have a reciprocal parking agreement anyway. So they can park on ours and we can park on theirs. As part of our arrangement with Nahas we are going to improve 40 additional spaces. After considerable searching we decided to have the building designed by Mark LaRoche of Seattle, he is rather famous for a number of restaurants that he has designed and also he is very big in designing wineries in the Napa Valley. The architect of the project will be Stan Olson of Olson and Associates of Nampa. He will do the construction documents. The engineer is Roylance Engineering, the traffic engineer is Bell Walker. Mr. Jim Parkinson the owner of Sandpiper Restaurants is also here this evening if we need to prevail on him. A brief description of the restaurant so you know what we intend on doing, it is a semi rustic steak house operation with lots of volume inside and somewhat of an • • Meridian City Council February 6, 1996 Page 16 industrial interior so lots of the ducting will be shown, the grain delivery shoot that goes to the micro-brewery will be exposed and it will be lots of wood inside. All of the cooking will be over open displayed custom wood fire grill and rotisserie. This cooking area is out in the center of the restaurant and there is counter in front of it, it will be very exciting, an all wood fire. This will be the focal point of the restaurant.. The restaurant will also include a 15 barrel capacity micro-brewing facility which will produce a variety of hand crafted beers and root beer. Some of the production of this micro-brewery will go to the other Sandpiper Restaurants located in Idaho and the one in Oregon. The brew pub components will be highly visible from the entrance to the restaurant from the lounge area and some of the locations within the restaurant where people will be eating. An outdoor patio with full food service is also accessible through the brew pub. Needless to say we are very excited about this project, we have been somewhat delayed by a few minor workouts with ACRD on the intersection there of Progress and Central Drive. As of Friday we are satisfied that they are reasonably resolved and that we now with the time constraint of needing to do working drawings and get a building permit and try and make the building season we are here before you tonight. We also hope that this is maybe a start of a successful expansion of this concept throughout states in the west. Please understand as you look at these drawings and that drawing up there that these are the preliminary design drawings by Mark LaRoche and when I say approximately 7000 feet and approximately 228 when we get down to the working drawings that might change a little bet but this is very close. I do have other drawings if you wish to see them either a plot map or a floor plan and a couple of other elevations showing the volume inside. I would be happy to share those with you. Exley: Well Shari was at the meeting Friday and I wasn't, but I am satisfied that the sufficient steps have been taken to ensure that we have a direct shot from Center Drive into the commercial area of the Central Valley Corporate Park and that the mitigation • • Meridian City Council February 6, 1996 Page 17 measure that ACRD wanted for the right tum lane of the McDonalds has been satisfied and McDonalds has agreed to it. We are under a time constraint and we are willing to go forward based on the fact that they will resolve it and I think they will. McDonalds has agreed to it and they are the key. They just have to do the legal documentation. They have to create a second right hand tum lane and it involves a minor take of that corner. We are kind of between a rock and a hard place, we don't have a lot of choices. We wanted to come through and we wanted a straight shot and Nahas the developers of the park wanted to go through, they understand where. we are and we are here for the use permit and we will have to wrestle that as it presents itself. Corrie: Any further comments from Council? Staff? Smith: Mr. Mayor, reading the Highway District's draft report, I just had a question, one of the items they talked about was left turn should be prohibited on Central Valley between east first and progress avenue. I am wondering if that meant the left turn into the chevron and the Taco Time? Sale: Mr. Mayor, again for the record Larry Sale, Ada County Highway District. First of all I want to express our appreciation for the patience that this applicant has had or maybe their contained impatience, but they were the tip of the iceberg so to speak and we were also hearing from the developer of the overall property that there were going to be some major traffic generators coming into that intersection and they wanted to make a four way intersection out of it. I will try to make this long story short. The entire subdivision was originally approved according to a master plan and a traffic study reflecting that master plan which indicated that progress avenue and central drive should come to a t- intersection and it would serve the whole project nicely. The developer comes forth and makes a four legged intersection out of central and progress and these gentlemen are on the property next door they are requesting a vacation of an existing platted street right of way. We wanted to make sure we had all of our ducks in a row if we could and we requested another traffic study reflecting the revised master plan of the whole area. When reviewing that that indicates and I am going to give these numbers from memory, so if they tum out later to be a little incorrect please forgive me. That indicates to be 13,000 trips a day on central drive between East 1st and progress, 9,000 of those trips I think will go on east through this what is going to be a private driveway, extension of central. That is going to require several things at the point in time that the traffic through the intersection exceeds 4,000 trips a day, these are what we are going to require of Mr. Nahas the subdivision developer. There will be an additional, let me back up, what we are requiring right now of him is that he provide the right of way at the southwest corner of progress and central on the McDonalds that he