Rapids and the Los Alamitos, I think we are dealing now with the first of the extensions
because we had substantial time with him on these projects trying to get them squared
away. As I recall we were working on these this time last year were we not?

Corrie: This would be an extension of final plat date to January 18, 1997 am I correct?
Shari has a letter.
Morrow: I guess I am a little confused by this letter, it says the Council approved the
extension of the final plat of Salmon Rapids No. 2 on May 21, 1996. This would extend
the final plat date to January 18, 1997 if we approved it. May 21, 1996 would that not run
to May 21, 1997?
Rountree: Not if went back to the original plat approval.
Morrow: (Inaudible)
Stiles: Councilman Rountree, Mayor and Council, I did write the applicant a letter that
indicated Salmon Rapids No. 2 was not eligible for another extension that they would have
to go through the variance process.

Corrie: So this was a second request for an extension?

Rountree: An extension of an extension.
Morrow: Are you indicating then Shari that the original extension that we di~ the one year
extension expired on May 21 of this year?
Stiles: They would have until May 21, 1997 with the extension of Salmon Rapids No. 2 to
plat. No I am sorry the extension was to May 21, (Inaudible)
Rountree: It is either a typo or it is overdue.
Stiles: He was requesting an extension beyond the January 18, 1997 date to plat Salmon
Rapids No. 2. That was what his request was for. He wanted an additional 6 months
beyond the January 18, 1997 date.
Morrow: So I am still confused here. The original final plat was due to expire on May 21,
1996 or it expired May 21, 1995 we granted a one year extension to May 21, 1996 and
now 3 or 4 months that it has been expired and he is asking fora 6 month extension to
January 18, 1997.
Rountree: Mr. Morrow, we granted an extension May 21 for 6 months to November 5 of
1997 at the or 1996 at the request of Mr. Goldsmith. That was six months.
Morrow: And that was his request, what we are saying then is that his letter here based
on that is not correct. He gets one extension even though it is only for six months.
Rountree: He has had one extension for fix months at his request.
Morrow: My question to the Counselor would be is does one extension for a period of time
(inaudible) encompass a year. Obviously here (inaudible) could have asked for a year. So
by virtue of what Shari is indicating is if (inaudible) second extension that is not
(inaudible).
Crookston: The extension is for the period of time that the Council granted, it doesn't
matter if it is for a year or six months or 3 months or whatever. The extension only lasts as
long as the Council granted that previous extension to. There is no right in our ordinance
for an extension, that is up to the Council.

Morrow: So the answer is basically he is asking for a second extension in order to do that
he would have to have a variance.
Crookston: That is correct.
Corrie: Is that what, yours is a little different than that but I think it is the same thing as that
is that correct?
Stiles: Mr. Mayor and Council the ordinance reads that the Council can grant a single

So now we need to instruct him that he has to apply for a variance.

Dear Mr. Goldsmith:
I received your letters dated August 16, 1996 today regarding extensions on the above-referenced
projects. For Salmon Rapids No. 2 Subdivision, the Council is only authorized to gent a single
extension of one year. Extensions beyond one year would require that a variance be granted by
the City Council. A formal application for variance would need to be prepared and submitted.
Time extensions of up to one year may be ganted by the City Council for Los Alamitos No. 3 and
Salmon Rapids No. 3. Each request for a time extension must be accompanied by a fee of
$100.00. When the City has received your check for $200.00, we can place these items on the
agenda for the next available Council meeting. Please call if you have any questions.

modifications necessary but they can be done.
Corrie: I did talk to Shari about this afternoon she didn't have any problems. Shari any
comments or any problems with this request?
Stiles: Mr. Mayor and Council I asked Mr. Wood to come and ask the Council for this just
because I didn't feel I wanted to make that as a staff level decision. I didn't know what
policy is as far as ACHD's policy. I haven't seen anything very definitive on what they
prefer and since these were going to add two lots to the buildable lots and take away
common area I would prefer that the Council acted on this change in the plat. Did you ask
Gary?
Corrie: Yes
Rountree: It looks like a reasonable request, it meets our ordinances, it meets the terms
or requirements for this particular subdivision zoning.

