List of mailing addresses of property owners attached. Also attached is a petition which was circulated to most property owners within a 300 foot radius of the subject property. A best-effort attempt was made to contact all property owners; however, after several attempts, not all were home to be reached. 12. Ordinance -ey allows child care in homes for up to 5 children. This application is to ask to allow a home child care for up to 12 children. 13. Allow a home child care for up to 12 children (a State Child Care License is already allowed for up to 12 children). 14. The home was purchased for use as both a residence and a child care. Prior to purchasing the home, I was informed by the City Clerk that there were no restrictions against a home child care for up to 12 children in that subdivision. The decision to purchase the home was based on this information. Also, after September, which is when I had wanted to start the child care, I was planning not to return to work and have already given notice to my employer as such. In summary, I now have a home that I cannot do what I have been planning to do for over a year, not including the great expense involved, as well as the possibility of not being able to retain my employment. 15. Please see response to question #14 16. Acxording to the City Clerk, the subdivision is built to R-8 zone standards (which would allow such a child care), however, is considered an R-4 zone. The Meridian Compsive Plan encourages a variety of supportive social services in all neighborhoods. I believe that this is a greatly needed service in this neighborhood. In addition, it has been mentioned to me by several of the residents in this subdivision that a child care service in this neighborhood would be welcomed. If you have no problem with these we can approve them all at the same time. Rountree: I just have a question on Ites #~, in the body of the Findings it has reference to the operating hours and times of the week, on Page 3. Those were not included in the Conclusions, my question is am I right in assuming that if they are in the Findings they are as well a pot^tion of the Conclusions and would be carried through with? Johnson: We'll look at Item #~ separately. Are there any other^s that anybody has discussion or questions about. If not, let's handle Items 1, 3, 4, 5, 6, 7 8 8 now. MERIDIAN PLANNING 8 ZONING JULY 13, 1993 PAGE ~ ITEM #.c': FINDINGS OF FACT AND CONCLUSIONS OF LAW: REQUEST FOR ACCESSORY USE PERMIT TO ALLOW A FAMILY CHILD CARE HOME OCCUPATION BY DEBB CARSTENSEN: The Motion was made by Rountree and seconded by Shearer that the Mer^idian Planning and Zoning Commission her^eby adopts and approves these Findings of Facts and Conclusions of Law with the amendment to the Conclusions that it add the stipulation about hours of operation and days of the week of operation as item indicated in Item 10 in the Findings of Facts. Morris: When we took out this application for commercial, our intention was to use this property for a Real Estate Office and an office for our construction firm and when we were looking thr^ough the different classifications I think we chose one that would have allowed that but is I think a little more than we need in the way of uses. Since then we've discussed this with Mt^. Forrey and I .just submitted a letter tonight that states the actual classification to allow what we're doing and make it possible to open^ate our^ business then^e would be a LO zone. This particular property is not a par^t of the subdivision that sur^rounds, it' s on a mai n ar^t er^y and fulfill s al 1 the r^equir^ements and we'r^e asking acceptance of a LO use then^e. Rountt^ee: We've not heat^d anything from ACRD? Fort^ey: No. Mor^ris: Recently the Highway Distt^ict was out there repairing that road and they did install at that time two curb cuts to allow for easier access. Johnson: Did you have an opportunity to talk to then specifically about that? Morris: No. Hepper; Is the-^e a sidewalk in front of this proper^ty? Morris: Evet^ything has been improved and upgraded, it has curb, gutter and sidewalk. Rountt^ee:. Thei^e is a parking requii^ement for this business that's based on square footage and it was also have to be surfaced. Motion Carried: All Yea: MERIDIAN PLANNING & ZONING JULY 13, 1993 RAGE 4 ITEM #10: PUBLIC HEARING: ACCESSORY USE PERMIT TO ALLOW HOME BUSINESS B`f SALLIE GALLIGHER: Johnson: We basically are not going to handle that. This property curt^ently has a home accessory use that has been approved by the City Council for in home business. That business coupled with this pr^oposed business stilt would not utilize more than 25X of the total squat^e footage of the home and for that reason and because then^e are no additional traffic