JOINT POWERS AGREEMENT
Ada County, a political subdivision of the State of Idaho, hereinafter
referred to as "County" and the City of Meridian, hereinafter referred to as "City" hereby
covenant, promise, and agree as follows:
I.
That the City, as an independent contractor, shall provide trained personnel
in the Meridian City Clerk's Office in sufficient numbers to perform the designated tasks
and duties set forth below in Paragraph VII.
II.
The parties hereto agree and understand that neither the City, nor any
person performing the requirements of this Contract on behalf of the City, are employees
of the County. It is further understood that the relationship between the County and the
City is that of principal-independent contractor, respectively, and nothing herein should
be construed to be inconsistent with this relationship.
III.
The City agrees to hold harmless and indemnify the County from any and
all liability, loss, or damage the County may suffer, arising out of or in connection with
any service or failure to provide any service by the City pursuant to this Contract. The
City further agrees to defend against any claims, demands, actions, or suits, brought

against the County, arising out of or in connection with any service provided, or the
failure to provide any service, pursuant to this Contract. The City further agrees to
secure and maintain during the life of this Contract liability insurance in an amount no
less than $1,000,000.00 through cancellation or expiration, which insurance shall provide
protection to the parties hereto against any claims, demands, actions, or suits arising out
of or in connection with any service provided, or the failure to provide any service
pursuant to this Contract. The County shall be made an additional named insured under
the liability insurance policy secured pursuant to this provision, and evidence of such
insurance coverage indicating that the County has been made a named insured shall be
delivered to the County upon the execution of this Contract, or as soon thereafter as is
practicable.
IV.
That the County shall reimburse the City for the services provided pursuant
to Paragraph I in the amount of Ninety-Three Thousand Eight Hundred Four and No/100
Dollars ($93,804.00) on an annual basis, said amount to be prorated and paid each month
upon the completion of the services for that period. In order to obtain said
reimbursement, the City shall submit a claim voucher for the monthly amount due and
owing to the Auditor of the County for processing. A County warrant for said claims
shall be issued within a reasonable period of time thereafter.
V.
That this Contract shall be effective from October 1, 1993, through
September 30, 1994. This Contract may be renewed at the option of the parties hereto.

That this Contract may be cancelled for any reason whatsoever, by either
party to this Contract, after thirty (30) days' written notice is provided to the non-
cancelling party, at which time this Contract shall no longer have any effect, force, or
power and shall be completely null and void.
VII.
That the duties and tasks to be performed by the personnel referred to in
Paragraph I above, are as follows:
A. Duties and tasks performed by the City as a function of the Ada County
Assessor's Office ($63,886.00):
1. Issuance of and collection of appropriate fees for the following:
a. Motor vehicle license plates;
b. Registration of motor vehicles;
c. Licensing of recreational vehicles and travel trailers;
d. Registration of recreational vehicles and travel trailers;
e. Duplicate registrations for all of the above- listed vehicles;
f. Snowmobile, boat, and motorcycle licenses and licensing
numbers;
g. Title transfers for all types of vehicles listed above.
2. Collection of sales tax on private sale of all types of vehicles.
3. Collection of fees for PUC permits.
4. Keep proper records, receipts, copies, and forms for all of the above-
listed tasks on a weekly basis and turn over all monies collected to the Motor Vehicle
Division of the Ada County Assessor's Office.

5. No employee of the City is authorized to perform the duties and tasks
listed in Paragraphs VII(A)(1-4) herein, unless he or she has been sworn in as an Ada
County Deputy Assessor.
B. Duties and tasks performed by the City as a function of the Ada County
Sheriff's Office ($29,918.00):
1. Test for visual acuity of all applicants for Idaho Motor Operator
Permits, whether first time or renewal applicants.
2. Administer a written examination to all applicants for Idaho Motor
Vehicle Operator Permits.
3. Administer vehicle operation examinations to all applicants who have
not completed an accredited drivers education program.
4. Issue duplicate Idaho Motor Operator Permits to replace those which
are lost, stolen, or mutilated. Proper identification must be shown before issuance.
5. Issue State of Idaho Identification Cards after proof of identity is
shown.
6. Sale of Drivers Education Permits after a birth certificate has been
shown as proof of legal name and age.
7. Proper processing of camera cards for both State of Idaho
Identification Cards and Idaho Motor Vehicle Operator Permits.
8. Collect the appropriate fees and charges for all of the above-listed
duties and tasks.
9. Properly account for the monies referred to in Paragraph VII(B)(8)
so that the monies received for each type of application are enumerated and a proper
allocation is made for those monies designated for the County and those designated for
the State. Said accounting shall be done on a weekly basis and the money shall be
collected by a member of the Ada County Sheriff's Office.
10. Forward the proper forms, papers, documentation, and receipts to the
Department of Law Enforcement, Drivers License Division, for processing.

11. No employee of the City is authorized to perform the duties and tasks
listed in Paragraphs VII(B)(1-10) herein, unless he or she has been sworn in as an Ada
County Deputy Sheriff.