Winn: Mr. Mayor and Council members, I will make this very brief I applied for a liquor
license in 1978 and it came through this year and I tried all establishments in Meridian and
I couldn't place it. I had an agreement there at EI Zocalo's and the place was taken by a
divorce settlement. Therefore I have an agreement with Dean Mayes to use part of his
building to sell alcohol beverages. In 1980 they changed the law so that you did have to
be open for a period of six months to retain your IicFr~se. I would like to open this
establishment here, it will be open from 10 to 6, if I don't sell a drink that will be fine. My
intent is to keep the license.
Corrie: Alright, Council, any questions? Chief, any comments?
Gordon: Mr. Mayor and Council I did a background investigation on Mr. Winn and there
is nothing in his background that would prohibit him from having a City license. Also, his
intent to retain and put into service this license is required by State law and I have
checked with the alcohol beverage control people. Mr. Winn does meet those

fee. It is my understanding that this item will be on the City Counsel's May 21st
meeting agenda.
With respect to the Salmon Rapids No. 1 fence, as I indicated to you, given the
City Council's variance of the twenty foot planting strip ordinance down to ten feet
on' Salmon Rapids No. 1, and given the Homeowners Association has agreed to
relinquish the ten feet, and each lot owner has agreed to incorporate the ten feet into
their lots, I am instructing Marty to once again immediately move the fence. The
Homeowners Association will grant to each lot owner an exclusive right of use of the
particular ten feet strip, which easement will run with the title to their lots.
With respect to the B&L Cedar v. Goldsmith. City of Meridian et al, this case
has been settled and is in the processing of being dismissed. The City was not served
and no action need be taken on its part.

Re: Salmon Rapids Subdivision No. 2
Dear Dave:
Nampa & Meridian Irrigation District has completed a review of the
construction plans for the above mentioned project. The plans
indicate that all run-off will be retained on-site which will meet
the requirements of Nampa & Meridian Irrigation District.
The plans do note that the retention pond will be located along the
Eightmile Lateral which has an 80 foot easement (40 feet from the
center both ways). If the pond is to be located within the ease-
ment area, we will require detailed plans and we would like to per-
form an inspection at the time of construction to make sure that it
will not interfere with the District's operation and maintenance.
In addition, if the pond is to be located within the easement,
Nampa & Meridian Irrigation District will require an agreement for
encroachment. To obtain this agreement, contact the District's
attorney, Daniel Steenson, at 342-4591 and request that he prepare
a License Agreement. Once the developer has signed and returned
the License Agreement, it will go before the District's Board of

Kingsford: Shari, have your comments been met?
Stiles: Yes, with the exception of, as with Los Alamitos they both need to have the
development agreements updated. I imagine we can take care of the pressurized irrigation
at that time.
Morrow: I think Mr. Mayor, I have a question with respect to Item 5 on page 2 of Gary
Smith's comments, site specific comments. My question is that under item 5 it says all
buildable lots for single family dwellings only, each dwelling unit shall have a minimum
floor area of 1400 square feet excluding the garage area. Any houses within 500, what is
the rest of that paragraph, within 500 what?
Stiles: That would be any within 500 of Meridian Greens which was a condition of the
phase 1 plat.
Morrow: Does that apply to this also?
Stiles: Yes
Morrow: And what does the within 500 feet mean, that
Stiles: Five hundred feet of the boundaries of Meridian Greens. I think that, I am not sure

if their covenants address that. Wayne Crookston went through something with Marty's
attorney.
Kingsford: Those things dealt with sizes were larger and also had a restriction on roof
construction did they not?
Mon'ow. I think my question was that there seems to have been some feedback to whether
or not they were single level homes and the square footage requirement in that 500 feet
was higher than the 1400 square feet and it is my understanding that there was at least
one home that was built.
Kingsford: That was Hunts Bluff, same developer but a different development.
Morrow. Okay, and my question is that is it clearly spelled out within these documents if
the same thing applies?
Smith: Mr. Mayor and Councilman Morrow, let me read you this note on the plat and what
we did when we reviewed this is we didn't show the whole sentence, ~~ue just showed a
correction for a portion of that sentence. That is why it is unclear. Note number 5 on the
plat states, This subdivision is subject to the requirements of the Uniform Building Code,
UBC as regulated by the City of Meridian. All buildable lots are for single family dwellings
only, each dwelling unit shall have a minimum of 1400 square feet excluding the garage
area and any houses within 500 feet of Meridian Greens shall be a minimum of 1500
square feet." So there was a restriction on that.
Morrow: Was the 1500 square feet and there was no reference in the testimony where
that they would be single level or multi-level homes?
Smith: I can't answer that, I don't know.
Morrow. And the other issue is that I believe that Mr. Goldsmith needs to state that he will
also with the pressurized irrigation system for this subdivision tum that over to either the
homeowners association or Nampa Meridian In-igation District.
Goldsmith: Yes I will tum over the pressurized irrigation system, that is retroactive through
phase 1 as well.