pr^oblems created with the proposed business here it would be redundant to issue a second accessory pet^mit because those are not specific as to what use. In that case the existing permit there would also handle this application. So based upon that and after^ discussion with the attorney, it's our conclusion that we do not need to pursue this any further^. ITEM #li: PUBLIC HEARING: REQUEST FOR VARIANCE OF GROUP CHILD CARE IN R-4 ZONE WITH A CONDITIONAL USE PERMIT TO ALLOW GROUP CHILD CARE BY CAROLYNE RIDGEWAY: Johnson: I will open the Public Hearing at this time. Is there someone representing the applicant that would like to address the Commission? Car^olyne Ridgeway, 1~c'3 Darrah Dr^ive, was sworn by the attorney. Ridgeway: What we'd like to do is operate a child care home for^ up to twelve childr^en and we were told by the City Clerk that we would be unable to do that under a nor^mal conditional use permit in our^ s~~bdivision. Pr^i or to purchasing our hose to da the Day Car^e a~it of we had inquir^ed on whether^ or not we could do the Child Car^e Home at this particular home before we purchased and we wet^e told by Wayne Far^rey that there wouldn't be a pr^oblem we .just have to apply for^ the conditional use permit. After we pur^chased the home and I did apply for the conditional use permit I was told that we ar^e in an R-8 Zone which does not allow a child car^e of that size. Ther^efore I am filing a var^iance to the ordinance to be able to allowed to operate a child care of that size in our home. Alidjani: On your map it shows that there is a ]ft1x14 stor^age shed. Ridgeway: Yes we have not yet et^ected a fence in the front and on the one side, however there will be a fence er^ected and there wi 1 1 be padlocked gates. Round^ee: AT^e you c~~rrent 1 y open^at ing day care? Ridgeway: No not at this time. Rountr^ee: How long have you lived then^e? Ridgeway: We've just lived Chet^e for two months. Hepper: Yot~' ve got a petition her^e when^e you were t1^ying to get the opinion of the pY^oper^ty own et^s within three hundred feet, how many of the proper^ty owners within three hundred feet signed this petition? Ridgeway: Of the 25 there were 17, 1E~ of which had no pt^oblem with it, one was undecided. Hepper^: Is the person that lives right next to you on this petition? Ridgeway: Yes he's the first pet^son. Johnson: Thank you. Anyone else to testify? Joe Simunich, 955 W. Ustick Rd., was savor^n by the attot^ney. Simunich: I own the pt^opet^ty to the east of this pi^oposed child care business. One thing I would like to ask, is this permit only for^ this pet^son or is it fai^ the pt^opet^ty? Johnson: It's my understanding that conditional use permits are for^ the per^son and cannot be transfer^red. Simunich: Ali^ight then I have no objection. Johnson: Thank you. Anyone else? MERIDIAN PLANNING & ZONING JULY 13, 1993 PAGE 6 Tom Eggar•, 2564 NW 12th, was sworn by the attorney. Eggar: I live just around the corner from this proposed facility. What ar•e the ages of the children that will be watched? Also want to know if there is going to be a sign out front and if there's going to be any considerations about the traffic impact? It is a dead end there and your proposing twelve children a day, that would be twenty four trips in and out of the development in the ~aor•ning and in the afternoon that would be fifty additional cars down that road there. Johnson: Thank you. Ridgeway: Ther^e will not be a sign. The ages of children we anticipate one infant, appr^oximately eight toddlers or preschool age and thr^ee school age children who would be there part time. We will be offering ti^ansportation for the school age children to and from school. As far as tr^affic is concerned we do have a two car driveway and then^e will not be any of our vehicles in that dt^iveway 50 there will be off street parking. There is not a whole lot of space to tur^n around but there is auple space for us to turn around to get out of our di^iveway. Johnson: Do your^ subdivision covenants adds^ess this specific use? Ridgeway: No it does not. Our pT^oposed operating hours at^e ft^om 6:00 A. M. to E,:00 P. M. five days a week. Round^ee: Do you propose do have any help? Ridgeway: Both my sister^ and I are doing this together. Hepper: Felt that 6:00 A. M. was a little early. Johnson: Thank you. I will close the public hearing. Motion Carried: All Yea: MERIDIAN PLANNING 8 ZONING JULY 13, 1993 PAGE 7 Forrey: For the benefit of the Com®issioners and the pubic that is her^e you might know that Meridian is in the middle of a ®orat of^i um that began on May 18th and it wi 1 1 1 i ft ed on Sept ember 10th. We've used that per^iod to re-evaluate some of the policies in the current Comprehensive Plan. We will have a draft Comprehensive