The Commission shall: a. Conduct at least one public hearing at which interested persons will have the opportunity to be heard. At least 15 days prior to hearing notice of the time and place shall be published in newspaper. b. Within 45 days after hearing the Commission, shall transmit its recommendation to the Council with supportive reasons, the Commend shall recommend the application be approved, approved with conditions or denied. The Commission shall insure that any approval is in accordance with the Comp. Plan, this Ordinance and State Law. 2. The Council: a. The Council shall conduct one public hearing after notice requirements as above. b. After hearing the Council shall approve, approve with conditions or deny, with supportive reasons. r APPLICATION FOR REZONE. SCOTTSDALE ESTATES SUBDIVISION 1. - 5. Attached. 6. The property is currently developed with one single family dwelling and accessory buildings. 7. The applicant intends to develop the parcel with 26 patio homes. The dwellings will have one zero lot line or common wall. Each dwelling will have a two car garage. The developer is trying to create a neighborhood for elderly couples with small lots and one-story homes. 8. Present zoning on the subject parcel is E-4. 9. Proposed zoning is R-15. The R-15 will accommodate the smaller (less maintenance) lots. 10.& 11. The subject property is located on the south side of Franklin Road. Commercial development exists on the north. side of Franklin Road and is scattered along the south side. West of the parcel is a duplex and single family development. East of the property is four-plex units. The overall mixed uses in the area and degree of development creates a situation of compatibility. IDAHO FINDINGS OF FACT AND CONCLUSIONS The above entitled variance request having come on for consideration on February 15, 1994, at approximately 7:30 o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, the Petitioners appearing through Becky Bowcutt, and the City Council having heard and taken oral and written testimony, the City Council of the City of Meridian makes the following: FINDINGS OF FACT 1. That notice of the public hearing on the variance was published for two consecutive weeks prior to the scheduled hearing for February 15, 1994, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the February 15, 1994, hearing; that the public was given full opportunity to express comments and submit evidence; that copies of all notices were available to newspaper, radio and television stations. 2. That this property is located within the City of Meridian and is owned by the Applicant and which property is described in the application which description is incorporated herein; that the FINDINGS OF FACT AND CONCLUSIONS OF LAW Page - 1 property is presently zoned R-4 Residential; the area surrounding Applicant's property is largely developed as a residential area; the property to the south is vacant land; the property to the west is a housing development consisting of single family residences of single family dwellings and town houses; the property to the east is developed with four-plexes; the property to the north is used commercially and residentially. 3. The R-4 zone is the zone that was placed on the property at the time that the 1984 Zoning Ordinance was adopted by the City of Meridian; that the zoning of the property prior to 1984 was "A" Residential; that the Applicant proposes to now have the property zoned R-15 Residential; that the Applicant submitted a proposed preliminary plat for the land. 4. That the subject parcel contains approximately 5.87 acres of land; that the request for rezone is to change the existing R-4 Residential zone to R-15 Residential for the entire parcel of property. 5. That the R-4 District and the R-15 District are described in the Zoning Ordinance, 11-2-408 B. 3. and 5 as follows: jR-4) LOW DENSITY RESIDENTIAL DISTRICT: The purpose of the (R-4) District is to permit the establishment of low density single-family dwellings, and to delineate those areas where predominately residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible non- residential uses. The (R-4) District allows for a maximum of four (4) dwelling units per acre and requires connection to the Municipal Water and Sewer systems of the City of Meridian. (R-15L Medium High Density Residential District: The purpose FINDINGS OF FACT AND CONCLUSIONS OF LAW page - 2 • • of the (R-15) District is to permit the establishment of medium-high density single-family attached and multi-family dwellings at a density not exceeding fifteen (15) dwelling units per acre. All such districts must have direct access to a transportation arterial or collector, abut or have direct access to a park or open space corridor, and be connected to the Municipal Water and Sewer systems of the City of Meridian. The predominant housing types in this district will be patio homes, zero lot line single-family dwellings, town houses, apartment buildings and condominiums. 