The people in Kachina Estates were more concerned about the fencing and screening
them and making sure they weren't involved with their properties in any way.
Kingsford: And that was part of your conditions that they have agreed to am I right?
Stiles: Yes
Kingsford: What is the Council's pleasure?

with the following conditions that there will be an updated agreement signed that the

I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
We have been receiving quite a few complaints of low water pressure from residents in
various parts of the City. Also, our water system has not been able to supply required flows
to fire sprinkler systems in some recent commercial developments. These developments have
had to install a pressure booster pump in their line in order to meet required fire sprinkler
flows. In tight of these problems we don't feel comfortable adding more demand to our
ah~eady taxed water system, and we respectfully request that this application be tabled until
such time as we have the problems better defined and a clear plan of action in place.
GENERAL COMMENTS
1. Any existing irrigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the
appropriate irrigation/drainage district, or lateral users association, with written
confirmation of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface
soil conditions as prepared by a soil scientist with street development plans.

4. Submit copy of proposed restrictive covenants and/or deed restrictions for our review.
5. Provide a statement as to whether the pressurized irrigation system in this development is
to be owned and maintained by the Irrigation Dist. or the Homeowners Assoc.
6. Indicate any FEMA Flood Plains affecting the azea being platted, and detail plans for
reducing or eliminating the boundary.
7. Please address in writing, each of the comment, within this transmittal, to the City
Engineer's office.
SITE,~PECIFIC COMMENTS
1. This Plat generally conforms to the previously approved Preliminary Plat map.
2. Please revise the street names to conform with the Ada County Street Name Committee's
requirements.
3. Create Common Area Lots covering the areas within the 40 foot wide easement for the
Eight Mile Lateral. These two Lots shall be owned and maintained by the Salmon Rapids
Subdivision No. 2 Homeowners Association. A fence shall be erected along the
southwesterly line of these Lots per the requirements of the Meridian Planning and Zoning
Administrator.
4. Please add or revise the following notes:
(5) ...Meridian. All buildable Lots are for single family dwellings only, each
dwelling unit shall have a minimum floor azea of 1400 square feet,
excluding the garage azea. And any houses within 500...
(7) ...installation of Public Utilities and Pressure Irrigation System...

6. Detail the tie to the radius points for the bulbs on E. Snow Hole Dr. and S. Redside Way.
These tie need to be shown on the Final Plat Map.
7. Provide for (50') fifty foot radius temporary turn azounds at the end of S. Redside Way
and S. Velvet Falls Dr.
8. Verify the square footage of Lots 33-35, Block 2. The Lots in this development must
contain a minimum of 8000 square feet, exclusive of easements and rights-of--way.
9. Indicate front of Lot 27, Block 2 as facing E. Snow Hole Dr. and front of Lot 1, Block
5 as facing the north-south portion of S. Redside Way.
10. It has been brought to our attention that the developer of this Subdivision intends to retain
ownership and maintenance of the pressurized irrigation system throughout the
development. Recently a contractor who built a home in phase one of this development
contacted our office asking for information because FHA/VA wouldn't loan on the home
because of the uncertainty of the regulation of user fees associated with pressurized
irrigation system. It appears to us that since we are requiring the installation of pressurized
irrigation systems in developments, that we condition it upon the systems being owned and
maintained by either the Irrigation District or the Homeowner Association.

To prevent and treat disease and disability; to promote healthy lifestyles; and to protect and promote the health and quality of our environment.
STORMWATER MANAGEMENT RECOIVIMENDATIONS
We recommend that the first one half inch of stormwater be pretreated through a grassy swale
prior to discharge to the subsurface to prevent impact to groundwater and surface water quality.
The engineers and architects involved with the design of this project should obtain current best
management practices for stormwater disposal and design a stormwater management system that
is preventing groundwater and surface water degradation. Manuals that could be used for
guidance are:

C. Salmon Rapids No.3 proposes one public street connection to Locust Grove Road and-two "
stub streets to connect with Salmon Rapids No.2. No other stub streets are recommended by
staff because the abutting properties are developed as 5-acre lot subdivisions.
D. In compliance with District policy, staff recommends that internal streets be constructed to a
37-foot street section with curb, gutter, and 4-foot sidewalks within a 50-foot right-of--way.
Staff recommends that raised islands be installed in three of the larger "knuckles" to focus
traffic. The raised medians are recommended at the corner of Redside and Lake Creek, the
southern "knuckle" on Spring Bar and on Velvet Falls.
E. The landscaped median proposed at the entrance to Locust Grove Road should be a platted
lot, owned and maintained by a homeowners association. The road section on the north side/
entrance of the median should be 21-feet back-to-back and on the south side of the
median/exit should be 24-feet back-to-back.
F. In compliance with District policy, direct lot or parcel access to Locust Grove Road will be

1. A request fo~~modification, v~iriance or waiver of any requirement or policy outlined herein
shall be mad , in writing,,to the Manager of Engineering Services within 15 calendar days of
the original~k~ 'sciran'action. The request shall include a statement explaining why such a
requirement«:` ult in substantial hardship or inequity and minimum fee of $110.00.
2. Aright-of--way permit must be obtained from ACHD for any street or utility construction
within the public right-of--way. Utility cuts should be combined where practical to limit
pavement damage. Contact Construction Services at 345-7667 (with zoning file number) for
details.
3. Submit site drainage plans and calculations for review and appropriate action by ACHD.
The proposed drainage system shall conform to the requirements of the City of Meridian and
shall retain all storm water on-site.
Public street drainage facilities shall be located in the public right-of--way or in a common lot
owned by a homeowners association set aside specifically for that use. There shall be no
trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage
lots and their use restrictions shall be noted on the plat (when applicable).
4. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when
driveways are not being shared with the adjacent property.
5. Locate obstructions (utility facilities, irrigation and drainage appurtenances, etc.) outside of
the proposed street improvements. Authorization for relocations shall be obtained from the

I addressed this issue with the City Council and indicated to
them that there were no height restrictions specifically placed on
this property and that there was no authority to place height
restrictions now. It was my understanding that a builder was

I received your letter, dated May 2, 1995, on May 10, 1995.
I apologize for the delay in responding.
You asked that I respond to the claims raised concerning the
last three (3) incidents in your letter. Those incidents relate to
Hunts Bluff Subdivision No. 2, regarding height restrictions, house
sizes in Salmon Rapids Subdivision No. 2, and the house sizes in
Los Alamitos Park No. 1.
In regards to the Hunts Bluff height .restrictions on houses,
this matter came up as a result of the City receiving a complaint
from an owner of adjacent property. I believe he lives in Meridian
Greens. He stated that Mr. Goldsmith had indicated that there
would not be two story homes near his property. Mr. Goldsmith did
state at a hearing regarding a variance that he would not construct
two story homes on the lots fronting Meridian Greens if he was
required not to. There was also a memorandum from Wayne Forrey,
who was an employee of the City at that time, pertaining to Hunts
Bluff No. 2 which stated, in essence, as follows:

delayed in the construction of a two story home, but was allowed to
finish his project. It was also my understanding that this matter
was going to be discussed with Mr. Goldsmith to see if it could be
agreed that, on lots adjacent to Meridian Greens, no further homes
would be built that were two story in height. I do not know the
final status of any discussions.
In regards to the home sizes in Salmon Rapids No. 2, the
Findings of Fact and Conclusions of Law for the annexation state
that there will be 1,500 square foot homes within 500 feet of
Meridian Greens. The preliminary plat application states that the
homes would be 1,400 square feet, but the final plat application
states that the homes would be at least 1,500 square feet and on
the final plat, it lists 1,800 square feet as being the mandatory
requirement.
In regards to the home sizes in Los Alamitos Park, the
Findings of Fact and Conclusions of Law state that the R-4 house
size requirement applies, which is 1,400 square feet. However, the
Los Alamitos Covenants, Conditions and Restrictions require 1,500
square feet as a mir_imum for house sizes. Also, the final plat
application received by the City on April 14, 1994, states that the
minimum square footage of the structures would be 1,500 square
feet.
Therefore, from the above, it can be seen that one builder was
slowed down while the City of Meridian considered the issues
regarding two story houses in Hunts Bluff, but to my knowledge the
matter has been resolved. With regard to the house sizes in both
Salmon Rapids and Los Alamitos, the City is not requiring a larger
house size than Mr. Goldsmith asked for and submitted on his final
plats. I don't believe therefore, that the City of Meridian is
causing any more hardship on Farwest Developers, Inc., which as I
understand it, is basically Marty Goldsmith, then they requested to
have placed upon them.