Plan and dr^aft a®end®ents to the zoning and development or^dinance plus a proposed development fee schedule, those things will be available to the public on July 26th and they will be available for public review at the library, the post office and her^e at City Hall. If you wish to purchase a copy of those three documents together^ we've estimated the cost to be 330.00. That would give you about 15 days advance notice to prepare yourselves for a public hearing which will be held at the next Mer^idian Planning and Zoning Meeting which is August 10th. Petween now and the 2tth of July this Comaission and the City Council will be individually reviewing that draft to get their inpait into it and then it will be available to the public on the 26th. Motion Carried: All Yea: tTAPE ON FILE OF THESE PROCEEDINGS) APPROVED: JIM JOHNSON, CHAIRMAN ATTEST: ~1 WAYNE F REY, CITY CLER. alt BEFORE THE PLANNING AND ZONING COMMISSION OF THE CITY OF MERIDIAN CAROLYNE RIDGEWAY VARIANCE AND CONDITIONAL USE PERMIT 1223 DARRAH DRIVE MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing July 13, 1993, at the hour of 7:30 o'clock p.m., the Petitioner appearing in person, the Planning and Zoning Commission of the City of Meridian having duly considered the evidence and the matter, makes the following Findings of Fact and Conclusions: FINDINGS OF FACT 1. That a notice of a public hearing on the Conditional Use Permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for July 13, 1993, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the July 13, 1993, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations; 2. That this property is located within the City of Meridian and the Applicant owns the property which property is described in the application which description is incorporated herein; that the surrounding properties are residential homes; that the subject property is zoned R-4 Residential. FINDINGS OF FACT AND CONCLUSIONS OF LAW -- PAGE 1 3. That the Applicant requests a Conditional Use Permit for a Group Child Care business in the R-4 District for the operation of a Group Child Care Home; that such use requires a Conditional Use Permit in any zone where allowed. 4. That the R-4 District is described in the Zoning Ordinance, 11-2-408 B 3. as follows: (R-4) LOW DENSITY RESIDENTIAL DISTRICT: Only single-family dwellings shall be permitted and no conditional uses shall be permitted except for Planned Residential Development and public schools. The purpose of the (R-4) District is to permit the establishment of low density single-family dwellings, and to delineate those areas where predominately residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible non-residential uses. The (R-4) District allows for a maximum of four (4) dwelling units per acre and requires connection to the Municipal Water and Sewer systems of the City of Meridian. 5. That the property is contained in the CAIRNS NEIGHBORHOOD as designated on the Policy Diagram at Page 7 of the Meridian Comprehensive Plan; neighborhoods are defined in the Plan at Page 6 and states as follows: "Definition: The neighborhood is a residential area with uniform characteristics of a size comparable to that usually served by an elementary school or a small business convenience center or a local park. Although neighborhoods occur in various shapes and sizes, a section of the City measuring one-half to one and one-half miles across is usually used for planning purposes. It has facilities within easy walking distances and provides the basis for community identification." 6. That the use proposed by the Applicant is set forth above and the Applicant proposes to care for 12 or less children; that the definition of Group Child Care Home allows the number of children in that type of facility to be 12 or less. FINDINGS OF FACT AND CONCLUSIONS OF LAW -- PAGE 2 7. That the day care use proposed by Applicant is not an allowed conditional use in the R-4 District which the Applicant's property is zoned; the Applicant has filed an application for a variance from the R-4 District provisions which prohibit the use requested by Applicant. 