6. Even though R-15 zoning is requested, the Applicant lists the density as 4.60 as the density per acre on the Application for preliminary plat which was submitted in conjunction with this rezone request. 7. The significant difference between the R-4 and R-15 zoning is in the bulk and coverage requirements of the Zoning Ordinance; the R-15 Zone allows a minimum of 2,400 square feet per dwelling and 50 feet of street frontage and 6,500 square foot lots whereas the R-4 zone allows only single-family dwellings and requires 80 feet of road frontage and 8,000 square foot lots as a minimum; that the Applicant's representative indicated at the hearing that there would only be single family dwellings even though zoned R-15 but they will request 0-lot line development with patio homes and some single family dwellings; he stated that the City ordinance allows the 2,400 square foot lots but they were have 5,000 square foot lots; he stated that the large lot in the north end of the development would remain residential; he also stated that they would have two car garages with one dwelling per lot; he further stated that there would be no disruption of the irrigation water. FINDINGS OF FACT AND CONCLUSIONS OF LAW Page - 3 • 8. That the subject property has been solely used in the past as vacant ground or as agricultural ground with no development whatsoever, except for the house fronting Franklin Road. 9. That the Applicant's representative stated at the hearing they were applying for a variance to construct 0-lot line patio homes; that they would meet the front, rear and one side of the setback requirements, but desired the variance to build on a 0-lot line; that they would be one story units, the lots would range about 3,500 square feet; that they would pipe all ditches except the Eight Mile lateral, a part of which is already tiled; that they would make sure that the irrigation water would proceed through the property; that they were asking for a rezone from R-4 to R-15 but were not taking advantage of the density; that the Planning and Zoning Commission had concerns that would build what they represented they would; that to resolve the P & Z concerns that they would submit to design review; that the Christenson brothers, the Applicants would be building all of the homes; that the Applicant asked her to ask that they be allowed to have a duplex on a large lot; that she stated that they are asking for five additional units; that the density would be increased from 4.6 units per acres to 5.5 units per acre; that there were questions by the Council as to the change in the plan to add duplexes and Councilman Morrow indicated that he would not approve of that unless the P & Z Commission had seen the change and the Applicant's representative stated that that was acceptable and she would relay the information to the Applicants. FINDINGS OF FACT AND CONCLUSIONS OF LAW Page - 4 • 10. Ralph Patey testified to the Council about concerns as to an already populated area being increased around the Fenway Park area. He stated his neighborhood is a really great neighborhood just as it is and now another development wants to come in next to him and there is no connection or additional access to Franklin from within his subdivision; another egress is needed and now another development is being considered and the only way out of the mess is an "itty bitty artery". He stated that from the fire stations standpoint, safety of any kind is poor, and that is bad and that with any kind of an emergency in the neighborhood with one street obstructed, you've got some real problems. Mr. Patey raised the question also about the ditch being unfenced which is a potential hazard to a neighborhood full of children. 11. Mr. Kent Shepard of Meridian, Idaho raised a question as to responsibility of the piping of a small drainage ditch that runs down the west side of the property. It was suggested by the Council to Mr. Shepard that he get in touch with the Nampa Meridian Irrigation District since the ditch is solely on Mr. Shepard's property with an easement in favor of users of that ditch. 12. That comments were submitted by the Meridian Police Department, Meridian Fire Department, City Engineer, Meridian School District, Central District Health Department, Nampa & Meridian Irrigation District, Idaho Power, U. S. West, and the Meridian Planning Director. Ada County Highway District may submit comment. All comments, including Ada County Highway District if submitted, are by this reference incorporated herein as if set FINDINGS OF FACT AND CONCLUSIONS OF LAW Page - 5 • forth in full. 13. That the comments of the Planning Director were that the project would be good infill between Franklin Square Subdivision which included four-plexes and Crestwood Estates which is predominantly single-family dwellings; that there was a large lot shown on the preliminary plat and if it was to be commercial it would not comply with the Comprehensive Plan; that the application implies one patio home unit per lot with 26 lots and that the this should be verified. 14. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicants' property. 2. That the City has the authority to take judicial notice of its own ordinances, other governmental statues and ordinances, and of actual conditions existing within the City and state. 3. That the City of Meridian has authority to place conditions upon granting a zoning amendment. 4. That the City has judged this Application for a zoning amendment upon the basis of guidelines contained in Section 11-2- 416 of the Revised and Compiled Ordinances of the City of Meridian FINDINGS OF FACT AND CONCLUSIONS OF LAW Page - 6 • • and upon the basis of the Local Planning Act of 1975, Title 67 Chapter 65, Idaho Code, the Comprehensive Plan of the City of Meridian, and the record submitted to it and the things of which it can take judicial notice. 5. That 11-2-416 A of the Zoning Ordinance states, in part, as follows: "When the public necessity, convenience, general welfare or zoning and development practice require, the Council may amend, supplement, change, or repeal the regulations, restrictions, and boundaries or classifications of property as well as the regulations and provisions of this Ordinance." 6. That 11-2-416 (K) of the Revised and Compiled Ordinances of the City of Meridian sets forth standards under which the City shall review applications for zoning amendments; that upon a review of those requirements and a review of the facts presented and conditions of the area, the Planning and Zoning Commission specifically concludes as follows: (a) The R-15 zoning would be harmonious with and in accordance with the Comprehensive Plan since the property is being developed in a residential manner consistent with surrounding development. (b) The area was not intended to be rezoned in the future, but growth in the City is requiring such. (c) The area included in the proposed zoning amendment is intended to be developed in the fashion that would be allowed under the new zoning as the Applicant has submitted a proposed subdivision plat of the entire area and it shows development to meet the requested rezoning of R-15. (d ) There have been no recent changes in the area or adjacent area which dictate that the area requested to rezoned should be so rezoned. (e) That the property, designed in an R-15 fashion and under R-15 requirements and limitations, is designed so as to be harmonious with the surrounding area. FINDINGS OF FACT AND CONCLUSIONS OF LAW page - ~ • • ( f ) The 15 zone and its use would not be hazardous to the existing or future uses of the neighborhood and should not be disturbing to the property owners in the adjacent residential areas. (g) The property would be able to be adequately served with most public facilities. (h) The R-15 zone would not create excessive additional requirements at public cost for public facilities and services and would not be detrimental to the economic welfare of the community. (i) The R-15 zone and developments should not involve a use detrimental to the existing residential area or the general welfare of the area. (j) Development in an R-15 fashion should not cause an increase in vehicular traffic over and above what the traffic increase would be if developed as R-4 since it is presently designed to flow immediately to Franklin Road. (k) That a rezone would not result in the destruction, loss or damage of any natural or scenic feature of major importance. (1) The proposed zoning amendment to rezone the land to R-15 is in the best interest of City of Meridian. 7. That Section 11-9-605 M., PIPING OF DITCHES, of the Subdivision and Development Ordinance requires piping of ditches, canals and waterways and that ordinance shall be complied with as a condition of development of the R-15 residential. 8. It is further concluded that, upon development, the comments, recommendations and requirements of the City Engineer and other governmental agencies shall have to be met and complied with as would the ordinances of the City of Meridian. 9. It is concluded that a variance to allow 0-lot line development will have to be obtained to allow the type of development represented. FINDINGS OF FACT AND CONCLUSIONS OF LAW Page - 8 10. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, Uniform Electrical Code, the Fire and Life Safety Code, all parking and landscaping requirements. 11. That all ditches, canals and waterways shall be tiled. 12. The large lot shown on the preliminary plat must remain in its current use, even though zoned R-15, unless application for a different use is made to the City and the different use approved. 13. That if the Applicant desires to have duplexes rather than single-family patio homes with 0-lot lines, the Applicant shall be required to submit the plan, along with the proposed zoning, to the Meridian Planning and Zoning Commission; that any development is restricted to single-family development since that is what Applicant represented to the City, at least until the hearing before the City Council; that a change at that level is not acceptable. 