The site is in the southwest quarter of Section 17, Township 3 North, Range 1 East of the Boise Meridian, Meridian, Idaho. The site is presently developed with a recreational vehicle pazk and agolf-driving range. These uses were previous approved by the city of Meridian. It is the developer's intent at this time to subdivide the parcel into three (3) lots. One lot will contain the recreational vehicle pazk. One lot will contain the driving range. The third lot lays between these established uses. Development of this lot will meet conditions of approval previously established for this site. No new interior streets will be dedicated with this development. Additional right of way will be dedicated to the public along the Overland Road and Locust Grove Road frontages. Improvement to the rights of way will comply with the requirements of the Ada County Highway District. The site is served by Meridian City water and Meridian City sewer services. Both utilities have been extended within the site. Except the driving range lot, sewer service is available within the development. As stated previously, development of this parcel meets the provisions of the Meridian Zoning Ordinance. The preliminary plat has been prepared according to the Meridian Subdivision Ordinance. Development of this site meets the Meridian City Comprehensive Plan. In summary, this plat will create lots around two existing commercial uses reviewed and approved by the city of Meridian. The developer may also meet with the Commission or Council prior to submitting an application. C PRELIMINARY PLAT 1. Avnlication - The applicant shall file rith the Administrator a complete subdivisian application form and preliminary plat data as required in this Ordinance, nat less than thirty (30) days prior to the Commission's public hearing. The Commission rill not schedule any hearing or rorkshops or put the application an the agenda unless the above conditions have been met. 2. Public Hearing to be Held Prior to Subdivision Plat Aplproval - A public hearing shall De held at the time of presentation of the preliminary plat by the developer to the Commission for the purpose of allowing public input on the proposed subdivision. 3. Combining Preliminary and Final Plats - The applicant may request that the subdivision application be processed as bath a preliminary and final plat if all of tT,e following exists a. The proposed subdivision does not exceed four (4) late; b. No new street_dedication or street widening is involved; c. No major special development considerations are involved, such as development in a flood plain. hillside development or the like; and d. All required inf ormation for both preliminary and final plat is complete and in an acceptable form. Content of Preliminary Plat - The contents of the preliminary plat and related information shall be in such form as stipulated by the Commission; however, additional maps and supporting data deemed necessary by the Administrator or the Commission or Council may also be required. The subdivider shall submit to the Administrator at least the following: a. Thirty t30) copies of the preliminary plat of the proposed subdivision, drawn in accordance with the requirements hereinafter stated; each copy of the preliminary plat shall be on good quality paper, shall have dimensions of not less than twenty-four t24) inches by thirty six t36) inches, shall be drawn to a scale suitable to insure clarity of all lines, dimensions and other data. shall show the drafting date. and shall indicate thereon, by arrow, the general northerly direction; b. Thirty t30) copies of a one tl) inch equals three hundred t300) feet scale map on 8-1/2"x11" paper indicating therean all adjacent development and/or lots of record within three hundred (300) feet of any boundary of the proposed development, and the layout of the proposed development in bold outline; c. Thirty t30) copies of the completed and executed subdivision application farm; d. The names, addresses and telephone numbers of the owner, the subdivider or subdividers and the engineer, surveyor or planner who prepared the preliminary plat; c. The Super•ir,tender,t of the School District; and ~4. Other agencies having an interest in the propased subdivision. 9. Commission Action - a. Hearing by Commission - Following the receipt of application ar,d after notice, the Commission shall conduct a public hearing. at which time they shall •review the preliminary plat and receive comments from concerned persons and agencies to arrive at a decisior, an the preliminary plat. b. Commission's Finding - In determining the acceptance of a propased subdivision. the Commission shall consider the objectives of this Ordinance and at least the following: 1. The canfor•mar,ce of the subdivision with the Comprehensive Development flan; 2. The availability of public services to accommodate the proposed development; :~. Tr,e continuity of the proposed development witl-i the capital improvement program; 4. Ttie public financial capability of supporting services for• the proposed development; and 5. The other health. safety or~ environmental problems that may be brought to the Commissiar,'s attention. (8) -• ~ • • c. A -record of the public hearing, findings made and action taker, shall be made and maintained. 