provides sufficient right of way there now for a future right turn lane. If we don't' do it now we lose the handle on everyone. When the trips go through the intersection exceed 4,000 trips a day there wall be a requirement that the • Meridian City Council February 6, 1996 Page 18 developer construct a new right turn from Central south bound to progress. The. two progress legs will be stopped, with stop signs and central, the through traffic will extend east and west on central into this private driveway back to the major traffic generator. At some point in the future probably about that time the highway district will construct a median in central valley which will prohibit left turns both into the Chevron station and into that existing driveway into McDonald's which for all intensive purposes is a right in and right out now because it is so close to East 1st. Central will be widened a bit to allow enough room for additional left turns at progress. Based on last Wednesday's meeting or last Friday's meeting I am able to tell you that we think all of the questions have been resolved that application, Nahas' application goes before the Commission tomorrow. We will proceed with the vacation of Headway Court and it will be going ahead in due course. So, I think that I can substantiate the gentleman's statement that it took some time but I think we got the right answers and they all seem to be in a win win situation right now. We will present this to Larry Sale and Terry Little or anyone else within ACRD in order to review the aspects and the recommendations (End of Tape) Bell Walker traffic engineers did recommend an intersection that would bring traffic from 4 directions and not just three. We will discuss that with ACRD at this meeting, but it has been recommended that an X type intersection would be better than a T intersection by~ the engineer. Bowcutt: Good evening, this is a preliminary plat on a property located an Overland Road adjoining I-84 to the north. It is just west of Kuna Meridian Road. The Sandman Motel, the new Texaco and the JB's Restaurant lies on our east boundary. To our west boundary is the Mountain. View Equipment complex. This came before this body not too long ago as an annexation. If you recall a portion of the property was in the city limits currently zoned C-G and a portion was outside the city limits in Ada County's jurisdiction zoned C2. We asked for annexation so that we have a consistent zone throughout the whole property. Mr. Moore intends to develop this property. He had kicked around multiple ideas, commercial center, officer center. And we basically decided to proceed with the preliminary plat, it was listed under our conditions of approval of annexation that we would submit a preliminary plat and the development agreement would be tied to that. We are proposing exactly 25 buildable commercial lots on approximately 39 acres .The roadway you see there would be~a private drive area. Our current ordinance would require only 36 parking spaces; 63 are shown. This would be slightly lessened by handicap stalls required. That the zoning of General Retail and Service Commercial, (C-G) is defined in the Zoning Ordinance at 11-2-408 B. 11. as follows: (C-G) General Retail and Service Commercial: The purpose of the ( C-G ) District is to provide for commercial uses which are customarily operated entirely or almost entirely within a building; to provide for a review of the impact of proposed commercial uses which are auto and service oriented and are located in close proximity to major highway or arterial streets; to fulfill the need of travel-related services as well as retail sales for the transient and permanent motoring public. All such districts shall be connected to the. Municipal Water and Sewer systems of the City of Meridian, and shall not constitute strip commercial development and encourage clustering of commercial development; 5. That the R. T. Nahas Co. of Idaho is the owner of record of the property; that the owner has submitted a consent to this application. 6. That the property is located on a portion of Lot 1, Block 6 in Central Valley Corporate Park consisting of 1.06 acres. 7. Mr. Exley testified that Sandpiper Restaurants accepts the conditions of the City staff. 9. That Mr. Sale, of the Ada County 8ighway District, testified that ACRD staff have not yet reviewed this application but that it appears that the tentative recommendation is that the extension of Central Drive not be approved; that the restaurant take other access than as proposed by their site plan; that the de- emphasizing of travel and traffic on East 1st and Meridian Road is in consideration; that the ACHD .staff would be meeting Friday, September 22, 1995, and will submit their recommendations to the City Commissioners. 10. Charlie Gongre, of Roylance Engineers, testified that the Developer, Bob Nahas, hired Bell Walker traffic engineers to do a traffic study of the area including the intersection at East 1st and Meridian Road; that Bell Walker traffic engineers did recommend an intersection that would bring traffic from four (4) directions and not just three; that an X type intersection would be better than a T intersection; that this will be discussed with the staff of ACRD at this meeting, September 22, 1995. 11. NAHAS • and would go so far to say that the developer-will meet all ACRD requirements and will leave the ball in Nahas's court to work it out. 12. That there was no testimony in opposition to this application. 13. That the Meridian Planning and Zoning Administrator, Shari Stiles submitted comments; that this project would utilize a portion of an existing lot that is being replatted, along with the vacation of Headway Court through the Ada County Highway District; that detailed landscaping plans will be reviewed during the building permit process; that a minimum of one (1) three-inch (3") caliper tree is required for each 1,5000 square feet of asphalt; that handicap parking facilities shall be installed in accordance with the Americans with Disabilities Act, including appropriate signage; that current ordinance requires only 36 parking spaces; 63 are shown; that the Ordinance should be revised to require a minimum of one (1) parking space for every two (2) seats for restaurants. 