14. That the Applicant is required to submit a deed restriction, to be recorded, that states that only single-family dwellings 'shall be allowed on the property; that this deed restriction must be submitted prior passage of any rezone Ordinance; that in the event the Applicant decides to change the development plans for the land, this deed requirement could be rescinded and re-evaluated by the City Council. 15. That the City Council must pass and approve Applicant's request for a variance of the set back requirements prior to the construction of any 0-lot line dwellings. Street names need directional prefix and need to conform with review comments of the Ada County Street Name`Committee. 2. Show street light and fire hydrant locations. Three street lights are needed. Hydrant locations shall be coordinated with City Water Superintendent. 3. Sanitary sewer laterals shall be located jn the south and west side of centerline; preferably in the center of the travel lane. - 4. Water mains shall be lacated 12 feet north and east of street centerline. 5. Reference the benchmark used for the contour lines. 6. Establish depth of highest seasonal groundwater to assist builders in setting bottom of house _footing at least 12 inches above high water level. 7. Will storm drainage drain run into Franklin Square Subdivision, and if so how will this impact their existing retention basin? 8. What will be the status of the existing irrigation ditches along the parcels boundaries at the time of subdivision development? 9. The existing piping of Eight Mile Lateral should be connected with a junction box and approved by Nampa/Meridian Irrigation District. 10. How will irrigation water be delivered to the north side of Franklin Road to the point presently served by the 15 inch diameter C.M.P.? 11. IDAHO FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing December 14, 1993 at the hour of 7:30 o'clock p.m., the Petitioner appearing through Dan Ells of Briggs Engineering, Inc., the Planning and Zoning Commission of the City of Meridian having duly considered the evidence and the matter, makes the following Findings of Fact and Conclusions: FINDINGS OF FACT 1. That the R-4 District and the R-15 District are described in the Zoning Ordinance, 11-2-408 B. 3. and 5 as follows: (R-4) LOW DENSITY RESIDENTIAL DISTRICT: The purpose of the ( R-4 ) District is to permit the establishment of low density single-family dwellings, and to delineate those areas where predominately residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible non-residential uses. The (R-4) District allows for a maximum of four ( 4 ) dwelling units per acre and requires connection to the Municipal Water and Sewer systems of the City of Meridian. FINDINGS OF FACT & CONCLUSIONS OF LAW Page 2 ~~ ~ • (R-15) Medium High Density Residential District: The purpose of the (R-15) District is to permit the establishment of medium-high density single-family attached and multi-family dwellings at a density not exceeding fifteen (15) dwelling units per acre. All such districts must have direct access to a transportation arterial or collector, abut or have direct access to a park or open space corridor, and be connected to the Municipal Water and Sewer systems of the City of Meridian. The predominant housing types in this district will be patio homes, zero lot line single-family dwellings, townhouses, apartment buildings and condominiums. 6. Even though R-15 zoning is requested, the Applicant lists the density as 4.60 as the density per acre on the Application for preliminary plat which was submitted in conjunction with this rezone request. 7. The significant difference between the R-4 and R-15 zoning is in the bulk and coverage requirements of the Zoning Ordinance; the R-15 Zone allows a minimum of 2,400 square feet per dwelling and 50 feet of street frontage and 6, 500 square foot lots whereas the R-4 zone allows only single-family dwellings and requires 80 feet of road frontage and 8,000 square foot lots as a minimum; that the Applicant's representative indicated at the hearing that there would only be single family dwellings even though zoned R-15 but they will request 0-lot line development with patio homes and some single family dwellings; he stated that the City ordinance allows the 2,400 square foot lots but they were have 5,000 square foot lots; he stated that the large lot in the north end of the development would remain residential; he also stated that they would have two car garages with one dwelling per lot; he further stated that there would be no disruption of the irrigation water. FINDINGS OF FACT & CONCLUSIONS OF LAW Page 3 • 8. That the subject property has been solely used in the past as vacant ground or as agricultural grouna wizn no development whatsoever, except for the house fronting Franklin Road. 10. That there was no testimony at the hearing objecting to the Application. 