9-604 D ADMINISTRATIVE PROCESSING OF THE PRELIMINARY DEVELOFMENT PLAN FOR THE COUNCIL AND NOTIFICATION PROCEDURE Upor, receipt of the Commission's action concerning the Preliminary Development Plan or the receipt of an appeal of such action by the applicant or other aggrieved party, the Administrator shall respond as follows: 1. Set the public hearing date far the Preliminary Development Plan; and ?. Review public hearing comments by concerned persons. public agencies or City departments. 9-604 E COUNCIL HEARING, NEGOTIATIONS, AND ACTION 1. No final subdivision plat shall be approved until one (1) public hearing before the Council has been held for the purpose of allowing public input on the proposed subdivision. This public hearing shall be held at the time of the presentation of the preliminary plat by the developer to the City Council. Notice of the public hearing shall be given by mailing, by certified mail, notice of the hearing to all property owners within three hundred (300) feet of the proposed boundaries of the subdivision, which mailing shall be completed by the developer and by publishing notice of said hearing in the City's newspaper of record at least one (i) time fifteen (15) days prior to the date of such hearing, which publication shall be handled by the Administrator. The notice to be mailed to the adjacent property owners shall include a copy of the notice of hearing and a vicinity map of the area, which map shall show the proposed subdivision and the property within three hundred (300) feet. 3. During the hearing, the Administrator shall report on the status of the application. 4. In considering the proposed development, the Council shall consider the requirements of this Ordinance and at least, but not limited to, the following; a. The conformance of the proposed development with the Comprehensive Plan; b. The availability of urban services to accommodate the proposed development; c. The continuity of the proposed development within the City's capital improvement program; d. The public financial capability of supporting services for the proposed development; and e. Health, safety, or environmental problems that may be brought to the Commission's attention. (io) . • • 5. Prior to Council action, the Council, Admir,istr•ator, applicant, and interested persons may negotiate items of the Preliminary Development Plan, which are of mutual interest. In order that the negotiations be an open process and the rights of all parties and persans shall be protected (applicant, Cauncil, Admir,istr~ator~, and the general public). the following guidelines shall be observed: a. The negotiations shall not occur in private a'r• closed meetings; b. Negotiations shall take place in open ar,d informal meetings; c. Wrier~e there is a quorum of the Council in attendance, appropriate records shall be kept of the negotiating session or sessions, namely minutes which shall be submitted with the proposed development; d. The negotiation process shall be separate from the decision making process of the Council. e. kesults of the negotiations sr,all be a recornrner,datian to the Council and be available for• public scrutiny; f. The negatiation process shall be designed and carried out in a manner wriicri assures the general public treat decisions have not been made ir, advarice of tree input and scrutiny by the ger~er~al public; g. Ax,ulication - After the approval or conditional _ approval of the preliminary plat, the subdivider may cause the total parcel, or• any part thereof, to be purveyed and a final plat prepared in accordance with the approved preliminary plat. The subdivider shall submit to the Administrator- the following: a. Thirty t30) folded copies of the final plat; tl2) v • • b. Faur• t4) copies of the final engineering construction, drawings far streets, water, sewers. sidewalks and other public improvements; and c. Ten t10) prints of the final plat at a scale of one tl) inch equals three hundred t300) feet. 2. Contents of Final Plat - The final plat shall include and be in compliance with all items required under Title 50, Chapter 13 of the Idaho Code. The final plat submittal shall include at least: a. A written application for approval of such final plat as stipulated by the Commission; b. Proof of current ownership of the real property included ir, the proposed final plat and consent of recorded owners of the plat; c. Such otrier information as the Administrator or• Commission may deem necessary to establish whether or not all proper parties have signed and/ar approved said final plat; d. A statement of conformance with the approved prelimir~ar•y plat ar,d meeting all requirements or conditions thereof; e. A statement of conformance with all requirements and provisions of this Ordinance; and f. A statement of canfor•mance with acceptable engineering. architectural and surveying practices and local standards. 3. Fee - At the time of submission of an application fur a final plat, the applicant shall pay the applicable fee which T,as been approved by the Council to cover the cost of pracessing. 