8. That the subject property is occupied by the Applicant and her family; that the yard is proposed to be entirely fenced and have padlocked gates; that the property does have irrigation canals or facilities in the area; that Five Mile Creek is adjacent to the rear property line. 9. That sewer and water is already connected to the property, but the use may require additional charges or fees. 10. That the City Engineer submitted comments which are incorporated herein as if set forth in full. 11. This. was a-hectic time for both of us... you were in the middle of buying a house and I was trying to cover for Jack. During our conversation we discussed the possibility of a Day Care operation in your new home. I had the understanding that you were buying a home in an area zoned>R-8 and you wanted a Group Child Care fore 6 to 12 children. Based on this understanding ,`I did tell you that you needed to file a Conditional Use Permit (CUP) application. Group Child Care homes are allowed in the R-8 zone by CUP. Subsequent to our March conversation, I haws learned that your new home is located in a R-4 subdivision which does not allow Group Child Care homes. The only way°'a Group Child Care Home could be allowed in your subdivision is by a variance to the City's ordinance. I am truly sorry for this misunderstanding and any trouble I may have caused, As you proceed to apply for a CUP and/or variance, please let me help any way I can. REZONE AND CONDITIONAL USE PERMIT 1915 WEST CHERRY LANE MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing July 23, 1993, at the hour of 7:30 o'clock p.m., the Petitioner appearing through William M. Morriss, the Planning & Zoning Commission of the City of Meridian having duly considered the evidence and the matter makes the following Findings of Fact and Conclusions: FINDINGS OF FACT 1. That a notice of a public hearing on the Rezone and the Conditional Use Permit Application was published for two (2) consecutive weeks prior to the said public hearing scheduled for July 23, 1993, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the July 23, 1993, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations; 2. That this property is located within the City of Meridian and the Applicant is not the owner of record of the property which property is described in the application which description is incorporated herein; that the Applicant has an agreement to FINDINGS OF FACT & CONCLUSIONS OF LAW Page - 1 purchase the property; that the property is now zoned R-4; the area in which Applicant's property is located is developed as an R-4 Residential subdivision; that the property to the east, west and south is zoned R-4; the property to the north is Cherry Lane and an R-4 subdivision. 3. That the Applicant requests that the property be re-zoned from R-4 to L-O Limited Office; that the Applicant proposes to use the property as a real estate agency office and for an office for a construction business. 4. That the uses proposed by the Applicant are allowed uses in the L-O district; that there is property. at the southwest corner of Linder Road and Cherry Lane, to the east, that is used and zoned for commercial purposes. 5. That the L-O District is described in the Zoning Ordinance, 11-2-408 B. 5 as follows: (L-O) LIMITED OFFICE DISTRICT: The purpose of the (L-O) District is to permit the establishment of groupings of professional, research, executive, administrative, accounting, clerical, stenographic, public service and similar uses. Research uses shall not involve heavy testing operations of any kind or product manufacturing of such a nature to create noise, vibration or emissions of a nature offensive to the overall purpose of this district. The L-O District is designed to act as a buffer between other more intense non- residential uses and high density residential uses, and is thus a transitional use. Connection to the Municipal Water and Sewer System of the City of Meridian is a requirement in this district. 6. That the property is contained in the WARRIOR neighborhood as designated on the Policy Diagram at Page 7 of the Meridian Comprehensive Plan; neighborhoods are defined in the Plan at Page 6 and states as follows: FINDINGS OF FACT & CONCLUSIONS OF LAW Page - 2 "Definition: The neighborhood is a residential area with uniform characteristics of a size comparable to that usually served by an elementary school or a small business convenience center or a local park. Although neighborhoods occur in various shapes and sizes, a section of the City measuring one- half to one and one-half miles across is usually used for planning purposes. It has facilities within easy walking distances and provides the basis for community identification." 7. That the subject property has previously been used as a residence; that the structure on the premises is designed as a single-family dwelling; that the property is surrounded on three sides by the Vineyards subdivision and on the north side by Cherry Lane; that the property is fenced. 8. That the property has two access points on Cherry Lane; Cherry Lane is a principal arterial and carries a substantial amount of traffic. 9. That sewer and water is already connected to the property, but the use may require additional charges or fees. 10. The City Engineer submitted comments which are incorporated herein as if set forth in full herein; that he commented that all improvements shall be made in accordance with City Ordinance, 11-2-414 (D) and (E). 