11. That comments were submitted by the Meridian Police Department, Meridian Fire Department, City Engineer, Meridian School District, Central District Health Department, Nampa Meridian Irrigation District, Idaho Power, U. S. West, and the Meridian Planning Director. Ada County Highway District may submit comment. All comments, including Ada County Highway District if submitted, are by this reference incorporated herein as if set forth in full. 13. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicants' property. 2. That the City has the authority to take judicial notice of its own ordinances, other governmental statues and ordinances, and of actual conditions existing within the City and state. FINDINGS OF FACT & CONCLUSIONS OF LAW Page 4 i • 3. That the City of Meridian has authority to place conditions upon granting a zoning amendment. 4. That the City has judged this Application for a zoning amendment upon the basis of guidelines contained in Section 11-2- 416 of the Revised and Compiled Ordinances of the City of Meridian and upon the basis of the Local Planning Act of 1975, Title 67 Chapter 65, Idaho Code, the Comprehensive Plan of the City of Meridian, and the record submitted to it and the things of which it can take judicial notice. 5. That 11-2-416 A of the Zoning Ordinance states, in part, as follows: "When the public necessity, convenience, general welfare or zoning and development practice require, the Council may amend, supplement, change, or repeal the regulations, restrictions, and boundaries or classifications of property as well as the regulations and provisions of this Ordinance." 6. That 11-2-416 (K) of the Revised and Compiled Ordinances of the City of Meridian sets forth standards under which the City shall review applications for zoning amendments; that upon a review of those requirements and a review of the facts presented and conditions of the area, the Planning and Zoning Commission specifically concludes as follows: (a) The R-15 zoning would be harmonious with and in accordance with the Comprehensive Plan since the property is being developed in a residential manner consistent with surrounding development. (b) The area was not intended to be rezoned in the future, but growth in the City is requiring such. (c) The area included in the proposed zoning amendment is intended to be developed in the fashion that would be allowed under the new zoning as the Applicant has FINDINGS OF FACT & CONCLUSIONS OF LAW Page 5 submitted a proposed subdivision plat of the entire area and it shows development to meet the requested rezoning of R-15. (d) There have been no recent changes in the area or adjacent area which dictate that the area requested to rezoned should be so rezoned. (e) That the property, designed in an R-15 fashion and under R-15 requirements and limitations, is designed so as to be harmonious with the surrounding area. (f) The 15 zone and its use would not be hazardous to the existing or future uses of the neighborhood and should not be disturbing to the property owners in the adjacent residential areas. (g) The property would be able to be adequately served with most public facilities. (h) The R-15 zone would not create excessive additional requirements at public cost for public facilities and services and would not be detrimental to the economic welfare of the community. (i) The R-15 zone and developments should not involve a use detrimental to the existing residential area or the general welfare of the area. (j) Development in an R-15 fashion should not cause an increase in vehicular traffic over and above what the traffic increase would be if developed as R-4 since it is presently designed to flow immediately to Franklin Road. (k) That a rezone would not result in the destruction, loss or damage of any natural or scenic feature of major importance. (1) The proposed zoning amendment to rezone a portion of the land to R-15 is in the best interest of City of Meridian. 7. That Section 11-9-605 M., PIPING OF DITCHES, of the Subdivision and Development Ordinance requires piping of ditches, canals and waterways and that ordinance shall be complied with as a condition of development of the R-15 residential. It is further concluded that, upon development, the comments, recommendations and requirements of the City Engineer and other governmental agencies shall have to be met and complied with as would the ordinances of the City of Meridian. 9. It is concluded that a variance to allow 0-lot line development will have to be obtained to allow the type of development represented. 10. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code,. Uniform Fire Code, Uniform Plumbing Code, Uniform Electrical Code, the Fire and Life Safety Code, all parking and landscaping requirements. 11. That all ditches, canals and waterways shall be tiled. 12. The large lot shown on the preliminary plat must remain in its current use, even though zoned R-15, unless application for a different use is made to the City and the different use approved. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. We ask that you assure the developer will provide walkways, bike paths and safe pedestrian access.