4. Administrator Review - a. Acceptance - Upon receipt of the final plat. ar,d compliance with all other requirements as provided for her•eir,, the Administrator shall certify the application as complete and sriall affist the date of acceptance thereon. t13) • • b. Resubmittal of Final Plat - The Administrator shall review the final plat for compliance with the approved or conditionally approved preliminary plat. If the Administrator determines that there is substantial difference in the final plat than that which was approved as a preliminary plat or conditions which have not yet been met, the Adminf strator may require that the final plat be submitted to the Commission in the same manner as required in the preliminary plat process, including a public hearing and notice thereof. c. Submission to the Council - Upon the determination that the final plat is in compliance with the preliminary plat and all conditional requirements have been met, the Administrator shall place the final plat on the Council agenda within forty-five (45) days from the date that an acceptable final plat application was received and acknowledged by the Administrator. 5. Agency Review - The Administrator may transmit one (1) copy of the final plat, or other documents submitted, for review and recommendation to the departments and agencies as he deems necessary to insure compliance with the preliminary approval and/or conditions of preliminary approval. Such agency review shall also include the construction standards of improvements, compliance with health standards, the cost estimate for all improvements and the legal review of the performance bond. 6. Council Action - Within forty-five (45) days following receipt of the application, the Council shall consider the requirements of the preliminary plat and comments from concerned persons and agencies to arrive at a decision on the final plat. The Council shall approve, approve conditionally, disapprove, or table the final plat. If the final plat is tabled, it may be reconsidered by the Council within forty five (45) days of the date of initial consideration. A copy of the approved plat shall be filed with the Administrator. 7. The Administrator shall notify the applicant of the Councils action within ten (10) days of such action. Hutchinson: Members of the Council this is a 3 lot subdivision of the Playground that is at the northeast corner of Overland and Locust Grove Roads. This is a development that is currently under the development agreement with the City of Meridian for the development of the R.V. park and the golf driving range. Park, one lot will contain the driving range and the third lot will be in the middle there subject to future development. We have reviewed the comments from staff and have no problems with those. Have you ever noticed that, I don't know about the traffic going by there how it affects them. But if you are looking at those lights shining on the back of the house, it doesn't happen to do it on mine but several to the west of me they do. I talked to several neighbors with respect to that and they are not happy with the fact that you go out in the back yard and you can't see anything when you look south, you are blinded. I don't know whether that pertains to the approval of the plat Tolsma: Counselor, isn't there an ordinance that pertains to lights or is that just (inaudible). Crookston: We have in the past I don't recall whether we did on this parcel of ground or not but we have in the past required lights at shopping centers, we did it at the Fred Meyer area, we have done it since then to require that those lights be set so that they do not shine that light into residences. That could be a condition as part of the preliminary plat. We are not dealing with annexation here but that could be done for the plat. Tolsma: Anyone else wish to testify on this issue? Hutchinson: Mr. Chairman. members of the Commission this is a 3 lot commercial subdivision that is currently under a development agreement from the City of Meridian. What we are doing is platting 3 lots, one lot would contain the RV park, one lot will contain the driving range, and then there will be a third lot in the middle subject to future development. That development will be in accordance with the provisions of the City of Meridian zoning ordinance and the requirements of the development agreement that were in place. I have reviewed the comments from your City staff and have no problem with those. It looks like most of these are, some of the comments are geared more toward the actual development rather than the ground and basically at this time all we are doing is platting the ground we are not proposing any additional development. With that are there any questions of the Commission that I can answer? Hepper: Was this not platted before? Hutchinson: Mr. Chairman and Mr. Hepper not it was not, it was developed under I believe, we didn't handle the application when it was approved or presented to the City but it was processed either from a conditional use or planned development. So there is a development agreement that is in place on this particular site. Hepper: (Inaudible) incorporating all three of those parcels into one. Hutchinson: What we are doing is separating one parcel of land, we are now separating that into 3 separate lots with one use on each lot. The RV park on one lot, the middle lot that will be developed in the future and then the driving range lot. Hepper: And you don't have a