11. That Ada County Highway District did not submit comments but they may and if it does that shall be incorporated herein as if set forth in full herein. 12. That the residential subdivision in which the property is located was approved within the past year and one-half; that there were no residents in the residential area that appeared objecting to the application. FINDINGS OF FACT & CONCLUSIONS OF LAW Page - 3 CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicants' property. 2. That the City has the authority to take judicial notice of its own ordinances, other governmental statutes and ordinances, and of actual conditions existing within the City and state. 3. That the City of Meridian has authority to place conditions upon granting a zoning amendment. 4. That the City has judged this Application for a zoning amendment upon the basis of guidelines contained in Section 11-2- 416 of the Revised and Compiled Ordinances of the City of Meridian and upon the basis of the Local Planning Act of 1975, Title 67 Chapter 65, Idaho Code, 'the Comprehensive Plan of the City of Meridian, and the record submitted to it and the things of which it can take judicial notice. 5. That Section 11-2-416 A. states in part as follows: "When the public necessity, convenience, general welfare or zoning and development practice require, the Council may amend, supplement, change „ or repeal the regulations, restrictions, and bouncaries or classification or property as well as the regulations and provisions of this Ordinance." 6. That 11-2-416 (R) of the Revised and Compiled Ordinances of the City of Meridian sets forth standards under which the City shall review applications for zoning amendments; that upon a review FINDINGS OF FACT & CONCLUSIONS OF LAW Page - 4 of those requirements and a review of the facts presented and conditions of the area, the Planning and Zoning Commission specifically concludes as follows: (a ) The L-O zoning would be harmonious with and in accordance with the Comprehensive Plan since the property is included in the WARRIOR Neighborhood and the Comprehensive Plan describes a neighborhood as a residential area served by an elementary school or a small convenience center or a local park. (b) The area was not intended to be rezoned in the future but there is a commercial property to the east of the subject property. (c) The area included in the proposed zoning amendment is intended to be used in the fashion that would be allowed under the proposed new zoning. (d) There has been no change in the area or adjacent areas which dictate that the property could be rezoned. (e) That the property, is designed and should be used as allowed in the L-O District, and as it presently exists, would be designed and constructed to be harmonious with the surrounding area, which is developed in the R-4 fashion. (f) The L-O use would not be hazardous to the existing or future uses of the neighborhood. (g) The property, if developed in the L-0 fashion, would be able to be adequately served with most public facilities. (h) L-0 development would not create excessive additional requirements at public cost for public facilities and services and would not be detrimental to the economic welfare of the community. (i) The proposed use would not involve uses, activities, processes materials, equipment or conditions of operation that would be detrimental to any person, property or the general welfare of the area however the traffic would be increased more than it would be under R- 4 use. (jj Development in the L-O district, and particularly as planned by the Applicant, would cause an increase in vehicular traffic over and above what the traffic FINDINGS OF FACT & CONCLUSIONS OF LAW Page - 5 increase would be if the R-4 use was continued. (k) That a rezone would not result in the destruction, loss or damage of any natural or scenic feature of major importance. (1) The proposed zoning amendment is in the best interest of City of Meridian. 7. That the City has judged this Application for a zoning amendment upon the basis of guidelines contained in Section 11-2- 416 of the Revised and Compiled Ordinances of the City of .Meridian and upon the basis of the Local Planning Act of 1975, Title 67 Chapter 65, Idaho Code, the Comprehensive Plan of the City of Meridian, and the record submitted to it and the things of which it can take judicial notice. 8. It is further concluded that the comments, recommendation and requirements of the City Engineer will have to be met and complied with. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The Meridian City Council hereby adopts and approves these Findings of Fact and Conclusions of law.