14. That the Assistant City Engineer, Bruce Freckleton, submitted comments, stating that off-street parking paving and stripping,.a drainage plan, signage and outside lighting shall all be provided in accordance with City Ordinances; that all construction shall conform to the requirement of the Americans with Disabilities Act; that sewer and water assessments will be determined during the building plan review process. That proper notice has been given .as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural. requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met. including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512,. Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian. 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property. pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho. 4.That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 5 SANDPIPER RESTAURANTS - ROBERT W. NAHAS •• conditions of the area, concludes as follows: • • the Planning and Zoning Commission a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use will be required. i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code,. Because of the heavy east-west traffic flow, Traffic Services has determined that the Central Valley Drive/Progress Avenue intersection will require stop signs at the Progress Avenue approaches. iii. The intersection of Central Valley Drive/Progress Avenue will require a free eastbound right-turn lane to southbound Progress Avenue. A high volume of traffic (405 pm peak hour trips) is anticipated at build-out conditions for the MCU1595.WPD Page 3 eastbou~ right-turn lane. L. With the proposed revisions, the transportation system will be adequate to accommodate additional traffic generated by this proposed development. M. This application was scheduled for a public hearing by the Meridian Planning and Zoning Commission on September 12, 1995. The following requirements are provided to the City of Meridian as conditions for approval: Site Specific Requirements: 1. No direct lot access is proposed or approved from Progress Avenue. 2. Receive approval of the vacation of Headway Court from the District. If the vacation of Headway Court is not approved, submit a revised site plan to Development Services to be reviewed and approved by the Commission. This building is located at the southeast corner of Fifth and King Street and could be leased in the near future. However, as a condition to receiving an occupancy permit the owner must the the irrigation ditch located on the west side of this improved lot. This ditch is full and will remain so until October 15. We are currently talking to a prospective tenant and there is a possibility that same could take possession before October 15. The problem, as we discussed, is that the irrigation season makes it impossible to the the ditch until after the irrigation season is over and the ditch has dried out. Given these circumstances, it is my understanding that if the owner secures a tenant before we can commence work on the ditch, then the City of Meridian will require that the owner post a bond before a CofO shall be issued. Mr. Exley testified that Sandpiper Restaurants accepts the conditions of the City staff. 9. That Mr. Sale, of the Ada County Highway District, testified that ACHD staff have not yet reviewed this application but that it appears that the tentative recommendation is that the extension of Central Drive not be approved; that the restaurant take other access than as proposed by their site plan; that the de- emphasizing of travel and traffic on East 1st and Meridian Road is in consideration; that the ACHD staff would be meeting Friday, September_22, 1995, and will submit--their recommendations to the City Commissioners. 10. Charlie Gongre, of Roylance Engineers, testified that the Developer, Bob Nahas, hired Bell Walker traffic engineers to do a traffic study of the area including the intersection at East 1st and Meridian Road; that Bell Walker traffic engineers did recommend an intersection that would bring traffic from four (4) directions and not just three; that an X type intersection would be better than a T intersection; that this will be discussed with the staff of ACHD at this meeting, September 22, 1995. 11. That the Meridian Planning and Zoning Administrator, Shari Stiles submitted comments; that this project would utilize a portion of an existing lot that is being replatted, along with the vacation of Headway Court through the Ada County Highway District; that detailed landscaping plans will be reviewed during the building. permit process; that a minimum of one (1) three-inch (3") caliper tree is required for each 1,5000 square feet of asphalt; that handicap parking facilities shall be installed in accordance with .the Americans with Disabilities Act, including appropriate signage; that current ordinance requires only 36 parking spaces; 63 are shown; that the Ordinance should be revised to require a minimum of one (1) parking space for every two (2) seats for restaurants. 14. That the Assistant City Engineer, Bruce Freckleton, submitted comments, stating that off-street parking paving and stripping, a drainage plan, signage and outside lighting shall all be provided in accordance with City Ordinances; that all construction shall conform to the requirement of the Americans with Disabilities Act; that sewer and water assessments will be determined during the building plan review process. That Central District Health Department, Meridian Police Department and Meridian City Fire Department submitted comments and they are hereby incorporated herein as if set forth in full. 16. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian. 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho. 4. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 5 SANDPIPER RESTAURANTS - ROBERT W. NAHAS • conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan and Zoning Ordinance. c. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use will be required. i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, Uniform Electrical Code, the Fire and Life Safety Code, all parking and landscaping requirements and the comments of the Planning and Zoning Administrator and the City Engineers office must be met and complied with. 6. NAHAS paved, the landscaping placed, and any outdoor storage and/or trash receptacles properly screened, all done prior to issuance of an occupancy permit. 7. Exley: I am representing Sandpiper Restaurants here this evening and we are before you to seek your aprpoval of a full service, lounge and micro-brewery located in Central Valley Corporate Park on a portion of Lot 1, Blodc 6. The restaurant will be of a bam style architecture located on a pad consisting of 1.06 acres for 46,300 square feet. The gross square footage of the restaurant is 6,924 square feet with a total seating capacity of 228. We 63 on site parking spaces at your ratios is 160% of required. We accept the conditions and the submittal of the agencies as passed onto us. I would be happy to answer any questions for you. Is there anyone else from the public that would like to address the Commission on this application from the Sandpiper Restaurants? Sale: Mr. Chairman, we have not reviewed this application yet but it appears that our tentative at this time our tenative recommendation is that the extension of Central Drive not be approved. And that the restaurant take other access than as proposed by their site plan. We will be meeting with the applicant Friday Morning to discuss this further. For the Commissions Information that is the tentative recommendation of ACRD staff. Johnson: As long as you are informing us of that, could you detail any reasons for not wanting to do that? Sale: Mr. Chairman, members of the Commission, it involves the design of that entire intersection of Meridian Road, East 1st, our extension of Corporate Drive to East 1st I mean from East 1st to Meridian and the need to de-emphasize travel or traffic at the Central Drive intersection. I can't give you a more technical explanation than that. But it will be included in our staff report when it is prepared by Friday. Johnson: Thank you, any questions of Mr. Sale? Crookston: I just have one, ACHD Commissioners will act on that Friday did you say? Sale: Mr. Chairman, Commissioners, Mr. Crookston, the Commission will act on it next Wednesday noon. The ACRD staff will meet with the applicant this Friday morning, this coming Friday morning. Crookston: Thank you Exley: We are aware of the technical meeting that took place the other day and we are really having a major problem with this and are going to try and use all of our devices to have ACHD help us with the entrance as it is drawn on our presentation. I would like to have Charlie Gongre come up for one moment he has a traffic report that has been done by the Nahas people on Central Valley Corporate Park and let him just point out a couple of things if you please. We will present this to Larry Sale and Terry Little or anyone else within ACHD in order to review the aspects and the recommendations (End of Tape) Bell Walker traffic engineers did recommend an intersection that would bring traffic from 4 directions and not just three. We will discuss that with ACHD at this meeting, but it has been recommended that an X type intersection would be better than a T intersection by the.engineer. Johnson: We appreciate that information thank you. Before I close the public hearing is there anyone else that would like to comment? Are there any questions the Commission would like to ask? Crookston: Mr. Chairman, I would like to have the Commissions feelings as to what they want to do, whether or not they want to have this tabled until we have ACHD comments and Bell Walkers comments. Or do you want to leave the record open only for those tv~ro recommendations so that they can be included in the findings of fact. Or do you just want to continue it until you receive them and have it and had a chance to review them. Johnson: You are going to present them on the 20th is then when the Bell Walker study will be done by then, you will present it then, is that correct. Oh it is done now, when will you present it to ACRD to discuss it with them, on Wednesday the 20th? (Inaudible) Johnson: The meeting Friday, I thought Mr. Sale said you were going to bring that up on the 20th. Sale: Mr. Chairman, the staff tech review meeting will be Friday morning it would be very advantageous to us if we had benefit of the study tomorrow so that we can review it before our Friday meeting. The purpose of the meeting Friday would be to finalize staffs recommendation to the Commission which will meet on Wednesday the 20th to render a decision for the Highway District. Johnson: Thank you, that clarifies my misunderstanding. And I am assuming you can make that study available for them by tomorrow? We have several options here as a Commission on which ever way you would like to proceed. I will close the public hearing and invite you. Bowcutt: Good evening, this is a preliminary plat on a property located on Overland Road adjoining I-84 to the north. It is just west of Kuna Meridian Road. The Sandman Motel, the new Texaco and the JB's Restaurant lies on our east boundary. To our west boundary is the Mountain View Equipment complex. This came before this body not too long ago as an annexation. If you recall a portion of the property was in the city limits currently zoned C-G and a portion was outside the city limits in Ada County's jurisdiction zoned C2. We asked for annexation so that we have a consistent zone throughout the whole property. Mr. Moore intends to develop this property. He had kicked around multiple ideas, commercial center, officer center. And wee basically decided to proceed with the preliminary plat, it was listed under our conditions of approval of annexation that we would submit a preliminary plat and the development agreement would be tied to that. We are proposing exactly 25 buildable commercial lots on approximately 39 acres .The roadway you see there would be a private drive area. The reason that we chose a private drive, we had some pre-application meetings with the City, some meetings with the Highway District with the Ada County Engineer and we basically wanted some flexibility.