proposed use for the middle lot? Hutchinson: I don't know that they have one right now. I know there was mention of something in the previous application a sports related use. We are not proposing anything at this time. We are just platting the ground and if the owner decides to sell that or develop it themselves then a development application will have to come forward to you for your approval. Hepper: So you would be willing to go with a conditional use permit on that middle piece of property requirement for a conditional use? Hutchinson: I believe that is what is in place at this time. Rountree: How do you propose to access that third lot? Hutchinson: Mr. Chairman, Commissioner Rountree, when we originally presented this to the Highway District we were looking at doing a shared access. The owners have a buyer for the lot that contains the driving range. We are taking that back to the Highway District • Meridian Planning & Zoning Commission November 14, 1995 Page 27 and asking for a third access. We have over 1300 feet of Frontage on Overland Road. There is no real conflict with any use to the south of this that should create a problem so we are going to propose a third access otherwise it would be a shared access with cross access easement for the access on Overland Road from the 2 lots. Rountree: Nothing from Locust Grove? Hutchinson: We are not proposing anything from Locust Grove. The Locust Grove frontage is completely development right now with the RV lot. There is no access, no direct access onto Locust Grove Road. The Highway District has asked our client to consider that in the future if they put an overpass over I-84 that it will create a problem for that parcel to the north. They have asked our client to consider allowing some type of joint access assuming that the RV park may be developed into something else. That would be only at the time some time after they do an overpass there. At this point we have no access onto Locust Grove Road. Johnson: Any other questions of the applicant? Hepper: Have you seen the comments from Shari? Hutchinson: Yes I have. Hepper: Do you have a problem with any of those? Hutchinson: No, in fact we appreciate Shari's comment at the bottom where we did ask this as a preliminary final and then checking with Shari prior to submitting this I was unsure of the procedure for a preliminary and final. When I contacted her either we had mis- communication or something was dropped and we will get her the 30 copies of the final plat as quickly as I can get them drafted so that we can go forward. The proposal itself I did and it does comply with the provisions in the ordinance to process this is as a preliminary~nal. But no, like I say most of those issues are directly related to development rather than the subdivision of ground. We have no problems with them. Mike Wardle, 9550 Bethel Court, Boise, was sworn by the City Attorney. Wardle: Mr. Chairman, Commission members, I am here to discuss a mod cation of a plat that was approved about a year and a half ago. The first thing that I would like to do is pass out a little illustration of what we are discussing and then I will use the original concept map to discuss it with you. The original annexation and zoning of this 40 acre parcel was an R-8. The preliminary plat that was approved when I recounted I counted 152 it was either 152 or 153 lots. Basically a straight forward subdivision with the minimum 6500 square foot lots. As originally proposed there was a common area strip along the south boundary that was adjacent to the Fothergill subdivision in which it was proposed to realign the Finch Lateral and place a bicycle pathway system. This particular enlargement illustrated the concept. At the time that it was presented to Nampa Meridian they had no difficulty with the relocation but they made no commitment with respect to a pathway in that area. In fact, when the construction plans were designed for that relocation with the single crossing of Arrow Wood Way that connects this project to Fothergill the Nampa Meridian Irrigation District specifically disapproved any pathway system within their easement area. In addition when the construction actually began the adjacent property owners became concerned about the location and the depth of that particular facility. A meeting was held between property owners from Fothergill Subdivision and the developer and Mayor Kingsford, Councilman Walt Morrow, City Engineer Gary Smith. I would like to present to the Commission as well copies of the minutes and the memorandum of understanding an agreement that resulted from that. Johnson: Is that any different from this one. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. The ditches to be piped are to be shown on the Preliminary Plat. Plans will need to be approved by the appropriate irrigation/Drainage District, Lateral Users Association or Down Stream Users, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-.S17. Wells may be used for non-domestic purposes such as landscape imgation. 3. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. The ditches to be piped are to be shown on the Preliminary Plat. Plans will need to be approved by the appropriate Irrigation/Drainage District, Lateral Users Association or Down Stream Users, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape imgation. 3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions, as prepared by a soil scientist, with the subdivision construction plans. 4. Submit copy of proposed restrictive covenants and/or deed restrictions for our review. 5. Provide 5 foot wide sidewalks in accordance with City Ordinance Section 11-9-606. B. 6. Water service to this development is contingent upon positive results from a hydraulic analysis by our computer model 7. Make any necessary mapping corrections to comply with the requirements of the Ada County Street Name Committee prior to resubmittal to the City. Sanitary Sewer service to this site is divided between two different drainage areas. The Hunter Lateral which traverses through Lot 3, Block 1 is more or less the dividing line. Service for the drainage area west of the Hunter Lateral will be via existing sewer mains installed as part of the development of the R.V. Park. Service for the drainage area east of the Hunter Lateral will be via an extension of a future main line that is proposed as Phase II of the Five Mile Creek Sewer Trunk being constructed towards St. Lukes. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Sewer manholes are to be provided to keep the sewer lines on the south and west sides of the centerline. 2. Water service to this site will be via an extension of the existing 12 inch diameter main in East Overland Rd. Applicant will be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 3. Revise the Preliminary Plat Map to show X11 adjacent land use and existing zoning of properkies surrounding the proposed development, including existing or approved proposed streets and lots, and addressing all other comments contained herein. This property is currently controlled by a development agreement that has been recorded. Findings of Fact and Conclusions of Law state development shall be as represented in the public hearings regarding annexation. 2. Existing trees on the driving range portion of the property shall be retained on site. 3 . One three-inch caliper tree is required for each 1, 500 square feet of pavement. All off- street parking areas are to be paved and striped. 4. Applicant's representative has stated that a sale of driving range property to another interest is possible and driving range would be discontinued. At minimum, detailed site plan review should be required, for any future development, at Commission level. A conditional use permit could also be required as development will not be as represented at public hearings. The recorded development agreement would need to be amended or a separate agreement entered into for any new use. 5. Thirty-five-foot (35') landscape setbacks shall be required along I-84 and Overland Road, beyond required ACRD right-of--way. 6. Any trash receptacle areas shall be screened in accordance with City Ordinance. 7. Certificates of Occupancy are required in accordance with City Ordinance. 8. The unplatted parcel north of Lots 2 and 3 of Block 1 will not have access to a public roadway when the Locust Grove overpass is constructed. ACHD has suggested that an access be shared on Locust Grove. Applicant's representative was requested to fide apreliminary/final plat application. However, only a preliminary plat was submitted. I would still like this application to be considered as a preliminary/final provided all agencies have the opportunity to comment and that 30 copies of the proposed final plat be submitted immediately. The new Meridian Comprehensive plan indicates that Locust Grove Road will eventually cross over the Interstate 84, and staff recommends that adequate right-of--way be acquired. The bridge for Locust Grove over Interstate 84 will probably begin a grade separation at the site's north boundary, complicating access to Locust Grove for the abutting parcel to the north. The site has already developed an RV park abutting Locust Grove Road and the site's north boundary. Staff suggests that the applicant consider a shared access to Locust Grove Road for both parcels. B. Interstate 84 is under the jurisdiction of Idaho Transportation Department (ITD). The developer is required to submit application materials to ITD for review and requirements of that Department. The proposal included an RV park, a 36-hole miniature golf course, convenience store, office space, and snack bar. The site is presently developed with a recreational vehicle park and a golf driving range. D. Two 32-foot wide paved driveways have been constructed on the site as approved in the previous development approval. However, the driveways were not improved with pavement tapers with 15-foot radii to allow vehicles a smoother transition from Overland Road to the site. Staff recommends that the pavement tapers be required. E. In accordance with District policy, staff recommends that the applicant be required to deposit to the Public Rights-of--Way Trust Fund the cost of constructing 435-feet of 5-foot wide concrete sidewalk on Overland Road abutting the parcel. These improvements are estimated to cost a total of $3,700. The applicant has already made deposits to the Public Rights-of--Way Road Trust Fund for sidewalk abutting the site on Locust Grove Road and 845-feet of sidewalk on Overland Road. The preliminary plat includes 435 additional feet of frontage on Overland Road that the previous development review did not include. F. The applicant has submitted a copy of a warranty deed #95025407 recorded March 28, 1995, for 20 additional feet of right-of--way on Overland Road and Locust Grove Road, as required in the previous development review. G. The transportation system will be adequate to accommodate additional traffic generated by this proposed development. H. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on November 14 , 1995. The following requirements are provided to the Ciry of Meridian as conditions for approval: Site Specific Requirements: 1. Comply with requirements of ITD for Interstate 84 frontage. Lot access restrictions shall be stated on the final plat. 4. Construct 15-foot radii pavement tapers on the two existing driveways on Overland Road, as previously required. Standard Requirements: A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the Development Services Supervisor. The request shall specifically identify each requirement to be reconsidered and include a written explanation of ~y such a requirement would result in a substantial hardship or inequity. Requests received prior to the date scheduled for Commission action shall be rescheduled for discussion with the Commission on the next available meeting agenda. 2. A request for an appeal of the Commission's action shall be made in writing to the Development Services Supervisor within 15 calendar days of the action and shall include a minimum fee of $110.00. The appeal will be scheduled to be heard by the Commission within 20 calendar days after receipt. A right-of--way permit must be obtained from ACRD for any street or utility construction within the public right-of--way. Utility cuts should be combined where practical to limit pavement damage. Utili street cuts in roads paved within the last five years will not be allowed unless approved by the District Commission. Submit site drainage plans and calculations for review and appropriate action by ACRD prior to issuance of building permit (or other required permits). The proposed drainage system shall retain all storm water on-site and shall conform to the requirements of Meridian. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no PLAYGROU. WPD Page 4 • • trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 5. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when driveways are not being shared with the adjacent property. 6. Construct pedestrian ramps on the corner of all street intersection in compliance with Idaho Code, Section 40-1335. 7. Dedicate up to a 20-foot x 20-foot right-of--way triangle (or appropriate curve) to keep street improvements within the public right-of--way at all intersections abutting and/or within the development prior to issuance of building permit (or other required permits). 8. Continue existing irrigation and drainage systems across parcel. 9. Continue borrow ditch drainage abutting parcel (culvert may be required). 10. Provide written approval from the appropriate irrigation/drainage district authorizing storm runoff into their system. 11. If street improvements are required, locate obstructions (utility facilities, irrigation and drainage ditches and appurtenances, etc.) outside of the public right-of--way. Authorization for relocations shall be obtained from the appropriate entity. If determined by the District, existing irrigation facilities may remain in the right-of--way with District review and approval of easements recorded for future relocation at a later date. 12. Locate proposed sign(s) out of the public right-of--way and out of the clear-vision sight- triangle of all street and driveway intersections. 13. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 14. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street name signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. The District will not manufacture street signs until a copy of the recorded plat showing the recording data has been provided to Development Services staff. 15. Provide a clear vision sight triangle at all street intersections. Within this triangle no obstruction higher than 36-inches above the top of pavement will be allowed, including PLAYGROU. The triangle shall be defined by the long leg measured down the centerline of any collector 350-feet; and the short leg measured down the centerline from the collector street curb line 20-feet. Provide design data for proposed access to public streets for review and appropriate action by ACHD. 18. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 19. Hutchinson: Mr. Chairman, members of the Commission this is a 3 lot commercial subdivision that is currently under a development agreement from the City of Meridian. What we are doing is platting 3 lots, one lot would contain the RV park, one lot will contain the driving range, and then there will be a third lot in the middle subject to future development. That development will be in accordance with the provisions of the City of Meridian zoning ordinance and the requirements of the development agreement that were in place. I have reviewed the comments from your City staff and have no problem with those. It looks like most of these are, some of the comments are geared more toward the actual development rather than the ground and basically at this time all we are doing is platting the ground we are not proposing any additional development. With that are there any questions of the Commission that I can answer? Hepper: Was this not platted before? Hutchinson: Mr. Chairman and Mr. Hepper not it was not, it was developed under I believe, we didn't handle the application when it was approved or presented to the City but it was processed either from a conditional use or planned development. So there is a development agreement that is in place on this particular site. Hepper: (Inaudible) incorporating all three of those parcels into one. Hutchinson: What we are doing is separating one parcel of land, we are now separating that into 3 separate lots with one use on each lot. The RV park on one lot, the middle lot that will be developed in the future and then the driving range lot. Hepper: And you don't have a proposed use for the middle lot? Hutchinson: I don't know that they have one right now. I know there was mention of something in the previous application a sports related use. We are not proposing anything at this time. We are just platting the ground and if the owner decides to sell that or develop it themselves then a development application will have to come forward to you for your approval. Hepper: So you would be willing to go with a conditional use permit on that middle piece of property requirement for a conditional use? Hutchinson: I believe that is what is in place at this time. Rountree: How do you propose to access that third lot? Hutchinson: Mr. Chairman, Commissioner Rountree, when we originally presented this to the Highway District we were looking at doing a shared access. The owners have a buyer for the lot that contains the driving range. We are taking that back to the Highway District • • Meridian Planning & Zoning Commission November 14, 1995 Page 27 and asking for a third access. We have over 1300 feet of Frontage on Overland Road. There is no real conflict with any use to the south of this that should create a problem so we are going to propose a third access otherwise it would be a shared access with cross access easement for the access on Overland Road from the 2 lots. Rountree: Nothing from Locust Grove? Hutchinson: We are not proposing anything from Locust Grove. The Locust Grove frontage is completely development right now with the RV lot. There is no access, no direct access onto Locust Grove Road. The Highway District has asked our client to consider that in the future if they put an overpass over I-84 that it will create a problem for that parcel to the north. They have asked our client to consider allowing some type of joint access assuming that the RV park may be developed into something else. That would be only at the time some time after they do an overpass there. At this point we have no access onto Locust Grove Road. Johnson: Any other questions of the applicant? Hepper: Have you seen the comments from Shari? Hutchinson: Yes I have. Hepper: Do you have a problem with any of those? Hutchinson: No, in fact we appreciate Shari's comment at the bottom where we did ask this as a preliminary final and then checking with Shari prior to submitting this I was unsure of the procedure for a preliminary and final. When I contacted her either we had mis- communication or something was dropped and we will get her the 30 copies of the final plat as quickly as I can get them drafted so that we can go forward. Wardle: Mr. Chairman, Commission members, I am here to discuss a modification of a plat that was approved about a year and a half ago. The first thing that I would like to do is pass out a little illustration of what we are discussing and then 1 will use the original concept map to discuss it with you. The original annexation and zoning of this 40 acre parcel was an R-8. The preliminary plat that was approved when I recounted I counted 152 it was either 152 or 153 lots. Basically a straight forward subdivision with the minimum 6500 square foot lots. As originally proposed there was a common area strip along the south boundary that was adjacent to the Fothergill subdivision in which it was proposed to realign the Finch Lateral and place a bicycle pathway system. This particular enlargement illustrated the concept. At the time that it was presented to Nampa Meridian they had no difficulty with the relocation but they made no commitment with respect to a pathway in that area. In fact, when the construction plans were designed for that relocation with the single crossing of Arrow Wood Way that connects this project to Fothergill the Nampa Meridian Irrigation District specifically disapproved any pathway system within their easement area. In addition when the construction actually began the adjacent property owners became concerned about the location and the depth of that particular facility. A meeting was held between property owners from Fothergill Subdivision and the developer and Mayor Kingsford, Councilman Walt Morrow, City Engineer Gary Smith. I would like to present to the Commission as well copies of the minutes and the memorandum of understanding an agreement that resulted from that. Johnson: Is that any different from this one.
